San Francisco Wins National Planning Grants

MayorEdLee,cityofficialsandcom-munityleadersjoinedtheU.S.Depart-mentofHousingandUrbanDevelop-mentonFridaytoannouncethatSanFranciscowasawardedtwo$300,000Choice Neighborhoods PlanningGrants.Withthemoney,BridgeHous-ing Corp. and Sunnydale Develop-mentCo.willbeabletodevelopnewplans formixed-usehousingat sitesinPotreroHillandSunnydale.

Once the plans are complete, theprojectswillbeeligibleformorefundsfromHUDthroughtheChoiceNeigh-borhoods implementation grants —suchasthe$30millionTheCitywasawardedlastyearfortheAliceGriffithPublicHousingDevelopment.

InPotreroHill, theplan is toconvertthe Potrero Terrace and PotreroAn-nex sites into a community that has1,600 units of public, workforce andmarket-rate housing, according toAmy Tharpe, director of policy andplanning for the Mayor’s Office ofHousing. The site currently has 606publichousingunitsthatdatebackto1941,accordingtoHopeSF.

InSunnydale,the785unitsofpublichousing will be converted to include1,000affordablerentalunitsand700affordable and market-rate for-saleunits,planningdocumentsshow.Pre-liminary plans also call for newparkspaceandrevitalizedstreetcorridors.

Acomponent in theNationalAssn.of Home Builders index showedthat,according tobuilders’ reports,prospectivebuyertrafficsoaredfivepointsto35—thatgauge’shighestlevelsinceApril2006.

Builders last month started con-struction on single-family housesand apartments at the fastest rateinmore than four years, theCom-merce Department said Wednes-day. And they laid plans to buildhomes at an even faster pace incoming months—a signal of theirconfidence that the housing re-boundwilllast.

Thepaceofconstructionhasgrownsteadily in the past year, and ana-lysts expect it to keep rising. Theincreasehasbeenfueledbyrecord-low mortgage rates, more stablehomepricesandashortageofpre-viouslyoccupiedhomesforsale.

Proposals Sought For Block 9 in San Francisco

Developersarelininguptotakeonblock9,theTransbayDistrictparcelin San Francisco that is slated for580unitsofmarket-rateandafford-able housing. Proposals are dueDecember12.

TheSuccessorAgency to theSanFrancisco Redevelopment Agencyrecently held a workshop whereprospective developers could askquestionsabouttheproject.BuildersinattendanceincludedMegSpriggsof AvalonBay, Steve O’Connell ofGrosvenor, Glen Ceridono of BREProperties, Don Lusty and JuliaBennettofRelatedCalifornia,DrewSullinsofJacksonPacific,andEricTaoofAvantHousing.

Diede Construction Wins Fire Station Contract

The Manteca City Council has ap-proved a $3.2 million design buildagreementwithDiedeConstructionfor a 7,173-square-foot fire stationdesignedbyLDAPartnersofStock-ton.ThecityiscurrentlynegotiatingthesaleoftheoldCarpenter’sHallatUnionRoadandLouiseAvenuetheyboughtafewyearsbackforpossibleconversiontoafirestation.Withtheproceeds from that sale plus whatfirefacilityfeeshavebeencollectedfromgrowth therewould be a $1.3millionshortfallofthe$3.579millionneededtobuildthestation.

Thearchitecturemirrors thatoff theDelWebb community. The fire sta-tionplannedforthenortheastcornerofthefutureintersectionofMadisonGroveatLathropRoad justwestofRaley’s will employ cement plasterand stone veneer for the exteriorwallsandusewarmearthtones.Theelevations will also include alumi-numwindowsandatileroof.

It ispart of a two-prongedplan theManteca City Council implementedin June to bolster public safety bytapping an $8 million endowmentfund set up using developer fees.The fundpaid for the restorationofafourofficergangunitinJuly.Italsoisfronting$1.3millionintheformofano-interest loan tohelpcover theconstruction costs plus $165,000 ayeartohelpcoveradditionalstaffingalongwithutilitiesandupkeep.

enginehousedatthemainstationonUnionRoadwill allow the new sta-tion to open without impacting thestressedgeneralfund.

Apartment Complex Work In San Jose To Begin Soon

A mixed-use apartment project inSan Jose’s midtown should startconstruction within weeks now thatthedeveloper has closedona$42millionconstructionloan.Thefour-tofive-storybuildingwillwraparoundafive-storyparkinggarageandfeature36studios,96one-bedroomsand86two-bedrooms.

Republic Urban Properties is nowready to start constructing 218rental unitsand15,800square feetofground-floor retail thathave longbeenplannedforthe3.5-acresiteat1400WestCarlosStreet.Crewswillsoonbeginpreppingthesiteforcon-struction, andbuild out is expectedtotakeabout24months.

San Jose-based Barry SwensonBuilder is thecontractoronthe$68million,design-buildproject.

Sacramento City Unified School District Asks

Voters For $414 Million For Construction

TheSacramentoCityUnifiedSchoolDistrictisaskingvoterstoapprovetwoschoolbonds totaling$414million toaddressahostofconstructionprojectsaswellashealthandsafetyissues.

Thosecostswouldbeinadditiontobondspreviouslyapprovedbyvotersin1999and2002.Propertyownersin the school district are currentlypaying $83 per $100,000. Moneyfromthosebondshasbeenallocat-ed or spent, district SuperintendentJonathanRaymondsaid.

“Giving our kids the best educa-tion we canmeans providing themwiththeequipment, technologyandlearning environments essential toacquiringtheskillstheyneed,”Ray-mondsaid.

The primary bond up for a vote isMeasureQ for $346million in con-struction, rehabilitation or replacingschool facilities, primarily at districthighschools.Projects includemod-ernizing classrooms, science labsand computers; fixing leaky roofsand gutters; and replacing heatingandairconditioningunits.

MeasureRfor$68millionisfocusedon student health and safety at allgrade schools by fixing old play-grounds and athletic fields, improv-ingphysicaleducation facilitiesandupgrading kitchen facilities. Schoolbondmoneycannotbeusedforop-eratingexpenses,includingadminis-trator,teacherorjanitorsalaries.

Raymond said Sacramento CityUnified schools, on average, are50 years old and badly in need ofrenovation. School district officialssaidtheywillbenefitfromlowinter-est rates and competitive bidding,which are bringing down construc-tion costs.SacramentoCity trusteePatrickKennedysaidthedistrictwillalsobeaggressiveaboutlookingformatchinggrantsformoneyspent.

“Wecanturnthis$400millionintoalotmore,”Kennedysaid.“Wehaveahistoryofdoingthat.”

The program is set up for those who are transitioning from military

New CSLB Program For Veteransservice to civilian employment. In many cases, veterans have transfer-able skills to help meet minimum experience and training require-ments for state contractor licensure. This program offers priority services to veteran applicants by evaluating transferable military experience and

training, as well as education.

We’ve got staff who’ve been specially trained to evaluate transferable military training and experience from all branch-es of the military. We feel this will really speed up the process for veterans to get a contractor’s license.

Nearly 100 people face the pos-sibility of criminal charges af-ter being caught in simultaneous statewide undercover sting opera-tions this week conducted by the Contractors State License Board (CSLB). Among those arrested dur-ing CSLB’s fall California Blitz were several repeat offenders, in-cluding one who was caught in a CSLB sting just two weeks ago. Investigators from CSLB’s State-wide Investigative Fraud Team (SWIFT) conducted stings on Oc-tober 17 and 18, 2012, in Alam-eda, Los Angeles (2 locations), Monterey, Placer, San Diego, San Luis Obispo, and Sonoma counties. SWIFT investigators posed as hom-eowners seeking bids for home im-provements such as painting, floor-ing, landscaping, fence repair, tree trimming, gutter installation, and water heater replacement. A total of 92 individuals were ar-rested and now may face misde-meanor charges for contracting without a license (Business and Professions Code section 7028). The penalty for a conviction is up to six months in jail and/or a fine of up to $5,000. At least two are repeat offenders and now face a mandatory 90-day jail sentence if convicted a second time. Seventy-seven of the individuals also may be charged with illegal advertising (Business and Profes-sions Code section 7027.1). State law requires contractors to place their license number in all print,

his CSLB license (#931776) ex-pired in April 2011, he has contin-ued to work, regularly placing mul-tiple ads on craigslist.org. Those ads continued to be posted after Kelly’s recent arrest, so CSLB in-vestigators invited him to the Ros-eville sting. Kelly and his business partner, Anthony Lester Arriola, showed up. Even though they did not give a bid, both were taken into custody for fraudulent use of an in-valid license number (Business and Professions Code section 7027.3) in some of the craigslist ads. That violation can be charged as a felo-ny, which carries a possible penalty of up to one year in jail and a fine of up to $10,000.

A suspect caught in the Union City sting is connected to one of CSLB’s Most Wanted. Investigators con-tacted Samuela Lavulavu and in-vited him to give a bid for concrete work. Lavulavu sent someone else to give the bid. That man gave the undercover investigator a CSLB-is-sued pocket license for a different company. He left the sting house midway through the bid process, saying there was an emergency. Vaionita Foketi arrived a short time later, stated he was from Lavulavu Concrete, and gave the CSLB in-vestigator a bid. Foketi was ar-rested for contracting without a license. Investigators now will try to determine if the legitimately licensed contractor will face ad-ministrative action, for either not carrying workers’ compensation in-surance, or for aiding and abetting unlicensed activity.

Contractors State License Board Cracks Down On Unlicensed Activity During California Blitz

broadcast, and online advertise-ments. Those without a license can advertise to perform jobs valued at less than $500, but the ad must state that they are not a licensed contractor. The penalty is a fine of $700 to $1,000.

Twelve others may be charged with requesting an excessive down pay-ment (Business and Professions Code section 7159.5). In Califor-nia a down payment cannot exceed 10 percent of the contract total or $1,000, whichever is less. This misdemeanor charge carries a max-imum penalty of six months in jail and/or up to a $5,000 fine. Fourteen of the phony contrac-tors also were issued Stop Orders (Business and Professions Code section 7127). CSLB investigators can halt job site activity when any person with or without a contrac-tor license does not have workers’ compensation insurance coverage for employees. One licensee also was given a Stop Order. Failure to comply with a Stop Order can re-sult in misdemeanor charges and penalties, including 60 days in jail and/or up to $10,000 in fines.

The totals may increase as some suspects are expected to provide their bids via email or fax.STING HIGHLIGHTS

Andy Karl Kelly is all too famil-iar with what it’s like to get stung by CSLB. Kelly was arrested at a sting in Yolo County two weeks ago (News Release). Even though

A few of those caught were former-ly licensed contractors. Gary Gene Gayer had a contractor license from 1988 through 1990. It is unknown how many of the last 22 years he has worked without a license. But, during this week’s sting in Arroyo Grande, he gave a CSLB undercov-er investigator a bid for concrete work. The next day, he posted an ad on craigslist.org that included a greeting to the investigator.

CSLB investigators at the Redon-do Beach sting were assisted by the federal Immigration and Cus-toms Enforcement (ICE) Fugitive Unit. Agents helped when suspects could not be identified or were in the United States illegally. ICE was responsible for identifying the sus-pects and determining if they had prior criminal history or previously had been deported. Eleven suspects were booked by ICE during the two-day operation.

Also in Redondo Beach, CSLB in-vestigators noticed a house next door to the sting property was be-ing painted. During a break, an in-vestigator asked the man doing the work for a business card and de-termined that he was the business owner and might be unlicensed. He invited the man, Jacinto Borjas-Ayon, to the house to give a bid. Borjas-Ayon bid and was arrested. He also was booked by ICE and his vehicle was towed because he did not have a driver license.

“CSLB and its partners in law en-forcement are serious about enforc-ing our state’s consumer protection laws,” says CSLB Registrar Steve Sands. “Unlicensed, illegal activity that puts homeowners at risk and puts those who follow state laws at a competitive disadvantage will not be tolerated.”

“The Alameda County District At-torney’s Office remains dedicated to protecting citizens from unli-censed contractors,” says District Attorney Nancy E. O’Malley. “This

When ap-propriate, we file criminal charges and always seek restitution on be-half of the victims.” CSLB urges consumers to follow these tips before hiring anyone to work in or around their home or business:

• Look for the contractor’s state license number. California law re-quires it to be in all forms of ad-vertising.

• If the contractor doesn’t have a state license, the ad must state that fact.

• In California, unlicensed people can’t take jobs valued at $500 or more (combined labor and materi-als).

• Don’t be misled by unlicensed contractors who give you a business or “handyman” license number.

• Before you call anyone for a bid, check the license number on CSLB’s website at www.cslb.ca.gov or www.CheckTheLicenseFirst.com to make sure the license is in good standing, and that the contractor has workers’ compensation insurance coverage for employees.

• Contractors are required to have their plastic pocket license or Home Improvement Salesperson registra-tion card with them. Ask to see it when getting your bid.

• Ask to see a photo ID to verify the person’s identity.

• Get at least three bids, check ref-erences and previous work, and get a detailed written contract.

• Don’t pay more than 10 percent or $1,000, whichever is less, as a down payment.

• Don’t pay in cash, and don’t let payments get ahead of the work.
