The Spanish government’s new 10 year housing plan reveals some remarkable statistics about Europe’s number one overseas property destination.

It finds there are between 4 million and 4.3 million empty homes in Spain. To put that in perspective, that’s over 16% of the total housing stock, which is estimated at just under 26 million.

Existing housing accounts for 3.1 million and empty new build is estimated to be 900,000. The number of empty holiday homes is forecast at 150,000 to 300,000.

A major part of the government’s 10 year plan is to target foreign buyers. However, the evidence for this seems to be a stay of execution for properties affected by the “Ley de Costas” and the promise of a few more promotional road shows.

The reality is that the Spanish govern-ment will be focusing on rentals and refur-bishment of existing (mainly non-holiday home) housing stock. Construction was once Spain’s biggest industry but approv-als are down 44% on last year and the

trend is likely to continue. Building is no longer a strategic priority. It could be a generation before we see Spanish devel-opers back to anything like their boom-time glory.

In the grander scheme of things, shifting a few more holiday homes will not even touch the sides when it comes to helping the economy recover from arguably its deepest ever recession.

The best role for the government is argu-ably to facilitate cheap finance for both local and international buyers and to in-stigate schemes to encourage younger people to leave home and begin renting.

Spain has suffered from a colossal misal-location of resources. Thousands, perhaps millions of properties have been built that might never be tenanted.

Increasing holiday home sales from north-ern European bargain hunters tempted with 100% finance will help but the num-bers indicate this maybe just a drop in the ocean.

The Canary Islands’ government may have to turn to private enterprise to help meet a massive funding gap in improv-ing educational infrastructures. Education chief José Miguel Pérez has admitted that it needs around 100 million euros and has commissioned a private report at a cost of 55,00 euros to see if this kind of funding might be an option. Sr. Pérez said private funding would not involve a drain on the public accounts and would help renew school buildings in urgent need of updat-ing and renovations.

Tourism chiefs believe the outlook for the winter season in the Canary Islands is “moderately positive” given the difficult economic situation. The markets from Germany, Poland, Russia and the Nordic countries are all showing signs of growth despite the fact that Egypt and Tunisia are beginning to recover. Last year, the Canar-ies saw a huge boost in visitors because of the unrest in these countries. Speaking at a tourism forum in Las Palmas, Deputy Minister of Tourism for the Canary Islands, Ricardo Fernández said the archipelago envisaged a 2% increase in British tourists. This bucked the trend of mainland Spain which had seen a 1% fall. Prospects for the German market were far more optimistic with growth of 9% per cent envisaged for the Canary Islands and 10% for the whole

of Spain. The domestic market for both Spain and the Canary Islands is not ex-pected to change much as Spaniards still have low spending power because of new cuts.

Lanzarote’s most famous wine-producing area is considering imposing a ‘green’ tax on its products to help guarantee its fu-ture, although the idea has not gone down well with everyone. A local consortium comprising the island’s Cabildo and five town halls is keen to add one euro to the price of a bottle of wine from La Geria and also to tax tourist day-trips to the area to see its unique farming system for grape-growing in volcanic sands, with low semi-circular stone walls to protect the vines from the wind. However, critics say the tax will price the already expensive wines out of the market and could encourage Lan-zarote’s restaurants to offer cheaper wines from mainland Spain instead.

line Aerfolot is to operate a twice-weekly

service as of 30 October with a 260-seat

Ilyushin aircraft. 110,000 Russians holi-

dayed in Tenerife last year, double the fig-

ure for the previous year, and the numbers

are expected to be even higher in 2012,

with 90,000 tourists from the country al-

ready recorded in the first six months.

International Monetary Fund leader Chris-tine Lagarde has called for ‘more time’ for Spain, Portugal and Greece to pay back their debts. She says the austerity meas-ures need to slow down to avoid sinking all three countries into near-poverty, given

that the Eurozone has some ‘unaccepta-

ble’ and ‘terrifying’ unemployment levels,

particularly among the 18-40 age group.

reliable strategies’ to enable them to pay

back their deficits, as well as maximising

growth in order to create employment,

says Lagarde, former minister for the

economy for France. She criticised the fact

that all three countries have been ‘spend-

ing years on’ their economic reforms and

as yet achieved nothing.

The ‘surplus’ of unsold new housing in Spain amounts to a very large figure suit-able for holiday accommodation. These properties are largely located in the Medi-terranean and in the islands and located in areas that make them particularly suitable for use as a holiday home and tourism.The government stated that the demand by for-eigners is critical for the recovery and stim-ulation of the real estate sector. They also recognised that improving the legal and fis-cal framework are important for the recov-ery, promising a commitment to enhance

the brand image of Spain to buyers outside of Spain.In addition, the Institute for For-eign Trade (ICEX) is persevering with pro-motional plans aimed at selling property to foreign investors, including participation at trade fairs and business events in a number of foreign countries.The general approach is to develop a set of commercial, informa-tional and ‘business to business’ tactics that increases potential interest and awareness of the Spanish real estate supply, particu-larly for new property – the priority markets are the UK, Germany and Russia.

Rating agency Standard & Poor’s has downgraded Spain’s credit rating by two notches, warning that the deepening eco-nomic recession is limiting the govern-ment’s options. S&P warned that rising unemployment and harsh austerity meas-ures are likely to intensify social unrest and cause further friction between Spain’s central and regional governments.”The downgrade reflects our view of mounting risks to Spain’s public finances, due to ris-ing economic and political pressures,” said the rating agency in a statement.”In our view, the capacity of Spain’s political insti-tutions (both domestic and multilateral) to deal with the severe challenges posed by the current economic and financial crisis is declining, and therefore, in accordance with our rating methodology (see “Sov-ereign Government Rating Methodology And Assumptions,” published June 30,

2011), we have lowered the rating by two notches.”The downgrade to BBB- from BBB+ late on Wednesday leaves Spain one notch above “junk” status. S&P also at-tached a “negative outlook”, which warns of a possible downgrade in the medium term. S&P said it would downgrade the country’s debt status further if political sup-port for Madrid’s reform agenda weakens, if eurozone support fails to prevent Spain’s borrowing costs hit unsustainable levels or if debt tops 100pc of economic output or debt payments surpass 10pc of general government revenues. The rating agency also expressed doubts that all of the eu-rozone countries would give their backing to 17-nation bloc’s attempts to recapitalise Spain’s troubled banking system, which S&P said would force the country’s debt burden to “balloon”.”Against the back-drop of a deepening economic recession,

we believe that the government’s resolve will be repeatedly tested by domestic con-stituencies that are being adversely affect-ed by its policies,” S&P said. “Accordingly, we think the government’s room to contain the crisis has diminished.” The euro fell against the US dollar after the news, trad-ing down 0.1pc late in the session on Wall Street. The downgrade comes after Spain announced five austerity packages in less than a year and is fighting for time to avoid a full-fledged rescue. Concerns over the creditworthiness of the government have risen since the country requested 100bn euros (£80bn) in aid to bail-out its banks. The cut puts S&P in line with rival rating agency Moody’s, which has the recession-hit country on review for another down-grade.

Your high street bank will offer to send your Pounds to an overseas bank account, converting them into Euros or Dollars along the way, but there is another option. Currency or FX brokers are specialists in foreign exchange markets and as such are better suited to transferring money overseas than banks.

By buying and selling large amounts of foreign currency on behalf of clients, currency brokers have been known to beat exchange rates offered by banks by up to 4% – a saving of up to £4,000 on a €120,000 transaction. Also, unlike banks, it is usual for currency brokers to charge no commission – although this can depend on the value of the transaction – and waive transfer and receiving bank fees. When clients open an account with a currency broker they are allocated a personal account handler, thus avoiding the “call centre” environment of banks.

Currency brokers have a range of solutions, or contracts, to suit different client scenarios. The Spot contract is the most basic and commonly used solution and lets you fix an exchange rate with your broker for an immediate transfer.

If you are someone who prefers to budget carefully and protect yourself against fluctuating exchange rates, currency brokers offer Forward contracts. These are a type of ‘buy now, pay later’ solution that allow you to fix an exchange rate for future delivery of funds, often up to 12 months ahead.

If you’re not risk averse and wish to take a gamble on rates improving, then you could opt for a Stop Loss or Limit order. The former will protect you against adverse exchange rate movements and secure your currency if it falls below a pre-agreed rate; the latter is placed at the top end of the market to secure currency at a specific price that may not be currently available. These tools allow you to aim for a higher rate while providing protection should markets move against you.

Finally, currency brokers can set up regular payment schemes for you. Examples include transferring Pounds into Euros on a monthly basis to cover overseas mortgage repayments or transferring a UK pension to an overseas account each month.

The FSA

In November 2009 currency brokers – officially classed as Money Services Businesses (MSB) – became regulated by the Financial Services Authority (FSA). This move should give peace of mind to consumers who previously were nervous about entrusting their money with an unregulated money services business. Now, depending on their monthly turnover, currency brokers must either be ‘registered’ or ‘authorised’ by the FSA. However, companies that have been trading for a specified period – so have a proven track record – have a grace period to become authorised or registered. Whatever their current FSA status, all currency brokers must comply with FSA regulations.

Naturally, ensuring your funds are in safe hands throughout the transfer process is of paramount importance. With this in mind we spoke to Nat Davison, Head of Private Clients at Global Reach Partners Limited, to understand how his company goes about giving clients peace of mind.

Perhaps the biggest generalisation one can make about Spanish property in 2012 is that they are deluged with deals. In the drawn-out wake of the global downturn most major markets, with some notable exceptions such as Switzerland and Scandinavia, have a hefty proportion of homes worth at least 20-30 percent less than they were five years ago.

It is clearly a buyers market right now and if an overseas property purchase is on your agenda and you can afford it, the current climate puts you in a strong negotiating position.

But when faced with such volumes of bargains buy-ers can be easily fazed. How do you tell a genuine good deal from something that is not? How can you be sure you are buying something that will recover its value in five or ten years?

There is a certain amount of truth in the mantra of the downturn: ¨If it sounds too good to be true, it probably is¨

Even if you are buying for lifestyle reasons, you should still think of your exit strategy (will it be sellable in a few years and who is likely to buy it?) as you never know what might happen that might mean you need to sell it sooner than originally planned.

So, you need to sort the wheat from the chaff and make sure you make a sound - and safe- investment.

First of all, at the risk of repeating ourselves, you must always use independent legal advice.

Secondly, when dazzled by drastic price reductions, you must not forget the most basic rule of buying a property – location, location, location!

A cheap price doesn´t always mean a good deal, and, just as if when contemplating buying a half price coat in a high street sale, ask yourself if you´d still want to own it if it was at its original price?

Spain, as an example, has around 400,000 repos-sessed properties in the hands of banks alone, never

mind the ones being sold by agents or individu-als desperate to sell. Bear in mind banks have got properties because owners could´t sell them in time before they defaulted on their loans. They are more than likely to be residential and not in prime loca-tions, and any great buys have probably been cherry picked and snapped up. That said, there are new bank owned properties entering the market on a daily basis, but you need to be in a position to move very quickly and watch the market diligently, to get the pick of the best.

Don´t try approaching banks yourself – unless you are fluent in Spanish – as they are not very geared to dealing with foreign buyers. Their administration and protocol is a minefield and agents who are act-ing as brokers for the banks are the most equipped to deal on your behalf as they are aware of their poli-cies and procedures.

If you are offered bank-owned properties via an agent, bear in mind that an agent may be only working behalf of one bank that he has links too, so do your own research for comparables.

Going back to location, Is the property genuinely close to the coast ( if that is what it is being pro-moted as being ), and is it on a healthy and well-established complex?

Ho else is buying on the development, are any of the properties empty – or worse, never been lived in?

If the bulk of the properties on a development aren´t occupied you may have problems with unpaid com-munity fees, which will lead to problems with the upkeep of common areas. As well as unpaid utility bills if the water & electricity is not on a separate metre and communal. If unpaid for a period of time it could lead to disruption as utilities could get cut off. This is a potential danger sign to look out for.

All these things make a visit to a property yourself essential; you won´t be able to ascertain its genuine condition – or that of its surroundings – without it.

Your lawyer should investigate thoroughly if a prop-erty has any debts, apart from the obvious mortgage if its been repossessed, including utility debts and

community fees. As banks invariably don´t have time to upkeep the management of their heft port-folios.

If you are tempted by buying something at auction, again, it is also essential that you inspect it yourself and get full legal checks done on its background. You must also have completed all the research you need to make an educated decision about your maximum bid on the day of auction. What have neighbouring properties been selling for? What is its rental potential? Ho much is it going to cost to get into good shape?

Needless to say, your finance should also be in place beforehand, and if you have any doubts on the day, walk away.

It is important to remember that foreclosed proper-ties, have their own set of problems, based on the fact they would have remained unoccupied for a pe-riod of time, potentially leading to issues of neglect, dampness and at times infestation

BARGAIN HUNTERS BEWARE

• A cheap rice doesn´t always mean a great deal. Forget the numbers and ask all the usual questions about lo-cation, access and rentability.

• If it sounds too good to be true, it prob-ably is. Why hasn´t it been snapped up by someone else?

• If you had to sell in on in a years time, could you be sure that someone else would want it? ( i.e. does it tick lots of boxes? )

• Don´t scrimp on thorough legal ad-vise and due diligence

• Bank owned properties should be treated with as much caution as a standard resale. Do not be tempted to cut out a lawyer because you feel secure in dealing with a bank!

Of course there’s nothing new about emigrating and it’s no longer seen as something only the brave or maybe the foolhardy would consider doing. It can be of the opinion that life is a daring adventure or nothing at all, so most should give it some serious consideration if they are tempted. After all, what’s the worst that could happen? If you don’t like it after a while and you’re unhappy then come on home, there’s no shame in that. It’s far worse to spend the rest of one’s life wondering “what if”. As always, analysing your motivation and doing your research is the key so we’ve put together some tips to help guide you though.

1. Think long and hard about it. It’s not something to take on flippantly, especially if there are children involved. You have to be sure you really want to give it a go.

2. Make sure you do your homework, holidaying and living somewhere are two completely different things. The world is such a big place you have to be sure you are moving to a country you could eventually call home.

3. If you are planning on working, make sure you can. Check visa situations (are you allowed to work there if you’re not a resident?) and unemployment levels. In certain countries, like Spain, where the unemployment levels are high, you may struggle to find work.

4. Think about family and friends. Everyone says they will visit but realistically most people can only manage a few days a year and Skype isn’t a substitute for the real thing. If you are moving thousands of kilometres away, how often do you think you will return home, are you the sort of person who could cope with living so far away from loved ones?

5. Think about renting for a while in your chosen destination. That way you can get a real feel for the place at different times of year. Is it really for you? If not you can always return home without the added worry of trying to sell a property abroad, or you could always move around the chosen country until you find somewhere you like.

6. Rent out your UK house, don’t sell it. If you’re a homeowner and are thinking of taking the plunge, have a back-up and don’t put all your eggs in one basket. By renting any property you have , if you do want to return home you will find the

transition much easier if you can move back into your old house.

7. Visit your chosen destination as many times and in as many seasons as you can before you move there. Some resorts are very different in the winter than they are the summer.

8. How are your language skills? If you move to a country where English is not widely spoken, you have to make an effort to learn the language. It’s not enough to speak English very slowly and very loudly. You’ll find people will respond to you much more positively if you attempt to speak to them in their own language.

9. Embrace the culture. Some countries are very different to the UK. Siestas aren’t put on for tourists; they are a way of life for lots of people. Lots of countries move at a slower pace than we do – including services and trades people. It’s something you’ll have to get used to.

10. If you are moving with children, think about their education and how the move will affect them. A lot of countries have international schools, where the English curriculum is taught, or do you want them to be educated in the local schools with a local syllabus?

Top tips for making that permanent move abroad a successBuying a holiday home abroad, somewhere that you can escape to a few weeks of the year, is one thing but moving lock stock and barrel to a brand new country is a whole different ball game.

In this age of austerity, governments are keener than ever to find extra sources of income – which essentially means more taxes in addition to cutting public services.

Second-home owners are inevitably going to be targeted by such governments, and we are seeing in Spain, especially, that authorities are suddenly clamping down on regulations and tax obligations previously ignored – with hefty fines, the result.

So, as an overseas property-owner, are you fully aware of your obligations? It is essential you understand the difference between being resident in a country and being tax-resident there. This has implications for inheritance tax – and inheritance issues should also be discussed with a legal/tax expert so you can avoid heartache and expense later down the line. In fact, it is worthwhile using an overseas lawyer or accountant – or in Spain, a gestor - once a year to ensure you pay the right tax – at the right time.

In Spain, to be a tax–resident you must make an annual tax declaration to the Spanish tax office (even if it amounts to a nil return) Unless you do this, you won´t be eligible for tax exemptions.

But, wherever you´re buying, the initial dose of tax you´re likely to pay is that associated with purchasing a property, what we broadly term stamp duty in the UK.

Transfer tax / Stamp duty

Overseas this is often called transfer or purchase tax but is essentially the same thing: a govrnment tax levied on the buyer in a property transaction and calculated as a percentage of the value of the transaction.

Transfer tax rates vary considerably by country and often according to the value of a transaction, with a sliding scale of rates (in the Canaries, for example) It is usually minimal on new properties, although new-builds will typically be liable for VAT ( IVA in Spain, IGIC in the Canaries)

In the Canaries transfer tax (or ITP) on a resale is 6.5%

IGIC on new builds dought direct from a developer is currently reduced at a rate of 2.75 % until the end of the year if the property is under 150,000 euros and is the first property to be bought in Spain as a principal residence.

Take advice! In Europe, taxes for a property transaction typically are paid via a notary and your final notary bill will include transfer taxes, as well as fees for notary services.

Annual Property taxes

Once you own a property abroad, you are likely to

have an annual municipal real estate tax to pay, the equivalent of council tax in the UK. In Spain this is known as IBI. Municipal taxes or IBI are based on a propertys rateable or book value as recorded by the local government which tends to be much less than the market value

Capital Gains Tax

Finally, when you come to sell, you´ll encounter Capital Gains Tax (CGT): a tax levied on the gain between the purchase and sale price of your property (minus some renovation costs if documented)

Note that in the Canaries if the vendor is not a resident, the buyer must withold a percentage of the purchase price and pay it direct to the tax authorities – this is to cover any CGT the vendor might be liable for.

As an incentive Capital Gains tax has been reduced by 50% if the property is purchased by 31st December 2012

As a tax resident in the UK, you´re taxed on worlwide income, which would include capital gains and income generated through an overseas property, regardless of the laws local to that property.

The good news is that the UK has double taxation treaties with more than 100 countries, including Spain, so you´ll never pay the same tax twice
