CORCORAN UNIFIED SCHOOL DISTRICT SPECIAL BOARD MEETING GOVERNANCE TEAM WORKSHOP October 6, 2015 5:30 P.M. CALLTO ORDER Robert Alcorn, President of the Board, called the special meeting of the Corcoran Unified School District Board of Trustees to order at 5:30 p.m. in the Board Room. APPROVAL OF AGENDA The Board voted to approve the agenda for the Special Board Meeting of October 6, 2015 with the addition of a Trustee’s Report. Motion: Karen Frey Second: Bobby Toney AYES: Mary Wadsworth, Mary Gonzales-Gomez, Steve White, Robert Alcorn, Karen Frey TRUSTEE’S REPORT Trustee Mary Wadsworth announced that the Corcoran Foundation has contributed $12,500 to Kings County Promise for scholarships for nine Corcoran students to attend West Hills Community College. GOVERNANCE TEAM WORKSHOP Mike Smith of the law firm Lozano Smith directed training for the Governance Board. Board Roles and Responsibilities Mr. Smith spoke of the three duties of the Board: the Duty of Loyalty, the Duty of Care, and the Duty of Inquiry. He spoke of abstention when an item may be a conflict of interest for one of the members. That could be a personal economic interest or spouse or family. A Board member should recuse themself from the item and leave the dais prior to discussion and sit in the audience. In order to avoid an appearance of impropriety, they should not return to the dais until it is over, whether it is in open session or closed session. Under the Duty of Care, a Board member must be prepared to provide the level of care and diligence and look at the big picture without being mired in detail. They should read up on the provided information to the best of their ability. As for the Duty of Inquiry, no one expects a Board member to be an expert, but duty of care is asking questions, being thoughtful and being prepared.

The Board President is the spokesperson for the Board. No individual member should make a public statement for the Board. The Board would set protocol. On the Board roles and responsibilities, he said the Board has power only as a board as a whole, not as an individual. Outside of Board meetings, the Board members have the same power as ordinary citizens – no more and no less. He said the most difficult thing for Board members is that others perceive them as having power. He cautioned to exercise care regarding their implied powers. In regards to the Public Records Act, all actions at the Board meetings are taken in open session. Some documents are for closed session only if they fall into exceptions, such as student records and personnel records. Otherwise it is disclosable. When it comes to complaints, the Board’s role is to listen and direct them to the superintendent. The superintendent’s role is to resolve the complaint and keep the Board informed. Mr. Smith noted that if a Board member becomes the investigator, they could possibly be crossing the line and there could be ramifications. For Board meetings, Mr. Smith enforced that the Board meeting is just that – a meeting of Board members. The public is to observe only, but may give input during the proper time during public comments. Public comments may be limited to number of people speaking on the same subject and length of time allowed to each person. Other subject matters Mr. Smith touched on were Lease/Leaseback Agreements, Conflict of Interest/Form 700, Board Professionalism, Superintendent Evaluation, Board Member Liability and Brown Act Basics. SWEARING IN OF PATTY ROBERTSON Superintendent Rich Merlo swore in Patty Robertson as appointed Board Trustee for Area 3. INTRODUCTION OF NEW TEACHERS Principals introduced the new teachers at the High School and other sites. CHS Principal Antonia Stone introduced Trista Waymire, Violet Germinaro, Rudy Cardona, Gonzalo Solis, Julia Davila, Kaytlyn Naylon, Tayza Casillas, Kurtis Sawtelle, Ben Prins, Justin Ramirez, Brett Miller, Caleb Araujo, Catarina Crown, Nick Campbell, and Gwendolyn Filipski. Mark Twain teachers Kelly Houston and Ken Serpa were also introduced, as well as K-5 P.E. teacher Jerome Chappelle. PUBLIC HEARING FOR INSTRUCTIONAL MATERIALS The Public Hearing to discuss Pupil Textbook and Instructional Materials was opened at 6:16 p.m. Lora Cartwright, Director of Educational Services, informed the Board that there were no findings, but that the District must have extra devices available in the classrooms for back-up devices for the students. The hearing was closed at 6:18 p.m.

HIGH SCHOOL REPORT ASB representative Julia Avila reported that two weeks prior the High School sent a few students to SCICON to serve as ambassadors for the John Muir students. There will also be some High School students going with additional John Muir classes to SCICON in December, January and March. While there, they will be learning how to be leaders. Homecoming is coming up and ASB is making sure there are plenty of activities and rallies. She noted that every one is anticipating and looking forward to it this year. In October, the school will be observing Cancer Awareness month. Students and staff will wear pink on Wednesdays to acknowledge breast cancer. The staff on Wednesdays of every month may wear college alumni shirts in an effort to have students become interested and talk to their teachers on how to get into college. Night rallies are being formed to improve student involvement. She said that ASB wants everyone involved and with school spirit. SUPERINTENDENT’S REPORT SBAC Results: Superintendent Merlo and Mrs. Cartwright shared a SBAC results report with the Board. They noted that the results were disappointing in how the District compared with State reports. However, there are some silver linings. Mrs. Cartwright said she looks at the numbers as the District’s baseline and it can only go up. Also, some of the issues are the way the State is reporting the test scores and it has been confusing to many districts.

Administrative Regulation 5131.6 – Alcohol and Other Drugs: The regulation is being updated to go along with the Board Policy. CBO REPORT Chief Business Officer Pamela Dihel informed the Board that the District’s LCAP has been approved by Kings County Office of Education and has been updated on the Website. There had been some clarifying information and clerical corrections.

She had good news that the State has approved the District’s Community Eligibility Provision to start this school year and will continue through June 30, 2019. Once she receives the state agreement, she will be bringing it to the board meeting for ratification. There has already been a media release and notices have been sent to households. While students will no longer be charged for meals, the District will continue to collect old debt. Lastly, her department has received a check from MAA for $106,539 for prior years of 2010-11 and 2011-12. BOARD OF TRUSTEES REPORT President Robert Alcorn: Mr. Alcorn attended the Technology Subcommittee Meeting. The department has gotten off to a great start. Pearson program for second through eighth grades is up and running. There has been a rollout of iPads and MacAirs with John Muir getting all new iPads for the Pearson curriculum. Reimbursements are going down on E-rate. They were 100% but are now down to 70% and will eventually go away completely. New routers are in force this year, improving service. The telephone service with Verizon has been transferred over to Telepacific. Calls will go straight to the schools now and the service will be at a much lower rate. CURSIVE WRITING REPORT Mrs. Cartwright reported on cursive writing in the District. Students are started in pre-school and kindergarten with printing many upper and lowercase block letters. By first grade they are printing all upper and lowercase block letters. By second grade, students are started printing in D’nealian style that leads to cursive writing. Students are taught cursive through John Muir so they don’t lose their ability to read and write cursive. They will be tested along the way in both writing style and being able to read it. The District is following the Common cores State Standards for the Handwriting Process. CFA REPORT CSEA REPORT INTERDISTRICT AGREEMENT DENIED FOR ESPINOZA The Board voted to deny an interdistrict agreement with Tulare Joint Union High School District for Yadira Mendoza to attend a school within Tulare Union High School District through June 30, 2016. Before accepting employment, a student under the age of 18 who is subject to the state's compulsory attendance law, including students who have not yet graduated from high school or have not received a certificate of proficiency, shall obtain a work permit.

The district may issue a permit authorizing employment while school is in session, including employment connected with a work experience education program pursuant to Education Code 51760-51769.5, to a minor student age 14-17. The district also may issue a permit to any minor age 12-17 to be employed during a regular school holiday, during a regular or specified occasional public school vacation, and when the student is exempt from compulsory school attendance because he/she arrived from another state within 10 days before the end of the school term pursuant to Education Code 48231. (Education Code 49111, 49113, 49160)

If a minor has obtained an offer of employment in the entertainment industry, he/she shall request a work permit from the California Department of Industrial Relations, Division of Labor Standards Enforcement, pursuant to Labor Code 1308.5and 8 CCR 11752-11753.

A student shall not be required to obtain a work permit if he/she is self-employed; is working at odd jobs such as yard work and babysitting in private homes where he/she is not regularly employed; is a self-employed news carrier delivering newspapers to consumers on a regular route; is employed by his/her parent/guardian in domestic labor on or in connection with premises the parent/guardian owns, operates, or controls; or is otherwise exempted by law.

Persons Authorized to Issue Work Permits

The following individuals are authorized to issue a work permit to a minor student in the district: (Education Code 49110)

1. The Superintendent

2. An employee holding a services credential with a specialization in pupil personnel services or a certificated work experience education teacher or coordinator, when authorized by the Superintendent in writing

3. A principal, or another school administrator designated by the principal, provided that he/she:

a. Provides a self-certification that he/she understands the requirements of law for issuing a work permit

b. Does not issue a work permit to his/her own child

If the person designated to issue work permits is not available and delay in issuing a permit would jeopardize a student's ability to secure work, the Superintendent may authorize another person to issue the permit. (Education Code 49110)

Approval Process

The student's parent/guardian, foster parent, caregiver with whom the student resides, or residential shelter services provider shall file a written request for a work permit. (Education Code 49110)

The request for a work permit shall be submitted to the Superintendent or designee on a form approved by the California Department of Education (CDE). The Superintendent or designee shall have discretion to determine whether or not to issue the work permit.

In determining whether to approve a work permit, the Superintendent or designee shall verify the student's date of birth, the type of work permit to be issued, and whether the student meets any other criteria established by the Governing Board. The Superintendent or designee may inspect the student's records and/or may confer with at least one of the student's teachers for evidence of satisfactory grades and school attendance and to determine whether the student possesses the motivation and maturity to maintain academic progress while working.

Minors shall not be approved to work in environments declared hazardous or dangerous for young workers or otherwise prohibited by child labor laws. (Labor Code 1290-1298; 29 CFR 570.33, 570.50-570.72)

The Superintendent or designee shall ensure that the requested work hours do not exceed the maximum work hours specified in law based on the student's age and whether the employment will occur while school is in session and/or not in session. (Education Code 49111, 49112, 49116; Labor Code 1391-1391.1; 29 CFR 570.35)

Full-time employment may be authorized for students age 14-17 only in accordance with Education Code 49130-49135. Freshmen students will not be allowed a work permit except for work during winter break, spring break and summer. Sophomore students will be allowed work permits for work during winter break, spring break and summer, as well as during the school year under the following conditions: parent and student are required to attend a conference with a team of their teachers and administrators where they sign a student study plan; student must maintain a 3.0 GPA or better; and attendance must be 95% or better.

All work permits shall be issued in a format approved and authorized by the CDE. (Education Code 49117)

Each permit shall authorize work for a specific employer. Whenever a student changes employers, he/she shall request a new permit.

The student may be issued more than one work permit if he/she works concurrently for more than one employer, provided that the total number of hours worked does not exceed the total number of hours allowed by law and the district.

The Superintendent or designee shall quarterly inspect the grades and attendance records of students granted work permits to ensure maintenance of academic progress and any additional criteria established in Board policy.

Expiration of Work Permits

Work permits issued during the school year shall expire five days after the opening of the next succeeding school year. (Education Code 49118)

Before the work permit expires, a student may apply for a renewed work permit in accordance with the procedures specified in the section "Approval Process" above.

Revocation of Work Permits

The Superintendent or designee shall revoke a student's work permit whenever he/she determines that employment is interfering with the student's education, that any provision or condition of the permit is being violated, or that the student is performing work in violation of law. (Education Code 49116, 49164)

The Superintendent may revoke a work permit issued by a principal of a public or private school located within the district if the Superintendent becomes aware of any grounds upon which the student may be deemed ineligible for a work permit under law. (Education Code 49110)

Retention of Records

The Superintendent or designee shall retain a copy of the work permit application and the work permit until the end of the fourth year after the work permit was issued. (5 CCR 16026)

The Governing Board recognizes that part-time employment can provide students with income as well as job experience that can help them develop appropriate workplace skills and attitudes. Upon obtaining an offer of employment, district students who are minors shall obtain work permits from the Superintendent or designee in accordance with law, regardless of whether the employment will occur when school is in session and/or not in session.

In determining whether to grant or continue a work permit, the Superintendent or designee shall consider whether employment is likely to significantly interfere with the student's schoolwork. Students granted work permits must demonstrate and maintain a 2.0 grade point average and 95% school attendance. On a case-by-case basis, the Superintendent or designee may approve a maximum work hour limit that is lower than the limit specified in law and administrative regulation.

Students with work permits may be exempted from attendance in a full-time day school provided they attend part-time classes. (Education Code 48230)

Work permits shall be limited to part-time employment as defined by law, except when the Superintendent or designee determines that circumstances warrant the granting of a permit for full-time employment.

Any student authorized to work full time when school is in session shall be enrolled in part-time continuation classes. A student age 14 or 15 who receives a permit to work full time shall also be enrolled in a work experience education program. (Education Code 49130, 49131, 49135)
