Good Morning Tajana - CJ informed me of your request on 10/30/2015 to attend ICSC in Dallas this week on 11/4/2015 and 11/5/2015. After contemplating your request, your attendance at the 2015 ICSC Texas event would not be in the best interest of you or the City at this time. Please consider all the following points: 1. In December 2014, you attended the ICSC Texas conference in Dallas with myself, CJ, Cheryl Stalinsky and Mary Meier. After initial discussions, you were included in making contacts that Cheryl and Mary had developed and planned. Cheryl trained you in how to make presentations and discuss City statistics with potential developers. In the summer of 2015 as a City Council Member serving with a measure of authority over employees, you were vociferous in the removal of Cheryl Stalinsky, Fulshear's Economic Development Director, from her position at the City. Finally in October 2015, you submitted your application to fill the position which you were trained for by the City and for which you had a significant role in creating the vacancy with your position of authority as a Council Member. 2. It is your prerogative to submit an application for any job you feel qualified for and I encourage you to follow your heart. However, there appears to be a conflict of interest with the City's Economic Development Director position. It is my responsibility to insure conflicts of interest are diminished and our selection process meets the highest standard of transparency. Your application has placed CJ in a position of conflict since you serve in a role of authority over him as a City Council member. In an effort to remove the conflict of interest created by your application, CJ will be disallowed from serving on the selection panel for the Economic Development Director (EDD) position. This will insure his job has not been jeopardized if you are not selected and he will not be placed in a compromising position by considering one of his superior's applications for a job under his purview. 3. Another conflict of interest going to ICSC developed when you made an application for the EDD position. We have numerous qualified applicants who applied for the EDD position in good faith of being evaluated on an equal or level playing field. If you participate in the City's ED

activities while the qualification review, interview and selection processes are occurring, you will be receiving an unequal advantage in the ability to respond to panel interview questions and understand the City's position for economic development. Fulshear under my tenure has prided itself on transparency and fair and equal treatment. Your request to attend ICSC places the Administration in an ethical dilemma and as a community servant I would hope you show your desire to place community over self and withdraw your request. 4. You serve the City as one member of a 5 member decision making body - City Council. The role of the City Council provides the policy making and policy direction that the Administration strives to carry out. We have 4 equally qualified members of City Council that would ably attend and represent the City at ICSC. In fairness and transparency, they would need to be offered the same opportunity or at least given their turn to represent the City at ICSC as you did last year in 2014. A rotation could be set up where a different Council Member goes to ICSC each year. 5. As a representative of the City, you have already attended the 2015 TML conference and the 2015 SxSW Eco Conference. Your colleagues have only attended the TML conference. You did not discuss the SxSW Eco conference with me nor was your planned activities and goals discussed with me. Therefore, I assumed the SxSW Eco Conference was your priority in serving the City this year along with TML. 6. The dates for ICSC have been known since last year. It was not until this late hour that a request was made for attendance. ICSC membership is tied to an individual and not the City. As a single individual with no membership and waiting until after 10/28/2015 requires a registration fee of $615.00. The total cost would approach $1,500. 7. We have a strong partnership with the Fulshear Area Chamber. Don McCoy has been a strong voice for sustainable development and works to help all Fulshear businesses. Therefore, Don was asked if the Chamber would send him to help the City during ICSC. The Chamber felt Don's support of the City would be a great opportunity to reciprocate support for the City. As such the Chamber has agreed to send Don and also cover his expense to attend. The Chamber support will save the City about $1,500 and supply the supporting needs we have. 8. You indicated last year you made several contacts on behalf of the City and you believe they may have an interest that we need to follow up on. Since you were working on behalf of the City last year, please provide me with your list of contacts and any pertinent information to accompany those contacts. We would like to build upon our successes from last year. We appreciate your willingness to help serve the City. Please consider the issues surrounding your attendance described above. Ponder that if I was taking another EDD position candidate to ICSC with the City, how would you feel? I am sure you would feel slighted and feel they were being given a distinct advantage over you. We will update you on the prospects we make when we return from Dallas. Thanks for your understanding and putting the integrity and transparency of the City first. Regards, Tommy
