City Council City of Hillsboro, Texas Minutes of Regular Meeting July 3, 2018 Present: Edith Turner Omberg, Mayor Frank Johnson, City Manager Eric Fleming, Councilmember Lauralee Vallon, City Attorney Andy Smith, Mayor Pro Tem Jerry Barker, Comm. Warren, City Secretary Scott Johnson, Councilmember Mayor Omberg called the meeting to order at 6: 00 p. m. The Invocation was given by Pastor Mike McReynolds of Church on the Hill, Hillsboro. Councilmember Johnson led the Pledge of Allegiance. Hear Statements from Persons Wishing to Address the Council. No one addressed Council at this time. Consent Agenda Deliberate and Act on the Approval of the Minutes for the Regular Meeting on June 19, 2018 and Minutes for the Second Town Hall Meeting — City Council in Conjunction With the Planning& Zoning Commission. Deliberate and Act on the Approval of Bills. On motion by Councilmember Robinson and second by Councilmember Johnson the consent agenda was approved. On roll call the following votes were cast: Ayes: Fleming, Smith, Robinson, Zarate, Skelton, Johnson Nays: None Absent: None Regular Agenda Deliberate and Act on a Resolution Approving the Recommendations of the Planning & Zoning Commission Accepting a Re- plat of a Portion of Lot 76 and All of Lots 77 and 78, Craig Addition, In the City of Hillsboro, Becoming Lots 77R and 78R, Craig Addition in the City of Hillsboro, Being the Same Property by Reference as Recorded in the Official Public Records of Hill County, Texas in Volume 26, Page 532. Community Development Director Jerry Barker said Ronald Edward Hayes, The First State Bank, Scott Hunt of Salt and Light Construction, LLC, and Citizen' s National Bank Hillsboro requested this re- plat following Scott Hunt' s renovations of 516 E. Franklin Street. The house ( 516 E. Franklin Street) had been listed for sale, and a boundary survey revealed a structure owned by Ronald Edward Hayes, 512 E. Franklin Street, encroached onto a portion of property owned by Scott Hunt. This re- plat will resolve the encroachment by providing ownership of the structure owned by 512 E. This matter was presented to the Planning and Zoning Commission on Monday, June 25, 2018and the Commission forwarded their unanimous recommendations to re-plat the proposed

property. Mayor Pro Tem Andy Smith of Citizens National Bank, ( mentioned above) signed a

Conflict of Interest Affidavit, recused himself from the meeting and did not vote on this agendaitem.

On motion by Councilmember Skelton and second by Councilmember Fleming the resolution wasapproved.

Resolution No. R2018- 07-28

Deliberate and Act on a Resolution Suspending the Effective Date For Ninety Days inConnection With the Rate Increase Filing Made on or About June 1, 2018 by Atmos EnergyFor Its Midtex Division.

Mr. Barker told Council that on or about June 1, 2018, Atmos Energy Corporation (" Atmos" or

Company") filed a Statement of Intent with members of the coalition of cities known as theAtmos Texas Municipalities(" ATM) comprised of about 50 cities, of which the City is a member,to increase rates by approximately $ 4. 5 million, which equates to an increase of about 8% in

annual non- gas- cost revenue in the ATM cities. On a system- wide basis, Atmos' proposed

increase would be the equivalent of about $ 46.0 million; this equates to an increase in annual

revenue of about 7.3%.

Mr. Barker stated that the City must take action no later than July 6, 2018. If the City does nottake action by July 6, 2018, Atmos' proposed rates will be deemed approved by operation of law,subject to the City' s right to hold a hearing to address Atmos' rate application.On motion by Councilmember Johnson and second by Councilmember Robinson the resolutionwas approved.

Resolution No. R2018-07-29

Hear and Deliberate on City Manager' s Report on:a) Street Improvements — The street department crews have completed the asphalt overlay

on Lamar Street. There was a delay because the machine used to lay down the asphaltbroke down but, crews were able to use other available machinery. Crews had been

working on patching the streets along the route for the Late Bloomer' s Parade on July4th

and will also patch along the route of the Peabody Homecoming Parade on July14th.

b) Main Street — It was reported that the Main Street Manager has been working on theCotton Pickin' Fair which is the next big event.

c) Community Appearance — City crews have made good progress on disposing the debrispile at the house on Matthew Street which had been used for training exercises by theDepartment of Public Safety.

d) Local History and Genealogy Library and Building for Antique Fire Engines —Progress has slowed on the project while waiting on a geo- tech report which is done bythe engineers.
