The Salisbury-Wicomico Planning and Zoning Commission met in

regular session on November 17, 2016 in Room 301, Council Chambers, Government Office Building, with the following persons in attendance:

Upon a motion by Mr. Quinton, seconded by Mr. Heath, and duly carried, the Commission APPROVED the minutes of the October 20, 2016 meetings as submitted.

RE: #9112-16DD COMPREHENSIVE SITE PLAN/WELLHEAD PROTECTION SITE PLAN –

Potomac Foods Real Estate, rep. by Smith Engineering – N. Salisbury Blvd. – North Pointe Plaza – General Commercial District – M-29; G-5; P-507; Parcel #4.

Mr. Blake Smith and Mr. Mark James came forward. Mrs. Gloria

Smith summarized the request explaining that Smith Engineering has submitted a Comprehensive Development Plan for a creation of a new 0.80 acre parcel at North Pointe Plaza. The new outparcel is proposed for development with a 2,866 sq. ft. fast food restaurant building. The Site Plan depicting proposed development of the outparcel includes the building location, parking area, drive-thru, driveway connections and landscaping. Building elevations with materials and typical signage were also submitted.

Mr. Smith stated that it is their intention to have the stormwater

management approved even if it has to be done on their site. Mr. James explained that their lease is up for their existing site in

August of 2017, and they were looking to purchase their own property so that they were not subject to a lease.

Mr. Heath discussed the location of the refuse disposal area being

along the entrance corridor to the City of Salisbury and stated that it would be better suited on the private road side of the property. Mr. Smith agreed that they could flip the dumpster location. Mr. James stated that he didn’t have any issues moving it but if it was located near the Wendy’s side of the lot that it might be difficult for the trash truck. Mr. Thomas suggested surrounding the refuse disposal area with landscaping. Mr. James discussed the trees along Verizon that may block their view since they can’t have a pylon sign. Mr. Rogers questioned the materials for the dumpster screening. Mr. James responded that it would be block material.

Mr. Thomas questioned how the stormwater would be controlled.

Mr. Smith explained that there would be flow drainage across the parking lot to each side. There will also be bioretention swales. The underdrain will put the remaining drainage in the stormwater system. An inquiry will also be made to see if the existing stormwater pond can be utilized.

Mr. Heath questioned if the same stormwater technology would be used as was being used at The Gathering. Mr. Wilkins responded that only part of what is being proposed for stormwater is similar to what is being utilized at The Gathering.

Mr. Dashiell expressed concern about pedestrian safety with the

double drive-thru lanes. Mr. Dashiell questioned the site lighting. Mrs. Smith responded that

the lighting poles for WalMart are taller than the other outparcels therefore they may want to consider matching the lighting to the adjoining outparcels.

Mr. Dashiell questioned the dumpster location. Mrs. Smith

questioned when the trash receptacle was typically emptied. Mr. James responded that the trash is usually picked up between 6 a.m. and 8 a.m., the same time as the delivery trucks unload. He added that he was not opposed to relocating the dumpster to improve the line of sight from Route 13, since there would not be a pylon sign for the business.

Upon a motion by Mr. Rogers, seconded by Mr. Quinton, and duly

carried, the Commission APPROVED the Revised Comprehensive Development Plan for WalMart to create an autparcel here and APPROVED the Comprehensive Development Plan/Wellhead Protection Site Plan for Burger King, subject to the following Conditions of Approval: CONDITIONS: 1. The site shall be developed in accordance with the approved Comprehensive

Development Plan. Minor plan adjustments may be approved jointly by the Directors of the Building, Permits and Inspections and Planning and Zoning Departments.

2. No signage shall be installed on this site until the Commission approves a complete Sign Plan.

3. Site lighting shall match, as closely as possible, the height of the lighting on the adjoining outparcels.

4. A subdivision plat shall be submitted for Commission and Salisbury Public Works Department review.

5. This project is subject to further review and approval by the Salisbury and Wicomico County Departments of Public Works.

6. The Commission granted a waiver of the Community Impact Statement and Statement of Intent to Proceed and Financial Capability.

7. The dumpster enclosure shall be relocated to the northwest corner of the lot.

Marina Project Critical Area Mitigation

Mr. Lenox discussed the maps that he had left at each Commission member’s seat regarding the City Marina project. During the discussion with the developer the City agreed to handle the mitigation for the Critical Area. Mr. Lenox explained that he was requesting the Commission’s consent for mitigation for work in the 100 ft. buffer. The calculations call for approximately 2 acres of mitigation off-site.

Mr. Thomas questioned the notations on the aerial photography as

to the 100 ft. buffer line. Mr. Lenox responded that he believed that the lines closest to the water would be the 100 ft. buffer. Mr. Thomas questioned if any of the sites were considered to be nontidal areas. Mr. Lenox responded that they would be contributing to the tidal area.

Mr. Kilmer questioned if trees were being planted. Mr. Lenox

responded in the affirmative. Upon a motion by Mr. Rogers, seconded by Mr. Heath, and duly

carried, the Commission gave consent for the Critical Area mitigation for the marina project.

Wicomico County Comprehensive Plan Update

Mr. Lenox discussed that the County Council has set a public hearing date for the County Comprehensive Plan for December 20, 2016 for possible adoption. A lot of time has been spent on this document. The Commission held a public hearing a couple years ago on this document. There will be some modifications. If the plan is adopted, it will then come back to the Commission for a few changes. Once those changes are done there will be some follow-up zoning changes. Mr. Dashiell questioned if it was possible that the Commission would see the plan in January. Mr. Lenox responded in the affirmative.

There being no further business, the Commission meeting was

adjourned at 2:12 p.m. by Mr. Dashiell.
