8027A RARE EARLY GUYUE XUAN ENAMELED GLASS SNUFF BOTTLEImperial Place Workshops, Beijing 1769 The milky-white glass bottle with a flat, flaring lip and a flat oval foot, with a neat leiwen border in iron red at the neck, a band of lingzhi heads around the shoulder, one face with enameled lotus in pink and green, the leaves delineated in black, reversed with a poem in regular script in iron red, dated jichou xia ri (1769, summer day), followed by two painted seals reading gu and yue, the foot with a four character mark in regular script in iron red. 2 1/2in (6.5cm) high

1769年 白料畫琺瑯花鳥蓮紋鼻煙壺 《乾隆年製》款 This interesting enameled glass bottle is from a fairly small group of bottles, several of which are precisely dated, that were produced within the Forbidden City between the years 1767 and 1775. It is theorized that the bottles were created with the intent of being gifted by the emperor, perhaps during the Autumn hunt. Adorned with lotus or chrysanthemum, these bottles would frequently feature a poem or poetic couplet in regular script written with iron-red enamels. On this bottle the poem was authored by the Ming dynasty painter Chen Chun (Chen Daofu, 1483-1544). The poem also appears in the Siku Quanshu, 24-87b.

Whereas the majority of the Guyue xuan bottles are designated as such by the standard three character iron red mark on the foot, this bottle bears a four character Qianlong Nianzhi reign mark on the foot, with the Guyue xuan connection indicated by two painted seals--Gu and Yue--that follow the poem. Other bottles from this same small group bear the reign marks around the neck, or adjacent to the poem, in addition to displaying the Gu and Yue painted seals. A few other white glass enameled bottles from this interesting and precisely dated group have been offered in recent years. One from the J & J collection dated 1767 was sold at Christie’s New York on 22 March 2007, lot 43. Two others, formerly in the collection of Mary and George Bloch, one dated 1768, was sold at Sotheby’s Hong Kong 26 November 2013, lot 145; and one dated 1775 was sold at Bonham’s Hong Kong 27 May 2012, lot 62. This compelling group has been carefully studied by Hugh Moss in “Mysteries of the Ancient Moon”, ICSBS Journal, Spring 2006, pp. 16-32, and further explored in Moss, Graham and Tsang A Treasury of Chinese Snuff Bottles, vol. 6 pp. 182-194.

PROPERTY FROM THE COLLECTION OF HIDENARI TERASAKI (1900-1951), BY DESCENTLots 8028 - 8029

Hidenari Terasaki, the transcriber of Emperor Hirohito’s famous Dokuhakuroku, sold Bonhams New York, Voices of the 20th Century, lot 1254, was a fluent English-speaking Japanese diplomat, married to an American, who on February 20 1946 assumed the special post of ‘Liason Officer to the Imperial Household’. He had the responsibility of interpreting for Emperor Hirohito and advising him on his dealings with General Douglas MacArthur (Herbert P. Bix, “The Showa Emperor’s ‘Monologue’ and the Problem of War Responsibility’, The Journal of Japanese Studies, 18/2 Summer 1992, p. 357). Terasaki was an elite Japanese diplomat who played a pivotal role in relations between his country and the United States, first in 1941 and again in 1946. In 1931, Terasaki married Gwen Harold, an American from Tennessee, and following postings in Shanghai, Havana and Beijing, was appointed in 1941 head of Western Intelligence and transferred to Washington, where, despite his position, he is thought to have tried to make a desperate failed attempt to have a cable sent directly from President Roosevelt to the Emperor, appealing for peace. After Pearl Harbor, he, his wife and daughter Mariko were interned and then repatriated to Japan in 1942. He moved away from diplomatic life, living in a mountain village, often close to starvation, but after Japan’s unconditional surrender, Terasaki was recalled to Tokyo and, with his experience, became the liaison between Emperor Hirohito and General MacArthur. Terasaki and his wife Gwen became a useful bridge between the two sides in these opening years of American occupation and they were visited by many of the senior American officers. Terasaki retired from his post in 1948 for health reasons, his wife and daughter returned to the US the following year. He died in Japan in 1951. Gwen wrote a biography of their life together, and a 1961 movie, Bridge to the Sun, took the book’s name as its title. The following two lots, figure of Maitreya (lot 8028) and the rare jun-type purple glazed bowl (lot 8029) were acquired by Terasaki sometime prior to 1941, when he was stationed in Shanghai and Beijing. The Maitreya is recorded in Gwen Terasaki Bridge to the Sun, Rock Creek Books, 2017, p. 204.

Based on the posture, this figure is believed to represent Maitreya, the buddha of the future. Maitreya is believed to return to earth to preach the teachings of the Buddha after a period of great turmoil where the Buddha’s teachings have been forgotten. He is Shakyamuni’s successor and his return heralds a period of great peace. The pose, first conceived in India and later transmitted to China, represents Maitreya in deep contemplation, while at the same time, because one foot is on the ground, he is ready to stand up and take his place as the buddha of the future. The karanamudra subdues negativity, dispelling impure thoughts and other obstacles to enlightenment. The Northern Wei dynasty was a period of political turbulence and intense social and cultural change. During such tumultuous times a messianic figure such as Maitreya held great appeal and Maitreya was one of the most popular bodhisattva during this early phase of Chinese Buddhism. This figure is similar to other figures of Maitreya from the Longmen caves dated to the Northern Wei dynasty. The combination of sky blue and vivid purple glaze coloration relates this bowl to the Junyao group of ceramics, recorded at kiln excavations and documented burials from the Song through Ming periods. Its function as a tea bowl is indicated by the indented lip on its exterior walls, a distinctive feature of tea bowls inaugurated at the Jian kilns of Fujian in the Song period and copied at kilns throughout northern and southern China. Tea bowls of identical shape to this lot have yet to be published from Jun kiln excavations or burials in the past few years. However a dish with the same contrasting reddish-purple and sky blue glaze, subtle shape and careful potting comparable to this tea bowl was discovered during excavations at the Juntai kiln site in Henan carried out in 2004. The dish was included in the Palace Museum study Jun ci ya ji: gugong bowu yuan zhencang ji chutu junyao ciqi huicui [Selection of Jun Ware: the Palace Museum’s collection and archeological excavation] (Beijing, 2013), cat. No. 117, pp. 264-265 (as Yuan-early Ming dynasty, diameter 18.8cm); and appeared earlier in Zhongguo chutu ciqi quanji: vol. 12: Henan (2008), cat. No 211 (as Jun type and dated as Yuan dynasty, 18.8cm diameter). See also the Jun-type purple glazed tea bowl of slightly different shape, related to the 2013 study of the Palace Museum Jun wares and sold in Christie’s Hong Kong sale 3372, 26 November 2104, lot 2925, (as Xuande period). Other shards from the 2004 Juntai kiln site excavation match the group of ‘numbered Jun’ containers with purple and pale blue glazes preserved in the former Qing imperial collections, various museums and private collections throughout the world. There is no agreement at present on the dating of this group, but thermoluminescence testing on the shards from the 2004 excavation and comparable tomb finds suggest Yuan or early Ming date for the ‘numbered’ Jun group and, by extension, this tea bowl (see Laurie E. Barnes, ‘Yuan Dynasty Ceramics’, pp. 338-34, published in Li Zhiyin et al, Chinese Ceramics: From the Paleolithic Period through the Qing Dynasty [Yale University Press, 2010]). This bowl appears to be the “Chungyao” bowl mentioned in Gwen Terasaki’s biography, Bridge to the Sun, Rock Creek Books, 2017, pp.51, 96, 97, 216.

Bonhams is pleased to offer objects from the collection of Sally and Decatur H. Miller III, highly regarded Baltimore collectors and philanthropists of the arts. Decatur was born into a prominent Baltimore family. He took great pride in the family’s longstanding civic ties as a champion of community and artistic causes. In addition to being a trustee at the Walters Art Museum, Decatur also held leadership posts with the Baltimore Symphony Orchestra and the Enoch Pratt Free Library. In his professional life, Decatur was a chairman and managing partner of the Baltimore law firm Piper & Marbury, now the global law firm DLA Piper.

Sally was an equally enthusiastic supporter of the arts and cultural causes in Baltimore. A student of art history, she devoted much of her intellectual curiosity to the local

institutions. She served as trustee of the Baltimore Museum of Art, as well as member of the Walters Art Museum and the Maryland-based Art Seminar Group. In addition to cultural foundations, Sally also dedicated her time to civic organizations, serving on the boards of Union Memorial Hospital and Planned Parenthood of Maryland.

As collectors, the Millers gravitated towards early Chinese art, and their home on North Charles Street elegantly displayed classical sculptural pieces from China’s Shang, Zhou and Tang dynasties with contemporary paintings and photography. The following ten works of art from the Miller collection evince their careful connoisseurship and keen eye toward excellence while celebrating the rich heritage of Chinese art.

The blade motif at the neck of these slender vessels is an Anyang innovation, (R. Bagley, Shang Ritual Bronzes in the Arthur M. Sackler Collections, p. 229); the distended cicada form is shown in a gu published by J. J. Lally, Chinese Archaic Bronzes. The Collection of Daniel Shapiro, 2014 no. 3, along with the descending kuilong at the knob and base. The unusual cusped quatrefoil band below the flanges can be found on a gu published by Eskenazi, Ancient Chinese Bronzes from an English Private Collection, no. 1, page 10. An impressive gu of similar size to our lot, was sold at Christie’s, New York, 15 March 2015, lot 3178; another also offered at Christie’s, New York, 18 September 2014. Provenance J.J Lally & Co., New York, October 2008 Intended to bear a pendant ring, this gilt bronze mask (pushou 鋪首) would have been secured on the outer door of a palace or noble residence. Perhaps first appearing on the doors of the Xianyang palace of the Qin dynasty, pushou were frequently used on the inner chambers of tombs in the Han dynasty. The fierce visage is likely derived from the taotie mask motifs used on archaic bronze vessels, and with its bulging eyes, flaring nostrils, and hooked fangs intended to ward off evil spirits as well as unwelcome intruders. A similar pushou dated to the Northern Wei Dynasty is in the collection of the Museum of Fine Arts, Boston, accession number 1986.243. 唐 鎏金魔羯紋四曲銀碗 Provenance J.J Lally & Co., New York, 2012 Published J.J Lally & Co., New York, Silver and Gold in Ancient China, Spring 2012, no. 14, and front cover With its distinctive curling snout, dragon head and finned body, the makara may be read as a representation of the mythical carp transforming into a dragon, a metaphor for success as a result of assiduous effort. However the origins of this mythical beast is traced to India and was transmitted to China with the Buddhist canon, the first datable appearance in the tomb of Li He (d. 583) in Shaanxi province. In the Buddhist tradition, the makara was originally a whale that rescued five hundred drowning merchants at sea, and then sacrificed itself by providing its own body for sustenance. As a result of its compassionate offering, the whale was immortalized and

transformed into a makara, endowed with a dragon’s head, fish fins and accompanied by a flaming jewel. Its foreign background and imagery made the makara an auspicious symbol for use in several extant examples of Tang dynasty silver and gold. A Tang gold cup, excavated in 1983 in Xi’an and now in the Shaanxi History Museum is illustrated by C. Michaelson, Gilded Dragons, London, 1999, pp. 98-9, no. 59. while a similarly coiled makara with flaming pearl is illustrated by Bo Gyllensvärd in ‘T’ang Gold and Silver’, Butlletin of the Museum of Far Eastern Antiquities, No. 29, Stockholm, 1957, Fig. 56b. As noted in the Lally catalog, a Tang parcel-gilt silver bowl also with a repoussé dragon-fish in a central medallion was excavated from Inner Mongolia and is now in the collection of the Ordos Museum, illustrated in Zhongguo meishu fenlei quanji, Zhongguo jin yin boli falang qi quanji, Vol. II, Shijiazhuang, 2004, p. 47, no. 91. A n analogous gilt silver bowl decorated with a peacock feather band enclosing a repousse medallion of two flying parrots is published as part of the Kempe Collection in Bo Gyllensvard. Chinese Gold and Silver in the Carl Kempe Collection, no. 118, pp. 182-83. Few parcel gilt silver bowls from the Tang period have appeared at auction. The most recent and closely related example to this lot, from the illustrious Carl Kempe collection and published in Gyllvensvard, Chinese Gold, Silver and Porcelain, Asia Society, New York, 1971, p. 52, no. 46, was sold in these Rooms, 14 September 2015, lot 8073. In his catalog entry, Mr. Lally speculates that the legible incised character on the side of the foot may be the name of the original owner.

唐 彩繪騎馬俑 Provenance J.J Lally & Co., New York, November 2004 The distinctive snout on this dog almost certainly identifies it as a Saluki (Shanxi Xigou 陝西細狗), a sight hunter prized for its speed and ability to catch rabbits. The Saluki came to China from Central Asia along the silk road at least as early as the 7th century as they appear on a tomb mural of the Tang prince Zhuanghuai in 685. Here the Saluki’s companion is also likely an immigrant from the West, given his Phrygian cap. The Tang aristocracy had an interest in the hunting styles of nomadic peoples from Central Asia, and they would often gather to witness staged hunts.

Provenance Gift of Mr. and Mrs Eugene Bernat, 1958 The present lot is impressive for its lively decoration of a pair of dragons. The way one dragon is portrayed looking over its back towards the other dragon, creates a sense of interaction between the dragons and heightens the sense of vivacity. The large size of the bowl makes possible the considerable amount of white space in the decoration which gives the composition room to breathe and adds to the sense of motion. Such large pieces were difficult to fire without cracking and warping and are testament to the technical virtuosity of the Jingdezhen potters of the late Ming period. The present lot follows Jiajing period examples such as the ones sold in our Hong Kong rooms, 28 Nov 2009, lot 324; and our London rooms, 6 Nov 2008, lot 67.

The thousand Buddha--or infinite Buddha--motif, where repeated registers of small Buddha figures seated in meditation are depicted, is frequently seen in both painting and sculpture in China from the 5th century onward. The imagery alludes to a passage in the Lotus Sutra where emanations of the Buddha from an infinity of Buddha worlds gather to listen to the historical Buddha Sakyamuni expound sacred teachings. This pillar is carved in the round indicating it was made to be viewed from all angles. It is likely that the pillar was created for circumambulation in its original location, a devotional, merit-accruing act. A similar pillar dating to the Northern Qi dynasty is in the collection of the Xuchang Museum in Henan province.

Tang Shao-yi was the first prime minister of the Republic of China. Born in Guangdong Province in 1861, he was sent to the United States to attend grammar school, high school and college. Following his return to China, he rose to political prominence through several diplomatic appointments within the imperial Chinese government. He served as Consul-General in Korea, Special Commissioner to Tibet, and Governor of Fengtian Province in Manchuria. He was often dispatched on official missions as a special envoy of the Qing imperial court. In 1908 one such mission brought him to Washington for a visit that was heavily covered by the American press. He led a delegation that presented gifts to the Library of Congress and was received at the White House. Tang Shao-yi was appointed Premier Minister after the Republican Revolution of 1911 and later held additional positions as Minister of Communications and Minister of Foreign Affairs. He developed a lifelong interest in Chinese porcelain during his years of public service. Upon retirement and until his death in 1938, he devoted himself to collecting porcelains, dividing his time between Shanghai and his villa and gardens in Tangjiawan in southern China. Tang Shao-yi acquired both fine porcelains and decorative Shiwan pieces made in his native province of Guangdong. His collection aptly reflected his sense of beauty and deep connection with his family heritage.

明隆慶 青花龍鳳呈祥紋魚缸 《大明隆慶年造》款

Few Longqing marked porcelains exist due to the brevity of the six year reign. We do know that many large fish bowls were made as reported by Jessica Harrison-Hall, Ming Ceramics in the British Museum, London, 2001, p. 267-268, where the author notes that in 1571, according to the Fouliang county records, an imperial order was made for 105,770 items. Xu Shi, the censor for Jingdezhen at that time, pleaded that large fish bowls be eliminated from the order as they were difficult to fire and had a high failure rate. However, from the surviving number of fish bowls from this short reign, it appears his plea was ignored. An wucai example of similar shape, with a similar mark is in the British Museum and illustrated op. cit., p. 268. A similar one was sold in our London rooms, 7 Nov 2013, lot 216. The heaping and piling effect, a characteristic of earlier Ming porcelains, is clearly visible on the clouds in the present example, and occurs when either because of high pigment concentration or impurities in the cobalt, the underglaze decoration breaks through the surface of the glaze.

See Emma Bunker and Julia White, with Jenny So, Ornament for the Body and Soul Ancient Chinese Ornaments from the Mengdiexuan Collection, no. 114, p. 272, which shows six gold sheets, four of which are decorated with cutout and repoussé designs. Julia White speculates in the text that this group could have been part of a larger head ornament. The present figure portrays Shakyamuni prior to enlightenment, where in the quest for truth, he engaged in ascetic practices. Having starved almost to the point of death, Shakyamuni concluded that exaggerated asceticism and self-mortification were not the solutions. He was also convinced that a person living in wealth and luxury would not be able to see things in the right perspective. It was then that he sat down under the Bodhi and began meditating. He eventually concluded that an individual who seeks enlightenment needs to avoid both self-indulgence as well as self-mortification, and laid down the path that came to be known as The Middle Way. Such large figures are rare due to the difficulty of firing. They were susceptible to warping and cracking during drying and firing if the clay was too wet, or slumping, warpage and further cracking if the clay was too dry. Gases also tended to build up inside hollow figures which could lead to the figure exploding or developing large cracks while firing. In the present figure there are numerous vent holes visible. In the base alone, there are five small and one large hole. Some of the holes have been plugged and painted over. The presence of these holes indicate the skill involved that have lead to the successful firing of this majestic figure. Two slightly smaller (23 7/8in./60.6 cm) biscuit enameled Daoist deities portraying the civilian and military gods of wealth, from the collection of John D. Rockefeller Jr., and now in the Metropolitan Museum of Art, are illustrated in Suzanne G. Valenstein, A Handbook of Chinese Ceramics, New York, 1989, col. pl. 33, and p. 228, no. 222 respectively.

Figures of luohan rose in popularity during the Song dynasty, due to divisions within Buddhism that lead to the establishment of different schools. The luohan being direct disciples of the Buddha, formed a connection between the patriarchs of the different schools and the Buddha, by allowing the patriarchs to claim descent through a lineage leading back to these original disciples. Depictions of luohans fall into two groups. The first group are depicted with clearly what Chinese artists considered Indian features, such as bushy beards, curly hair, big eyes beneath prominent brows and large noses. The second group more closely resemble Chinese scholars, except that they have shaved heads and wear monks’ robes.

The present lot, clearly belongs to the second group. With his shaven head and elongated earlobes, he is clearly a monk, but his refined facial features, elegant posture, with long-sleeved robe and pointed shoes more closely resemble figures of scholar’s popular during the Ming dynasty such as the type illustrated in Rose Kerr, Later Chinese Bronzes, London, 1990, nos. 64-65. Traces of stucco on the surface of the present figure indicate that it would have been painted at one time. An example of similar date and size is illustrated in Rene-Yvon Lefebvre d’Argence (ed.), Chinese, Korean, and Japanese Sculpture : The Avery Brundage Collection, Asian Art Museum of San Francisco, New York, 1974, no. 150. A Northern Song dynasty example is illustrated in Angela Falco-Howard, et. al., Chinese Sculpture, New Haven, 2006, fig. 4.38.

佚名 山水人物圖 設色絹本 鏡框 十七世紀 Although anonymous, this finely executed mountain landscape with figures describes a fascinating scene -- several scholar-officials converge in the middle section, while a group of hard working men are chiseling and hammering rocks in the lower part of the painting. It is an unusual composition as such, and it may be illustrating the tale of Yu the Great (c. 2200-2100 BCE) controlling the floodwaters, a Herculean effort to tame the Yellow River by creating irrigation canals and lessen the destructive floods that plagued central China. In the collection of the National Palace Museum Taipei, an unsigned work dated to the Tang dynasty titled “A Painting of the Great Yu Controlling the Waters” (access no. 故-畫-000012-00000, Gugong Shuhua Ji, no 44) similarly depicts people removing rocks to reroute the waters and a scholarly figure standing higher above with attendants. Whereas the narrative of the Tang composition painting provides more details, it is likely that the same tale is being illustrated in the present scroll.

REGULATED SPECIES MATERIALS AND CITES PERMITS

The export of a lot from the United States or import into certain countries may be subject to export or import regulations, licensure and/or other restrictions; in particular, lots containing plant or animal materials such as ivory, rhinoceros horn, tortoiseshell, coral, whalebone or certain types of woods, irrespective of age or value, may require the granting of one or more export or import licenses or certificates, or may be banned from import altogether by some countries. Moreover, the ability to obtain an export license or certificate does not insure the ability to obtain an import license or certificate in another country. Lots that contain such regulated species materials may also not be eligible for exportation or for re-importation into the United States if they are not at least 100 years of age, and, under current law, lots containing African Elephant Ivory may no longer be re-imported into the United States regardless of age. In addition, resales of lots containing certain regulated species materials may be subject to restrictions in some jurisdictions.

Lots noted in the catalog with a Y next to the lot number contain one or more such regulated plant or animal materials. It is the buyer’s responsibility to investigate any such restrictions and to obtain any relevant export or import licenses, which may require independent expert verification of the species and/or age of the regulated material; such reports must be obtained by the purchaser at his or her own expense. To the fullest extent permitted by applicable law: The purchaser grants us a security interest in the property, and we may retain as collateral security for the purchaser’s obligations to us, any property and all monies held or received by us for the account of the purchaser, in our possession. We also retain all rights of a secured party under the California Commercial Code. If the foregoing conditions or any other applicable conditions herein are not complied with, in addition to all other remedies available to us and the consignor by law, we may at our election: (a) hold the purchaser liable for the full purchase price and any late charges, collection costs, attorneys’ fees and costs, expenses and incidental damages incurred by us or the consignor arising out of the purchaser’s breach; (b) cancel the sale, retaining as liquidated damages all payments made by the purchaser; and/or (c) cancel the sale and/or resell the purchased property, at public auction and/or by private

sale, and in such event the purchaser shall be liable for the payment of all consequential damages, including any deficiencies or monetary losses, and all costs and expenses of such sale or sales, our commissions at our standard rates, all other charges due hereunder, all late charges, collection costs, attorneys’ fees and costs, expenses and incidental damages. In addition, where two or more amounts are owed in respect of different transactions by the purchaser to us, to Bonhams 1793 Limited and/or to any of our other affiliates, subsidiaries or parent companies worldwide within the Bonhams Group, we reserve the right to apply any monies paid in respect of a transaction to discharge any amount owed by the purchaser. If all fees, commissions, premiums, bid prices and other sums due to us from the purchaser are not paid promptly as provided in these Conditions of Sale, we reserve the right to impose a finance charge equal to 1.5% per month (or, if lower, the maximum nonusurious rate of interest permitted by applicable law), on all amounts due to us beginning on the 31st day following the sale until payment is received, in addition to other remedies available to us by law.

3. We reserve the right to withdraw any property and to divide and combine lots at any time before such property’s auction. Unless otherwise announced by the auctioneer at the time of sale, all bids are per lot as numbered in the catalog and no lots shall be divided or combined for sale.

4. We reserve the right to reject a bid from any bidder, to split any bidding increment, and to advance the bidding in any manner the auctioneer may decide. In the event of any dispute between bidders, or in the event the auctioneer doubts the validity of any bid, the auctioneer shall have sole and final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after the sale, our sales records shall be conclusive in all respects.

5. If we are prevented by fire, theft or any other reason whatsoever from delivering any property to the purchaser or a sale otherwise cannot be completed, our liability shall be limited to the sum actually paid therefor by the purchaser and shall in no event include any compensatory, incidental or consequential damages.

6. If a lot is offered subject to a reserve, we may implement such reserve by bidding on behalf of the consignor, whether by opening bidding or continuing bidding in response to other bidders until reaching the reserve. If we have an interest in an offered lot and the proceeds therefrom other than our commissions, we may bid therefor to protect such interest. CONSIGNORS ARE NOT ALLOWED TO BID ON THEIR OWN ITEMS.

7. All statements contained in the catalog or in any bill of sale, condition report, invoice or elsewhere as to authorship, period, culture, source, origin, measurement, quality, rarity, provenance, importance, exhibition and literature of historical relevance, or physical condition ARE QUALIFIED STATEMENTS OF OPINION AND NOT REPRESENTATIONS OR WARRANTIES. No employee or agent of Bonhams is authorized to make on our behalf or on that of the consignor any representation or warranty, oral or written, with respect to any property.

8. All purchased property shall be removed from the premises at which the sale is conducted by the date(s) and time(s) set forth in the “Buyer’s Guide” portion of the catalog. If not so removed, daily storage fees will be payable to us by the purchaser as set forth therein. We reserve the right to transfer property not so removed to an offsite warehouse at the purchaser’s risk and expense, as set forth in more detail in the “Buyer’s Guide.” Accounts must be settled in full before property will be released. Packing and handling of purchased lots are the responsibility of the purchaser. Bonhams can provide packing and shipping services for certain items as noted in the “Buyer’s Guide” section of the catalog.

9. The copyright in the text of the catalog and the photographs, digital images and illustrations of lots in the catalog belong to Bonhams or its licensors. You will not reproduce or permit anyone else to reproduce such text, photographs, digital images or illustrations without our prior written consent.

10. These Conditions of Sale shall bind the successors and assigns of all bidders and purchasers and inure to the benefit of our successors and assigns. No waiver, amendment or modification of the terms hereof (other than posted notices or oral announcements during the sale) shall bind us unless specifically stated in writing and signed by us. If any part of these Conditions of Sale is for any reason invalid or unenforceable, the rest shall remain valid and enforceable.

11. These Conditions of Sale and the purchaser’s and our respective rights and obligations hereunder are governed by the laws of the State of California. By bidding at an auction, each purchaser and bidder agrees to be bound by these Conditions of Sale. Any dispute, controversy or claim arising out of or relating to this agreement, or the breach, termination or validity thereof, brought by or against Bonhams (but not including claims brought against the consignor by the purchaser of lots consigned hereunder) shall be resolved by the procedures set forth below.

SALES AND USE TAX

New York sales tax is charged on the hammer price, buyer’s premium and any other applicable charges on any property collected or delivered in New York State, regardless of the state or country in which the purchaser resides or does business. Purchasers who make direct arrangements for collection by a shipper who is considered a “private” or “contract” carrier by the New York Department of Taxation and Finance will be charged New York sales tax, regardless of the destination of the property. Property collected for delivery to a destination outside of New York by a shipper who is considered a “common carrier” by the New York Department of Taxation and Finance (e.g. United States Postal Service, United Parcel Service, and FedEx) is not subject to New York sales tax, but if it is delivered into any state in which Bonhams is registered or otherwise conducts business sufficient to establish a nexus, Bonhams may be required by law to collect and remit the appropriate sales tax in effect in such state. Property collected for delivery outside of the United States by a freight-forwarder who is registered with the Transportation Security Administration (“TSA”) is not subject to New York sales tax.

MEDIATION AND ARBITRATION PROCEDURES

(a) Within 30 days of written notice that there is a dispute, the parties or their authorized and empowered representatives shall meet by telephone and/or in person to mediate their differences. If the parties agree, a mutually acceptable mediator shall be selected and the parties will equally share such mediator’s fees. The mediator shall be a retired judge or an attorney familiar with commercial law and trained in or qualified by experience in handling mediations. Any communications made during the mediation process shall not be admissible in any subsequent arbitration, mediation or judicial proceeding. All proceedings and any resolutions thereof shall be confidential, and the terms governing arbitration set forth in paragraph (c) below shall govern.

(b) If mediation does not resolve all disputes between the parties, or in any event no longer than 60 days after receipt of the written notice of dispute referred to above, the parties shall submit the dispute for binding arbitration before a single neutral arbitrator. Such arbitrator shall be a retired judge or an attorney familiar with commercial law and trained in or qualified by experience in handling arbitrations. Such arbitrator shall make all appropriate disclosures required by law. The arbitrator shall be drawn from a panel of a national arbitration service agreed to by the parties, and shall be selected as follows: (i) If the national arbitration service has specific rules or procedures, those rules or procedures shall be followed; (ii) If the national arbitration service does not

REGULATED SPECIES MATERIALS AND CITES PERMITS

The export of a lot from the United States or import into certain countries may be subject to export or import regulations, licensure and/or other restrictions; in particular, lots containing plant or animal materials such as ivory, rhinoceros horn, tortoiseshell, coral, whalebone or certain types of woods, irrespective of age or value, may require the granting of one or more export or import licenses or certificates, or may be banned from import altogether by some countries. Moreover, the ability to obtain an export license or certificate does not insure the ability to obtain an import license or certificate in another country. Lots that contain such regulated species materials may also not be eligible for exportation or for re-importation into the United States if they are not at least 100 years of age, and, under current law, lots containing African Elephant Ivory may no longer be re-imported into the United States regardless of age. In addition, resales of lots containing certain regulated species materials may be subject to restrictions in some jurisdictions.

Lots noted in the catalog with a Y next to the lot number contain one or more such regulated plant or animal materials. It is the buyer’s responsibility to investigate any such restrictions and to obtain any relevant export or import licenses, which may require independent expert verification of the species and/or age of the regulated material; such reports must be obtained by the purchaser at his or her own expense. Please note that this process is governed by local authorities and may take considerable time. Regardless of any delay in the obtaining of an export or import license or certificate or denial of a license’s or certificate’s issuance, purchased lots shall be paid for in accordance with the Conditions of Sale, and any such delay or denial shall not serve as the basis for cancellation of any sale. Prospective buyers are advised to obtain information from the relevant regulatory authorities regarding export and import restrictions, requirements, and costs prior to bidding.

Prospective buyers should also check with their local (e.g. state) regulatory authorities regarding any local restrictions and/or permit requirements that may apply with respect to purchases of regulated species materials, including without limitation purchases of items containing elephant ivory or rhino horn. For example, we are advised that New York buyers of any lot containing elephant or mammoth ivory or rhino horn will be responsible for obtaining a New York State permit before taking possession of the lot within New York State, and that the State of New Jersey has banned the import of items containing elephant or marine mammal ivory or rhino horn into that state.

Upon request, Bonhams can refer the purchaser to a third party agent to assist the purchaser in attempting to obtain the appropriate licenses and/ or certificates. However, there is no assurance that any necessary licenses or certificates can be obtained. Please contact the Specialist Department for a suggested list of shipping agents prior to placing a bid if you are uncertain as to whether a lot is subject to export/import license or certificate requirements or related restrictions.

SNUFF BOTTLE DISCLAIMER

Unless otherwise specified in the cataloguing of a lot, snuff bottle stoppers are not included in any snuff bottle lots or in the estimate or purchase price of such a lot sold hereunder, regardless of whether the snuff bottle lot is illustrated with one or more stoppers. While Bonhams makes reasonable efforts to ensure that a stopper illustrated or exhibited with a snuff bottle lot accompanies the lot upon collection or release, it accepts no liability for not doing so or for damage or for loss to stoppers during storage or shipment. In addition, if a snuff bottle lot is exhibited or purchased by a buyer outside the United States, Bonhams may remove any stopper accompanying a lot that contains restricted materials.

CONDITIONS OF SALE - CONTINUED

have rules or procedures for the selection of an arbitrator, the arbitrator shall be an individual jointly agreed to by the parties. If the parties cannot agree on a national arbitration service, the arbitration shall be conducted by the American Arbitration Association, and the arbitrator shall be selected in accordance with the Rules of the American Arbitration Association. The arbitrator’s award shall be in writing and shall set forth findings of fact and legal conclusions.

(c) Unless otherwise agreed to by the parties or provided by the published rules of the national arbitration service:

(i) the arbitration shall occur within 60 days following the selection of the arbitrator;

(ii) the arbitration shall be conducted in the designated location, as follows: (A) in any case in which the subject auction by Bonhams took place or was scheduled to take place in the State of New York or Connecticut or the Commonwealth of Massachusetts, the arbitration shall take place in New York City, New York; (B) in all other cases, the arbitration shall take place in the city of San Francisco, California; and

(iii) discovery and the procedure for the arbitration shall be as follows:

(A) All arbitration proceedings shall be confidential;

(B) The parties shall submit written briefs to the arbitrator no later than 15 days before the arbitration commences;

(C) Discovery, if any, shall be limited as follows: (I) Requests for no more than 10 categories of documents, to be provided to the requesting party within 14 days of written request therefor; (II) No more than two (2) depositions per party, provided however, the deposition(s) are to be completed within one (1) day; (III) Compliance with the above shall be enforced by the arbitrator in accordance with California law;

(D) Each party shall have no longer than eight (8) hours to present its position. The entire hearing before the arbitrator shall not take longer than three (3) consecutive days;

(E) The award shall be made in writing no more than 30 days following the end of the proceeding. Judgment upon the award rendered by the arbitrator may be entered by any court having jurisdiction thereof.

To the fullest extent permitted by law, and except as

required by applicable arbitration rules, each party shall bear its own attorneys’ fees and costs in connection with the proceedings and shall share equally the fees and expenses of the arbitrator.

LIMITED RIGHT OF RESCISSION

If within one (1) year from the date of sale, the original purchaser (a) gives written notice to us alleging that the identification of Authorship (as defined below) of such lot as set forth in the BOLD TYPE heading of the catalog description of such lot (as amended by any saleroom notices or verbal announcements during the sale) is not substantially correct based on a fair reading of the catalog (including the terms of any glossary contained therein), and (b) within 10 days after such notice returns the lot to us in the same condition as at the time of sale, and (c) establishes the allegation in the notice to our satisfaction (including by providing one or more written opinions by recognized experts in the field, as we may reasonably require), then the sale of such lot will be rescinded and, unless we have already paid to the consignor monies owed him in connection with the sale, the original purchase price will be refunded.

If, prior to receiving such notice from the original purchaser alleging such defect, we have paid the consignor monies owed him in connection with the sale, we shall pay the original purchaser the amount of our commissions, any other sale proceeds to which we are entitled and applicable taxes received from the purchaser on the sale and make demand on the consignor to pay the balance of the original purchase price to the original purchaser. Should the consignor fail to pay such amount promptly, we may disclose the identity of the consignor and assign to the original purchaser our rights against the consignor with respect to the lot the sale of which is sought to be rescinded. Upon such disclosure and assignment, any liability of Bonhams as consignor’s agent with respect to said lot shall automatically terminate.

The foregoing limited right of rescission is available to the original purchaser only and may not be assigned to or relied upon by any subsequent transferee of the property sold. The purchaser hereby accepts the benefit of the consignor’s warranty of title and other representations and warranties made by the consignor for the purchaser’s benefit. Nothing in this section shall be construed as an admission by us of any representation of fact, express or implied, obligation or responsibility with respect to any lot. THE PURCHASER’S SOLE AND

EXCLUSIVE REMEDY AGAINST BONHAMS FOR ANY REASON WHATSOEVER IS THE LIMITED RIGHT OF RESCISSION DESCRIBED IN THIS SECTION.

“Authorship” means only the identity of the creator, the period, culture and source or origin of the lot, as the case may be, as set forth in the BOLD TYPE heading of the print catalog entry. The right of rescission does not extend to: (a) works of art executed before 1870 (unless these works are determined to be counterfeits created since 1870), as this is a matter of current scholarly opinion which can change; (b) titles, descriptions, or other identification of offered lots, which information normally appears in lower case type below the BOLD TYPE heading identifying the Authorship; (c) Authorship of any lot where it was specifically mentioned that there exists a conflict of specialist or scholarly opinion regarding the Authorship of the lot at the time of sale; (d) Authorship of any lot which as of the date of sale was in accordance with the then generally-accepted opinion of scholars and specialists regarding the same; or (e) the identification of periods or dates of creation in catalog descriptions which may be proven inaccurate by means of scientific processes that are not generally accepted for use until after publication of the catalog in which the property is offered or that were unreasonably expensive or impractical to use at the time of such publication.

CONSIGNING YOUR PROPERTY

After you receive an estimate, you may consign your property to us for sale in the next appropriate auction. Our staff assists you throughout the process, arranging transportation of your items to our galleries (at the consignor’s expense), providing a detailed inventory of your consignment, and reporting the prices realized for each lot. We provide secure storage for your property in our warehouses and all items are insured throughout the auction process. You will receive payment for your property approximately 35 days after completion of sale.

Lots are auctioned in consecutive numerical order as they appear in the catalog. Bidding normally begins below the low estimate. The auctioneer will accept bids from interested parties present in the saleroom, from telephone bidders, and

from absentee bidders who have left written bids in advance of the sale. The auctioneer may also execute bids on behalf of the consignor by placing responsive or consecutive bids for a lot up to the amount of the reserve, but never above it.

We assume no responsibility for failure to execute bids for any reason whatsoever.

In PersonIf you are planning to bid at auction for the first time, you will need to register at the reception desk in order to receive a numbered bid card. To place a bid, hold up your card so that the auctioneer can clearly see it. Decide on the maximum auction price that you wish to pay, exclusive of buyer’s premium and tax, and continue bidding until your bid prevails or you reach your limit. If you are the successful bidder on a lot, the auctioneer will acknowledge your paddle number and bid amount.

Absentee BidsAs a service to those wishing to place bids, we may at our discretion accept bids without charge in advance of auction online or in writing on bidding forms available from us. “Buy” bids will not be accepted; all bids must state the highest bid price the bidder is willing to pay. Our auction staff will try to bid just as you would, with the goal of obtaining the item at the lowest bid price possible. In the event identical bids are submitted, the earliest bid submitted will take precedence. Absentee bids shall be executed in competition with other absentee bids, any applicable reserve, and bids from other auction participants. A friend or agent may place bids on your behalf, provided that we have received your written authorization prior to the sale. Absentee bid forms are available in our catalogs, online at www.bonhams.com/us, at offsite auction locations, and at our San Francisco, Los Angeles and New York galleries.

Buyer’s Premium A buyer’s premium is added to the winning bid price of each individual lot purchased, at the rates set forth in the Conditions of Sale. The winning bid price plus the premium constitute the purchase price for the lot. Applicable sales taxes are computed based on this figure, and the total becomes your final purchase price.

Unless specifically illustrated and noted, fine art frames are not included in the estimate or purchase price. Bonhams accepts no liability for damage or loss to frames during storage or shipment.

All sales are final and subject to the Conditions of Sale found in our catalogs, on our website, and available at the reception desk.

Payment All buyers are asked to pay and pick up by 3pm on the business day following the auction. Payment may be made to Bonhams by cash, checks drawn on a U.S. bank, money order, wire transfer, or by Visa, MasterCard, American Express or Discover credit or charge card or debit card. All items must be paid for within 5 business days of the sale. Please note that payment by personal or business check may result in property not being released until purchase funds clear our bank. Sales TaxResidents of states listed in Paragraph 1 of the Conditions of Sale must pay applicable sales tax. Other state or local taxes (or compensation use taxes) may apply. Sales tax will be automatically added to the invoice unless a valid resale number has been furnished or the property is shipped via common carrier to destinations outside the states listed in the Conditions of Sale. If you wish to use your resale license please contact Cashiers for our form.

Shipping & RemovalBonhams can accommodate shipping for certain items. Please contact our Cashiers Department for more information or to obtain a quote. Carriers are not permitted to deliver to PO boxes. International buyers are responsible for all import/export customs duties and taxes. An invoice stating the actual purchase price will accompany all international purchases.

Collection of PurchasesPlease arrange for the packing and transport of your purchases prior to collection at our office. Handling and Storage ChargesPlease not that our office has requirement for freight elevator usage. please contact us to schedule an elevator appointment for pickup of any large or awkward items. Bonhams will hold all purchased lots in our galleries until 5pm Thursday 22nd March without penalty. After Thursday 22nd March oversized lots (noted as W next to the lot number and listed on page 190) will be sent to Door To Door where transfer and full value protection fees will be immediately applicable. Storage charges will begin accruing for any lots not collected within 5 business days of the date of auction. All other sold lots will be retained in Bonhams Gallery until Friday 13th April without penalty provided however that if buyers of oversized lots also buy other non listed lots, these other lots will also be sent to Door To Door where Transfer and full value protection fees will be immediately applicable. Storage charges of $5 per lot, per day will begin accruing for any lots not collected within 14 calendar days. Bonhams Reserve the right to remove uncollected sold lots to the warehouse of our choice at the buyer’s risk and expense. further transfer handling, storage and full value protection fees will apply if move to a warehouse of our choice.
