Dear Mr. Rothrock:

I am enclosing herewith original and duplicate of amended notice of intention to drill well in Section 4, Township 11 South, Range 4 East, same being filed by Mr. F. E. Gilbreath, the drilling contractor. The original notice of intention to drill was approved by you on December 27, 1940, at which time a drilling machine was moved upon the ground, but no further operations were had. This well was spudded in on November 28, 1941.

I wish you would send me copy of the regulations govern-ing oil and gas operations in South Dakota, and also two copies of your report made in 1931, on the Chilson Anti-cline, of which the Hat Creek Structure is a part.

The leases on this structure were formerly held by the Klaw,a_greek Oil Com an ut they have been renewed in the name Of—Hat CiWil Development Company, which company is now drilling l a turnkey contract with Mr. Gilbreath.

I would appreciate your advising me what eurther reports or data you desire on these operations.

Dear Mr. Beeler:

Thank you-very much for your letter of December 18 with the information concerning the well north of Ardmore. It has straightened out a matter in which I was considerably confused. Under Another cover•I am pleased to send you a copy of the regulations governing drilling and prospecting for oil and gas in our state, and a separate blank for notice• of intention to drill. If you will fill out two of these blanks and return them to me, I will sign my signature as a permit to proceed with the drilling.

We do not have a very complicated set of regulations, and I hope we will not need them, as we are anxious to help those who would prospect our state rather than impede their operations with a lot of governmental red tape. Our purpose is to preserve an accurate log of the well where it will be available to the public when you have no further use for it, and to prevent the waste of gas or oil which may be struck, or contc.ination of our water supplies by artesian waters.

Thank you very much for you offer of cooperation. I assure you that we are more than glad to do what we can to return the favor.

Dear Sir:--

Your letter of the 14th inst to Mr J.P.Bariani of this city and his reply thereto has been handed to me, and T am writ-ing you to morrect certain statements made in his letter.

The Kiowa Creek Oil Company, of Colorado, of which T am president, has undertaken to take over and drill a well to the SuncL4nce sand on the Christensen farm ,some six miles north of Ardmore, Fall River County, 5.D., and for that purpose has begun moving in the necessary rig and material for the work. A photograph of the Star No. 30 rig is enclosed, taken on its arrival at the location on Nov. 29th last.

In connection with this work, 1r Bariani,whex is an oil driller,was hired and paid the usual wages for getting the rig in repair and sent to the location, where he had the usual pre-liminary work done and superintended the placing of the rig and material in the proper position for setting up and operation.

But hisstateraent that he "was persuaded to move the rig up there" is misleading as he simply did what he was told to do and has no authority whatsoever to speak for this Company.

It is our intention to spud in as soon as possible, the weather and other conditions being favorable,and to carry on the work will all reasonable diligence as provided in our leases and agreements, and not to delay as stated in the above letter.

In this connection, will you kindly advise me here what, steps are required to apply for the permit to drill, so that we comply at once, fees to be paid and if there are blank forms to be filled out, would appreciate copies of same. As I was State Geologist of Wyoming for night years, / fully appreciate the necessity of these requirements and can assure you that we will be glad to cooperate with your office to the fullest extent.

As soon as practicabbe after the first of the year q\my associate, Mr C.B.Garnett of this city, intend to come to Pierre and i'ermillion to become personally acquainted with the various departments with whom' we may have business and to learn first hand just what is expected of us in this work, at which time I hope to meet you.

In reply to your letter of December 14,1 wish to say that I was very pleased to get the information that I asked of you, relative to the Cascade and Chilson anticline. Enclosed you will find 160 to cover the cost of mailing same.

Referring to the rig that we moved into South Dakota six miles of north of Ardmore. The writer was persuaded to move the rig up there very suddenly and since time was very limited to get started in order to protect the leases we had no other choice. We don't intend to spud the well in before next May or June and certainly dasire to comply with the laws of your state. I would be very grateful if you would inform as to what steps that I must take to comply with the laws of South Dakota, regarding the proper authorization to drill a well.

In reply to your letter of December 11, I am enclosing a list of our publications on the second page of which you will note Report of Investigations No. 9. This is the report on -the Chilson anticline and contains the information we have available on the region immediately north of Ardmore.

Report of Investigations No. 8, The Cascade Anticline, contains a map of the structure immediately east of the north end of the Chilson fold. I can send you either or both of these publications upon receipt of the handling charges.

If you are moving the rig into the region near Ardmore, about which there has been so much secrecy, you had better get a permit to drill, as there are regulations in our state covering this matter with rather severe penalties for delinquency.
