Bridge St. Ofc. contacted the male who was identified as Travis Croy. Travis stated that he was recently released from prison and was unable to get into

an apartment at this time so he is homeless. While speaking with Travis, Karen Rhoades contacted Ofc. and stated that Travis was sitting on her door

step when she returned home. Karen stated that her back door was locked when she left and it is now unlocked and would not shut. Ofc. advised Travis

of his Miranda Rights prior to questioning. Travis stated that he was sitting on the door step of 23 Ewing when Karen returned home and she asked him

to leave so he did. Travis stated that he never went inside the house. Ofc. checked the house and the back door was able to be secured. Karen stated

that nothing was missing. Ofc. advised Travis that he is barred from 23 Ewing, he stated he understood. Travis was released without charges filed.

Eckles stated a sub-contractor for him had been using this unit until 9:00pm on 6/30/2013 and he did not return to the construction site until 8:00am

today. Mr Eckles stated there were no reported witnesses to this incident and he had no idea who would take this item. Ofc instructed Mr Eckles to

shoplifter being detained there. Ofc contacted Phillip L Coen (Loss Prevention) who stated he observed a white male in the shoe department trying on a

pair of white tennis shoes. Mr Coen stated this subject then walked away from the shoe department after placing his original shoes in the now empty

shoe box and returning it to the shelf. Mr Coen stated he watched as this subjects went through the check-out line, where he purchased a pair of shorts

and a shirt. Mr Coen stated he stopped this subject in the parking lot and returned him to the Loss Prevention Office. This subject was identified as

Michael A Dennis. Mr Dennis stated he "forgot" he had on the wrong shoes when he exited. Ofc obtained a written statement from Mr Coen, a sales

receipt for the stolen shoes ($69.54) and a copy of the video surveillance regarding this incident. Ofc transported Mr Dennis to the RCJ where he was

booked for Theft (2913.02). Mr Dennis was informed that he was being barred from Kohl''s property and returning there could result in further charges

being filed, which he stated he understood. Mr Dennis was left in the custody of the jail staff pending his appearance in court on 7/3/2013.

Ofc. was dispatched to High and North Sts ref. a possible child abduction. On arrival a male subject advised that Jason Byrd had ran in and said

someone had just abducted a child. He gave Ofc. Jason's phone number and departed. Ofc. made contact with Jason by telephone. He advised he had

followed the subjects as far as the motorcycle club and then went about his way. He said it appeared to him a male subject punched a female five or six

times "straight on in the face" and then grabbed a kid, threw her in his vehicle and drove away.

While speaking with Jason, Amber N. Neighborgall came up to Ofc. She advised that she was the child's mother and was told the police thought there

had been an abduction. She said her daughter, Kendall G Kaltenbach was with her father, Jeremy Kaltenbach. Amber said she and Jeremy had a

disagreement and he tried to take her cell phone which is probably what Jason saw. She said he at no time struck her nor did he act like he was going to.

Amber said that Kendall was safe with him and she did not have a problem with him having her. Ofc. noted that Amber had no marks on her nor any

other indication of a confrontation.

Ofc. spoke with Jeremy Kaltenbach on Amber's phone. He advised he was fine as was Kendall. He said he was not coming to the residence to speak

with Ofc. but would be returning home with his daughter shortly.

Municipal Court, where he was served a copy of this warrant, charging failure to appear on an original charge of theft filed by Officer Shaw of this

agency. Remson appeared before Judge Street and the charge was dismissed due to the lack of a victim to prosecute. No further action required ref this

Ofc. was dispatched to 53 Cheyenne ref. a disorderly. Ofc. spoke to Gayle Lansing who stated that Eric Hardesty had come up on his porch and

struck him in the left ear and told him he needed to get right with the Lord. Mr.Lansing stated he does not know why Eric did this. Mr.Lansing stated

that Gwen Davidson and Howard Hickman witnessed the incident. Ofc. spoke to Gwen and Howard and they both stated that Eric walked up on the

porch and struck Gayle.

Ofc. spoke to Eric Hardesty who stated that he was watching his disabled brother. Mr.Hardesty did not say anything else.

Ofc. did not observe any marks on the side of the head where Mr.Lansing stated that Eric Hardesty had struck him. Ofc. did receive written

statements from all three subjects. Due to the statements from all three subjects, Ofc. issued Eric Hardesty MM Citation 09 4155 for Disorderly

Conduct with a Municipal Court date of 7-12-2013 at 9:00AM.

On the above date and time officer was in personal vehicle driving into work, in uniform, from US 35 to E Main St. Officer was heading w/b on E

Main St when officer heard Ofc. S. Murray dispatched to the area of 1020 E Main St, Hooch's, in ref to a male subject in the roadway possibly drunk.

Officer was arriving in this area when officer noticed a white male with no shirt on standing in the eastbound lane of Main St near Hildegarten and had

traffic stopping and going around him. Officer then pulled his personal vehicle into a parking lot at Main and Hildegarten and attempted to make contact

with the male subject. As officer was approaching the male subject officer noticed he had pulled his white pants down around his ankles but still had a

green pair of pants on. Officer noticed the male then ran into the middle of Main St at which time officer noticed the subject was Kyle A. Fleming.

Officer stopped traffic and ordered Mr. Fleming several times to exit the roadway. Mr Fleming would not comply and again he was ordered out of the

roadway. Still Mr Fleming would not comply. Ofc then told Mr Fleming that he was under arrest. Mr. Fleming looked at this officer and put his arms up

and said "come on". Officer again instructed him to place his hands behind his back because he was under arrest. Mr. Fleming finally complied, placed

his hands behind his back but was still holding a cigarette. Officer knocked the cigarette from Mr. Flemings hand and placed him into handcuffs. Officer

then walked Mr. Fleming to the side of the road to await the arriving cruiser.

Once on the sidewalk Mr. Fleming tensed up and started to fall on his buttocks at which time he kicked his legs in the air and intentionally kicked

officer in the face knocking this officer's glasses off and breaking them. Officer let Mr. Fleming fall to the ground at which time he continued to kick at

officer at which time officer struck Mr. Fleming in the face with a closed fist and was able to get on top of him. Mr. Fleming continued to fight and resist

at which time officer noticed two civilian males come running to help. Officer was able to ID one of the males who was found to be a Scott Shepard. Mr.

Shepard got on the legs of Mr. Fleming and the other male was helping this officer hold Mr. Flemings upper body down. Officer then told Mr. Fleming if

he did not turn over to his stomach he would be tased. Mr. Fleming rolled to his stomach and Mr. Shepard continued to hold his legs down while this

officer and the other male held Mr. Flemings upper body against the ground. Officer asked for all units to run lights and siren to assist this officer. Mr.

Fleming continued to wrestle around but was able to be held by this officer, Mr. Shepard, and the unknown civilian until other officers arrived. Ofc S.

Murray arrived first and found this officer's eye glasses crushed on the ground under Mr. Fleming. Mr. Fleming was assisted off the ground and placed in

a cruiser to be transported to Ross County Jail. Officer thanked Mr. Shepard for his help and the other male subject, but when officer returned for the

unknown males name officer was unable to find him at this time. Officer will attempted to locate the unknown male and gather his information for this

report.

Mr. Fleming was transported to the Ross County Jail by Ofc. C. Lytle at which time he was charged with one count of Assault on a Peace Officer.

Mr. Fleming was advised of his charges and advised he would appear in court on 07/03/2013. Officer completed a CCH on Mr. Fleming along with a

Felony Packet to be sent to the Ross County Prosecutors Office. Officer also completed a Use of Force Form along with Injured Officers Form for cuts

and scrapes to this officer leg and damage to officers eye glasses. Officer photographed the damaged glasses as evidence but will keep them in this

officer's possession unless advised to place them into evidence by Ross County Prosecutor. Nothing further at this time.

and found no Megan E Farmer. Officer will secure the card into evidence. If officer has not heard from Ms. Farmer in couple of days officer will check

with Huntington Bank and see if they can help get it returned to Ms. Farmer. Officer has nothing further at this time.

Disposition Comments : Ofc was dispatched to Subway, 161 N Bridge St reference to a Theft complaint. Ofc was advised an older female over 50

wearing a pink tank top and long blond hair had taken a sub and walked to Rally''s at Bridge/Water. Ofc contacted Erica H Harrington (employee)

who stated that the female later identified as Valerie J Sever had came into the store and ordered a sub. She advised when she got to the end of the line at

the check out they handed her the sub and advised her she owed $6.42. Erica stated that Valerie grabbed the sub without paying and sat down in the store

and began to eat it. She then walked over and advised her once again how much it cost at which time Valerie advised she would pay after she ate. Erica

stated some customers later left the store at which time Valerie also left without paying for the sub. Erica followed her out advising her she needed to pay

for the sub however Valerie advised she didn''t have any money and continued to walk away. Erica advised some customers observed her walk to Rally''s

where she sat down and was later contacted by Ofc. Ofc was given a receipt showing the sub valued at $6.00 before tax. Ofc was given a written

statement from Erica. She advised Ofc they wanted to file charges a Bar Valerie from the store. Ofc contacted Valerie and advised her of her Miranda

Rights which she stated she understood. She advised Ofc that she was at Subway and had offered to give the sub back when they told her to pay. Valerie

first advised Ofc that she thought she had paid for the sub but later changed her story and stated she guessed she had not paid. Valerie then advised Ofc

that she only had change on her person. Ofc also noted later that was all she had. Valerie could not give an answer why she ordered the food knowing she

did not have the money to pay. Ofc arrested Valerie and transported her to the RCJ where she was booked on charges of Petty Theft. Ofc also verified

she had an active warrant for her arrest. Ofc served her FTA warrant CRB 1301697 charging Criminal Trespass filed by Ofc Newsome. Ofc advised

Valerie she was barred from Subway and if she returned she could be arrested for Trespass. Ofc left her in the custody of the jail staff pending her court

appearance on 7/3/13.

On the above date and time officer was dispatched to 1470 N Bridge St, Kmart, in ref to a Theft. As officer was enroute dispatch advised the vehicle

was a black Chevy S10, OH Lic FTJ8417, which had moved the grocery side of the store lot. Officer made contact with the vehicle and noticed there

were two younger male and an older male in and around the vehicle. Officer made contact with the older male, Robert Horsely Sr., who advised they were

just parking in the lot waiting on someone. Officer found the younger males were, Robert Horsely Jr, 6yr and Christopher Howard, 14yr. As officer was

speaking with the subjects Ofc McGowan made contact with Loss Prevention, Mendy Kellough, to find out what was stolen.

Ms. Kellough advised that Christopher had selected a SD card and placed it into his sock and walked out the door with out paying for it. Ms.

Kellough advised she noticed that Mr. Horsely and Robert Jr were walking around with Christopher while they were inside the store. Ms. Kellough

advised she thought that Mr. Horsely had also taken a 4 pack of batteries but she advised she was not sure and advised she had an empty pack but she

did not see him or have video of him taking the batteries. Ms. Kellough advised she wanted charges filed on Christopher and to bar everyone from the

property. Ms. Kellough advised she would provide a video and statement once she completed it.

Officer then found that Mr. Horsely had an active warrant, TRD1301620 ABCD, for Failure to Appear on a Traffic Citation. Mr. Horsely was

placed under arrest for the warrant. Mr. Horsely was advised of his Miranda Rights at which time he advised he understood them. Mr. Horsely was

asked about the batteries that were taken and he advised he did not take any batteries. Mr. Horsely advised the batteries in his camera had been there for

some time and he purchased them and did not steal them. Officer located 4 Kodak batteries in the digital camera that Mr. Horsely refered to inside of the

truck. Officer was unable to determine if the batteries that Mr. Horsely had were taken from inside the store or not. Officer found the Robert Jr was

inside the store when the theft occurred at which time his mother, Patty Spangler was contacted and she came to the scene and took custody of Robert Jr

and was also given the vehicle to transported Robert Jr. home. Mr. Horsely was then transported to the Ross County Jail to be held on the warrant. He

was issued his copy and advised he would appear in court on 07/03/13 at 0900 hours. Mr. Horsely was also advised he was barred from Kmart and he

advised he understood.

Christopher then advised this officer he had taken and SD card and advised it was inside the truck also. Christopher advised he did not want to go to

JDC and wanted to just give everything back. Christopher was advised of his Miranda Rights which he advised he understood them. Officer advised

Christopher that officer was not going to ask him questions because his parents were not there. However Christopher advised he wanted to tell

everything at which time he began to tell his side of the story. Christopher advised he grabbed the SD card from the shelf because he needed one for his

phone. Christopher advised he put it in his shoe and left the store. Officer was able to contact Ursula Keller, grandmother/guardian, who came to the

station to retrieve Christopher. Ms. Keller was advised Christopher was going to be charged with Theft and barred from Kmart. Ms. Keller then signed a

Promise To be Responsible form and took custody of Christopher.

The SD card was placed into evidence.

Darryle explained that he had spoken to Edward about his kids leaving their toys in the way of his stairs. Darryle told Ofc. that he works early in the

morning and was worried about tripping over things that were left out by the neighbor children. Darryle advised that Edward threatened him while

speaking with him about the issue. Darryle wanted Edward talked to by Ofc. Ofc. contacted Edward and advised him of the complaint that Ofc. had

received. Edward told Ofc. that Darryle was the perfect neighbor until he drinks. Edward explained that Darryle came over and began yelling at his

children so he and Darryle exchanged words over the way Darryle was talking to the kids. Ofc. did observe that Darryle had been drinking, but he wasn''t

a danger to himself or others. Edward advised that he cleans up the children''s toys everyday, but Darryle always has something to say when he drinks.

of Sherman Park when Ofc. observed a toddler aged female stand up in the rear of a black 2000 Chevy Suburban bearing OH registration FCR5758. Ofc.

observed that the toddler appeared to be in the vehicle alone. Ofc. checked the vehicle and observed that the toddler was inside the vehicle with another

child that appeared to be around 1 year of age. Ofc. observed that the one year old was sleeping in a car seat. Ofc. found that all the vehicles windows

were down, but there was no adults around the vehicle. Ofc. asked the toddler aged female, who was later identified as Laportia A. Beverly where she

lived. Laportia stated " my mommy is right there." Ofc. observed that Laportia had pointed towards 401 Sherman Park. Ofc. knocked on the door, but no

one came or answered the door at the residence. Ofc. asked around if anyone knew who lived at the apartment. Ofc. was told by James M. Harding Jr

that Megan Beverly lived at the residence. James also knocked on the door, but advised Ofc. that no one answered. Ofc. had the dispatcher log that Ofc.

needed a report for children left alone in a vehicle. Ofc. also had the dispatcher log that the temperature inside Ofcs. vehicle read that it was 88 degrees

out. Ofc. observed that all the windows were down on the Suburban and that the seats were made out of leather increasing the temperature inside the

vehicle. Ofc. figured that Ofc. had been in the parking lot for about 10 to 15 minutes before their mother, Megan RJ. Beverly came out of the residence.

Megan asked Ofc. what was going on. Ofc. informed Megan that Ofc. had found her children unattended in a vehicle with no adults around. Megan told

Ofc. that she had just ran inside to get her daughter a bib. Ofc. explained to Megan that Ofc. had been here for about 10 minutes or longer before she came

outside. Megan disagreed with Ofc. about how long she had been gone. Megan advised Ofc. that she had an open case with Children Services and that her

uncle, Jack Brooks has temporary custody of her children. Ofc. contacted the on call Children Services worker, Tisha Harper and advised her of the

situation. Ofc. advised Tisha that Megan told Ofc. that her children were in the temporary custody of a family member. Ofc. was then contacted by

Michelle Diehl, who is the Supervisor for Children Services. Michelle told Ofc. that she would come to the scene due to Megan not being allowed to be

alone with her children. Megan advised Michelle that she knew she wasn''t to be with her children alone, but her uncle, jack was working on the farm and

she wanted to spend time with them. Megan advised that she had left where Jack lives with the children to come lock her apartment. Michelle explained

to Megan that while her case is open she is to only have supervised visits with her children and that Jack must be present. Michelle was able to reach

jack via telephone and he was advised to come pick up the children.Ofc. cited Megan for child endangerment for leaving her children alone in the vehicle.

Ofc. served Megan summons 095394 and advised her of her appearance in Chillicothe municipal court on 07-12-2013 at 09:00AM.

Officer was flagged down on a disturbance. Officer then saw Rebecca Hardesty chasing after Jacklynne Martin. Officer then saw Rebecca attempt to

attack Jacklynne as Officer pulled up and Jaylyn was trying to stop Rebecca. Officer separated them and contacted Jacklynne and Jaylyn. Jaylyn said

Rebecca came up to their porch and just sat down drinking locos. Rebecca asked if she could use the restroom and she told her "No, I don''t know when

my mom will be home if you want to wait." Rebecca then got up and went inside the house. Jacklynne said she saw her coming into the house and she

tried to stop her, Rebecca then started to fight with her and she pushed her out of the house. Rebecca then came after her and this Officer arrived.

Jacklynn and and Jaylyn said they do not want any charges, they only want her no to come back again and leave them alone. Officer then contacted

Rebecca who was unsteady on her feet and had an odor of an alcoholic beverage on or about her person. Rebecca spoke with a thick tongue slurred

speech. Rebecca said that little girl (Jaylyn) said she could use the bathroom. Officer then arrested Rebecca for Disorderly Conduct- intoxication for her

own safety and the safety of others. Rebecca was also advised she is now barred from all properties of 352 E Second St and if she returned then she

could be arrested or cited for Criminal Trespass. Officer transported Rebecca to the Ross County Jail where she will be held until she is sober. Officer

issued Rebecca MM Citation 094333 and advised her of her court date on 7/12/13 at 9am.

23:45:34Incident Disposition Comments : Officer was dispatched to Kmart in reference to a male subject detained for shoplifting and being

uncooperative. Upon arrival Officer contacted loss prevention for Kmart, Mendy Kellough who stated she was watching Bobby Ackley on surveillance

cameras in the Electronic Department. She advised he was looking a SD memory cards and she noticed he selected one. She advised he walked from

camera view and then walked back and had dropped it on the ground. She advised he picked the SD card up and continued to look at more cards. She

advised he then attempted to hid the torn package behind other merchandise in the section. She then noticed Ackley pick up a camcorder and again

dropped the SD card. She advised he picked it up and concealed it in his right pocket. Another associate then walked into the area and Ackley asked him

a question and then selected another SD card. Ackley then walked the store and noticed he brushed against a button up tee shirt in the Clothing

Department and then he went to the cash register and paid for the other SD card. She advised he was then stopped as he was exiting the store. Mendy

advised the damaged package was found in the Electronic Department hidden behind other SD cards and the SD card was found in the left chest pocket of

the button up tee shirt Ackley brushed up against. Mendy continued to explain that Ackley continued to stated he did not steal the SD card and that

he never had it however after Officer advised him of his Miranda Rights and explained to him the facts that Officer was told he confessed stating he took

the SD card from the package and then hid the package and SD card and that he did not know why he did that because he had more then enough money to

pay for it. Officer photographed the damaged package, SD card, and tee shirt and released it to Mendy for safe keeping. A statement was also

obtained. Ackley was issued a summons citation for Criminal Mischief, ticket number 09-4123 and barred from Kmart which he said he understood.

He was given a court date in the Chillicothe Municipal Court on July 3 2013 at 9am.

Narrative

While on patrol Officer was flagged down in the area of 19 N Bridge St by an unknown citizen who advised he just observed a black male taking bags of

mulch from 10 N Bridge St Speedway and placing them into a Silver Nissan Maxima parked on the Chillicothe Inn Parking lot next to 10 N Bridge St. and

didn't pay for the items. The Unknown witness pointed at the only silver Nissan and the black male subject as he entered the passenger side of the

vehicle.

As Officer pulled up to make contact the vehicle began to leave and a traffic stop was initiated.

Officer contacted the driver Stefanie Pittenger and Robert Wright as the passenger. Officer also observed two bags of Cypress Rose Mulch laying on the

back seat.

Officer advised Robert his Miranda Warnings in which he waived speaking to Officer willingly without an attorney. Officer advised Robert he was seen

taking bags of Mulch from 10 N Bridge St Speedway without paying. Robert advised he was with a girl by the name of Chantelle who he believed had

paid for the mulch and received them from her and placed them into the car.

Robert had a female on speaker phone who refused to come and speak with this officer.

Officer walked over to speedway and spoke to the long time employee Gregory Cochenour who was asked if any one had come in tonight and

purchased bags of mulch? Gregory advised no. Gregory and this officer reviewed the store video and observed Robert with a white female believed to be

Chantelle walk near the mulch and over to the motel parking lot however due to the video player and customers officer wasn't able to clearly see what

took place with Robert, the female and Mulch however Officer will review the video and supplement any findings to this report.

Gregory provided Officer with a signed written statement.

Officer spoke to Ms. Pittenger who advised she didn't know the mulch was stolen that was placed into her car and was driving away with.

Ms. Pittenger and Robert advised they would gladly pay for the mulch now. Officer advised them no they were being placed under arrest for theft and

complicity to theft.

incident to arrest Ms. Pittenger had over $3,700 cash in multiple denominations in different locations on her person, car and purse along with five cell

phones.

Robert had no money on his person however advised some of the money found in Ms. Pittengers possession was his to the amount of $500 to $600.

Officer photographed the mulch inside the car and returned the two bags valued at $7.04 to Speedway.

Robert and Stefanie were transported to the Ross Co jail where they will remain in lieu of bond.

Robert charged with theft and Stefanie charged with complicity to theft, both with a Municipal Court date of 07/03/2013 at 9:00 am. Officer provided

Mr. Cochenour with a written statement form to return.

While reviewing the video at 10 N Bridge St. Robert and Stefanie returned back to the store after bonding out of jail. Officer advised them both they were

bared and if they returned they would be cited or arrested. Robert and Stefanie advised they understood and left.

Officer was then contacted by Chantelle Bryan who officer observed in the video with Robert. Ms. Bryan was advised her Miranda Warnings at which

time she waived speaking to officer without an attorney. Ms. Bryan advised she ran into Robert at Speedway and made a comment to him she needed

mulch for her brothers grave advising Robert must have thought she paid for it and took the mulch. Ms. Bryan advised she didn't buy any mulch and

never handed any mulch to Robert or tell him to get any for her. Ms. Bryan gave a verbal and signed written statement.

Narrative

Officer was dispatched to 333 E Main St. Reference to a fight. Upon arrival Officer contacted Megan Kellough, Angela Dyer and Thomas Speas. Officer

attempted to speak with Mr. Speas the homeowner However Megan who had a strong odor of an alcoholic beverage about her breath, slurred speech,

bloodshot eyes and very unsteady on her feet. attempted to tell Officer what the problem was. Megan advised Mr. Speas wanted her to lift her shirt up

to show him her breast and she wouldn''t. Officer spoke to Mr. Speas who advised he told Megan to leave his house numerous times because she was

being too loud and was drunk and he couldn''t control her. Officer spoke to Angela Dyer who also advised Megan was out of control and drunk and no

one was able to control her or look after her. Officer placed Megan under arrest for her safety and the safety of others transporting her to the Ross Co

jail where she will remain until she sobers up. Upon arrival Officer turns off Megan''s Cell phone that is ringing at which time Megan becomes very

hostile screaming Officer is going through her pictures and contact information. Officer removed Megan and gave her to the jail staff who take custody of

in reference to burglary. Upon arrival Officer spoke with building owner, Frank Jenkins who stated he arrived to the house today and when he went to

open apartment two a couch had been pushed up against the door. He advised a neighbor who lives at 362 East 4th Street told him two white females and

a white male walked out of that apartment around 8:20am this morning. Mr. Jenkins stated he could not find any sign of forced entry however one of the

windows to the front door had been knocked out the a Police raid that occurred there a couple weeks ago. Mr. Jenkins stated nothing was stolen.

Officer spoke with George Wilhelm who stated he was outside this morning around 8:20am and saw a blond haired white female and a dark haired white

female along with a white male exited the front door of the apartment. He advised it appeared the blond had just showered and was carrying several

grocery bags with her. Officer then returned to Mr. Jenkins and he stated he has two security cameras, one on the porch on a the other in the common

area and he will check the footage and get back with me if there are any images of the suspects.

Ofc was dispatched to Kohl's ref a shoplifter in the store. Ofc. arrived and the subject, later identified as Jonathan Brannon had exited the east door and

had been stopped by Loss Prevention Officer Phillip Coen. Jonathan was throwing a watch onto the sidewalk and saying that he fucked up and had

made a mistake. Ofc. made contact and secured him and then walked him back into the store.

Phillip Coen advised that he had observed Jonathan walk into the store, go straight to the watch display and select one and put it on. He then went

over to the earrings and selected a box of earrings. Phillip said Jonathan walked around and went to the shoe department where he removed the earrings

from the box and put them into his pocket. He then walked around some more before leaving the store passing all points of sale without attempting to

pay for the items. Phillip gave Ofc. a receipt for the two items, the watch Ofc. observed Jonathan throw to the sidewalk is a US Polo watch valued at

$34.99. The earrings Ofc. removed from his right rear side pocket are valued at $20.00. Both were secured by the store for evidence.

Jonathan said he had just gotten out of prison the week before and had done 3 1/2 yrs for robbery. He said he wasn't thinking and had just made a huge

mistake. Jonathan was transported to the Ross Co Jail where he will be held unless he posts bond until his court date of 7-5-13 at 9:00am. He was

advised of the court date. He was also advised by Phillip Coen that he is barred from all Kohl's stores and should he return he would be arrested for

criminal trespass.

Ofc contacted Kristie Nolen at the ER in reference to a possible assault. Nolen stated that around 9 am this morning Mark Mellott assaulted her.

Nolen stated Mellott assaulted her somewhere near N Sugar St in an alley. Nolen stated she was punched numerous times in the head and face, kicked

and tossed around by her arms. Nolen stated she believes she lost consciousness and woke up in the alley. Nolen stated she then went to a friends

house for the rest of the day before deciding to seek medical attention.

Nolen stated she and Mellott used to date but have been broken up for a while. They were never married and do not have children. Nolen stated

Mellott assaults her every time he sees her.

Nolen complained of head and neck pain and stated she believes her left arm was broken. Nolen signed a medical release form and will provide this

Ofc with her medical records upon her discharge. Ofc also requested Nolen follow up at the LEC with this Ofc in the coming days as Nolen did not have

any fresh visible injuries to photograph.

Ofc provided Nolen with a written statement form and explained to her the necessary steps to obtain a TPO.

Ofc has not been able to locate Mellott at this time.

The investigation is ongoing.

Officer was contacted by Jenna Hobbs in the lobby of the LEC. Jenna said her brown leather wallet is missing. Jenna said she had her wallet at the

First Capital Music Hall last night (7/2/13) when she bought a ticket to enter. Jenna said she found the wallet was missing after she arrived at school.

Jenna said she is not sure if the left the wallet on a table at the music hall or not, she has called the music hall and they had not found her wallet. Officer

check reports and the wallet has not been turned into the Police Department. Jenna said in her wallet was her Driver's License, SSN Card, her Visa Debit

Card, a Sunoco Gas card and maybe $5 in cash. Officer advised Jenna if she locates her wallet at home or in her vehicle to contact this Department and

advise this Officer. Officer will check with the business and see if the wallet has been turned in or if there is any video to see if the wallet was stolen and

not just lost. Investigation continues.

to Crispie Cream in reference to a theft complaint. Audrienn Watson stated she had been in contact with a male subject who found her lost cellphone.

Watson stated the male subject agreed to meet her at Crispie Cream to return the phone for a "reward". Watson met the subject and called police. Ofc

found Nicholas McCabe to be the male in possession of Watson''s phone. McCabe returned the phone to Watson without incident. Upon contacting

McCabe, Ofc could smell the strong odor of an alcoholic beverage on his breath. McCabe had slurred speech, glassy/bloodshot eyes and was unsteady

on his feet. For his own safety and the safety of the public, Ofc placed McCabe under arrest and transported him the to RCJ where he was issued MM

Citation 09-4199 charging disorderly intoxication with a court date of 7/19/13. McCabe will remain the RCJ until sober. Watson did not wish to

pursue charges.

Disorderly Intox with a court date of 7-12-13 at 9am. Chad refused to sign the citation and was left in the custody of the jail staff until sober. Nothing

Narrative

Officer was dispatched to Bubs Time Out Bar 66 N Paint St reference to a fight. Upon arrival Officer observed Sgt Gay attempting to secure Dan

Minser owner of First Capital Music Hall in handcuffs and assisted by taking control of Mr. Minser''s right free arm and placing it behind his back to

allow Sgt Gay to place handcuffs on it. Mr. Minser was secured in the back of Officers patrol car for his safety and the safety of others as this

investigation began. Officer was contacted by Darren Hall an off duty Aux police officer with this department. Officer Hall who was off duty advised he

didn''t see who initiated the incident however separated numerous subjects trying to get involved. Officer spoke to Andrew Lansing the owner of Bubs

Time Out Bar who advised he seen subjects beaten up with other subjects coming towards his bar from First Capital Music Hall looking as if they were

going to cause a disturbance at his establishment and called the police as he also tried to keep subjects separated. Officer observed Mr. Minser had a

busted lip however refused medical treatment from paramedic''s that arrived on scene. Mr. Minser advised while inside First Capital Music Hall he

observed a subject who he had bared previously but couldn''t remember the mans name. Mr. Minser advised he tried to tell the man to leave at which

time the unknown man and his brother Matthew Hurles who Mr. Minser pointed to at the scene began to assault him punching him in the face and

busting Mr. Minser in the lip. Mr. Minser advised the incident should be on video and would provide it at a later date. Officer advised Mr. Minser if

any video evidence showed an assault took place charges could brought forward at a later date once identification and proof are presented to this officer.

Officer spoke to Mr. Hurles who was seen by paramedic''s for a cut to his left eyebrow and refused treatment advised he didn''t punch anyone he was

punch by someone fighting but didn''t know who. Officer asked Mr. Hurles who his brother was? Mr. Hurles advised Wesley Brown. Officer Spoke to

Anthony Wagner who complained he observed the fight inside First Capital Music Hall and then followed it outside where he was assaulted by Matthew

Hurles who punched him in the face busting his mouth and nose. Mr. Wagner advised he fought back punching Mr. Hurles in the face. Mr. Wagner also

refused medical treatment at the scene. Officer cited Matthew Hurles and Anthony Wagner for Disorderly Conduct Fighting with each other. Mr. Hurles

was issued MM citation 09 5054. Mr. Wagner was issued MM citation 09 4862. Both men will have a Municipal court date of 07/12/2013 at 9:00 am.

Comments : Ofc dispatched to 72 N Bridge St, Family Dollar, reference a subject who fled with stolen items. Upon arriving, Ofc contacted

employee Connie L Kennedy who advised she was cashier when a W/M being approx 6''00" wearing a black cut off t-shirt and black hat turned around

backwards brought 2 items to the counter, a family size Banquet turkey dinner and a package of Oreo cookies, to be wrung up. After tending the items

that totaled $5.50 and bagging them, the W/M grabbed the bag and ran without paying for the items. Ofc contacted witness Brad Johnson who

advised he seen the W/M running E/B down the E/W alley between E Second St and E Water St. Ofc''s patrolled the area and located the subject running

into the backdoor of 90 N Rose St. The subject was detained with the bag of Family Dollar items and was identified as Roger P Cadwallader.

Cadwallader was read his Miranda Rights which he exercised his right to remain silent. Ofc arrived at 90 N Rose St and took custody of

Cadwallader, confirming the items in his possession was what was stolen from Family Dollar. The items were photographed and returned to Family

Dollar. Ofc searched records and found reference report 13-011484 that Cadwallader was barred from 90 N Rose St. Cadwallader was transported to the

RCJ charging theft and criminal trespass and was advised of his court date of July 5, 2013 at 9:00am in the Chillicothe Municipal Court. Cadwallader

was advised he was barred from Family Dollar at 72 N Bridge St and if caught back, he was subject to arrest for Criminal Trespass. He advised he

understood and Ofc left him in the custody of the RCJ awaiting bond or court appearance.

On the above date and time officer was dispatched to 203 Loganview in ref to a Theft from Elderly. Officer arrived on scene and made contact with

David Gunlock, who advised his mother in law was "scammed". Mr. Gunlock advised he takes care of Martha Schillers finances and noticed when he

came over today that she was missing a check from her check book. Mr. Gunlock advised he also found her phone line was unplugged and that is why no

one could get a hold of her. Mr. Gunlock advised the home heath care arrived at the home around 1400 hours so the incident with the missing check had

to happen before that. Mr. Gunlock advised the checks have a carbon copy at which time Mr. Gunlock advised he noticed the check was wrote for

$450.00 and was not in the hand writing of Ms. Schiller. Mr. Gunlock showed this officer the carbon copy at which time officer also noticed the check

was not wrote out to anyone and in the memo section it advised "roof".

Officer spoke briefly with Ms. Schiller who advised she remembered it was someone who said they knew her son in law, "Smiley" and she advised

they were in a red truck. Ms. Schiller could not give a description of the male subject but advised he was alone, she thought.

Mr. Gunlock advised that the "Smiley" reference was odd because no one calls him that but a few close family members and friends. Mr. Gunlock

advised it was a nick name he got in high school. Officer advised Mr. Gunlock to contact the bank first thing in the morning and stop payment on the

check. Officer also advised Mr. Gunlock to let the bank know that this department would need a copy of the check to help determine who the check was

made out too. Mr. Gunlock advised he would take care of this and contact this officer once it was complete. Officer will await contact from Mr.

Gunlock. Officer has nothing further

Sycamore St in reference to a complaint of telecommunications harassment. Ofc. arrived and spoke with Shauntay J. Rinehart, who is the complainant.

Shauntay advised that she has been receiving threatening text messages and voice mails from George E. Zimmerman, who is her ex-boyfriend. Shauntay

explained that George has been harassing her and threatening to have his children''s mother, Sunshine Eblin beat her up. Shauntay played Ofc. messages of

George calling her names and threatening to send Sunshine to beat her up. Shauntay told Ofc. that she wanted George advised to leave her alone. Ofc.

made contact with George and advised him of the complaint that Ofc. had received. George told Ofc. that Shauntay was mad because he was getting back

with Sunshine. George showed Ofc. text messages from Shauntay from where she had been threatening to beat up Sunshine and threatening to call his

Probation Officer. Ofc. advised George to leave Shauntay alone and stop sending her messages and Ofc. advised him that Shauntay would be told the

same. Ofc. contacted Shauntay and advised her that she needed to quit sending George messages as well. Both subjects were advised that they would be

charged with telecommunications harassment if they continued to bother one another. Shauntay and George both were advised to change their phone

numbers.

Narrative

Officers were dispatched to the area of Hirn St and Riverside in reference to a hit/skip. Officers were advised that a Honda Civic gray in color with OH

Reg EQB2789 had just struck and parked car and left the scene. Officers were then advised that the same Civic was N/B on the N Bridge St bridge.

Witnesses advised that the Civic then struck the retaining wall on the east side of the bridge and continued N/B. Only a few minutes a witness called and

stated the suspect vehicle was at 369 Midland Rd.

Ofc made contact with Betty Renchen who stated Will Elliott just showed up at her house and drove into the yard. Renchen stated Elliott's car was

smoking and was damaged. Renchen stated that only a few minutes later this Ofc and Ofc arrived.

Ofc made contact with Elliott as he exited through the front door. Elliott lost his balance and almost fell down. Elliott stated he was not injured and

agreed to speak with this Ofc. Ofc read Elliott his Miranda Rights, which he stated he understood and waived. Elliott had very slurred speech, red

blooshot eyes and was unable to keep his balance. Elliott admitted to being in a crash on Hirn St and then admitted to drinking a couple beers. Ofc

detained Elliott and transported him to the RCJ were he was asked to submitt to FST.

Ofc first administered the HGN test. Ofc noted lack of smooth pursuit, distinct nystagmus at maximum deviation and onset of maximum devaition

prior to 45 degrees in both eyes. Ofc then explained and demonstrated the walk and turn test. Elliott was unable to maintain his balance during the

instructional phase and could not stand heel to toe. Elliott was not able to walk heel to toe and stepped off of the line several times. Elliott lost his

balance and almost feel during the test. Ofc then explained and demonstrated the one legged stand test. Elliott was unable to keep his foot raised for

more than a 5 second count. Elliott hopped around trying to gain his balance and almost feel.

Ofc told Elliot he is under arrest for OVI. Ofc then read Elliott the BMV 2255, which he signed. Elliott agreed to provide urine for analysis at the

OSHP crime lab. A urine sample was obtained and placed into the USPS mailbox at the S Walnut St office at 2245 hours. Elliott was booked on one

count each of OVI and Hit/Skip of a MV. Elliott's vehicle was towed by Penwell's and he was placed under ALS. Elliott may face future charges upon

receipt of the lab analysis.
