BE IT ENACTED BY THE COUNCIL OF THE CITY OF 1 ABERDEEN, that Chapter 475, Subdivision Regulations, of the Code of the City of Aberdeen 2 (2010 Edition as amended), is repealed in its entirety. 3 4 SECTION 2. BE IT FURTHER ENACTED BY THE COUNCIL OF THE CITY OF 5 ABERDEEN that new Chapter 475, Subdivision Regulations, consisting of Sections 475-1 6 through 475-25, inclusive, to be under Articles I through VI, is hereby added to the Code of the 7 City of Aberdeen (2010 Edition as amended), to read as follows: 8 9

CHAPTER 475, SUBDIVISION REGULATIONS 10 11

ARTICLE I. GENERAL PROVISIONS 12 13 §475-1. Title. 14 15 This chapter shall be known and cited as the City of Aberdeen Subdivision Regulations. 16 17 §475-2. Legislative Authority. 18 19 This chapter is adopted pursuant to the Local Government and Land Use Articles of the 20 Annotated Code of Maryland and the Charter of the City of Aberdeen. 21 22 §475-3. Purpose. 23 24 The purpose of the Subdivision Regulations is to establish procedures and standards for the 25 development and subdivision of land within Aberdeen. It is further designed to provide for the 26 orderly growth and development of the City; for the coordination of streets and highways within 27 proposed subdivisions with existing or planned streets and highways and with other public 28 facilities; for the dedication or reservation of recreation and other public use areas serving 29 residents of the subdivision; rights-of-way or easements for street and utility purposes; for the 30 distribution of population and traffic in a manner that will avoid congestion and overcrowding 31 and will create conditions compatible with protection of the public health, safety, and general 32 welfare, water quality and areas of significant/special natural features; and to facilitate adequate 33 provision for water, sewerage, roads, parks, and other infrastructure. 34 35 §475-4. Area of Authority. 36 37 These regulations and requirements shall apply to all development of land, including the revision 38 of existing development, as well as to subdivisions of land creating two (2) or more lots within 39 the corporate limits of the City of Aberdeen. Any subdivision having a part of its platted land 40 outside the corporate limits cannot have the plat approved by the City unless that land is annexed 41 into the City. This chapter shall be in addition to any other applicable regulations promulgated by 42 other agencies, whether stated herein or not. In case of conflict or overlap with other requirements 43 found within the Code of the City of Aberdeen or any other statute, the more stringent 44 requirement shall apply. 45

DEFINITIONS. 1 2 UNLESS OTHERWISE EXPRESSLY STATED, THE FOLLOWING TERMS SHALL, FOR 3 THE PURPOSE OF THIS CHAPTER, HAVE THE MEANING INDICATED. IN GENERAL, 4 WORDS USED IN THE PRESENT TENSE INCLUDE THE FUTURE, AND THE SINGULAR 5 INCLUDES THE PLURAL. ANY WORD OR TERM NOT DEFINED HEREIN SHALL BE 6 USED WITH A MEANING OF STANDARD USAGE. 7 8 ALLEY - A PUBLIC OR PRIVATE WAY PRIMARILY DESIGNED TO SERVE AS A 9 SECONDARY AND/OR SERVICE ACCESS FOR VEHICLES TO THE SIDE OR REAR OF 10 ABUTTING PROPERTIES WHOSE PRINCIPAL FRONTAGE IS ON ANOTHER STREET. 11 12 APPLICANT – ANY PERSON WHO PROPOSES TO SUBDIVIDE OR DEVELOP LAND 13 AND REQUIRED TO MAKE SUBMITTALS AND OBTAIN APPROVALS PURSUANT TO 14 THIS CHAPTER. 15 16 BUILDING - ANY STRUCTURE HAVING A ROOF SUPPORTED BY COLUMNS OR 17 WALLS AND INTENDED FOR SHELTER, HOUSING, STORAGE, OR ENCLOSURE OF 18 ANY INDIVIDUAL, ANIMAL, PROCESS, EQUIPMENT, GOODS, OR MATERIALS OF 19 ANY KIND. 20 21 CITY – THE CITY OF ABERDEEN. 22 23 CODE – THE CODE OF THE CITY OF ABERDEEN. 24 25 COMPREHENSIVE PLAN – THE CITY’S CURRENT COMPREHENSIVE PLAN 26 ADOPTED PURSUANT TO THE LAND USE ARTICLE OF THE ANNOTATED CODE OF 27 MARYLAND. 28 29 CONCEPT PLAN - A PRELIMINARY PRESENTATION AND ATTENDANT 30 DOCUMENTATION OF A PROPOSED SUBDIVISION OR SITE PLAN OF SUFFICIENT 31 ACCURACY TO BE USED AS A BASIS FOR DISCUSSION AND CLASSIFICATION. 32 33 CUL-DE-SAC – A LOCAL PUBLIC STREET WITH ONLY ONE OUTLET THAT 34 TERMINATES IN A VEHICULAR TURNAROUND, WITH SUCH TURNAROUND 35 HAVING AN APPROPRIATE TURNING RADIUS FOR THE SAFE AND CONVENIENT 36 REVERSAL OF TRAFFIC MOVEMENT. 37 38 DEPARTMENT – THE DEPARTMENT OF PLANNING AND COMMUNITY 39 DEVELOPMENT OR DEPARTMENT OF PUBLIC WORKS, AS APPLICABLE TO THE 40 CONTEXT, FOR THE CITY. 41 42 DEVELOPER OR SUBDIVIDER – ANY INDIVIDUAL, PARTNERSHIP, FIRM, 43 CORPORATION, ESTATE, TRUST, OR ANY OTHER GROUP OR COMBINATION, 44

A. ROAD, ARTERIAL - A ROAD THAT CARRIES THE MAJOR PORTION OF THE 18 TRAFFIC ENTERING AND LEAVING AN AREA OF THE CITY. FOUR 19 ARTERIAL STREET TYPES ARE DEFINED IN THE ABERDEEN 20 COMPREHENSIVE PLAN AND LISTED IN ORDER FROM REGIONAL TO 21 LOCAL SIGNIFICANCE: 22

23 (1) REGIONAL CONNECTOR ARTERIAL - THIS IS AN ARTERIAL STREET 24

WITH A COMBINATION OF FREE-FLOW RAMP AND SIGNALIZED 25 POINTS OF ACCESS. IT PRIMARILY PROVIDES MOBILITY THROUGH 26 ABERDEEN FOR MOTOR VEHICLE, TRUCK, AND COMMUTER BUS 27 TRAFFIC, AS WELL AS ACCESS TO MAJOR DESTINATIONS WITHIN 28 ABERDEEN. PROVISION OF SPACE FOR BICYCLE AND PEDESTRIAN 29 TRAVEL IS SECONDARY TO MOTOR VEHICLE MOVEMENT BUT NOT 30 OPTIONAL, AND THE DESIGN SHOULD EMPHASIZE FREQUENT, 31 SAFE CROSSINGS FOR CYCLISTS AND PEDESTRIANS. 32

33 (2) COMMERCIAL PRIMARY ARTERIAL - AN ARTERIAL STREET 34

SEGMENT THAT SERVES (OR IS PLANNED TO SERVE) A LOW- OR 35 MEDIUM-DENSITY COMMERCIAL AREA THAT MAY BE 36 EQUALLY ORIENTED TO RETAIL STORES, SERVICE, AND 37 INDUSTRIAL USE. THIS STREET EMPHASIZES TRANSIT AND MOTOR 38 VEHICLE TRAVEL, INCLUDING TRUCK MOVEMENTS. IT ALSO 39 FACILITATES BICYCLE ACCESS. 40

41 (3) VILLAGE CENTER MIXED USE ARTERIAL - AN ARTERIAL STREET 42

SEGMENT THAT SERVES A COMPACT MIXED-USE AREA THAT IS 43 FRONTED BY (OR PLANNED TO BE FRONTED BY) A VARIETY OF 44 COMMERCIAL, INSTITUTIONAL, GOVERNMENT, AND/OR 45

NOTWITHSTANDING THE PROVISIONS OF SUBSECTION B., WHEN A TRACT 1 OF LAND TO BE SUBDIVIDED ABUTS AN EXISTING CITY ROAD, THE 2 SUBDIVIDER SHALL, AS A CONDITION OF SUBDIVISION APPROVAL, DEED 3 TO THE CITY, IN FEE SIMPLE, BY SPECIAL WARRANTY DEED, A ROAD 4 IMPROVEMENT APPROPRIATE TO THE ROAD AND ITS FUNCTIONAL 5 CLASSIFICATION. WHEN THE TRACT FRONTS ALONG ONE SIDE OF THE 6 EXISTING ROAD, THE SUBDIVIDER SHALL DEED ALL OF THE REQUIRED 7 RIGHT-OF-WAY, CALCULATED FROM THE CENTERLINE OF THE EXISTING 8 ROAD, THAT IS REASONABLY NECESSARY FOR ROAD WIDENING. DEPARTMENT OF PUBLIC WORKS AND THE DEPARTMENT OF 23 PLANNING AND COMMUNITY DEVELOPMENT, IN SUBDIVISIONS 24 EXCEEDING ONE HUNDRED (100) RESIDENTIAL LOTS, THE 25 IMPROVEMENTS MAY BE PHASED OVER A PERIOD OF TIME AND ON 26 A SCHEDULE TO BE DETERMINED BY THE DEPARTMENT OF PUBLIC 27 WORKS AND THE DEPARTMENT OF PLANNING AND COMMUNITY 28 DEVELOPMENT. THE PHASING SCHEDULE SHALL BE INCORPORATED 29 IN THE CONCEPT PLAN APPROVAL FOR PROJECTS REQUIRING 30 CONCEPT PLAN APPROVAL AND IN THE PRELIMINARY PLAT 31 APPROVAL FOR ALL OTHER PROJECTS. 32

A. THE DEVELOPER SHALL ACQUIRE RIGHTS-OF-WAY WHICH ARE 36 NECESSARY TO ACCOMMODATE IMPROVEMENTS REQUIRED BY THIS 37 CHAPTER. 38

A. THE REQUIREMENTS OF THIS CHAPTER SHALL NOT APPLY TO LOTS 10 SHOWN ON A PRELIMINARY SUBDIVISION PLAT APPROVED PRIOR TO THE 11 EFFECTIVE DATE OF THIS CHAPTER, PROVIDED THAT A FINAL 12 SUBDIVISION PLAT APPLICABLE TO THAT PARCEL IS RECORDED IN THE 13 LAND RECORDS OF HARFORD COUNTY WITHIN TWELVE (12) MONTHS 14 AFTER THE EFFECTIVE DATE OF THIS CHAPTER. 15 16

B. THE REQUIREMENTS OF THIS CHAPTER SHALL NOT APPLY TO LOTS 17 SHOWN ON A PRELIMINARY SUBDIVISION PLAT PENDING APPROVAL AS 18 OF THE EFFECTIVE DATE OF THIS CHAPTER, PROVIDED THAT THE 19 REQUIREMENTS OF CHAPTER 235 OF THIS CODE SHALL APPLY AND THE 20 PLAT SHALL BE APPROVED BY THE PLANNING COMMISSION WITHIN (60) 21 DAYS FROM THE EFFECTIVE DATE OF THIS CHAPTER, AND A FINAL PLAT 22 APPLICABLE TO THAT PARCEL SHALL BE RECORDED IN THE LAND 23 RECORDS OF HARFORD COUNTY WITHIN TWELVE (12) MONTHS AFTER THE 24 DATE OF APPROVAL OF THE PRELIMINARY PLAT. 25

2018 Badges & Ladders Charity Baseball Game, September 22 Leidos Field at Ripken Stadium

Harford County Police and Fire Departments will battle it out on the ball field to benefit Special Olympics Maryland and the Aberdeen Chamber of Commerce

Tickets to the game are $7 per person and can be purchased online or by visiting the box office at Leidos Field at Ripken Stadium. Fans can also purchase a 4-pack of tickets for $25, with additional tickets available for just $5. The Aberdeen IronBirds are partnering with Harford County's Police and Fire Departments to host the first ever Badges & Ladders Softball Game on Saturday, September 22 at Leidos Field at Ripken Stadium. Proceeds from the inaugural matchup will benefit Special Olympics Maryland and the Aberdeen Chamber of Commerce. "Every day, members from local police and fire departments dedicate their lives to making our community better and this game is just another example of how dedicated they are to helping others. We're proud to team up with them and benefit two organizations that are helping people in Harford County and throughout the entire state of Maryland," said Matt Slatus, IronBirds General Manager. The evening will start at 4:00 p.m. with a game featuring two teams from Special Olympics Maryland followed by the Badges & Ladders Softball Game at 6:00 p.m. The event will offer a full Minor League Baseball experience, complete with concessions, music, game entertainment and Kids Zone activities. Participating law enforcement agencies for the "Badges" team include the Harford County Sheriff's Office and representatives from local and state police departments from Aberdeen, Bel Air, Havre de Grace, MDTA, Natural Resources, Aberdeen Proving Ground and the Maryland State Police. The "Ladders" team will complete their roster with team members representing Fire and EMS departments from Aberdeen, Abingdon, Bel Air, Darlington, Fallston, Havre de Grace Ambulance Core, Norrisville, Susquehanna Hose, Joppa Magnolia and the Department of Emergency Services. The Aberdeen Police Department has begun their 3RD Annual P.A.C.K. Campaign. We will be collecting back packs and school supplies for Aberdeen children who need them. Once enough items have been donated, children will be able to pick up a backpack full of school supplies at the Aberdeen Police Department.
