DOCUMENTARY REQUIREMENTS FOR THE ISSUANCE OFDOE CERTIFICATE OF ENDORSEMENT
The DOECertificate of Endorsementis a requirement undertheAmendedGuidelinesfortheissuanceofCertificateofCompliance(COC)byEnergyRegulatoryCommission (ERC)promulgatedonMarch 7,2003.Nopersonmay engage intheGeneration of Electricity as a new Generation Company unless such person hasreceived a COC from the ERC to operate facilities used in the Generation ofElectricity. A person that demonstrates compliance with the standards andrequirementsofRule5,Section1ofR.A9136andsuchothertermsandconditionsasdeterminedbytheERCtobeappropriatetoensurethatpersonscomplywithallapplicablelegalandregulatoryrequirements,shallbeissuedaCOC.WHO ARE REQUIRED TO APPLY?- ExistingGenerationFacilities.- GenerationFacilitiesUnderConstruction.- NewGenerationFacilities. Plant)WHAT IS THE PROCEDURE?
1. SubmitLetterofRequesttogether with the required documents to
theDepartmentofEnergy.Application shall be addressed to the DOESecretaryandattentionto the DOE Undersecretary for Power,copyfurnishtheDirectorof Electric Power Industry ManagementBureau(EPIMB).
2. After application is received, the EPIMB Power Planning and DevelopmentDivision(PPDD)willconductitsinitialevaluationofthe
project,whileacopyoftheapplicationwillalsobeprovidedtoEPIMB- Rural Electrification Administration and Management Division (REAMD)forthe preparation of Memorandum of Agreement (MOA)fortheestablishment of Trust Account for the Financial BenefitsAccruing from the Electricity Sales of the proposed power generating facility (In compliance with Rule 29 (A) of the ImplementingRulesandRegulationsofR.A.No.9136).

3. The REAMD shall contact the proponent/applicant and provide the draft MOAforreviewandapprovaloftheproponent.TheMOAshall thenbefinalizedandendorsedforthesignatureoftheDOESecretary.
4.TheREAMDshallcontacttheproponentforthescheduleofMOAsigningwiththeDOESecretary.
5.AcopyofsignedMOAshallbeendorsedto thePPDDforthepreparationofCertificateofEndorsement(COE).
6. The COE shall be endorsed by EPIMB Bureau Director thru the DOEUndersecretaryforPowerforthesignatureoftheDOESecretary.
7. OncetheCOEissignedby theDOESecretary,thePPDDshallnotifytheproponent topay to the DOE Cashier the appropriate processing fee inaccordance withthe feesandcharges. Accordingly,anOfficialReceipt(O.R)shallbeissued.
8. TheproponentshallpresenttheO.R.tothePPDDforreleaseoftheCOE.
TheaboveprocedureisshowninaProcessFlow. HOW MUCH IS THE PROCESSING FEE? IncompliancewiththeExecutiveOrderNo.197,dated13January2000,andExecutive Order No. 218, dated 15 March 2000, on the fees and chargescollected by National Government Agencies and Controlled Corporations, theDOEpublishedtheSCHEDULE OF FEES AND CHARGES on12May2004intwo (2) newspapersofgeneralcirculation. TheDOE requires the proponent topay One Hundred Pesos (P100.00) per megawatt installed capacity or aminimumofTenThousandPesos(P10,000.00)as
processingfee.
