DEFENDANT'S RESPONSE IN OPPOSITION TO PLAINTFFS'OTION IN LIMINETO PRECLUDE REFERENCES TO INCIDENTS AT OTHER REHABILIATION

FACILITIES, AND SUPPORTING MEMORANDUM OF LAW

Defendant HERNANDO COUNTY, by and through undersigned counsel, moves this

Court to deny Plaintiffs* Motion for entry of an Order precluding Defendant from mentioning

deaths that occurred at another Narconon tacilities Defendant would show that the matter is

relevant in the instant case and this relevance is not substantially outweighed by any prejudice to

Plaintiffs. In support thereof, Defendant offers the following Memorandum of Law.

MEMORANDUM OF LAW

I. Introduction and Factual Background

Upon heing prevented from expanding PlaintilTs'rug and alcohol rehabilitation facility,

Plaintift's filed suit alleging violations of the I'ederal Housing Act and of the Americans With

Disabilities Act, for which Plaintiffs are seeking monetary damages, in part, on a theory of lost

profits. [Doc I] This theory requires Plaintiffs to make a showing that the facility would have

been able to operate as successfully as Plaintiffs intended.

The deposition testimony taken in the instant case shows that there was bad publicity in

the wake of the three deaths that occurred in the Narconon facility in Oklahoma. Mr. Mitchell

testified that he was aware of the deaths like "most of the country;" that there was bad publicity

for Narconon as a result of the incidents at Narconon Arrowhead: that bad publicity for

Narconon "obviously could have an effect on...us being that we provide a Narconon

program;" and that there was a drop in enrollment at the time the articles came out. [Exhibit

A. Depo. of Mitchell. p. 68. Ins. 5-25: p. 69, lns. 1-10, p. 70. Ins, 1-13]. Additionally, Mr.

Morgenstern testified that the reputation of Narconon could have an effect on Narconon Spring

Hill and that he was aware of the deaths that occurred in Oklahoma. [Exhibit B, Depo. of

Morgenstern dated Oct. 11, 2012, p. 28. Ins. 19-23; p. 31. Ins. 1-8].

While Narconon Arrowhead and Plaintiffs'acility are separate entities, they are both

Narconon facilities using the same methodologies. [Exhibit C — Excerpt from Narconon

International Website] Plaintiff's'acility uses the same Narconon methodology as Narconon

Arrowhead, including the "mainstay of the Narconon Program...the Narconon New Life

Detoxification Program" [Exhibit D —Fxcerpt from Suncoast Rehabilitation Center Website;

Exhibit E —Excerpt from Narconon Arrowhead]. Additionally, aside from the testimony from

Plaintiffs'itnesses showing that the deaths were highly publicized, a simple Google'earch of

"Narconon" will show that a the deaths caused wide spread bad publicity. [Exhibit F —Google

Search for "Narconon" ].

Narconon advertises on the internet and Google and pays to be promoted through severalonline directories [Depo. ol Mitchell. p 63. Ins 6-25. p. 64, Ins. 1-3].

Accordingly, it is beyond evident that there were three deaths in one year in a Narconon

facility using the very same methodologies as Plaintiffs'nd that this caused bad publicity.

II. Standard of Review

This Court has broad authonty to control the admission of evidence during trial, Chrysler

International Corp v Chetnal, 280 F. 3d 1358 (11th Cir. 2002). Error is created when

admission of evidence affects a substantial right of the party. Fed. R. Evid. 103(a). A motion in

limine is the vehicle to exclude irrelevant evidence or unduly prejudicial or confusing relevant

evidence. See Hodgetts v Cr(y of Venice, 2011 WL 2192819, 1 (M.D. Fla. June 6, 2011).

I I I. Discussion

Rule 401t Relevance and Rule 402t Admissibility - Evidence is relevant if it has any

tendency to make a fact more or less probable than it would be without the evidence and the fact

is of consequence in determining the action: relevant evidence is admissible unless provided

otherwise by statutory authority Fed R.Evid. 401, 402. Plaintiffs must establish that the facility

would have successfully attracted the amount of participants that Plaintiffs expected in order to

prove their damages. Plaintiffs will meet this burden by offering evidence that the program is

successful and widely accepted Accordingly, it is absolutely relevant to, and a critical portion

of, Defendant's defense in this matter to be able to set forth that the facility's reputation was

affected by the deaths at the similar Narconon t'acility and the bad publicity that came as a result,

thereby hindering Plaintiffs'bihty to attract customers. That a Narconon facility had three

deaths in one year which caused bad publicity is certainly true, as made clear above, and

relevant, as Plaintiffs witnesses have testified that bad publicity can affect reputation and

reputation can affect attracting potential participants.

Thus, evidence that three Narconon participants died at a similar Narconon facility and of

the resulting bad publicity is relevant to show that the program was less attractive and this fact is

both of consequence in determining Plaintiffs'amages and admissible as it is not prohibited by

any other source See Fed.R.Evid. 401, 402.

Rule 403r Not Unduly Prjeudicial and Confusing - Relevant testimony is excluded if the

probative value of the evidence is substantially outweighed by danger of unfair prejudice or

confusing the issues. Fed.R.Evid. 403. In the instant case, Plamtiffs seek to present the positives

of Narconon to paint a picture of a program that has absolute success and is widely accepted by

the community, while preventing Defendant from presenting any evidence that shows otherwise,

including bad publicity that occurred at the time m question as a result of three Narconon

participants dying while enrolled in a similar Narconon program. Evidence does not become

madmissible as pre)udicial simply because it is negative for the Plaintiffs, but, rather, it must

substantially outweigh the probative value of the evidence.

In seeking to exclude the evidence Plaintiffs cite to three completely distinguishable

cases to attempt to show that evidence of publicity or evidence of other facilities confuses jurors

However, the Court in Thomas excluded the publications, not because it was evidence related to

publicity, but, because it was offered to show an uncontested matter, dealt with a different

model, and was published after the fact; no mention of excluding the evidence based on it being

a publication was made by the Court. See Thomas v Bombardier Recreational Products, inc.,

2012 WL 4188308, I (M.D Fla, Oct. 20, 2010) Additionally, Staihos and Swiarek both dealt

with discrimination. specifically. the Court in Sicrihou excluded evidence of discrimination at

other facilities See Siaihos v Bowden, 728 F 2d 15, 19 (1st Cir 1984); Swiaiek v Bemis Co,

Inc, 2011 WL 7453417, 6 (D.N.J. Oct. 7, 2011). Clearly in the instant case, where the evidence

Plaintiffs seek to exclude is that of the actual fact that there was bad publicity and that there were

deaths due to a methodology that is the very same methodology employed by Plaintiffs, the facts

are distinguishable from the cases cited by Plaintiffs

There is no reasonable argument that reputation is not a factor considered by any

customer in choosing a service, moreover, this fact is acknowledged by Plaintiffs'itnesses.

Certainly there is nothing to prevent Plaintiffs from introducing evidence or cross-examining

witnesses to show that, as alleged by Plaintiffs. there was no actual effect on Plaintiffs'acihty.

However, Defendant seeks to use the evidence to show that there was a negative effect on

Plaintiffs'eputation. which is. not only directly relevant to the damages in this matter. but its

exclusion would result in prcludice to Defendant's ability to present a defense in this matter,

Thus the probative value of this information —there was bad publicity that affected the reputation

of Narconon which would have affected Plaintiffs'bility to attract participants - is not

substantially outweighed by the prejudice to Plaintiffs of the jurors knowing actual facts about

the Narconon program and the publicity it actually received. It is for the jurors to decide whether

and how much this information affected the facilitv's abilitv to attract customers

WHEREFORE, Defendant HERNANDO COUNTY requests this Court to deny

Plaintiffs'equest to enter an Order on this Motion in Limine prohibiting any testimony as stated

above.

5 Q Thank you. Are you aware of any patients who have

6 died as a result of participating in the Narconon drug

7 rehab program?

8 A Uh, you know, I, like most of the country, have

9 become aware of that only recently, uh, at the Narconon

10 center in Oklahoma. Until, you know, the recent media

11 coverage on that I was not aware of any deaths ever in

12 the Narconon program.

13 Q Do you know how many people died?

14 A It's my understanding that three people have died

15 at that center.16 Q And you said that you recently have become aware of17 this, like, through the media reading newspaper reports,18 is that19 A Uh, I, I first became aware of it, you know, from

20 the coworkers at my center who had said, hey, have you

21 heard, you know. Someone said to me one day did you

22 hear about, you know, the death at Narconon in Oklahoma,

23 at Narconon Arrowhead. So then I did some research24 online, read some news articles and so forth. And then

25 recently saw, you know, of, something on NBC, a special

1 that was on NBC one evening.

2 Q And would you agree that that's bad publicity for3 Narconon?

4 A Sure, absolutely.5 Q And that can effect your ability to attract clients6 to Suncoast?

MR. TASSO: Object to form.

8 A Yeah, of course. I mean, bad publicity for9 Narconon is, obviously could have an effect on, uh, on

10 us being that we provide a Narconon program, sure.11 Q (By Mr. Lowe) When did those deaths occur, do you

12 know?

13 A I don't know exactly. I think it was, uh, you

14 know, over the course of the last 18 months or so, is my

15 understanding.

16 Q Has any of your perspective patients asked you

17 about the deaths in Oklahoma?

18 A Actually, no.

19 Q Are you aware of whether or not so far, that in the20 last 18 months, whether or not your ability to attract21 patients to Suncoast has been effected by the bad

22 publicity for the, with those deaths in Oklahoma?

23 A I have not, I have not been told by one person, not

24 by one single case that they weren't coming to us

25 because of that. So as far as I know it has not been.

1 Q Have you seen a drop off in, in enrollment since2 all the news of the deaths were published in the

3 different newspapers?

4 A Um, you know, I'd have to review our census numbers

5 to really answer that question accurately. Um,

6 summertime is generally kind of a slow time anyway in

7 this industry. People are out of school. They'e8 either going on vacations, or doing this, or doing that.9 Uh, so we see a drop in census during the summer

10 regardless. I'm not sure that I can correlate it to the

11 news articles.12 Q But you did experience a drop this summer?

13 A Yes.

14 Q How are you able to do your job now that you live15 out of state?16 A I work with people over the phone and via e-mail.17 I, I don', my job is always done that way so it didn'

18 effect it. Or my job as an admissions counselor was

19 always done that way, let me rephrase that.20 Q So what about showing them the facility, meeting

21 with them? Is, is that someone else that performs that?22 A Yes, yeah that's an

The Narconon Program

Book 1

The first book of the Narconon program helps the student confront his surroundings,

fnends, family and life through a senes of communication dnlls These enable the

student to confront the areas that he may have become withdrawn from while suffering

from his addiction

Book 2

Building on the first book, book two enables the student to take better control of his life

by ndding his body of the drug residues (that have proven to cause physical crawngs for

the drugs) from his system This is done through exercise, a vitamin regimen and

sweating in a dry heat sauna This is called the Narconon New Life Detoxification

Book three focuses on enabling the student to learn any data he cares to with the ability

to apply it after studying Without fully understanding anything read, it is easy to forget

things that one has been "taught" before. By learning better ways to learn and retain

data, the student is enabled to take on any sublect he desires This information is

especially helpful when studying the following books and fully recovenng from addiction

Book 4

Book four is split into two parts, first doing more advanced communication drills to be

able to easily communicate in most any circumstance and second doing exercises that

enable the student to be more aware and in control of his environment Upon completion

of book four, the student is able to have better focus, have more control, and work

through any situation that may anse

Book 5

The fifth book enables the student to recognize people that are trying to help him, and to

differentiate these people from those that try to suppress him and bnng him down These

valuable tools allow the student to surround himself with people that will forward his

survival the best

Book 6

Addicts are usually laden with guilt from their mis-deeds from their addiction The sixth

book gives the student the ability to become free of lhe guilt of the wrongs he has done

to himself, fnends, family, co-workers, etc By releasing the guilt of what he has done in

the past, the student is able to move on to a bnghter future

Book 7

The seventh book enables the student to make up the damage he has done in the past

This builds upon the sixth book by fixing the relationships that were harmed by his bad

deeds Having confronted things he has done and effects he has created, the student is

now able to repair what has been broken and move on with more confidence than ever

Book 8

The eighth and final book gives the student twenty-one simple precepts that apply to

everyone. These are basic rules which enable people to live together and get along, no

matter what environment they are in

The first Narconon was started and founded by Wigiam Benitez,an inmate at Anzona State Pnson. During his quest at self-improvement, he read lots of self. betterment

books One of those books, titled "Fundamentals o(1hought" was a

self-help book wntten by Mr L Ron Hubbard

1his had some basic pnnciples that he started practiong and

incorporated into his hfe He found himself responding favorably to

his efforts and wrote the warden asking permission to start a small

drug recovery program to help others

Offiaals denied permission for the following six months Mr

Benitez's request to start a program consisting of twenty convicted

drug addicts, caused concern to officials who feared such a program

might pose a secunty problem (such programs were rare in pnsons

dunng that decade)

Officials had httle reason to beheve that the request of a habitual

drug addict and repeatedly convicted felon, would result in one of

the nauon's most successful rehabihtation program for substance abusers

1oday, Narconon has spread from that one program in Anzona State Prison to mclude community

programs in many states and countnes such as Denmark, Italy, Holland, Germany, France, Sweden, Spain,

Canada, Russia, Ukraine, Kazakhstan, Mexico, Columbia, Switzerland, New Zealand, the United Kingdom,

Austraha, Taiwan, Argentma, and Brazil

Mr Benitez was a Heanng Officer with the Anzona Department of Corrections, the same system which

once kept him under lock and key.

I-le was a husband for 30 years as well as a father and grandfather Mr Benitez passed away in June of

1999

Mr Benitez persisted and finally assured offioals the program was needed and would not pose a threat to

the safe and orderly operation of the pnson After being allowed to start the program on a tnal basis, he

founded NARCONON (NARCOtics-NONel on February 19, 1966

Shortly after the person starts in treatment, they would begin The Narconon New Life

Detoxification program which helps the person get nd of the build-up and residuals of

drugs and toxins in the body It has been scientifically proven that this build-up creates a

crawng for the drugs, even though the person himself wants to stop These residual

chemicals make it harder for the person to get off drugs and stay off them for good

The staff we have are specially trained in lhe piogiam methodology of Narconon The

staff as a whole has many years of experience and tens of thousands of hours working

with addicts to help them conquer their addiction(s) Another point is that the staff pnde

themselves in their desire of continued education They attend training classes and

enhance their skills on a regular basis

We have many counselors who are themselves recovered addicts which allows for a

strong shared understanding with our students and gwes them the ability to know first

hand how our clients feel Having been there themselves, the staff truly gets where our

students have been, what they are going through, and the bright, drug free future they

can each have
