    MINUTES OF COUNCIL

    A regular session of Troy City Council was held Monday, August 4, 2014, at 7:00 p.m . in Council Chambers.

    Members Present: Clark, Heath, Kendall, Oda, Phillips, Schweser, Snee and Tremblay.

    Upon motion of

    COUNCIL PRESIDENT COMMENTS REGARDING GAVEL: Mrs. Baker stated that the engraved gavel she

    was using at this meeting was to commemorate the 1oot anniversary of the Hayner Mansion and that on August

    9, during an event known as Hayner Days, that gavel would

    be

    placed in a time capsule at the Hayner Cultural

    Center.

    INVOCATION: An invocation was given by Council Member Schweser. The Pledge of Allegiance followed the

    invocation and was led by Jonathan Lu of Boy Scout Troop 413.

    MINUTES: The Clerk gave a summary of the minutes of the July

    21,

    2014, meeting of Troy City Council. There

    were no corrections or additions to these minutes. A motion was made by Mr. Clark, seconded by Mr. Phillips,

    to approve these minutes. Motion passed by unanimous roll call vote.

    COMMITTEE REPORTS:

    Committee of the Whole: Mrs. Baker reported that Council met

    in

    a workshop of a Committee of the Whole on

    July 28, 2014, with the workshop chaired by the Council President. The Riverfront Development Project would

    be

    funded by a bond issue, with the debt payable over 25 years. At the July 28 workshop, City staff

    summarized the program options. The City Auditor (via conference call) indicated that he has a comfort level

    with a bond issue not to exceed 10 million. The City Auditor further commented that with current low interest

    rates, this is the time to consider this project, particularly as all projections are that interest rates will be

    increasing next year. The members of Council then discussed the project, and a majority of the members of

    Council present indicated support

    of

    the Riverfront Development Project Option II with a total estimated cost of

    10 million. A majority of Council recommends that reappropriation legislation be presented to Council to

    provide the funding for the preparation and design of plans, specifications, cost estimates and bidding

    documents for the Option II elements at the Marina Building, Treasure Island Park, and Hobart Arena. While not

    a matter of legislation, based on the interest

    in

    the stand-alone second sheet of ice option, several members of

    Council asked that the 2015 budget include funds related to a feasibility study and a study of the economic

    impact such a facility could bring to the Troy community, as well as exploring funding partnerships. (Copy of

    report attached to original minutes.)

    Discussion. At the request of

    Mr.

    Kendall,

    Mr.

    Stickel commented that the cost

    of

    delaying action on the

    project could

    be

    substantial as the project

    is

    to

    be

    funded by a bond issue. Mr. Stickel further commented that

    interest rates remain very low and a

    2 increase

    in

    interest rates could add over 3 million to the debt service

    payments over a 25-year repayment period on a 10 million bond issue.

    -Mr. Clark indicated his concern, commenting that in his review of the 2014 budget the discussion was

    regarding the City's low rate of return from low interest rates, how

    to

    handle deficit spending, and cutting staff

    to

    keep costs down.

    In

    response to Mr. Clark regarding the City being ahead of the game by doing nothing, Mr.

    Stickel concurred that debt service payments would

    be

    saved if the project did not proceed.

    -Mr. Phillips stated

    he

    has received more calls this year than in his prior service on Council related to complaints

    of the City not meeting quality of life services, related to items such as trash pickup and unrepaired potholes .

    He

    further commented that he does not believe the impact of increased park maintenance staff and costs have

    been considered for this project.

    -In response to Mrs. Oda regarding the type

    of

    bonds that would be issued, Mr. Stickel advised it would be a

    general obligation bond issue. Mr. Stickel also noted that the City has retained a bond rating of Aa1, the second

    highest category of bond ratings.

    Buildings Committee: Mrs. Snee, Chairman, reported that Committee recommends legislation be prepared

    authorizing the Director of Public Service and Safety to advertise for bids and enter into a contract for repairs to

    the heating system at

    Public Square at a cost not

    to

    exceed 58,300, with Committee noting that the

    funding will be from CDBG Funds and Council previously approved a CDBG grant application for this project.

    Law & Ordinance Committee: Mr. Schweser, Chairman, gave an oral report that notice has been received of

    the transfer application for the existing C1 and C2 liquor permits from the name of Ninos Gas LLC, dba 55

    Express Market, 503 E. Staunton Road, to the name of Zar Lana LLC of the same address.

    Streets

    &

    Sidewalks Committee: Mr. Phillips, Chairman, reported that Committee recommends legislation be

    prepared to provide for the following:

    Approve the fee schedule recommended by City staff, which includes modest increases and meeting

    the goal of the fee paying for any related service. The fee schedule will also include parking fees.

    Committee noted that the City intends

    to

    purchase a parking kiosk for the S. Cherry Street Parking Lot

    to determine how a kiosk will work for managing off-street parking rather than having meters.

    Amending required ordinance sections for parking related fees to be

    in

    the fee schedule.

    Amend Section 351.15 related to two-hour parking to clarify the intent of a vehicle being permitted to

    park in any one parking place for one two-hour period per day

    Utilities Committee: Mr. Tremblay, Chairman, reported that Committee recommends legislation be prepared

    authorizing the Director of Public Service and Safety to enter into a Facility Encroachment Agreement with CSX

    Transportation, Inc. related to the Water Line Project No. 4 (Governors Road portion) for the boring under the

    CSX line. Committee supported emergency legislation so that the agreement can

    be

    executed as soon as

    possible.

    CITIZEN COMMENTS:

    -Lester Conard, 1210 S. Clay Street, commented he has been asked who Council works for. He also said he

    did not believe a large amount o money should be used for tourism, rather the money should

    be

    used to provide

    jobs, and Hobart Arena cannot be built big enough

    to

    pay the subsidy.

    -Paul Farrier, 35 Westhaven Drive, stated he is glad to be back

    in

    Troy after living

    in

    Vandalia for 18 years, and

    his son and family are also moving back. He commented that he attended the open house

    on

    the Riverfront

    Development Project, found the work planned for the marina area and Hobart Arena

    to

    be

    exciting, and

    he

    believes that maintaining, restoring and improving what Troy has will bring people and jobs to Troy with the

    overall economy benefitting.

    -Will Harrelson, 438 S. Plum Street, said he does not know that a second sheet of ice may be necessary for

    Hobart Arena, but the Arena has certainly been packed with events. As a young person, he said he sees

    amenities and activities as what a community needs, Troy has a wonderful downtown, the improvement of the

    riverfront area will improve tourism, and tourism is an economic driver. He said he believes these projects will

    substantially improve the economy of the county and give young professional adults a reason to want to live

    here.

    RESOLUTION NO. R-33-2014

    RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE AND SAFETY OF THE CITY OF

    TROY, OHIO TO ADVERTISE FOR BIDS AND ENTER INTO A CONTRACT FOR THE REPAIR OF THE

    BOILER/HEATING SYSTEM AT 121 PUBLIC SQUARE

    This Resolution was given first title reading.

    Mr. Clark moved for suspension of rules requiring three readings . Motion seconded by Mr. Kendall.

    PRESENTATION, TROY RECREATION ASSOCIATION. Nicole Hanes, Executive Director of the Troy

    Recreation Association, Inc., commented

    as

    follows: 2014 has been a very big year for the REC; the 75-year

    old building has been undergoing interior and exterior renovations; when completed the total investment will be

    375,000; the first floor renovation is complete; the second floor renovation should be done by the start o

    school; the exterior repair work is complete; and within the next two weeks the recreating of the historic murals,

    that have been part of the

    REC

    exterior for several decades, will

    be

    completed.

    Ms

    Hanes noted that funds for

    the renovation work came from grants and various fund raising efforts. She also commented that the building

    is

    constantly being used, with approximately 100 persons using it daily.

    Ms

    Hanes thanked Council and City for

    supporting the REC.

    -Mrs. Baker congratulated Ms Hanes on what she has accomplished as Executive Director, including her

    successful fund raising efforts. Mr Phillips complimented Ms Hanes on an outstanding job. Mr. Clark

    commented that Ms. Hanes works countless hours

    in

    her dedication to the REC.

    COMMENTS OF THE MAYOR. Mayor Beamish commented that:

    -National Night Out will

    be

    held August 5 at a new venue of the levee area near the stadium

    -The Hayner Days celebration will be this coming weekend, and he will include a copy of his proclamation for the

    event in the Hayner time capsule.

    -Troy native Matt Allen

    is

    a finalist

    in

    a national contest regarding a new potato chip flavor.

    COMMENTS OF THE DIRECTOR OF PUBLIC SERVICE AND SAFETY:

    -Mr. Titterington noted that recent bids for the sewer relining project and the Adams Street Phase II project both

    came in under the authorization and it may be possible to add areas to be worked on to both projects.

    -Water line work includes areas of Main Street. It is realized this is the busiest travelled street and the work on

    that roadway should be completed soon.

    COMMENTS OF COUNCIL:

    -In response to Mr. Harrelson, Mr Clark stated he is not against economic development and feels planned

    economic development with taxpayers in mind is an excellent thing. Mr Clark also noted that the Cemetery

    Department mows

    52

    acres each week during the mowing season.

    SUBJECT: TEMPORARY SIGN ORDINANCE AMENDMENT SIZE OF SIGN

    SUMMARY REPORT:

    This Committee met

    to review a recommendation that in Industrial and Commercial

    Districts, the size of a temporary sign shall not exceed 48 square feet if the building on which the sign is

    to be affixed

    is

    setback 150 feet or more from the right-of-way. Current provisions limit the size

    to

    24

    square feet, and it can be difficult to read the sign from the setback distance .

    RECOMMENDATION: To be read at Council meeting)

    It is the recommendation of this Committee that legislation

    be

    prepared

    to

    amend Section 749.14 (e) to

    read as follows:

    (e) Maximum Area. The maximum area of any temporary sign shall not exceed a total of

    twenty-four (24) square feet, except where a temporary sign is placed on a building

    setback one hundred-fifty (150) feet or more from the public right-of-way, then the

    temporary sign shall not exceed a total of forty-eight (48) square feet.

    This Committee met on August 11 2014 to review a proposed amendment to the Temporary Sign

    Provisions. This meeting was also attended by the Director of Public Service and Safety and members

    of the City staff.

    The current provision

    is

    that any face of a temporary sign cannot exceed 24 square feet for a single sign

    face in Industrial or Commercial District. Council recently approved a provision that temporary signs

    must be affixed to a building. When a sign

    is

    affixed to a building, only one face of a sign can be seen.

    When a building

    is

    set back 150' or more

    in

    an Industrial or Commercial District, it can be difficult to read

    a 24 square foot sign. We considered a proposal that when a temporary sign

    is

    placed on a building

    setback 150 feet or more from the public right-of-way, then the temporary sign shall not exceed a total of

    48 square feet. We believe that this amendment

    is

    appropriate. Any other provisions related to

    temporary signs would be unchanged.

    RECOMMENDATION:

    It

    is

    the recommendation of this Committee that legislation be prepared

    to

    amend Section 749.14 (e) to

    read as follows:

    WHEREAS, Council finds it both necessary and appropriate to amend Chapters 351 and

    353

    of the Codified Ordinances of the City of Troy, Ohio relating to parking,

    NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Troy, Ohio

    as

    follows:

    SECTION

    :

    That Chapter 351 of the Codified Ordinances of the City of Troy, Ohio is

    hereby amended to add the following:

    351 .21 PARKING METER ALSO MEANS PARKING KIOSK.

    SECTION II: That Section 351 .15 of the Codified Ordinances of the City of Troy, Ohio

    351.15 HOURS OF OPERATION; SEPARATE OFFENSES.

    parking for any period in excess of two hours.

    (d) It shall be unlawful and a violation of the provisions of this chapter for any person

    to cause, allow, permit, or suffer any vehicle registered in the name of,

    operated by

    such person to

    be

    parked or to remain in any parking space designated for 2 hour

    parking in any given day at separate times more than 2 hours apart.

    SECTION IV: That Section 351.99 of the Codified Ordinances of the City of Troy, Ohio

    is hereby repealed.

    SECTION V: That Section 351.99

    the Codified Ordinances

    Troy, Ohio,

    as set forth below, is hereby enacted:

    351.99 PENALTV.

    (a) Whoever violates Section 351.03, 351.04 (a}- (d), or Section 351.05 to 351.15,

    shall present such ticket at the Police Department and pay the sum

    of

    twenty dollars

    ($20.00) in full satisfaction

    of

    such violation

    if

    paid within seventy-two hours after the

    time of violation. If seventy-two hours have passed since the time of the violation, the

    violating individual shall present such ticket at the Police Department and pay the sum of

    fifty dollars ($50.00) in full satisfaction

    of

    such

    violation.

    {b) Whoever violates Section 351 .

    04 e)-

    {g) shall present such ticket at the Po lice

    Department and pay the sum of one hundred dollars ($100.00) in full satisfaction of

    such violation. A violation of this section also subjects the vehicle to being impounded

    under city ordinance.

    (c) Any person charged with a violation of any provision of this chapter for which

    payment

    of

    a prescribed fine may

    be

    made, may pay such sum in the manner

    prescribed; other penalties are set forth in Section 303.99. Any such payment shall be

    deemed a plea of guilty, waiver of court appearance

    and

    acknowledgment of prescribed

    penalty for such alleged violation. Payment

    of

    the prescribed fine shall not be accepted

    when the law is prescribed that a certain number of such officers shall

    be

    required at a

    court appearance.

    SECTION VI: That Section 353.

    hereby made a part of

    this chapter by reference.

    Such parking meter zones shall be as follows:

    (a) Off Street Parking Meter Zones. Parking meters/kiosks instal led in the said

    zones shall

    be in

    accordance with the regulations adopted by the Director of

    Public Service and Safety under section 353.14. The rates for off street parking

    set by

    the

    Director of Public Service and Safety under section 353 .

    approved by Council.

    (a} 2 Hour Parking Zone parking zones with no parking meters but parking is

    limited to 2 hours as provided in Section 351.15.

    In days gone by, most discussions of economic development incentives focused on taxes as an

    area where government could offer help to reduce the high initial capital investment cost of a

    company opening or expanding a facility. As legislatures have worked to reduce business taxes,

    however, those tax-based business incentives have become less effective. In Troy, this is borne

    out y the greatly decreased participation in the Enterprise Zone and Community Reinvestment

    Area programs. While still important for some very large economic development projects,

    lowering taxes makes less difference to business managers in their regular capital investment

    decision processes.

    In the past few years, Troy's three business loan programs have become more important as tools

    in our economic development efforts than our tax incentive programs. Just last year, for

    example, nine economic development projects involved City

    of

    Troy business loans. Another

    four business loans have closed to date this year. Each of these gap-financing loan programs

    leveraged additional private investment. Especially in Downtown Troy, these public sector loans

    made projects bankable for those private sector investments.

    A new copyrighted study released in June

    y

    the International Economic Development Council

    (IEDC) reinforces this trend away from relying only on tax incentives to encourage economic

    development. More than Money: Alternative Incentives that Benefit Companies and

    Communities lists five main categories of incentives local communities can offer to attract

    business investment. The good news for us is that the City of Troy and the Troy Development

    Council (TCD) already have been active with each of these recommended practices.

    The five categories in IEDC's More than Money study are:

    1

    Talent/Workforce Development - Availability of qualified labor has become a primary

    consideration in business location decisions. The Troy community already has

    an

    excellent

    skilled workforce, especially in the metal-working sector, but more skills are needed

    as

    work

    processes continue to change. TDC committees have been very involved in coordinating

    vocational and retraining programs with the Upper Valley Career Center, Edison State

    Community College, and Sinclair Community College. TDC currently is working with the Troy

    Chamber's HR Council to develop an on-line job-search program to link people with the right

    skills to the right job openings. This follows up on the Recruitment/Quality of Life on-line video

    project (www.troyohiousa.com) which went on-line earlier this year. The TDC Workforce

    Committee also has been coordinating with Miami and Shelby Counties' Job Centers. The

    Miami County Job Center especially has been instrumental in helping with initial applicant

    screenings than can be a big burden for companies.

    Real Estate and Permitting - This is another area in which Troy has been active for decades.

    We partner with TDC, Troy Main Street, and all regional commercial real estate brokers in this

    effort. We have kept in contact with owners of industrial buildings and maintain lists

    of

    available spaces. We link these to the J obsOhio database and the Dayton Development

    Coalition. We coordinate site visits and assist with permitting. We even help put together

    financing packages when necessary. In addition to marketing industrial space, we also have

    helped with back-filling retail and office spaces, particularly in Downtown Troy.

    3 Research and

    Data

    In addition to sharing typical demographics information any community

    is expected to provide, we also collect more detailed information about the local workforce. This

    is especially helpful to decision-makers in the industrial sector. The Troy Chamber's Wage and

    Benefit Survey also includes a breakdown by skill classifications, specific to the Troy area. Our

    cooperation with the Dayton Development Coalition gives us connections to an even wider

    workforce and a network of regional business services and suppliers.

    4

    Networking and Promotion Part

    of

    being business-friendly is helping incoming businesses

    make connections in the local community. n Troy, this is especially easy. The troy Chamber's

    Ambassador Program actively seeks

    to

    promote new businesses. Events such

    as

    TDC's Business

    Expo lets the community at large know more about individual companies. New executives also

    are individually invited to join Troy Chamber and TDC golf outings

    as

    well

    as

    other business

    social events.

    Of

    especial benefit in Troy has been a very active Japanese community within

    the community , which helps the families

    of

    managers/engineers temporarily assigned from

    Japan to Troy plants.

    Infrastructure Improvements - Troy's good infrastructure, such as its excellent water and

    wastewater treatment plants, already help attract new businesses to the area. Upgrades always

    are being planned and can be accelerated when necessary. A recent example is the

    reconstruction

    of

    Dye Mill Road, which had been included in the Comprehensive Plan

    as

    a future

    project, but was accomplished earlier when ConAgra's expansion brought additional State

    of

    Ohio grant funding.

    The IEDC study concludes with recommendations that local communities should:

    c Offer a Wide Spectrum of Services

    Bring Along the Key Stakeholders

    e Focus on the Needs

    of

    the Community

    For our community, these recommended practices are not new. Between city government, the

    Troy Chamber, and the TDC, these economic development activities are what have made Troy

    business-friendly . Our tax incentives and our business loan programs have played a big role in

    our successes and continue to help in certain circumstances. But TDC' s and City Council's

    many-year emphasis on economic development has made the most difference. Troy has been

    ahead of

    the trend, rather than having to react to a shift

    of

    emphasis toward alternative

    incentives in our economic development efforts.
