TAYLORSVILLE, UTAH

ORDINANCE NO. 18- 01

AN ORDINANCE OF THE CITY OF TAYLORSVILLE APPOINTING ANINDIVIDUAL TO FILL THE MID-TERM VACANCY ON THE CITY COUNCIL WITH

RESPECT TO DISTRICT 2.

WHEREAS, the Taylorsville City Council ( the " Council") met in a special session on

January 10, 2018, to consider, among other things, appointing an individual to fill the mid-termvacancy on the City Council with respect to District 2; and

WHEREAS, during the November 7, 2017 general municipal election, City CouncilMember Kristie S. Overson was elected to serve as the City' s next mayor from 2018 to 2021;and

WHEREAS, Kristie S. Overson was half-way through a four-year term as a City Councilmember when she was elected to serve as the City' s next mayor, consequently leaving open avacant City Council seat for District 2; and

WHEREAS, UTAH CODE ANN. § 20A- 1- 510( 2)( a) provides that vacancies on the CityCouncil be filled as provided in UTAH CODE ANN. § 20A- 1- 510( 2)( a); and

WHEREAS, UTAH CODE ANN. § 20A- 1- 510(2)( a) provides, in part, that " a vacancy inthe office of municipal executive or member of a municipal legislative body shall be filled by aninterim appointment, followed by an election to fill a two-year term if(i) the vacancy occurs or aletter of resignation is received by the municipal executive at least 14 days before the deadline offiling for an election in an odd-numbered year, and ( ii) two years of the vacant term will remainafter the first Monday in January following the next municipal election;" and

WHEREAS, the Council finds that, based on UTAH CODE ANN. § 20A- 1- 510(2)( a), the

vacancy must be filled by an interim appointment, followed by an election on November 5,2019; and

WHEREAS, the Council finds that it has satisfied the requirements of UTAH CODE ANN.20A- 1- 510(2)( a) and UTAH CODE ANN. § 20A- 1- 510(2)( a), and is ready to fill the vacancy on

the City Council for District 2; and

WHEREAS, after careful consideration, the Council has determined that it is in the bestinterests of the health, safety, and welfare of the citizens of the City to appoint

to fill the mid-term vacancy on the City Councilwith respect to District 2; and

WHEREAS, the Council has determined that is

a registered voter in the City and meets the qualifications for office established by Utah law.

NOW, THEREFORE, BE IT ORDAINED by the Taylorsville City Council thatis hereby appointed to fill the mid-term vacancy on

the City Council representing District 2 for a term that expires on the first Monday in Januaryfollowing the next municipal election that is scheduled for November 5, 2019.

BE IT FURTHER ORDAINED that the Council hereby directs that

be sworn in as a member of the City Council onJanuary 10, 2018, following the City Council' s special session ( or as soon thereafter as ispractical,) in the City Council Chambers.

This Ordinance, assigned Ordinance No. 18- 01, shall take effect immediately uponpassage and acceptance as required herein.
