    Property Sale

    Staff has been working to acquire right of way, slope, and temporary constructioneasements from John Wardlaw, Jr. for the Hillsborough Street Roundabouts Project.

    In order to facilitate a negotiated settlement for the necessary right of way, slope, and

    temporary construction easements needed from Mr. Wardlaw, staff requests authorizationto proceed with a proposed property exchange & sale of residual property to Mr.Wardlaw, and to publish a Notice of Intent to conclude the proposed property exchangeand sale.

    4. UUGrants4.1 UUCISCO Systems, Inc.

    Cisco Systems, Inc. has offered the City of Raleigh a cash grant of $10,000 insupport of the Citys student internship programs. Budgetary accounts wereestablished and approved during the July 15, 2008, Council meeting inanticipation of the gift. These accounts and amounts have not changed; however,City Council action is required to accept the grant funds and to authorize the CityManager to enter into the Grant Agreement on behalf of the City.

    Accept the grant and authorize the City Manager to execute the Grant Agreementwith Cisco Systems, Inc.

    4.2 UUClean Water Management Trust Fund (CWMTF) Application - LandAcquisition for the Neuse River Greenway, Walnut Creek Greenway

    Extension, and Crabtree Creek Greenway Extension

    The Parks and Recreation Department requests authorization to submit anapplication to the Clean Water Management Trust Fund (CWMTF) for matchingfunds to acquire 70+/- parcels along the Neuse River, Walnut Creek, and theCrabtree Creek greenway corridors. Approximately 280 acres must be acquiredfor these three projects. The City of Raleigh currently has secured greenwayinterests for most of the parcels needed to complete these planned greenwaytrails. The CWMTF funding assistance would be utilized to purchase and/oracquire greenway easements where ownership gaps remain. The acquisitionfunding included in the budget for each of these projects will be used to meet the50% match requirements.

    Authorize the Mayor and the City Manager to execute the necessary documentsto apply for the Clean Water Management Trust Fund Grant.

    4.3 UU2009 Park and Recreation Trust Fund (PARTF) Grant FundingThe Parks and Recreation Department is applying for a Park and RecreationTrust Fund (PARTF) Grant for Hill Street Park (formerly Timberlake Park). Theapplication requires that the City commit to 50/50 matching funds if the grant isawarded, and also requires the signature of the chief elected official.

    Hill Street Park is a 16-acre site located in east-central Raleigh. The Master Planwas adopted by the City Council on November 7, 2007. Funds for the grant

    match are available in account 636-9464-79001-975. This grant request will bein the amount of $500,000 and will be used for design and first phasedevelopment of the park.

    4.4 UUNorth Carolina Department of Transportation (NCDOT) Safe Routes toSchools Grant Application

    The North Carolina Department of Transportation (NCDOT) Division of Bicycleand Pedestrian Transportation is accepting applications for the Safe Routes toSchool (SRTS) Infrastructure Grant Reimbursement Program. This program is

    funded by the Federal Highway Administration and provides opportunities forcommunities to make bicycling and walking to school a safer and more appealingtransportation alternative. SRTS Infrastructure grants provide funds forplanning, design and construction of facilities to enhance walking and bicycleconnections to elementary and middle schools. Sycamore Creek Elementarylocated at 10921 Leesville Road in Northwest Raleigh has agreed to work withthe City in completing a proposal to improve sidewalk connectivity between theschool and adjacent Dominion Park Neighborhood. Currently there arenumerous gaps in sidewalk connections in this area, which need to be correctedin order to provide an improved walking environment for students.

    The grant program requires that the City enter into a reimbursement agreementwith NCDOT and also serve as the lead agency responsible for managing the

    construction and maintenance of the infrastructure improvements. Thisreimbursement program is 100% federally funded and no local match is required.The SRTS project currently scoped for Sycamore Creek Elementary Schoolincludes the construction of five-foot sidewalks along both segments of CapeCharles Drive and Dominion Boulevard within the Dominion ParkNeighborhood. The approximate cost for the proposed sidewalk improvements is$150,000.

    UURecommendationUU:

    Authorize staff to apply to NCDOT for the Safe Routes to School InfrastructureGrant for the purpose of constructing sidewalks in the Dominion ParkNeighborhood.

    4.5 UUClean Water Management Trust Fund Grant (CWMTF) - Restoration andWater Quality Improvements to Upper Longview Lake and Bertie Creek

    (Upstream of Albemarle Drive)

    The Public Works Department is applying for a Clean Water Management TrustFund (CWMTF) Grant this year. The grant application requires authorizationfrom the City Council to submit the application and enter into an agreement thatmay result from the grant submission.

    This grant application is for funding of potential stream enhancement projectconstruction costs along Bertie Creek and a lake preservation project at UpperLongview Lake. The design for these projects is underway and is jointly fundedby the City and a CWMTF grant. Improvements in this area have previously

    been funded in the Stormwater Capital Improvement Program (CIP).

    These projects will improve water quality in the Bertie Creek watershed. It isestimated these projects will involve up to 5,000 linear feet of streamenhancement improvements and the lake/wetland preservation project. Theimprovements construction costs are estimated to be in the range of $3,000,000to $4,000,000. It is anticipated the grant application will request 50% of theconstruction costs from the CWMTF. Bertie Creek drains into Crabtree Creekwhich is listed as an impaired stream by the State and EPA which will require theCity to take steps to improve the water quality within this watershed.

    5. UUPermanent Sanitary Sewer Easement - 2933 Brennan DriveCreedmoor Preserve LLC has contacted the City to request a 20-foot permanent sanitarysewer easement crossing City of Raleigh property located at 2933 Brennan Drive. Therequested sanitary sewer line would cross the eastern portion of the Citys property andwould connect Creedmoor Preserves planned office building project to an existing Cityof Raleigh sewer line. Monetary compensation in the amount of $8,200 ($1.68/squarefoot), along with non-monetary considerations are to be paid to the City of Raleigh asconsideration for the permanent easement.

    UURecommendationUU:

    Conveyance of the requested permanent 20-foot sanitary sewer easement in exchange forthe monetary and non-monetary considerations outlined.

    6. UUConsultant Services - Downtown Remote Operations Facility - EnvironmentalRemediationOn December 2, 2008, Council authorized the City Manager to negotiate contract(s)using the escrow funds for Environmental Work (investigations, testing and remediation)associated with the site and to proceed with needed environmental investigative andplanning work. A contract was negotiated with Duncklee & Dunham, Inc. based on priorwork during site acquisition and as recommended by the City Attorney. The City hasuntil December, 2009 to expend escrow funds for this Environmental Work prior to suchfunds reverting to the prior owner. The City needs to select a Registered EnvironmentalConsultant (REC) to provide additional services as required to develop the remedialinvestigation work plan defining the environmental work and to proceed with theimplementation.

    UURecommendationUU:

    Approve the selection of Duncklee & Dunham, Inc. as the Registered EnvironmentalConsultant (REC) and authorize the City Manager to execute Amendment #3 in theamount of $22,036 contract for Environmental Work (investigative, testing andremediation) associated with the site. Funds are in place and will be handledadministratively.

    7. UUContract Amendments7.1 UUSurdex, Inc.

    In April 2001, the City entered into a contract with Surdex, Inc. to complete a

    multi-year digital orthophoto, topographic and planimetric mapping project. InFebruary 2004, the contract was amended to provide annual aerial photographyand updates of the topographic and planimetric data for five years. This projecthas been extremely successful and has provided data which is used by City staffand citizens on an ongoing and daily basis. Therefore, the City would like toamend the contract once again to continue the annual updates for another fiveyears.

    The proposed amendment also includes the addition of annual oblique imageryfrom Pictometry International. The first year of oblique imagery will be

    primarily funded by a Department of Justice Appropriation that is providingimagery and software for the Wake and Durham County 911 centers. Theproposed contract amendment includes the annual update of this imagery forRaleighs jurisdiction.

    This proposal calls for annual updates at a maximum cost of $405,410. The first

    year cost is $340,209 and funds are currently allocated in this fiscal years budgetto continue the updates and acquire the oblique imagery.

    UURecommendationUU:

    Approve amending the current contract and extend the annual aerial photographyand data update program for another five years and include oblique imagery inthe annual update program.

    7.2 UUWrenn Road Wastewater Treatment Facility Project - Amendment #6The City currently has an agreement with HDR Engineering, Inc., of theCarolinas, for the Wrenn Road Wastewater Treatment Facility Project. ContractAmendment #6, in the amount of $448,000, is for permitting and designmodifications necessary to allow the Wrenn Road facility to accept wastewaterand solids from the new Dempsey E. Benton Water Treatment Plant. Work alsoincludes a stability analysis of the existing lagoon dikes and preparation ofcontract documents for the removal and disposal of sludge currently in the twotreatment lagoons.

The Personnel Department has reviewed the requestand concurs with the reclassification of the position. Funds are available in thesalary account.

    8.3 UUInformation Technology - Position Reclassification - GISThe Information Technology Department currently has a vacant GIS Analyst,pay grade 32. IT requests a reclassification of the position to a TechnologySupport Administrator, pay grade 37. The Personnel Department has reviewedthe request and concurs with the reclassification of the position.

    UURecommendationUU:

    Approve the reclassification of GIS Analyst (5283), pay grade 32 to TechnicalSupport Administrator; code 0346, pay grade 37; and an administrative budgettransfer between IT organizations 1825 and 1860 in the amount of $25,800.

    15.2 UUMarsh Creek Community CenterAs approved in the 2003 Parks and Recreation Bond Program, the new Marsh

    Creek Community Center is proposed at Marsh Creek Community Park innortheast Raleigh off New Hope Road. Davis-Kane Architects, PA was hired toprovide the design services for this project. The new building will include onegymnasium, lockerooms, large multi-purpose room, fitness room, computerroom, classroom, kitchen, storage, offices and associated site amenities.

    Eleven construction bids were received for the new Community Center and werepublicly opened on June 3, 2008. Staff and the consultant reviewed the basebids, alternates and available funding. Staff recommended accepting the base bidand all alternates. The apparent low bidder was D. A. Thomas ConstructionCompany Inc., License No. 34122. The apparent low bid, including allalternates, was in the amount of $4,754,648. Partial electrical work fromProgress Energy, telecommunications and construction testing are not included in

    the bid and will be paid for separately. Funding for this project is currentlyavailable in the Parks and Recreation CIP (636-9388-79001-975). Verificationof the MWBE participation for this construction project is provided byAdministrative Services at 16%.

    Because of difficulties reported by D.A. Thomas Construction Co. in obtainingperformance and payment bonds by surety licensed in the State, as required byCity bid documents, Thomas has requested that the City consent to an assignmentof their award of the contract to Harrod & Associates Contractors, Inc. Harrodand Associates Contractors has been evaluated by staff and is fully licensed,bonded by a State-licensed surety, and otherwise competent to perform theproject work. The City Attorneys Office has reviewed the assignment instrument

    submitted by counsel for D.A. Thomas, and has approved the assignment.UURecommendationUU:

Ms. Seymore has requested that the item be deferred until the February 3,meeting as she has a conflict and cannot attend this meeting.

    During the hearing questions were raised relative to the rezoning of this property andpossible conditions on the rezoning case with adjacent property owners requesting thatthe annexation be delayed to allow additional opportunity for discussion of proposedconditions relative to the rezoning. It was directed that the item be placed on this agendafor further consideration.

    Tobacco Use in ParksOn September 5, 2007, the City Council referred the question of restricting smoking inparks, particularly in childrens play areas, to the Parks, Recreation and GreenwayAdvisory Board.

    On April 1, 2008, the Parks, Recreation and Greenway Advisory Board voted torecommend that City Council present a legislative amendment to NCGS 207-193, HouseBill 24 and to forward the Tobacco Use in Parks Resolution for consideration. Theaction of Council was to direct that the resolution be placed on this agenda for a decisionas to whether to request legislative authority from the General Assembly and at the sametime ask Administration to look at our park sites and where we see problem areas, that iscigarette butts, to place a sign asking people to please not smoke and that the City installproper disposal units. A copy of the information is in the agenda packet.

    F. REPORT AND RECOMMENDATION OF THE CITY MANAGER1. UUComprehensive Annual Financial Report (CAFR)

    The Comprehensive Annual Financial Report (CAFR) of the City has been completed forthe year-ended June 30, 2008. The CAFR is the Citys official annual report and isprepared by the Finance Department. It has been audited by the certified publicaccounting firm of Cherry, Bekaert & Holland, L.L.P. and their unqualified opinion onthe fair presentation of the financial statements is included within the CAFR. The CAFRincludes the auditors report on internal controls, in which they cite one finding that theyconsidered to be a significant deficiency in internal control over financial reporting. Theauditors have also provided two required letters, the SAS 114 letter which explains their

    audit responsibilities and procedures; and the SAS 112 letter which formally reports onthe one audit finding and identifies future reporting standards applicable to the City.Also included in the packet is the Finance Departments written response to the auditfinding, identifying the action that has been taken to resolve this finding.

    It is appropriate for the City Council to accept the Citys Comprehensive AnnualFinancial Report. Perry James, Chief Financial Officer, and John House, Controller, willmake brief presentations.

    its services, clarify ambiguities, and improve document structure. City Code Section 1-4002(h) provides that amendments to board and commission bylaws shall be approved byCity Council. The code also specifies that the Council shall not approve any bylaws inconflict with City Code. Therefore, these amended bylaws are coordinated with TC-15-08, Historic Districts Commission Procedures. Blacklined and clean copies of theamended bylaws are in the agenda packet.

    K. REPORT AND RECOMMENDATION OF THE BUDGET AND ECONOMICDEVELOPMENT COMMITTEE

    1. UUSoutheast Raleigh Assembly NominationsThe Southeast Raleigh Assembly recommends the appointment of Vivian ThomasMcCoy and Fina Curtis for a three-year term to the Assembly. The Committee furtherrecommends that Leroy Reynolds and Chris Foye not be reappointed. The Committeealso recommends acceptance of resignations from Grady Bussey, F. Lonnette Williamsand Marcus Becton.

    2. UUJeffries Ridge/Downtown Housing Improvement Corporation (DHIC)The Committee recommends that the City subordinate City loans to new first mortgageloan allowing DHIC to refinance current loan for a lower interest rate, to pay off debts on

    the project, pay down accrued interest on City loan and replenish reserves.The Committee also recommends approval to extend loan maturity date between the Cityof Raleigh and Jeffries Ridge, LLC (managed by Downtown Housing ImprovementCorporation) so that the City loan, new loan and North Carolina Housing Finance AgencyLoan are co-terminus.

    The Committee also recommends approval to increase DHICs portion of available cashflow from 20% to 50% which would reduce the Citys percentage of cash flow from 80%to 50% of cash flow in exchange for a $200,000 pay down of the current loan.

    3. UUPublic Art Program - Percent for Art InitiativeThe Committee recommends that the City Attorney be requested to develop a resolution

    which would establish a Public Art Program/Percent for Art Initiative for submissionback to City Council. This resolution would provide a Public Art Program until theordinance could be developed and considered by Council. The resolution will establish abudget of one half percent of hard construction costs of City Capital projects which havesignificant citizen use/exposure for any projects started after April 1, 2009. CityAdministration will work with the Arts Commission to develop some pilot projects to testthe proposed program on a couple of current projects. This pilot will help to define thespecifics that will be included in the proposed ordinance.

    4. UUParks and Recreation Proposed 2009 Fees and ChargesThe Committee recommends approval of the fees and charges as amended by the Budgetand Economic Development Committee. A copy of the proposed fees and charges dated

    January 20, 2009, will be available at the meeting.5. UUConservation Trust for North Carolina Memorandum of Agreement

    The Committee recommends approval for the City Manager to execute an agreement withConservation Trust for North Carolina. The new agreement would reflect the CityCouncils original desire to provide increasing funds for actual land purchases and lessfor administrative costs, would clearly define the process by which the ConservationTrust for North Carolina obtains funding and allows grant funds to be amended annuallywith a new budget and additional grant funds without the necessity of a full agreementrevision process.

    In November of 2007, the City Council approved an Environmental Stewardship AwardsProgram. One of the aspects of the program was an Environmental Stewardship Awards Jury.The jury will be made up of eight people including a representative from the EnvironmentalAdvisory Board, Planning Commission, Parks, Recreation and Greenway Advisory Board,Appearance Commission and Stormwater Management Advisory Commission plus threemembers appointed by the City Council. Of the City Council appointments two would be at-largeand one would be a representative of a professional scientific community. It would beappropriate for the Council to start the nomination process on its three appointees. Included inthe agenda packet is information outlining suggestions of persons who have expressed interest.
