a.m. to discuss and deliberate on the following adjudicatory matters pursuant to HRS chapter 91.

1. Settlement Agreements

a. In the Matter of the Contractor Licenses of Approved

Electric, Inc. and Judith A. Means; CLB 2014-313-L

Judith A. Means (“Respondent Means”) was licensed as the RME for Approved Electric, Inc. (“Approved”) but dissociated as RME on or about September 21, 2012. Respondent Means was appointed as RME for RKR Enterprises, Inc. on or about September 21, 2012, but dissociated from RKR on or about September 1, 2014. Respondent Means placed her license on inactive status on or about November 3, 2014. RICO alleges that 13 liens and judgments were filed against Respondent Means between 2009 and 2013. On Respondent Means’ restoration application dated on or about October 17, 2012, Respondent Means answered “no” in response to question number 4, “Are there any liens or judgments against you?” On Respondent Means’ renewal application dated September 6, 2014, Respondent Means answered “no” to question number 4, “Are there any liens or judgments against you?” If proven at an administrative hearing, the allegations would constitute violations of the following laws and rules:

• HRS section 444-17(10) (misrepresentation of a material fact by an applicant in obtaining a license);

• HRS section 444-17(21) (failure to pay delinquent taxes, interest and penalties);

• HRS section 436B-19(5) (procuring a license through fraud, misrepresentation or deceit);

• HRS section 436B-19(8) (failure to maintain a history of financial integrity);

• HAR section 16-77-71(a) (RME responsibility); and • HAR section 16-77-71(a)(5) (RME responsible for

violations of company). Respondents Approved and Means admit to the veracity of the allegations, and agree to the voluntary surrender of their licenses and understand that they cannot apply for a new license until the

expiration of at least five years after the effective date of the revocation. After discussion, it was moved by Mr. Konishi, seconded by Mr. Lee, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case. b. In the Matter of the Contractor License of Bonterra Services,

LLC, dba Bonterra Solar Services; CLB 2014-78-L Bonterra Services, LLC, dba Bonterra Solar Services, (“Respondent”) was licensed in the C-60 Solar power systems and C-61 Solar hot water systems classifications on or about September 18, 2009, and are due to expire September 30, 2016. The C-61 classification was inactive effective October 8, 2013. RICO alleges that Respondent engaged in out-of-scope activity by offering to perform the installation of a solar water heating system at a residence on or about October 11, 2013. If proven at an administrative hearing, the allegations would constitute violations of the following laws and rules:

• HRS section 444-9 (unlicensed activity); and • HAR section 16-77-33 (out-of-scope activity).

Respondent does not admit to violating any law or rule, but agrees to pay an administrative fine of $1,000.00. After discussion, it was moved by Mr. Lee, seconded by Mr. Kamai, and unanimously carried to approve the First Amended Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case. c. In the Matter of the Contractor’s License of Sandra F. K.

Santiago; CLB 2009-545-L RICO alleges that Sandra F. K. Santiago (“Respondent”), on or about May 22, 1992, plead no contest to 11 felony counts of Forgery in the Second Degree and 1 felony count of Theft in the Second Degree. RICO further alleges that on or about June 26, 1992, a Judgment was filed reflecting Respondent’s twelve (12) felony convictions, and Respondent was sentenced to five (5) years of probation. Respondent, on her application for contractor’s license dated May 21, 2012, answered “no” to question 11, which asked, “Have

you ever been convicted of a felony which has not been annulled or expunged within the last 20 years?” If proven at an administrative hearing, the allegations would constitute violations of the following laws:

• HRS section 436B-19(5) (procuring license through fraud, misrepresentation, or deceit); and

• HRS section 444-17(10) (misrepresentation of a material fact by an applicant in obtaining a license).

Respondent alleges that when she answered “no” to question 11, she believed that more than 20 years had passed since her conviction, and that she mistakenly calculated the 20-year period from the date of her no contest plea instead of from the date of the judgment (conviction). Respondent does not admit to violating any law or rule, but agrees to pay an administrative fine of $1,000.00. After discussion, it was moved by Mr. Konishi, seconded by Mr. Lee, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case. d. In the Matter of the Contractor’s License of Antonio C.

Dalit, dba T.D. Builders; CLB 2014-346-L RICO received a complaint alleging that Antonio C. Dalit, dba T.D. Builders (“Respondent”) failed to complete a project in Waipahu, and failed to provide bond and lien rights in his contract. If proven at an administrative hearing, the allegations would constitute violations of the following laws:

• HRS section 444-17(11) (failure to complete project); and • HRS section 444-25.5 (failure to provide requisite bond

and lien rights).

Respondent does not admit to violating any law or rule, but agrees to the voluntary surrender of his license, and understands that he cannot apply for a new license until the expiration of at least five years after the effective date of the revocation. After discussion, it was moved by Mr. Lee, seconded by Mr. Konishi, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.

2. Board’s Final Orders a. In the Matter of the Contractors License of Alireza Sabri;

CLB 2013-499-L At the Board’s August 20, 2015 meeting, the Board accepted the Hearings Officer’s Findings of Fact and Conclusions of Law in this case; however, the Hearings Officer’s recommended sanctions were modified as the Board revoked the Respondent’s contractor’s license, ordered the Respondent to pay the homeowner the recommended amount of $146,077.00 in restitution, and fined the Respondent $55,000.00 Mr. and Mrs. Sabri and RICO staff attorney, Patrick Kelly, were present. DAG Tam stated that neither Mr. Sabri nor RICO filed written exceptions to or statements in support of the Board’s Proposed Final Order, and neither party requested oral argument. However since both Mr. Sabri and Mr. Kelly were present, the Board gave them an opportunity to address the Board. Mr. Sabri stated that it started off with a simple contract with the homeowner but it turned out to be a more complicated one. Mr. Kelly objected and stated that it is not proper procedure for the Board to hear any testimony on the matter as no written exceptions or oral arguments were filed. The Chairperson asked DAG Tam to address Mr. Kelly’s objection, and DAG Tam stated that although the Board is aware that no written exceptions were filed, the Board is going to allow both of them to present oral argument today. Mr. Kelly’s objection would be noted in today’s meeting minutes for the record. Mr. Sabri related that there were major changes in the scope of work to the house with an increase in size, and the homeowner had decided to have a separate septic tank installed. This meant he had to clean out the existing cesspool and fill it in for safety reasons, and build a new concrete septic tank. He knew the homeowner did not want more charges so he tried to keep the additional cost as low as possible, but which came to about $65,000.00. The additional costs and new contract price of $400,000.00 was signed and sealed by Mrs. Duldulao. Mr. Kelly stated that RICO filed a petition for disciplinary action, a hearing was held, and the Hearings Officer’s Recommended Order was issued. The burden of proof is on the Respondent to show that the Findings of Fact are not supported. The Hearings Officer notes that the Respondent was properly served but did not appear and did not participate at the hearing. The proper procedure is for the Board to proceed with its Final Order.

Mr. Sabri also stated that he has been in and out of the hospital for the past three years as he has been very sick and had high blood pressure. He did not mean to disregard Mrs. Duldulao’s complaint. Executive Officer Ito asked Mr. Sabri to confirm that the Ward Ave address is his current address. Mr. Sabri answered that it is his current address. Messrs. Sabri and Kelly were excused from the room. Mr. and Mrs. Sabri and Mr. Kelly returned to the room. After discussion, it was moved by Mr. Kamai, seconded by Mr. Lee, and unanimously carried to adopt the Board’s Proposed Final Order as the Board’s Final Order. DAG Tam explained to Mr. Sabri that pursuant to the Board’s Final Order, his license is revoked for five years from the date of the Board’s Final Order, he must pay $146,077.00 restitution to the homeowner, and pay an administrative fine of $55,000.00.

Following the Board’s review, deliberation and decisions in these matters, pursuant to HRS chapter 91, Chairperson Akasaki announced that the Board was reconvening to its open meeting at 9:13 a.m.

Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 9:24 a.m., it was moved by Mr. Mochida, seconded by Mr. Lee, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

After discussion, it was moved by Mr. Mochida, seconded by Mr. Lee, and

unanimously carried to approve Mr. Weiss’ application for licensure in the “B” classification.

Mr. Weiss was informed that he would need to be in residence in the

State when the projects are ongoing. Mr. Weiss indicated that their company usually only has one license holder in each state and therefore may consider having the superintendent in Hawaii also apply for an RME license. However, Mr. Weiss stated that they are applying for licenses in Hawaii specifically for two residential projects coming up on Kauai.

e. Wayne A. Westcott, RME Despins General Construction Inc. C-13 Electrical Executive Session: At 9:27 a.m., it was moved by Mr. Kamai, seconded by Mr. Lee, and

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 9:33 a.m., it was moved by Mr. Suehiro, seconded by Mr. Lee, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

After discussion, it was moved by Mr. Suehiro, seconded by Mr. Konishi,

and unanimously carried to defer Mr. Westcott’s application for licensure in the C-13 classification pending the submission of a revised project list which verifies only electrical supervisory experience.

g. Logan P. White, RME Pai’ea Millwrights LLC “B” General Building Executive Session: At 9:41 a.m., it was moved by Mr. Konishi, seconded by Mr. Suehiro, and

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 10:00 a.m., it was moved by Mr. Suehiro, seconded by Mr. Kagawa,

and unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

After discussion, it was moved by Mr. Polischeck, seconded by Mr. Lee,

and unanimously carried to deny Mr. White’s application for licensure in the “B” classification because he did not meet the experience requirement; and to amend and defer his application for the C-5 Cabinet, millwork, and carpentry remodeling and repairs classification pending the submission of a project list verifying four years of on-site supervisory experience.

h. Wesley E. Saunders, RME TEC Pro Ltd. C-13 Electrical Executive Session: At 10:01 a.m., it was moved by Mr. Kagawa, seconded by Mr. Polischeck,

and unanimously carried to enter into executive session pursuant to HRS

After discussion, it was moved by Mr. Suehiro, seconded by Mr. Lee, and

unanimously carried to deny Mr. Nguyen’s application for licensure in the C-13 classification because he did not meet the experience requirement.

Executive Officer Tamanaha explained that he can apply and qualify for a

license by forming an entity and hiring someone with the required C-13 experience to be his RME.

Executive Session: At 10:25 a.m., it was moved by Mr. Polischeck, seconded by Mr. Kagawa,

and unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J.
