1.0 EXECUTIVE SUMMARY
Federal Aviation Administration (FAA) Program Guidance Letter (PGL) 08-02, dated February 1, 2008, as amended, provides guidance for the management of land acquired for noise mitigation purposes including inventory, reuse, and disposal. Per this PGL, Phoenix Sky Harbor International Airport (PHX) is required to submit an Inventory and Reuse Plan to the FAA Airports District Office by August 2008. Accordingly, this report contains the Noise Land Inventory and Noise Land Reuse Plan for the Community Noise Reduction Program (CNRP) Voluntary Acquisition and Relocation Services (VARS) at PHX.
As of August 15, 2008, the VARS program has purchased 56 residential parcels with FAA AIP Grant funding. These parcels are generally located west of the Airport, in an area generally bounded by Jefferson Street to the north, Interstate 17 to the south, 16th Street to the east and 7th Street to the west. All 56 parcels are owned by the City of Phoenix, are currently vacant, and are proposed to be retained for noise compatibility purposes. Parcel data summarized in Exhibit 1 and Exhibit 3 depicts the location of each parcel. Exhibit 2 depicts the current approved noise contours for the Airport.
The Noise Land Reuse Plan presents information for each of the 56 parcels acquired under the VARS program with FAA AIP Grant funding. This information includes the noise contour that contains each parcel, and the retention review date.
The VARS program is an ongoing voluntary noise land acquisition program for residential properties. Because there are additional parcels identified for acquisition that have yet to be acquired, all parcels currently owned by the City are proposed to be retained for noise compatibility with a vacant land use. The vacant land use is warranted due to the ongoing voluntary acquisition of residential parcels under the CNRP VARS program, the dispersed locations and site dimensions of the acquired residential properties, and the current zoning and land use regulations on the respective properties. The result of these conditions is that economic reuse of the lots for noise compatible land use is not feasible under current conditions.
Upon final acquisition of the other eligible parcels, a change to the approved noise contours, a change to the airport master plan, or in five years time, the Noise Land Reuse Plan for the VARS program will be reviewed and, if necessary, updated.

2.0 INTRODUCTION
In accordance with the FAA Program Guidance Letter (PGL) 08-021, dated February 1, 2008, as amended, this report contains the Inventory and Reuse Plan for Noise land purchased with FAA Airport Improvement Program (AIP) grant funds for the Voluntary Acquisition and Relocation Services (VARS) of the Community Noise Reduction Program (CNRP).
As of August 15, 2008, the VARS program has purchased 56 residential parcels with FAA AIP Grant funding. These parcels are generally located west of the Airport, in an area generally bounded by Jefferson Street to the north, Interstate 17 to the south, 16th Street to the east and 7th Street to the west. All 56 parcels are owned by the City of Phoenix, are currently vacant, and are proposed to be retained for noise compatibility purposes.
These residential parcels are subject to Grant Assurance 31, Written Assurances on Acquiring Land, to assure that optimal use is made of the federal share of the proceeds from the disposal of noise land. This assurance requires that, when noise land is no longer needed for noise compatibility, the land will be disposed of and the federal share of the disposal proceeds will be either paid to the Airport and Airway Trust Fund or will be used for another noise compatibility project. As stated in PGL 08-02, it is the airport’s decision whether unneeded noise land is sold, kept by the airport and leased, or exchanged.

3.0 BACKGROUND
3.1 FAA AIP Eligible Noise Land
There are two cases when acquiring noise land is eligible for AIP funds:
• If it is a Part 150 Noise Compatibility Program (NCP) measure
• If it is a mitigation measure in a Finding of No Significant Impact (FONSI) or a Record of Decision (ROD) for an airport development project where approval of the project is conditioned upon implementation of the mitigation measure.
All noise land grants include the grant assurance requiring an airport sponsor to submit a Noise Land Inventory and Reuse Plan to the FAA. Noise Land is defined as land that is acquired to remove or prevent an incompatible land use and then disposed of so that it can be developed compatibly.
3.2 Phoenix Sky Harbor International Airport
In 1999, the City of Phoenix performed a Federal Aviation Regulations (FAR) Part 150 Noise Compatibility Program Update. Through that process, it was recommended that residential sound mitigation services and voluntary land acquisition services be provided. In 2002, the Phoenix City Council authorized the creation of the Community Noise Reduction Program (CNRP). The CNRP’s Residential Sound Mitigation Services (RSMS) are available to eligible Phoenix and Tempe residents living in neighborhoods within the 65 Day Noise Level (DNL) or greater and thus impacted by aircraft noise generated at Phoenix Sky Harbor International Airport. The Voluntary Acquisition and Relocation Services (VARS) are available to residential property owners within the noise impacted boundaries adjacent to the Airport within the City of Phoenix.
CNRP service areas, determined by the FAA, include single-family homes located within the 1992 and 1999, 65 and 70 Day Noise Level (DNL) Contours and constructed prior to October 1, 1998. Residential property owners, living within the affected areas and wishing to receive assistance, are eligible for either Residential Sound Mitigation Services (RSMS) or Voluntary Acquisition and Relocation Services (VARS). FAA AIP grant funding was used to purchase residential parcels within the 1999, 65 and 70 DNL Contours.

4.0 NOISE LAND INVENTORY
This Noise Land Inventory for Phoenix Sky Harbor International Airport accurately reflects all of the noise land parcels, purchased through the VARS program up to August 15, 2008 with FAA AIP grant funds. As shown on Exhibit 1, there are currently 56 parcels acquired under the VARS program, with a total reimbursed amount of $10,771,737.
Per Attachment B, Requirements for Noise Land Inventory, of the Program Guidance Letter 08-02, the following information is summarized in Exhibit 1:
• AIP Grant Number
• Federal share for the AIP Grant
• Federal reimbursement amount for each parcel
• Current use of each parcel
• Proposed Categorization for each parcel
• Assessor’s Parcel Number (APN) for each parcel
• Sale recording information for each land purchase
Exhibit 2 depicts the current accepted noise contours for the Airport. Exhibit 3 depicts each parcel in the Noise Land Inventory, by APN.
The CNRP has provided FAA staff with access to a secure document management and Geographic Information System (GIS) website containing information for all parcels in the RSMS and VARS programs. Additional parcel information is available via the Internet from the Maricopa County (Arizona) Assessor’s Office at http://www.maricopa.gov/Assessor/GIS/Map.html.

5.0 NOISE LAND REUSE PLAN
This Noise Land Reuse Plan identifies each of the 56 VARS residential parcels that were purchased using FAA AIP funds. At this time, all parcels are scheduled to be retained for noise compatibility under a vacant land use. The vacant land use is warranted due to the following reasons:
• The ongoing voluntary acquisition of residential parcels under the CNRP VARS program,
• The dispersed locations and site dimensions of the acquired former residential properties, and
• The current zoning and land use regulations on the respective properties.
The result of these conditions is that economic reuse of the lots for noise compatible land use, as identified in Attachment A, Land Use Compatibility, of the Program Guidance Letter 08-02, is not feasible under current conditions.
Per Program Guidance Letter 08-02, “Management of Acquired Noise Land: Inventory, Reuse, and Disposal”, page 6, upon completion of the residential land acquisitions, a change to the approved noise contours, a change to the master plan, or in five years, whichever is sooner, the Reuse Plan will be updated.
Per Attachment C, Requirements for Reuse Plan, of the Program Guidance Letter 08-02, the following information is summarized in Exhibit 4:
• Deed recordation data for each parcel
• FAA AIP Grant Number
• Current noise contour for each parcel
• Current use of each parcel
• Identification of land to be held for noise compatibility and date of retention review
Exhibit 5 depicts the location of each parcel, each parcel’s APN, and the current accepted noise contours.

6.0 CONCLUSION
This Noise Land Inventory and Noise Reuse Plan for Phoenix Sky Harbor International Airport presents noise land data for the CNRP Voluntary Acquisition and Relocation Services (VARS) program. At this time, all parcels purchased with FAA AIP Grant funding are owned by the City of Phoenix, and shall be retained for noise compatibility purposes under a vacant land use, until such time that all parcels identified in the VARS program are acquired.
The vacant land use is warranted due to the ongoing voluntary acquisition of residential parcels under the CNRP VARS program, the dispersed locations and site dimensions of the acquired residential properties, and the current zoning and land use regulations on the respective properties. Economic reuse of the lots for noise compatible land uses is not feasible under current conditions.
Upon completion of land acquisition, a change to the approved noise contours, a change to the master plan, or in five years time, whichever is sooner, this Noise Land Reuse Plan will be reviewed for accuracy, and each parcel will be reviewed for retention purposes.
