Narrative

Sgt. T. Gay was in the area in front of 376 E. 2nd St. with Ofc. Brown and heard 5 gun shots in the area. The shots came from a location just Southwest

of our location toward Mosher Alley. Sgt. advised other Officer who arrived and checked the area. There was nobody found out in that area at that time.

Sgt. returned to my cruiser and continued checking the area. Sgt. observed 4 people sitting out behind a garage at 342 1/2 E. 2nd St. which is located

just West of Mosher Alley. The people sitting out advised they also heard gunshots and pointed to the area to the East by the rear of 376 E. 2nd St.

Sgt. did not see any signs of weapons on any the 4 people at that time and did not obtain their names.

At 1:16am Sgt. performed a traffic stop of a possible drunk driver, Barry Maxwell. The passenger was Ricky Wickline Jr. The car was a 1994 green

Cadillac STS Ohio lic. plate#FNE5991. Sgt. recognized them both as being present at 342 1/2 E. 2nd St. along with the car. Mr. Maxwell was arrested

for OVI and Mr. Wickline was arrested for Disorderly Intoxication. The car was towed by Penwells Towing. While performing an inventory of the car

Sgt. found a Taurus revolver .38special in the trunk. The cylinder had 6 spent shell casings still in the revolver. Sgt. placed the gun into evidence and

obained a Gun Shot Residue Kit from Mr. Maxwell. The evidence and investigation will be conducted under report#13-6812.

Sgt. T. Gay was on patrol and sitting stationary in the area of E. 2nd St. and Mosher Alley. At 12:38am Sgt. was in the area and heard possible gun

shots, see report#13-6811. There was still a lot of people out in the area walking. Sgt. heard a car peel out in the area of Mosher Alley and observed a

green 1994 Cadillac 4dr, Ohio lic. plate#FNE5991 traveling E/B in the East/West alley between 2nd St. and Main St. and stop at Mosher Alley. The car

turned N/B on Mosher Alley and swerved to the right and ran off the right side of the roadway nearly hitting a utility pole. The car swerved back onto

the roadway and continued N/B. The car then turned E/B on E. 2nd St. Sgt. pulled behind the car and it immediately pulled over onto a parking lot in the

area of E. 2nd St. just East of Sugar St. Sgt. activated the overhead lights and performed a traffic stop on the car.

Upon the initial contact with the driver, Barry Maxwell, Sgt. observed he had an odor of alcohol on his breath and slurred, thick tongued speech. Sgt.

had previously had contact with Mr. Maxwell at the rear of 342 1/2 E. 2nd St. ref. the earlier report#13-6811 while investigating the possible shots fired.

Sgt. spoke briefly to Mr. Maxwell at that time and witnessed him fall down while attempting to sit in an electric wheelchair. Sgt. had to ask his 3 friends

that were present to help pick him up off the ground and sit him in the chair. Mr. Maxwell had a physical disability/handicap but was also obviously

intoxicated. Sgt. left him in the care of his 3 friends at that time. The green Cadillac was also parked in front of the building at that time.

At this time Mr. Maxwell was not cooperative with Sgt. and initially refused to provide his I.D. Mr. Maxwell claimed to have dual citizenship and

had diplomatic immunity from Russia. Mr. Maxwell stated he did not have his credentials with him. Mr. Maxwell finally provided his Ohio ID and

stated he did not have a valid drivers license in Ohio but did have driving privileges in Russia but again was unable to produce any form of a valid

operators license. Sgt. read the Miranda Rights to Mr. Maxwell and he waived his rights and stated he had been drinking beer and drank three 12oz beers

over the last 6 hours. While seated in the car Sgt. performed the HGN test on Mr. Maxwell and observed 6 clues of nystagmus. Sgt. attempted to run a

check on Mr. Maxwell's O.L. status and he began to yell and cuss at Ofc. Yoder who had arrived as back up. Ofc. Yoder asked Mr. Maxwell to stop

reaching around and place his hand where he could see it and Mr. Maxwell became angry and attempted to get out of the car and yell at Ofc. Yoder. Sgt.

then placed Mr. Maxwell under arrest for OVI and escorted him to the back seat of car 19. Sgt. had to assist Mr. Maxwell to keep him from falling down

because he was very unsteady on his feet. Sgt. did not place Mr. Maxwell in handcuffs at this time because he did not appear to have use of his right

arm. Mr. Maxwell advised his right arm was paralyzed. Prior to sitting in the back seat of car 19 Mr. Maxwell stated he had to urinate. He stated if he

did not urinate on the ground he would urinate in the back of the cruiser. Sgt. warned Mr. Maxwell that if he urinated on the ground he may be issued a

citation and he stated he did not care and proceeded to urinate on the ground. Sgt. attempted to talk to Mr. Maxwell about a tow truck for his car and he

was very uncooperative.

Sgt. then assisted Ofc. Yoder with the passenger in the car, Ricky Wickline, who was also very intoxicated. Ofc. Yoder placed him under arrest for his

own safety. At that time Ofc. Anderson attempted to talk to Mr. Maxwell in the back seat of his cruiser. Ofc. Anderson arrived with Ofc. Yoder as

they were riding together in car 19. Ofc. Anderson advised Mr. Maxell was hitting the shield inside the car and refused to stop or cooperate with him.

Ofc. Anderson told Mr. Maxwell several times to stop or he would have to handcuff him. Mr. Maxwell continued so Ofc. Anderson asked Mr. Maxwell

to step out of the car and he refused and tried to pull away from Ofc. Anderson. Ofc. Anderson then pulled Mr. Maxwell out of the car and onto the

ground where he attempted to handcuff him. Mr. Maxwell refused to place his hands behind his back. Ofc. Anderson was able to handcuff Mr. Maxwell

who them began to threaten to kill Ofc. Anderson. He was then transported to the Ross County Jail. The OVI paperwork and traffic citation was then

handles by Ofc. Yoder with the assistance of Ofc. Brown. Ofc. Anderson completed the arrest paperwork involving the threats made by Mr. Maxwell.

Sgt. then performed an inventory of the car while waiting for the tow truck. Penwells Towing arrived to tow the car. Sgt. checked the trunk of the car

and observed a black Taurus revolver Model 82 serial #1469633, .38 special caliber. The revolver was laying on top of a black zipp up hooded

sweatshirt. The revolver was a 6 shot that contained 6 spent (Fired) shell casing still in the cylinder. The gun also had black rubber Hogue handgrips.

Sgt. photographed and secured the gun and placed it in evidence. Sgt. then went to the jail and spoke to Mr. Maxwell and reminded him of his Miranda

Rights. Mr. Maxwell was very belligerent and continued to threaten to kill Ofc. Anderson and his family. Sgt. obtained a gun shot residue kit from Mr.

Maxwell and placed it into evidence. While obtaining the sample from Mr. Maxwell he stated, "So you found my gun." Sgt. attempted to question Mr.

Maxwell further about the gun and shots fired and he refused to answer any further questions. Sgt. returned to 342 1/2 E. 2nd St. and checked the area

but was unable to locate any evidence. Sgt. will send the gun and GSR kit to BCI for analysis with additional charges pending.

Sgt. ran a criminal history check on Mr. Maxwell and found he has numerous convictions for weapons charges and explosives charges and offenses of

violence.

dispatched to Circle K (659 N. High) reference to a theft. Ofc. contacted Marie Lopez and store employee, Linda Rinehart. Linda reported that Marie

came into the store asking to use the restroom which she told Marie was for employees only. Linda reported that Marie then walked to the grill in the

store and ate an egg roll without paying for it. Linda reported that Marie the began eating a cheese burger off of the shelf of the store without paying for

it. Ofc. obtained a receipt of sale and a voluntary witness statement from Linda. Linda was unsure how to operate the camera system. Ofc. will pick up

the video at a later time on this date. Ofc. contacted Marie and advised her of her Miranda Rights which she waived. Marie reported that she is in

Chillicothe from Arizona visiting her sister. Marie was unable to inform Ofc. how she got to Circle K. Marie informed Ofc. that she had smoked a joint

"in the day time" and did not remember anything after that. Marie was unable to inform Ofc. who she smoked the joint with. Ofc. observed Marie''s

eyes to be glassy and blood shot. Marie stated that she did not remember eating an egg roll or cheese burger in Circle K. Ofc. observed a half ate cheese

burger sitting in front of Marie. Marie stated that she did not have any money to pay for these items on her person. Ofc. placed Marie under arrest for

petty theft and transported her to the RCJ where she was left in the custody of the staff awaiting her court hearing on 4/24/13 at 9:00am. Marie was

informed she is barred from Circle K. Once at the jail ofc was advised there was an active warrant for Marie Magil (Lopez). The Common Pleas Court

Bench warrant (10 CR69) is for FTA for criminal arraignment. She received her copy and it was explained to her. Nothing further at this time.

asked Carrie how much she had to drink tonight and Carrie told Ofc 1/2 a bottle of liqueur and three beers. For her safety and the safety of others Ofc

placed Carrie under arrest and transported her to the Ross County Jail where she will be held until sober. Ofc issued Carrie cit #094107 charging

disorderly intox with a court date of 5-3-13 at 9am. Nothing further.

was dispatched to the listed location reference illegal dumping. Upon arrival Officer contacted the complainant Mr Poe. He advised Officer last week

someone had placed several bags of trash next to his when he had put his out for the night. He said yesterday evening when he set his two trash cans out

there were no other bags around his. He said he stayed awake until around 2:30AM on this date to see if anyone came back and dropped off anymore

trash bags. He said when he awoke around 8:15AM he observed that there were now four extra bags of trash next to his cans. He said he opened one up

and found a letter addressed to a Jaime Sherman of 878 Tiffin Avenue. He then called this department. Mr Poe stated all he wanted was for whoever is

dumping the trash to stop. Officer then went to 878 Tiffin Avenue, but Ms Sherman was not at home at that time. Officer will try to make contact

with her reference this incident.

Ross Co Banking Center Master Card for $125.75 to Zoosk.com and the on 4-23 a second one for $121.75. She said on 4-23-13 there was a charge to

Walmart.com for $193.29. Sharon said she does not do any online shopping and is not familiar with Zoosk. She said she did not make these charges. She

gave Ofc. a copy of her account info and Ofc. did note the above transactions. Ofc. attempted contact with Zoosk without success but was able to make

contact with a Walmart representation. Ofc. was advised Sharon''s account (which she did not open herself) was being closed and any further transaction

attempts would be stopped. The items ordered on her account had already shipped to Pittsburgh, PA. Sharon advised she does not know anyone in

Pittsburgh and would not have ordered anything and shipped it there. Ofc. has no options for follow up in this matter. Sharon advised her bank was

returning her money. Nothing further.

:Incident Disposition Comments : Officer was dispatched to Adena Mansions and Gardens reference a garage had been broken into. Upon arrival

Officer contacted Mr Detty the grounds keeper for the property. He advised Officer he had left the garage/maintenance shed to go to the visitors center

around 9:45AM. He said he had told the two men working with him to go and check signs they had put up that might have been blown down and that

they left around 10:00AM. He said around 10:45AM they called him and told him that someone had forced open the man door to the building and stole

two (2) Stihl chain saws from the garage. He said he arrived and found that they had been telling the truth and contacted this department. He then showed

Officer where the saws had been chained to a workbench and Officer could observe that whoever had stolen the saws had broken the handles off while

stealing them. A bar cover was also observed lying on the floor. Officer checked the man door and could see where it had been pried open with an object

and damaged the lock catch in the door frame. Officer photographed the damage and where the saws were stolen from and then checked for latent prints,

but none were observed. Officer asked Mr Detty if anything else was missing as there were several weed eaters and other equipment in the garage. He

stated these were the only things he had found missing. Officer asked if he had the serial numbers off of the two saws, if he knew who the property was

actually owned by and if it were insured? He stated the property was owned by the State of Ohio Historical Society and he did not know what the serial

numbers or insurance was, but he would find out that information and contact this Officer. Officer asked if he or his workers had observed anyone acting

suspicious in the area? He stated they had not.

Nicholas some professional help. He advised he was going to do so. He said he did not want to file any charges on his son as he did not think that would

was dispatched to Mt Logan School located at 841 E Main St in reference in reference to an assault. Upon arrival Officer made contact with with the

Principal Elaine Domo, the victim Dominic Dutcher, his mother Maria Dutcher and the Substitute Teacher Jean Ziogas. Dominic said Anthony was

making threats towards him so when Anthony came up to him he pushed him away, Anthony then punched him in the left side of his face and then Ms

Ziogas separated them. Jean Ziogas said she did not see any punches only the two boys grappling with each other so she yelled and Anthony

stopped. She said she she told Dominic to stay close to her to stop anything else from happening. Elaine Domo said Anthony Kennedy is his name

and they have had lots of problems with him misbehaving. Elaine said there is no working video in Mt Logan and she does not have any witnesses at this

time. Elaine said she will contact the Class in the morning and see if there are any witnesses and obtain statements. Officer contacted Anthony at 15

Mosher his guardian and grandmother Rebecca Kennedy was present. Anthony said he was playing with Dominic all day then Dominic pushed him into

a desk so he hit him back. Anthony made this statements before Officer could advise him of his Miranda rights. At this time Officer has not other

witnesses available. Investigation continues.

Incident Disposition Comments :

Officer was dispatched to JCPenney in reference to subjects loading a bag with clothing possibly going to steal the items. Officer waited out of view in

the parking lot and was advised a white female wearing a blue hoodie was running from the store towards Red Lobster. Officer then was advised she came

in a green Toyota Camry and observed that vehicle about to pull out of a parking spot. Officer stopped behind the vehicle, a 1995 dark green Totota

Camry OH/FUZ4059, and activated his over head lights. Officer made contact with the driver/owner, Donald Wright, front seat passenger, Whitney Lett,

and rear passenger, McKenzie Rhea. Officer observed McKenzie was wearing a blue hoodie and Officer detained all.

Officer made contact with JCPenny Employees, Store Manager Doyd Wycinski, Cashier Jessica Mead, and Supervisor Patty Janes. Doyd advised he

was advised that three subjects, later identified as Whitney, McKenzie, and Donald, selected several items in the store and placed them in a bag. Doyd

advised his employees thought the subjects were going to try to steal the items due to them acting suspicious. Doyd advised he then called the Police in

case the subjects tried to run out the store with the items. Doyd advised Whitney and Donald then left all the items with one of his employees and

advised they would be back in to pay. Doyd advised they went out to the green Toyota and McKenzie went to pay for all of the clothing items totaling

$901.90. Doyd advised his cashier, Jessica, observed McKenzie try to pay for all the items with a JCPenny credit card with the name Jean Moore on it.

Doyd advised Jessica refused to accept payment with the card due to her not being authorized to use it. Doyd advised McKenzie then took off running

with the credit card out to the vehicle. Doyd advised he called the Police and that was when the Officer pulled up behind the vehicle. Doyd and Jessica

provided Officer with a written statement and a copy of the receipt. Doyd also advised he would call the Police Dept when a copy of the security video

could be picked up.

Patty advised the same and provided Officer with a written statement.

Officer advised Donald, Whitney, and McKenzie of their Miranda Rights which all advised they understood.

Donald and Whitney denied knowing McKenzie was going to pay with and/or possess a stolen credit card. Donald gave Officer consent to search his

vehicle and Officers located a brand new pair of Nike shoes in the back seat, trash, and a large bag of used clothes in the truck.

McKenzie at first denied having a credit card but then advised Officers that she stuck the card down the front of her pants. McKenzie retrieved the credit

card from the front of her jeans and her under wear. McKenzie advised she put it there when she was exiting the store. Officer observed the card was a

JCPenny credit card with the name Jean Moore on the front of it. McKenzie advised it was her grandmothers and that she is allowed to use it and she

was buying herself and the other two subjects clothes. McKenzie also provided a recent from Champs for the shoes in the back seat.

Officers retrieved a phone number for Jean from Doyd and had dispatch contact Jean. Dispatch advised Jean did not give McKenzie authorization to use

the card and/or have the card. Dispatch contacted Waverly PD who was enroute to take a Theft report from Jean. Officer made contact with Waverly PD

who advised they would fax the report and Jean's statement when it was done.

Officer arrested McKenzie for Felony Receiving Stolen Property (ORC 2913.51) and Officer Howell transported her to Ross County Jail to be held until

her Municipal Court date on 4/25/13 at 9:00am.

While at the Ross County Jail McKenzie handed over a syringe and a burnt spoon that was hidden on her person.

Officer also added the charges of Possession of Drug Abuse Instruments (ORC 2925.12) and Drug Paraphernalia (ORC 2925.14) to McKenzie.

The JC Penny Card along with the syringe and spoon were photographed and placed into evidence.

McKenzie advised she uses the syringe to inject Heroin and the burnt spoon to cook it. McKenzie advised she has a drug problem. McKenzie was

advised that she is barred from JCPenney at the request of Management and if she is caught on their property she could be charged with Criminal

Trespass.

Officer had the vehicle McKenzie was arrested out of towed by Best Towing and a hold was placed on the vehicle for evidential purposes due to the

possibility it could contain more evidence and/or be more involved. Officer released Donald and Whitney due to no evidence they were involved in the

theft and/or possessing the stolen property.

Officer made contact with Robert Graves at 139 Vine St in reference to his garage being broken into. Robert advised someone broke into his garage

sometime last night and took $60.00 in tools. Robert advised no damage was done to the garage and thinks they got in by wiggling the lock. Robert

advised the lock is old and unlocks easily. Robert advised he has secured the garage better and that his property is insured through Western Reserve.

Officer was unable to make contact with any neighbors and observed no damage to the garage. There was no physical evidence and Robert was unable to

provide any serial numbers for his property.

Officers were dispatched to the area of E 2nd St and Mosher Alley in reference to a fight.

Ofc saw a white male subject run behind an E 2nd St home. The male was not wearing a shirt and attempted to hide from officers. Ofc made contact

with the subject and identified him as Jonathan Campbell. Ofc could immediately smell the strong odor of an alcoholic beverage on his breath and person.

Campbell had glassy/bloodshot eyes and was unsteady of his feet. Campbell confirmed that he was just involved in a fight with "some guy". Campbell

did not have anyone to care for him or keep him under control. Campbell was placed under arrest for disorderly intoxication for his own safety and the

safety of others. Ofc was unable to locate anyone else involved in the altercation.

Campbell was issued MM citation 09 4371 with a court date of 4/25/13. Campbell was left in the custody of jail staff until sober.

Approximately 45 minutes after the initial call Edward Yerian called and stated he was assaulted in the area of E 2nd And Mosher. Ofc contacted

Yerian at 295.5 N High St. Yerian stated that Campbell hit him in the head with a baseball bat. Yerian stated he was involved in a fight with Campbell

and thinks he gave Campbell a "whoopin" after Campbell struck him with a bat. Yerian had a large knot on the back of his head consistent with being

struck by a blunt object. Yerian had the strong odor of an alcoholic beverage on his person and admitted to drinking several beers. Yerian also stated that

he was drinking with Campbell earlier and even bought him a beer. Yerian refused medical treatment. Yerian was left in the care of his wife.

Yerian told Ofc that he did not want to pursue any charges and that he just wanted the "police" to know about the incident so he did not have to go

back and "take care of it" tomorrow. Yerian was told that when he sobers up tomorrow to contact this Ofc if he changed his mind.

Due to the intoxicated state of Yerian and Campbell as well as the fact there are no independent witnesses, Ofc will not be pursuing assault charges at

this time.

Ofc was dispatched to 138.5 Prospect St ref to a telephone harassment complaint. Upon arrival Ofc contacted Virginia Houser. She said that her soon to

be ex husband, Rick Houser, keeps texting her current boyfriend's phone. She said that Mr. Houser can not call her because she blocked his number but

he does keep texting Brian Rinehart. She said that he hadn't threatened Mr. Rinehart or anything but the two of them keep calling each other names etc.

She said that she would like Mr. Houser to stop before things get worse.

Ofc spoke with Mr. Rinehart, who became angry when Ofc advised him on how to block Mr. Houser's number. Mr. Rinehart just stormed off and said

that he would take care of it himself.

Ofc did attempt to make contact with Mr. Houser but he would not answer. Ofc advised him, via voicemail, to quit calling and bothering Mr. Rinehart or

he could possibly be charged with Disorderly Conduct.

At this time Ofc has nothing further.
