Article 1 Interpretation

1116.1.1 Administrative penalty – defined

“administrative penalty” means an administrative penalty established by the Administrative Penalty By-law for contravention of this Chapter. By-law 27-17, March 27, 2017.

1116.1.2 Administrative Penalty By-law – defined

“Administrative Penalty By-law” means the Town’s By-law No. 69-16 establishing a system of administrative penalties enacted pursuant to section 102.1(1) of the Municipal Act, 2001, S.O. 2001 and O. Reg. 333/07, as amended. By-law 27-17, March 27, 2017.

1116.1.3 Authorized sign - defined

“authorized sign” means any sign, curb or sidewalk marking or other device placed or erected on a highway under the authority of this Chapter for the purpose of regulating, warning or guiding traffic. By-law 402-89, 6 November, 1989.

1116.1.4 By-law Enforcement Officer - defined

“By-law Enforcement Officer” means any employee of the Town who is appointed as such by the Commissioner of Planning and Development of the Town. By-law 145-08, 14 July, 2008.

1116.1.5 Boulevard - defined

“boulevard” means the area between the travelled portion of the highway and limit of the highway right-of-way, but does not include a gravel shoulder. By-law 402-89, 6

1116.1.6 Cul-de-sac - defined

“cul-de-sac” means the area at the end of a closed ended street designed for vehicles to turn around and may include a decorative centre island. By-law 179-96, 15 July, 1996.

1116.1.7 Commissioner - defined

“Commissioner” means the Commissioner of Engineering and Public Works or his or her authorized deputy or representative. By-law 31-07, 26 June, 2007.

1116.1.8 Designated disabled parking space - defined

“designated disabled parking space” means a parking space clearly marked and identified with a sign or symbol and provided for the exclusive use of motor vehicles operated by or used for conveying a disabled person and displaying a permit in accordance with the requirements of the Highway Traffic Act, and the regulations made thereunder. 1116.1.9 Director of Operations – defined

“Director of Operations” means the individual occupying the position of the City’s Director of Public Works Operations from time to time, or any successor position and includes any person designated to fulfill any of the Director of Operation’s powers or duties under this by-law. 1116.1.10 Fire route - defined

“fire route” means a private roadway providing vehicular access to or from a building or structure and designated as a fire route and shall include any part of a parking lot designated by visible markings or markers as a fire route.

1116.1.11 Hearing Officer – defined

“Hearing Officer” has the meaning set out in the Administrative Penalty By-law. By-law 27-17, March 27, 2017.

1116.1.12 Highway - defined

“highway” includes a common or public highway, street, avenue, boulevard, parkway, driveway, island, square, place, bridge, viaduct or trestle, designed and intended for, or used by, the general public for the passage of motor vehicles.

1116.1.13 Interfere with winter operations – defined

“Interfere with Winter Operations” means to require the change of course, or to prevent the continuance on a course, or to in any way limit the effectiveness of materials and/or equipment used for winter operations. By-law 107-19, July 9, 2019.



1116.1.14 Intersection - defined

“intersection” means the travelled portion of a highway embraced by the extension of the curb lines to where such lines intersect or, where no curbs exist, the travelled portion of a highway embraced by lines extended 4.25 metres (14 feet) on either side, and parallel to, the centerline of a highway.

1116.1.15 Motor vehicle - defined

“motor vehicle” means any vehicle drawn, propelled or driven by any kind of power, except muscular power, and includes a trailer, motorcycle, traction engine, farm tractor and road-building machine.

1116.1.16 Motor vehicle owner - defined

“motor vehicle owner” means the registered owner of a motor vehicle as registered with the Ministry of Transportation of Ontario. By-law 179-96, 15 July, 1996.

1116.1.17 Municipal By-law Enforcement Officer - defined

“Municipal By-law Enforcement Officer” means all persons who are appointed under section 15 of the Police Services Act, R.S.O. 1990, c. P.15, as amended by the Commissioner of Planning and Development of the Town to enforce the provisions of this Chapter in specific areas as designated. By-law 145-08, 14 July, 2008.

1116.1.18 Occupant - defined

“occupant” means:

the tenant of the property or part thereof whose consent shall extend only to the control of the land of which he or she is tenant, and any parking spaces allotted to him or her under his or her lease or tenancy agreement;

the spouse of a tenant; a person or a municipality or a local board thereof, having an interest in the

property under an easement or right-of-way granted to or expropriated by the person, municipality or local board whose consent shall extend only to the part of the property that is subject to the easement or right-of-way; or

a person authorized, in writing, by an occupant as defined in Section 1116.1.11 (a), (b) or (c), to act on the occupant’s behalf for requesting the enforcement of a provision of this Chapter.

1116.1.19 Officer – defined

“officer” means a Municipal By-law Enforcement Officer or a police officer employed by York Regional Police, Ontario Provincial Police or the Royal Canadian Mounted Police. By-law 27-17, March 27, 2017.

1116.1.20 Owner - defined

“owner,” when used in relation to property, means:



the registered owner of the property; the registered owner of a condominium whose consent shall extend only to

the control of the unit of which he or she is the owner, and any parking spaces allotted to him or her by the condominium corporation, or reserved for the owner’s exclusive use in the declaration or description of the property;

the spouse of a person described in Section 1116.1.12 (a) and (b); where the property is included in a description registered under the

Condominium Act, the board of directors of the condominium corporation; or a person authorized, in writing, by the property owner as defined in Section

1116.1.12 (a), (b), (c) or (d) to act on the owner’s behalf for requesting the enforcement of any provision of this Chapter.

1116.1.21 Park or parking - defined

“park or parking” means the halting of a motor vehicle, whether occupied or not, except when halting temporarily for the purpose of, and while actually engaged in, loading or unloading goods or passengers. By-law 402-89, 6 November, 1989.

1116.1.22 Parking infraction - defined

“parking infraction” means any unlawful parking, standing, or stopping of a vehicle in contravention of this Chapter. By-law 8-19, February 11, 2019.

1116.1.23 Repealed: By-law 27-17, 27 March, 2017

1116.1.24 Parking meter - defined

“parking meter” means an automatic or mechanical meter or device which has:

a receptacle for receiving and storing coins; a slot in which coins may be deposited; a timing mechanism to measure and record the duration of parking; and a signal which, when displayed, indicates that the period of time paid for has

expired.

1116.1.25 Parking meter space - defined

“parking meter space” means a space within any parking meter zone (set out in Schedule ‘H’) intended for the parking of one vehicle and designated by suitable markings, such as a sign or paint marks on the pavement.

1116.1.26 Parking meter zone - defined

“parking meter zone” means any part of a roadway or any area specifically set aside for the parking of vehicles as set out in Schedule ‘H’. By-law 179-96, 15 July, 1996.

1116.1.27 Parking space - defined

“parking space” means any area of a highway designated under this Chapter for motor vehicle parking.



1116.1.28 Repealed: By-law 179-96, 15 July, 1996

1116.1.29 Pedestrian crosswalk - defined

“pedestrian crosswalk” means any portion of a highway designated by by-law of a municipality, at an intersection or elsewhere distinctly indicated for pedestrian crossing by signs on the highway and by lines or other markings on the surface of the highway as prescribed by regulation.

1116.1.30 Penalty notice – defined

“penalty notice” means a notice in relation to a parking infraction issued pursuant to the Administrative Penalty By-law. By-law 27-17, March 27, 2017.

1116.1.31 Physically disabled person - defined

“physically disabled person” means a person who is physically disabled in such a way that his or her mobility is seriously restricted either permanently or temporarily including, without limiting the generality of the foregoing, a person who uses a wheelchair, crutches, braces or other mobility-assisting devices.

1116.1.32 Private roadway - defined

“private roadway” means any private road, private driveway, lane, ramp, or other means of motor vehicle access to or egress from a building or structure and it may include part of a parking lot. By-law 402-89, 6 November 1989.

1116.1.33 Roundabout or traffic circle - defined

“roundabout” or “traffic circle” means an intersection of two or more highways with a raised circular island located in the centre. By-law 32-11, 28 March, 2011.

1116.1.34 School bus loading zone - defined

“school bus loading zone” means an area marked by signs indicating such area to be for the sole use of school buses engaged in receiving or discharging passengers.

1116.1.35 Screening Officer – defined

“Screening Officer” has the meaning set out in the Administrative Penalty By-law. By-law 27-17, March 27, 2017.

1116.1.36 Sidewalk - defined

“sidewalk” means that portion of a boulevard which is paved, bricked or otherwise hard surfaced and intended for the use of pedestrians.

1116.1.37 Stop or stopping - defined

“stop or stopping” means the halting of a motor vehicle, even momentarily, whether occupied or not, except when necessary to avoid conflict or in compliance with the directions of a police officer or of a traffic control sign or signal.



1116.1.38 Town - defined

“Town” means The Corporation of the Town of Richmond Hill. By-law 402-89, 6 November, 1989.

1116.1.39 Winter event – defined

“Winter Event” means an icefall or an accumulation of snow that is likely to exceed 5 cm is likely to occur within the next 24 hours, as declared by the Director of Operations in accordance with the provisions of this by-law. By-law 107-19, July 9, 2019.

1116.1.40 Winter operations – defined

“Winter Operations” means the use of equipment and/or materials to ensure that roadways remain relatively clear of snow and ice, whether prior to or subsequent to any snowfall, including, but not limited to, the application of salt, sand, or like materials and the use of a plow for the removal of snow and ice. Article 2 Traffic Sign - Signal

1116.2.1 Erected - by Commissioner - purpose

The Commissioner is authorized to place or erect and maintain such authorized signs and traffic control signals as are required to give effect to the provisions of this Chapter or as are required to warn or guide traffic for the safety or convenience of the public. By-law 31-07, 26 February, 2007.

1116.2.2 Authorized sign - imitation of - prohibited

No person shall place, maintain or display upon or in view of any highway any sign, signal, marking or device which purports to be or is an imitation of or resembles an authorized sign or traffic control signal, or which conceals from view or interferes with the effectiveness of an authorized sign or traffic control signal.

1116.2.3 Yellow paint - on curb - declared an authorized sign

Yellow paint applied to a curb is hereby declared to be an authorized sign indicating that parking is prohibited where the curb is so marked. By-law 402-89, 6 November, 1989.

Article 3 General Stopping - Parking Regulations

1116.3.1 Highway - parking on - location - direction of travel

No person shall park a motor vehicle on any highway unless on the right hand side of the highway having regard for the direction in which the motor vehicle had been proceeding,



but this provision shall not apply to prevent the parking of a motor vehicle on the left hand side of a designated one-way highway unless prohibited by sign.

1116.3.2 Curb - parking - distance from - exception

No person shall park a motor vehicle on any highway unless the motor vehicle is parallel to and not more than 30 centimetres (12 inches) from the curb or boundary of the highway, but this Section shall not apply where angle parking is permitted under Sections 1116.3.3 through 1116.3.5 inclusive.

1116.3.3 Angle parking - conditions - set out

Angle parking shall be permitted in those areas designated as such under Schedule ‘F’ to this Chapter subject to the conditions set out in Sections 1116.3.4 and 1116.3.5.

1116.3.4 Angle parking - front facing curb - 45 degree angle

No person shall park any motor vehicle except at an angle of 45 degrees from the curb or boundary of the travelled portion of a highway with the front end of the motor vehicle at such curb or boundary. By-law 402-89, 6 November, 1989.

1116.3.5 Parking - lines - painted - vehicle within space

Where parking spaces are designated by lines painted on the highway or a parking lot, no person shall park any motor vehicle so as to infringe upon or take up more than one parking space. By-law 95-05, 26 September, 2005.

1116.3.6 Parking prohibited - specified places - no signs

No person shall park a motor vehicle:

on a highway within 9 metres (30 feet) of an intersection; park within 3 metres (10 feet) of a point on the edge of the roadway or curb

that is nearest to or in front of a fire hydrant; so as to obstruct a private roadway; so as to obstruct a sidewalk; so as to obstruct a pedestrian crosswalk; so as to interfere with the movement of traffic; on a highway during any winter event on a highway so as to interfere with winter operations;

Repealed: By-law 49-04, 23 February, 2004 on any boulevard, except on that portion of a boulevard immediately in front of

and leading from the travelled portion of a highway to a private driveway, provided that, notwithstanding the aforesaid exception, no person shall park a motor vehicle on a sidewalk whether or not any portion of such sidewalk forms part of a boulevard;

on a highway within 152 metres (500 feet) of fire-fighting apparatus while said apparatus is actually engaged in fighting a fire, or any greater distance directed by a police officer or member of the Fire Department;



on a highway within 7 metres (5 feet) of the entrance-way to a fire hall on the same side of the highway on which the fire hall is located or within 30 metres (100 feet) of the entrance-way to a fire hall on the opposite side of the highway;

on a bridge; on a highway within 6 metres (20 feet) of a bus stop; Repealed: By-law 49-04, 23 February, 2004 park on centre island of cul-de-sac;

1116.3.7 Parking - stopping - prohibited - specified places signs

Where a sign has been erected indicating that parking and stopping is prohibited or that stopping is prohibited, no person shall park or stop a motor vehicle in any of the following places:

in front of the entrance to any public hall, theatre, school or church at times which are designated on the signs; provided that taxicabs legally permitted to pick up passengers in the Town of Richmond Hill shall be excluded from this provision;

on a highway within 24 metres (75 feet) of a point designated as a bus stop; in areas designated “Police Vehicle Only;” in areas designated “Emergency No Parking;” in areas designated “School Bus Loading Zones” on Schedule ‘D’; on a highway within 15 metres (50 feet) of an intersection, not controlled by

traffic signals; on a highway within 30 metres (100 feet) of an intersection controlled by

traffic signals; on a highway at those places designated in Schedule ‘A’ during the period

therein prohibited; on a highway at those places designated in Schedule ‘B’ during the period

therein prohibited; on a highway at those places designated in Schedule ‘C’ for a period in

excess of the period therein specified; Repealed: By-law 1-07, 12 February, 2007; on Newkirk Road between Centre Street and Major Mackenzie Drive within 5

metres (16.4 feet) of a private roadway; on a highway within 5 metres (16.4 feet) of a private roadway;

for a period exceeding three hours at any time on any highway except between the hours of 5 pm and midnight;

on a highway between the hours of 3 am and 6 am; on a highway between the hours of 1 am and 7 am from December 1 to March; park in a cul-de-sac; and



on a highway within 30 metres (100 feet) of a roundabout or traffic circle. 1116.3.8 Fire route - parking on - prohibited

No person shall park a motor vehicle on a fire route. By-law 402-89, 6 November, 1989.

1116.3.9 Disabled parking - permit - required

No person shall park or stop a motor vehicle in a designated disabled parking space unless that person is the driver of a motor vehicle on which a handicapped permit is properly displayed and which is being driven by or is carrying one or more physically disabled persons. By-law 43-90, 5 February, 1990; By-law 311-90, 10 September, 1990.

1116.3.10 Repealed: By-law 278-98, 30 November, 1998

1116.3.11 Private property - parking - owner consent - required

No person shall park or leave any motor vehicle on private property without the consent of the owner or occupant of such property.

1116.3.12 Private property - parking - when deemed without consent

For the purposes of Section 1116.3.11, where an owner or occupant of property has posted signs stating conditions on which a motor vehicle may be parked or left on the property, a motor vehicle parked or left on the property contrary to such conditions or prohibition shall be deemed to have been parked or left without consent.

1116.3.13 Municipal By-law Enforcement Officer - authority

A Municipal By-law Enforcement Officer appointed to enforce this Chapter in respect of a particular property shall be deemed to have written authority of the owner or occupant of the property and is not required to receive a written complaint before enforcing this Chapter.

1116.3.14 Municipal property - parking - where not authorized

No person shall park any motor vehicle on property owned or occupied by the Town or a local board thereof where parking by the public is not authorized. By-law 402-89, 6 November, 1989.

1116.3.15 Municipal property - parking - continuous - limited

Subject to posted signs stating otherwise, no person shall leave any motor vehicle on property owned or occupied by the Town or a local board thereof for a continuous period of twenty-four hours. By-law 95-05, 25 September, 2005.

1116.3.16 Exemption - emergency - public works vehicles



This Chapter shall not apply to ambulances, police and fire department motor vehicles, public utility motor vehicles and motor vehicles actually engaged in works undertaken for the Town if compliance herewith would seriously interfere with the function which the motor vehicle is performing.

1116.3.17 Time - Eastern Standard - Daylight Savings

Where any hour or other period of time is stated, the time referred to shall be Eastern Standard Time except in periods when Daylight Saving Time has been declared in effect, in which periods it shall be Daylight Saving Time. By-law 402-89, 6 November, 1989.

1116.3.18 Time - parking permitted - days limited - Schedule ‘G’

Notwithstanding anything in this Chapter to the contrary, parking shall be permitted at those places designated in Schedule ‘G’ for the period specified therein and during the days and time specified therein. By-law 407-90, 26 November, 1990.

1116.3.19 Schedule - forming part of Chapter

Schedules ‘A’ to ‘H’ inclusive and the designations in those schedules are hereby, and incorporated in, and form part of this Chapter. By-law 402-89, 6 November, 1989; By-law 179-96, 15 July, 1996.

1116.3.20 Parking - parking meter zones

No person shall allow a vehicle to remain parked in a parking meter space for longer than the maximum time set out in column 2 of Schedule ‘H’. No person shall park a vehicle in any parking meter zone (column 1), for up to the maximum period of time (column 2), and during the times on the days (column 3) set in Schedule ‘H’, unless that person:

properly parks the vehicle wholly within a parking meter space; and deposits coins in the parking meter provided for that space in accordance

with the rates (column 4) set out in Schedule ‘H’.

1116.3.21 Parking - meter zones - space occupied

No person shall park a vehicle in a parking meter zone unless that person parks the vehicle wholly within one parking meter space. If a person can- not so park because of the vehicle’s length or width, that person may park the vehicle within more than one space, but shall deposit coins in the parking meter provided for each space partly or wholly occupied.

1116.3.22 Parking meter - coins deposited

No person shall deposit or cause to be deposited in any parking meter anything other than a coin of the Dominion of Canada or of the United States of America. By-law 179-96, 15 July, 1996.

1116.3.23 Winter Event – Declaration by Director of Operations – Public Notice



The Director of Operations may declare a winter event at any time the Director of Operations, in the Director of Operation’s sole and absolute discretion, determine s that a winter event is occurring or is likely to occur within the next 24 hours by arranging for public notice by a minimum of the following means:

(a) the issuance of a media advisory; and

(b) posting notice of the same on the City’s public website.

The Director of Operations may arrange for any additional notice that has a reasonable likelihood of coming to the attention of affected persons. The Winter Event shall commence immediately upon the giving of the notice. The Winter Event shall end upon the giving of a further notice by the Director of Operations by the same means listed above. By-law 107-19, July 9, 2019.

Article 4 Permit Parking

1116.4.1 Area designated - Schedule ‘E’

The area described in Schedule ‘E’ is designated for permit parking only.

1116.4.2 Parking - designated hours - permit displayed - only

Where properly worded signs have been erected and are on display, no person shall park a motor vehicle in an area designated for permit parking only, during the hours designated therein, except a motor vehicle issued a parking permit by the Town on which such parking permit is readily and openly displayed upon the front windshield. By-law 402-89, 6 November, 1989.

Article 5 Penalty

1116.5.1 Penalty notice- issue - for contravention

An officer, upon discovery of any motor vehicle parked or left in contravention of this chapter may issue a penalty notice, which must be served in accordance with the requirements of the Administrative Penalty By-law. By-law 27-17, March 27, 2017.

1116.5.2 Parking penalty notice- payment

Upon issuance of a Penalty Notice, the owner of the motor vehicle shall be liable to pay to the Town an administrative penalty in the amount specified in Schedule “A” to the Administrative Penalty By-law. By-law 27-17, March 27, 2017.

1116.5.3 Penalties - – review – Screening Officer – Hearing Officer

A person who is served with a Penalty Notice may request a review of the



Administrative Penalty by a Screening Officer in accordance with the timelines and process set out in the Administrative Penalty By-law. A person may further request a review by a Hearing Officer of the decision of a Screening Officer in accordance with the timelines and process set out in the Administrative Penalty By-law. By-law 27-17, March 27, 2017.

1116.5.4 Vehicle - on private property - removal - storage

In addition to any other penalty provided for in this Chapter, a police officer, or Municipal By-law Enforcement Officer upon written complaint of an owner or occupant of private property, may cause a motor vehicle that is parked in contravention of this Chapter to be removed and taken to and stored in a safe place. By-law 189-93, 21 June, 1993.

1116.5.5 Vehicle - removal - storage - authority

In addition to any other penalty provided for in this Chapter, an agent of the Town may cause a motor vehicle that is parked on property owned or occupied by the Town, in contravention of this Chapter, to be removed and taken to and stored in a suitable place.

1116.5.6 Vehicle - removal - storage - charge to owner

Where a motor vehicle is removed and stored pursuant to Section 1116.5.4 or 1116.5.5, all costs and charges for removing, care and storage of the motor vehicle shall be paid by the motor vehicle owner and shall be a lien on the motor vehicle which may be enforced in the same manner as provided for in the Repair and Storage Liens Act. By-law 402-89, 6 November, 1989.

Article 6 Enforcement

1116.6.1 Non-application of Provincial Offences Act

The Provincial Offences Act, R.S.O. 1990, c.P.33, as amended, shall not apply to any contravention of this Chapter. By-law 27-17, March 27, 2017.

1116.6.2 Unpaid Administrative Penalties – Enforcement

If an administrative penalty is not paid within fifteen (15) days after the date it becomes due and payable to the Town, the Town may enforce payment of the amount in default in accordance with, and as set out in, O.Reg. 333/07. By-law 27-17, March 27, 2017.

1116.7.2 Ministry of Transportation - approval - required

The provisions of this Chapter shall be deemed to be severable. Any provision requiring the approval of the Ministry of Transportation of Ontario shall become effective only upon receipt of such approval and any provision not requiring such approval shall become effective upon the final passing of the enabling by-law, and notwithstanding the provisions of this Chapter to the contrary, any provisions in the by-laws thereby repealed shall, until the approval hereof of the Ministry of Transportation of Ontario is received, remain in full force and effect.
