• The Federal Rules of Civil Procedures govern civil lawsuits in the U.S.
• New amendments for Electronically Stored and Exchanged Information (ESEI) were added for discovery
• ESI has unique qualities over paper/traditional information– Higher Volume
– Dynamic
– Only comprehensible in the system it was created or maintained
– May require metadata (data that describes data) to make sense
FRCP – “Reasonably Accessible”
• There are currently no clear standards for
“reasonably accessible”.
– Legal Test cases:
• In one case it was deemed “reasonably accessible” for
email reproduction at a cost of $37,500
• In another case Production that would cost $80,000
was deemed “not reasonably accessible”
