NOW COMES the Plaintiffs, Al-fred David Light and PeterDeane, by and through their at-torney, Walter J. Salens ofSalens & Salens, P.C., and fortheir Complaint to Quiet Titlestates as follows:

1. That the Plaintiff, Alfred Dav-id Light, is a resident of PortHope, County of Huron, Stateof Michigan.

2. That the Plaintiff, Peter A.Deane, is a resident of PortHope, County of Huron, Stateof Michigan.

3. That to the best of yourPlaintiffs information and belief,the whereabouts and lastknown address of the Defend-ant, Gerline Fehrman, is un-known.

4. That your Plaintiffs are in-formed and believe that theDefendant, Anna B. DeFoor,passed away on March 20,2014. Fur ther , that yourPlaintiffs are informed and be-lieves, Ms. DeFoor was a res-ident of Macomb County,Michigan at the time of herdeath. A diligent search of therecords of the Macomb CountyProbate Court show that no Es-tate was ever opened for andon behalf of Ms. DeFoor in-volving this property, or anyother assets.

5. That Plaintiffs seek equit-able relief pursuant to MCL600.2932 to quiet title againstthe Defendants regarding realproperty located in the Town-ship of Rubicon, County of Hur-on, State of Michigan.

6. That this Complaint involvesthe title to real property loc-ated in the Township of Ru-bicon, County of Huron, Stateof Michigan described as fol-lows:

SEC 4 T17N R15E LOT 21 &SLY 44 FT OF LOT 20 BLK 22VILLAGE OF PORT HOPE.

Parcel Number: 3238-004-164-00

7. That based upon the abovelocation of property venue isproper in this Court. Further,that this Court has jurisdictionpursuant to the applicable Stat-ute.

8. That the Defendant, Anna B.DeFoor, received title to thisproperty, along with her hus-band, Joseph M. DeFoor,through a Warranty Deeddated August 29, 1989 and re-corded with the Huron CountyRegister of Deeds on August30, 1989, Liber 529, Page 48.(See attached Exhibit “A”.)

9. That Joseph M. DeFoorpassed away on August 8,1994 and his Death Certificateis recorded with the HuronCounty Register of Deeds onAugust 11, 1994, Liber 1415,Page 399. (See attached Ex-hibit “B”.)

10. That the Defendant, AnnaB. DeFoor, entered into a LandContract with Defendant, Ger-line Fehrman, for the propertyin ques t ion on or aboutSep tember 12 , 2012 . AMemorandum of Land Con-tract was recorded with theHuron County Register ofDeeds on September 14, 2012and is recorded at Liber 1415,Page 398. (See attached Ex-hibit “C”.)

11. That the Defendant, Ms.Fehrman, failed to pay theproperty taxes for the abovedescribed parcel of real prop-erty that she was purchasingon Land Contract from Defend-ant, Anna B. DeFoor and theproperty was placed up for saleby the Huron County Treas-urer.

12. That Plaintiff, Alfred DavidLight, purchased the propertyat an auction sale by the Hur-on County Treasurer pursuantto MCL 211.78m. On October24, 2018 the Plaintiff receiveda Deed to the above describedproper ty f rom the HuronCounty Treasurer which wasrecorded at 1653, Page 234 re-corded with the Huron CountyRegister of Deeds. (See at-tached Exhibit “D”.)

13. That the Huron CountyTreasurer, in foreclosing on theunpaid real estate taxes applic-able to the property, compliedwith all statutory requirements,including sending and postingall required notices to Defend-ants and filing all other re-quired documentation.

14. That Defendants at onetime had an interest in theproperty, based on the Deedand Land Contract that are setforth above and in the at-tached Exhibits.

15. That the Defendants failedto redeem the delinquent realestate on the property, despiteproper notice from the HuronCounty Treasurer of the im-pending foreclosure.

16. That the Plaintiff, AlbertDavid Light, purchased theproperty at the auction salelawfully held pursuant to MCL211.78m and holds absolutetitle to the property in feesimple.

17. That the Plaintiffs are try-ing to secure title insurance forsaid property and the title com-pany will not insure this trans-action or issue a title policy un-til a Court Order is issued bythis Court vesting title in feesimple with the Plaintiffs.

18. That your Plaintiffs are in-formed and believe that theDefendant, Anna B. DeFoorpassed away on March 20,2014, and Plaintiffs have beenunable to locate her next of kin.Further, a search of the inter-net showed that Ms. DeFoorwas a resident of MacombCounty when she died. A dili-gent search of the records inthe Macomb County ProbateCourt show that no Estate wasever opened for and on behalfof Ms. DeFoor involving thisproperty, or any other assets.Therefore, no heirs can befound.

19. That a search for thewhereabouts of the Defendant,Gerline Fehrman, a/k/a Ger-line Pigford, reveals from thePost Office that she did not filea change of address when sheleft the residence after the fore-closure was conducted by theHuron County Treasurer’s Of-fice. A check of the internet hasnot been able to locate Ms.Feh rman , and the re fo rePlaintiffs are unable to ascer-tain her whereabouts.

20. That the Plaintiff, AlfredDavid Light, has transferredthrough Warranty Deed his in-terest in the real property to thePlaintiff, Peter A. Deane. (Seeattached Exhibit “E”.)

21. That your Plaintiffs are re-questing that the Court find thatboth Mr. Deane and Mr. Lighthave title in fee simple for theabove described real property.

WHEREFORE, your Plaintiffsrequest that this Court:A. Enter a Judgment that thePlaintiffs hold full legal andequitable title to the real prop-erty in fee simple absolute freeand clear of any and all claimsof the Defendants in this ac-tion and quieting title to theproperty forever in the name ofAlfred David Light and sub-sequently to the current ownerPeter A. Deane;

B. That the Court grant suchother or such further relief asthis Court deems just andequitable.

10. That the Defendant, AnnaB. DeFoor, entered into a LandContract with Defendant, Ger-line Fehrman, for the propertyin ques t ion on or aboutSep tember 12 , 2012 . AMemorandum of Land Con-tract was recorded with theHuron County Register ofDeeds on September 14, 2012and is recorded at Liber 1415,Page 398. (See attached Ex-hibit “C”.)

11. That the Defendant, Ms.Fehrman, failed to pay theproperty taxes for the abovedescribed parcel of real prop-erty that she was purchasingon Land Contract from Defend-ant, Anna B. DeFoor and theproperty was placed up for saleby the Huron County Treas-urer.

12. That Plaintiff, Alfred DavidLight, purchased the propertyat an auction sale by the Hur-on County Treasurer pursuantto MCL 211.78m. On October24, 2018 the Plaintiff receiveda Deed to the above describedproper ty f rom the HuronCounty Treasurer which wasrecorded at 1653, Page 234 re-corded with the Huron CountyRegister of Deeds. (See at-tached Exhibit “D”.)

13. That the Huron CountyTreasurer, in foreclosing on theunpaid real estate taxes applic-able to the property, compliedwith all statutory requirements,including sending and postingall required notices to Defend-ants and filing all other re-quired documentation.

14. That Defendants at onetime had an interest in theproperty, based on the Deedand Land Contract that are setforth above and in the at-tached Exhibits.

15. That the Defendants failedto redeem the delinquent realestate on the property, despiteproper notice from the HuronCounty Treasurer of the im-pending foreclosure.

16. That the Plaintiff, AlbertDavid Light, purchased theproperty at the auction salelawfully held pursuant to MCL211.78m and holds absolutetitle to the property in feesimple.

17. That the Plaintiffs are try-ing to secure title insurance forsaid property and the title com-pany will not insure this trans-action or issue a title policy un-til a Court Order is issued bythis Court vesting title in feesimple with the Plaintiffs.

18. That your Plaintiffs are in-formed and believe that theDefendant, Anna B. DeFoorpassed away on March 20,2014, and Plaintiffs have beenunable to locate her next of kin.Further, a search of the inter-net showed that Ms. DeFoorwas a resident of MacombCounty when she died. A dili-gent search of the records inthe Macomb County ProbateCourt show that no Estate wasever opened for and on behalfof Ms. DeFoor involving thisproperty, or any other assets.Therefore, no heirs can befound.
