     CDOT, High Performance Transportation Enterprise (HPTE), Plenary RoadsDenver, Town of Superior, City of Louisville, and other project partners joinedthe US 36 Express Lanes Project team to officially open the state's secondDiverging Diamond Interchange (DDI) at the McCaslin Boulevard bridgeover US 36. A ribboncutting ceremony was held January 7, to signify theofficial opening of the DDI bridge.

    The US 36 Express Lanes Project was built with the welldefined strategy ofmoving traffic more efficiently. One innovation to help meet this goal was theaddition of the DDI on the McCaslin Boulevard bridge in Louisville/Superior. The DDI is one of 34 DDIs in the country but only the second in thestate of Colorado. The state's first DDI in Grand Junction opened in early2014. 

    The bridge, which began construction last year, will still have someconstruction over the next few months to finish sidewalks, landscaping andstriping, but drivers can experience the benefits now. There have beennumerous small businesses and DBE/ESB certified firms that contributed tothis milestone. Congratulations to the entire team!

    Exclusivity Arrangements: Should You orShouldn't You?This is a question that comes up often during the RFP phase of large designbuild projects. Essentially, an exclusivity arrangement ties a particular DBEsubcontractor to a single prime preventing the DBE from bidding to the otherpursuit teams. In many cases, prime contractor teams are working todifferentiate themselves, create competitive advantage, and keep proprietaryapproaches under wraps.

    The Associated General Contractors (AGC) DBE Tookit states "anexclusivity arrangement involves the situation where a DBE agrees to performwork for only one entity. These arrangements may cause questions regardingthe independence of the DBE and its eligibility to be certified. To be safe,prime contractors should avoid setting up an exclusivity arrangement with aDBE."

    The federal regulations do not explicitly prohibit a prime or DBE from havingan exclusive relationship. Instead the regulations state that the DBE firm'srelationships with prime contractors should be examined to determinewhether a pattern of exclusive or primary dealings with a prime contractorcompromises the independence of the potential DBE firm. So, generally,exclusivity arrangements are discouraged to be fair to all parties and tosupport the overall goals of the DBE program.

    Then, what is the answer? Ultimately it comes down to a business decision. Itis typically in a subcontractor's best interest to bid with multiple teams toincrease their chances of getting work on the project. However, a DBE maychoose to enter into this type of agreement to build a longterm relationship.Another option to consider is a confidentiality agreement which protects a
