Stagner; Laile Don Stagner; Lonny Gene Stagner; Hartz Energy Capital, LLC; and Domestic Investment Properties, LLC, as Plaintiffs, have filed in the District Court of Logan County, State of Oklahoma, their Petition against the known and unknown successors and assigns, both immediate and remote, of Minnie Myrtle Stagner; Thomas Everett Stagner; Vernon E. Stagner; Jewel Mae Stagner; and Cleo Stagner, Defendants therein, alleging that the above named persons are deceased, that they died seized and possessed of certain undivided mineral interests underlying the lands described in the Petition on file herein;

that the Plaintiffs are now the owners of said mineral interests and in actual and peaceable possession thereof; that the unknown successors and assigns, immediate and remote, of Minnie Myrtle Stagner; Thomas Everett Stagner; Vernon E. Stagner; Jewel Mae Stagner; and Cleo Stagner, claim some right, title, or interest in and to said mineral interests adverse to the Plaintiffs, which claims constitute a cloud on the Plaintiffs’ title; that there has been no judicial determination of death and heirship of said Minnie Myrtle Stagner; Thomas Everett Stagner; Vernon E. Stagner; Jewel Mae Stagner; and Cleo Stagner, by a court of competent jurisdiction; and, praying that the Plaintiffs have judgment against all of the named Defendants, and each of them, judicially determining the names and individual identity of each and all of the persons who took, or were entitled to take, said mineral interests under the laws in force at the time of death of each said deceased Defendant and the proportion thereof that each took, or was entitled to take as successor or assign of Minnie Myrtle Stagner; Thomas Everett Stagner; Vernon E. Stagner; Jewel Mae Stagner; and Cleo Stagner, be required to show what right, title or interest, if any, that they now have in and to said mineral interests adverse to the right, title and interest of Plaintiffs herein; that all of the named Defendants be adjudged to have no right, title and interest or estate therein, and that the title of the Plaintiffs in and to said mineral interests be quieted as against the unknown successors

and assigns, immediate and remote, of Minnie Myrtle Stagner; Thomas Everett Stagner; Vernon E.
