Meeting of March 10, 2020 Committee of The Whole

The Committee of the Whole met on Tuesday, March 10, 2020 at the Township of Drummond/North Elmsley Administrative Building, 310 Port Elmsley Rd. Members Present: Steve Fournier Reeve Ray Scissons Deputy Reeve Paul Kehoe Councillor John Matheson Councillor George Sachs Councillor (Chair) Staff Present: Cindy Halcrow Clerk Administrator Cathy Ryder Deputy Clerk Scott Cameron Public Works Manager

1. Call to Order The meeting was called to order at 5:08 p.m. A quorum was present.

2. Disclosure of Pecuniary Interest The Chair invited members wishing to disclose a pecuniary interest to do so now. No members declared a pecuniary interest.

5. Petitions/Delegations/Public Hearings 5.1. Sierra Planning & Management – Recreation Master Plan – John Hack

John Hacks and Ira Banks reviewed the Perth, Tay Valley, Drummond/North Elmsley, & Lanark Highlands Recreation Master Plan. The report was received as information.

5.2. McIntosh & Perry – 2019 Code Road Landfill Report Jennifer Cavanagh and Eliza Walker presented the 2019 Annual Code Road Landfill report and discussed the recommendations. New recommendations for 2020 include groundwater monitoring program and topographical survey of the waste mound. MOTION #COW-20-059 (Verbal)

THE COMMITTEE OF THE WHOLE RECOMMENDS TO COUNCIL, THAT adopts the 2019 Annual Monitoring Report for the Code Road Waste Site prepared by McIntosh Perry Consulting Engineers Ltd.

No items were pulled from the Communication package although the following item was discussed before the motion was adopted: #3 – Enbridge Natural Gas Expansion Program Action Item: Direction given to staff to investigate to determine if this is a feasible option for Crain’s subdivision.

7.1. Community Development: None

7.2. Public Works a) Report of the Public Works Manager – Repair Work on John Deere Track

Loader The Public Works Manger provided an update on the track loader at the Waste Site. He reported that the undercarriage has worn down and requires replacement. He recommended replacing the undercarriage with aftermarket parts for an approximate cost of $19,824.04 (plus tax). The Committee accepted the recommendation and the following motion was adopted:

c) Report from the Library Board, John Matheson, March 2, 2020 March 2nd tri-Council information session with Perth, Drummond/North Elmsley and Tay Valley.

Action Item: Direction given to staff regarding partnership options for grant opportunities with the Library.

d) Report from CA’s RVCA next meeting March 26, 2020 MVCA next meeting March 18, 2020

e) Report from Members of Committee Environment Initiatives Committee – George Sachs Next meeting March 31st

George Sachs will meet with Ottawa Valley Trails Committee

Action Item: Direction for staff to provide a map of current Township unopened road allowances. Dealt with Item 10.1 at this point in the meeting.

10.1. Structural Report – Ferguson’s Falls Community Hall The Clerk Administrator and Chief Building Official provided an update regarding the structural report for Ferguson’s Falls Hall. The recommendation from the Engineer’s Report is to replace the hall. The costs to renovate the hall would be equal to or more than building a new hall. There was discussion on the frequency of use of the hall, facility reserves, grant options and land options within the community for rebuilding the Hall. Action Item: Staff direction to proceed to explore options for land purchasing, grants, and review the capital reserves.

Recommendation:

That the Committee of the Whole recommend that the Council of the Township of Drummond / North Elsmley

approve the proposed Zoning By-law Amendments for the Earnshaw (ZA-19-10) and Hollinger (ZA-19-11)

Properties legally described as Parts of Lots A and 23 on Registered Plan 158, Village of Millford, Now Ferguson

Falls, Township of Drummond/North Elmsley.

1.0 PURPOSE OF THE APPLICATIONS

A Zoning By-law Amendment application (ZA-19-10), submitted by Mike James, has been received by the

Township of Drummond / North Elmsley to rezone lands municipally known as 1337 Ferguson Falls Rd.

(Earnshaw Property) (Figure 1). A portion of the Earnshaw Property will be rezoned from Residential (R) to

Residential Exception Zone (R-x) in order to permit the continued use and future expansion of an existing small-

scale custom furniture manufacturing use. The application also proposes to rezone a portion of the Earnshaw

Property from Residential (R) to Rural (RU) as required as a condition of an approved Consent application (File

No. B19-031).

A Zoning By-law Amendment application (ZA-19-11), submitted by Mike James, has ben received by the

Township of Drummond/North Elmsley to rezone lands located on Part of Lot A on Plan 158 (Hollinger Property)

(Figure 2). A portion of the Hollinger Property will be rezoned from Rural (RU) to Residential Exception Zone

(R-x) in order to ensure the zoning matches the portion lands subject to the proposed rezoning in ZA-19-10

above, as required as a condition of an approved Consent application (File No. B19-030).

2.0 BACKGROUND

2.1 Description of Subject Lands

The subject lands consist of the Earnshaw property, located on 1337 Ferguson Falls Road, and the Hollinger

Property, located on Part of Lot A on Plan 158. The subject lands are legally described as Parts of Lots A and 23

on Registered Plan 158, Village of Millford, Now Ferguson Falls, Township of Drummond / North Elmsley. As

per the applications submitted to the Township by the applicant, the Earnshaw Property, located on 1337

Ferguson Falls Road, is 1.35 acres with 60 metres of road frontage. The Hollinger Property is a large, irregular

land holding of 30.4 acres, with frontages on both Ferguson Falls Road and Jerome Street.

2.2 Review of Consent Applications B19-030 & B19-031

The proposed rezoning of the subject lands are conditions of provisionally approved Consent applications B19-

030 and B19-031. Consent application B19-030 severs a portion of the Hollinger Property to add as a lot

addition to the Earnshaw Property (Figure 3); the lot addition will allow for the relocation of an existing dwelling

on the Earnshaw Property along with future expansion of a small business consisting of a 93 sq. m. shop

manufacturing custom furniture. Condition No. 8 of the Notice of Decision for B19-030 provides that, prior to

final approval, the lands to be severed shall be zoned to an appropriate category to match the lands to receive

the lot addition. Consent Application B19-031 severs a portion of the Earnshaw Property to add as a lot addition

to 142 Jerome Street, an undersized lot abutting the Earnshaw Property to the east (Figure 4); following the lot

addition, 142 Jerome Street would directly abut the Hollinger Property to the south, and, having the same

owners, would allow for a consolidation of these two properties. Condition No. 8 of the Notice of Decision for

B19-031 provides that, prior to final approval, the lands to be severed shall be zoned to an appropriate category

to match the lands to receive the lot addition.

3.0 POLICY FRAMEWORK AND REGULATORY CONTROL REVIEW

3.1 Provincial Policy Statement

Matters of provincial interest are addressed in Section 2 of the Planning Act and through the Provincial Policy

Statement 2014 (PPS) issued under the authority of Section 3 of the Planning Act. The Planning Act requires

that planning matters “be consistent with” the PPS. The subject lands are designated Settlement Area in the

Lanark County Official Plan and Hamlet in the Township of Drummond / North Elmsley Official Plan. The PPS

promotes and directs development in settlement areas provided that land is used efficiently, the development

does not result in the provision of unplanned municipal services, that the development can be appropriately

serviced without unanticipated impacts on municipal finances and does not result in negative impacts on

natural heritage features. Negative impacts on municipal services or natural heritage features are not

anticipated as a result of the proposed Zoning By-law Amendments.

Settlement areas shall have a mix of land uses with opportunities for intensification and redevelopment and

shall be the focus of growth and development, as per Section 1.1.3 of the PPS. The proposed development

contributes to the mixed-use nature of the settlement area, and the proposed expansion of the small-scale

custom furniture manufacturing use further contributes to the intensification of the subject lands.

The proposal is considered to be consistent with the applicable provisions of the PPS.

3.2 Lanark County Sustainable Community Official Plan

The subject lands are designated Settlement Area pursuant to the Lanark County Sustainable Community

Official Plan (County OP); Section 2.3.1 of the County OP provides that the limits of Settlement Areas be in

accordance with the limits established in local Official Plans. The County OP further provides that Local Official

Plans establish land use polices promoting intensification and mixed-use development in Settlement Areas and

the Township of Drummond / North Elmsley has incorporated these policies. As per Section 2.6.1 of the County

OP, Settlement Areas shall have mixed use communities with appropriate commercial, institutional and

employment uses. The proposed expansion of the small-scale custom furniture manufacturing use contributes

to the mixed-use nature of the neighbourhood with an appropriate commercial use.

The proposed Zoning By-law Amendments are considered to be in conformity with the purpose and intent of

the County OP.

3.3 Township of Drummond / North Elmsley Official Plan

The Earnshaw Property and the portion of the Hollinger Property subject to rezoning are in the Settlement Area

of Ferguson’s Falls and are designated Hamlet, as per Schedule A of the Township of Drummond / North Elmsley

Official Plan (Township OP). The Township OP notes that the Hamlet designation is placed on the established

settlement areas of the Township and is characterized by a mixture of residential, commercial and institutional

uses. Pursuant to Section 4.2.1 of the Official Plan, the intent of the Hamlet designation is to “recognize the

mixed-use nature of these areas and to permit them to expand.” The existing small-scale custom furniture

manufacturing use contributes to the mixed-use nature of the Hamlet, and a proposal for future expansion

conforms to the intent of the Township OP.

Section 6.4.1 of the Township OP provides that the “extension or enlargement of the non-conforming use shall

not unduly aggravate the situation created by the existence of the use” and that appropriate setback for

buildings and structures shall be applied to the extension or enlargement and, where feasible, shall be

extended to the established use. The proposed rezoning of the subject lands would allow for the relocation of

the residential dwelling to a complying setback from Jerome Street. The applicant notes that the proposed

expansion of the small-scale custom furniture manufacturing shop would not result in the frequent pedestrian

and vehicular traffic typical of commercial development, and that the existing shop has been operating on the

property for over twenty years. The definition and wording for the proposed residential exception zone

provides that the proposed expansion of the shop would be permitted “subject to the submission and review

of any plans or permits deemed necessary for said expansion.”

The proposed Zoning By-law Amendments are considered to be in conformity with the purpose and intent of

the Township OP.

3.4 Zoning By-law No. 2965

Zoning By-law Amendment application ZA-19-10 proposes to rezone a portion of the Earnshaw Property from

Residential (R) to Residential Exception Zone (R-x) in order to both permit the continued use of an existing

small-scale custom furniture manufacturing use and to add provisions into the Zoning By-law Amendment to

facilitate future expansion of the business. There are currently four structures located on the Earnshaw

Property, consisting of a residential dwelling, two accessory structures used for storage, and a 93 sq. m. shop

used for manufacturing custom furniture. Following the lot addition as outlined in B19-030, the applicant

proposes relocating the residential dwelling to comply with required setbacks and a future expansion of the

existing small-scale custom furniture manufacturing shop by a maximum of 92.9 square metres.

The applicant requests the following exceptions to the Zoning By-law with respect to the two accessory

structures on the subject lands:

a) An exception to Section 4.2.2.1 to allow the existing accessory buildings to remain closer to the exterior

side lot line than the main building once relocated to a complying setback.

b) An exception to Section 4.2.4.1 to allow the lot coverage for the existing accessory structures to exceed

140 square metres.

c) An exception to Section 8.2 to allow the accessory structures to remain within the required exterior side

yard setback

The following definition and wording have been proposed for the Residential Exception Zone:

Custom Furniture Manufacturing Use: Means a building or part of a building where individual custom furniture

pieces such as chairs, tables, desks and other non-offensive, non-dangerous crafted wood furniture is produced.

Notwithstanding any provisions of this By-law to the contrary, on the lands zoned R-x a Custom Furniture

Manufacturing Use shall be permitted, in accordance with the following provisions:

1. The existing dwelling on site will be relocated to a complying setback from Jerome Street.

2. The existing shop measuring 92.9 square metres (1,000 sq. ft) which houses the business will be recognized.

The shop shall be expanded to a maximum of 185.8 square metres (subject to the submission of any plans

or permits deemed necessary).

3. The existing accessory buildings shall remain closer to the exterior side lot line than the main building once

relocated to a complying setback.

4. The existing accessory structures shall have a maximum combined lot coverage of 155 sq. m.

5. The existing accessory structures shall have a minimum exterior side yard setback of 0.6 m and a minimum

rear setback of 0.86 metres.

6. The existing shop shall have a rear setback of 2 metres.

Zoning by-law Amendment application ZA-19-10 further proposes to rezone a portion of the Earnshaw Property

from Residential (R) to Rural (RU) as required as a condition of an approved Consent application (File No. B19-

031) and as discussed in Section 2.2 of this Planning Report.

Zoning By-law Amendment application ZA-19-11 proposes rezoning a portion of the Hollinger Property from

Rural (RU) to Residential Exception Zone (R-x) in order to ensure the zoning matches the portion lands subject

to the proposed rezoning in application ZA-19-10 discussed above, as required as a condition of an approved

Consent application (File No. B19/030) and as discussed in Section 2.2 of this Planning Report.

4.0 CONCLUSION AND RECOMMENDATION

Based on the review of Zoning By-law Amendment applications ZA-19-10 and ZA-19-11, the proposed rezoning

of the subject lands is consistent with the applicable provisions of the PPS. The rezoning also conforms to the

purpose and intent of the county and Township Official Plans. The applications to rezone the Earnshaw and

Hollinger Properties are an appropriate use of the subject lands and represents good planning. It is, therefore,

recommended that the Township of Drummond / North Elmsley Committee of the Whole recommend that the

Council of the Township of Drummond / North Elmsley approve the proposed Zoning By-law Amendments for

the Earnshaw (ZA-19-10) and Hollinger (ZA-19-11) properties.

AND FURTHERMORE that staff are directed to bring a By-law fonrvard for passage.

2. PURPOSE:The purpose of this report is to provide for business continuity in the event thatmembers of Council become incapacitated during the COVID-19 pandemic andquorum cannot be met.

BACKGROUND:The Premier of Ontario has declared a State of Emergency pursuant to Section7.0.1. or the Emergency Management and Civil Protection Act because of theCOVID-19 pandemic.

DISCUSSION:Staff have been discussing business continuity planning and have enacted plans

to ensure that the Township business will still be able to operate in the event amember of staff gets illwith COVID-19.

Part of business continuity planning takes into consideration what would happen

if quorum requirements cannot be met and Council decisions cannot be made.By delegating powers to the Clerk Administrator in consultation with the Head of

Council, the necessary decisions can still be made.

The power would only be exercised during this pandemic and only when aquorum cannot be met. Iwould be required to report to Council on all decisionsmade under the delegated power.

OPTIONS:Approve the by-law — Recommended. This ensures that business can continueas required.

Not approve - not recommended. While it isn't crucial to have this by-law inplace, the amount of infected people has grown quite considerable in the pastweek. The potential for wide spread infections is very likely.

A BY-LAW TO DELEGATE COUNCILS AUTHORITY TO THE CLERK ADMINISTRATORFOR THE CORPORATION OF THE TOWNSHIP OF DRUMMONDINORTH ELMSLEY IN

RESPONSE TO COVID-19 PANDEMIC

WHEREAS Section 23, subsections (1) and (2) of the MunicipaIAct, 2001, s.o. 2001,Chapter 25, provides that a municipality may delegate its powers and duties to a person orbody subject to the restrictions set out in the act;

AND WHEREAS in accordance with Section 270 of the Municipal Act, 2001, S.O. 2001,Chapter 25, the Council of the Corporation of the Township of Drummond/North Elmsiey hasestablished a policy to delegate its powers and duties to persons or bodies, subject torestrictions set out in the Act;

AND WHEREAS the Premier of Ontario has declared a State of Emergency pursuant toSection 7.0.1 of the Emergency Management and Civil Protection Act, R.S.O. 1990;

AND WHEREAS the Clerk Administrator of the Corporation of the Township ofDrummond/North Elmsiey is responsible for exercising general control and management ofthe Township for the purpose of ensuring the efficient and effective operation of themunicipality;

AND WHEREAS the Council of the Corporation of the Township of Drummond/North Elmsieydeems it necessary and expedient to delegate certain authority and powers in the event thatCouncil or its Committees is unable to act due to the current COV|D—19 outbreak;

NOW THEREFORE LET IT BE RESOLVED THAT the Council of The Corporation of TheTownship Of DrummondlNorth Elmsley Hereby Enacts as Follows:

1. THAT the Clerk Administrator in consultation with the Head of Council, be delegatedthe authority to:

(a) The hiring or dismissal of any employee of the municipality; and

(b) The disposition and acquisition of any real or personal property of themunicipality; and

(c) Making any expenditures or incurring any other liabilitywhich exceeds$100,000 which were part of the 2020 Budget, and

(d) Making any expenditures or incurring any other liabilitywhich exceeds$100,000 which were not part of the 2020 Budget, and

(e) Enter into and execute agreements on behalf of the municipality,including but not limited to labour relations or employee negotiations andfunding agreements; and

(f) Implement matters that have been given Council approval.

3. THAT upon the termination of this by-law, the Clerk Administrator shall, as soon aspracticable, advise Council by way of written public report of any exercise of a poweror duty delegated under this by-law.

3. THAT where a conflict exists between this by-law and any other by-law, policy orpower or duty delegated by Council, the exercise of any authority delegated under thisby—|awshall prevail.

4. THAT the delegation of powers and authority under this By-law be limited to such timethat Township Council is unable to hold regular or special meeting of Council or itsCommittees as a result of the COVID-19 pandemic, and the said By-Law is revoked byCouncil.

5. EFFECTIVE DATE

This By-Law willcome into effect on the 24”‘day of March, 2020.

- Deals only with existing communities 50 or more homes — new developments do not

qualify. We could submit for less than 50 homes but the program is based on cost

per customer — higher density, more chance of getting approved- Requires a letter of support from Reeve and a map showing areas.- Municipality does not need to provide money but customer will pay the surcharge for

a number of years (still cheaper than alternative energy sources)
