European Patent Office 3
Introduction
The aim of classification
Retrieval of technical subject-matter
(IPC-Guide VIII.75.)
When classifying, keep in mind how a
search examiner searches,
i.e. what is useful for search and what is not.
European Patent Office 4
Introduction
The main kinds of search
Text-feature search
i.e. a search for written features, mainly the examples
No figure-feature search
When flipping through documents, in A61K 8 or A61Q,
the search examiner often only looks at the claims and
the examples, i.e. classification of the examples is often
more important than classification of the wording of broad
and vague claims.

What and where to classify
Characterisation of a patent application
with classification
What Essential features of the invention :
compounds (or mixtures) which make the invention
No distinction between active ingredients and carriers
The invention information is classified :
claimed subject-matter which has been really disclosed
(examples). If only generic terms in the claims, then the
concrete compounds used in example are classified
European Patent Office 13
What and where to classify
What is classified
Intrinsic nature :
i.e. cosmetic or similar toilet preparations characterised
by special physical form or by the composition
(i.e. active ingredients)
Use or application :
i.e. use of cosmetics or similar toilet preparations
Specific properties :
i.e. properties of cosmetic compositions or active ingredients
thereof or formulation aids used therein and process
related aspects
European Patent Office 14
What and where to classify
What is classified
A61K 8/00 :
defines the composition by a specific form (if applicable)
and the compounds (if applicable).
A61Q :
defines the use of the composition.
A61K 2800/00 :
defines the specific properties of the composition or
the compounds.
Only as invention information
Both as invention or additional information
Only as additional information
European Patent Office 15
What and where to classify
Multiple classification approach
Where A document has always at least one A61K 8/00 symbol
and one A61Q symbol as invention information.
Invention information and additional information
(if necessary).
European Patent Office 16
What and where to classify
Last-place-rule (LPR)
Where Definition :
In each of groups A61K 8/02 and A61K 8/18, in the absence
of an indication of the contrary, classification is made in the
last appropriate place.
The feature to be classified is only classified in the place
which appears last in the classification scheme.
European Patent Office 17
What and where to classify
Last-place-rule (LPR)
Example Salicylic acid is a hydroxycarboxylic acid
with carboxyl group directly bound to an
aromatic ring.
European Patent Office 18
What and where to classify
Last-place-rule
Salicylic acid
A61K 8/36 A61K 8/368
A61K 8/365
A61K 8/36 .... Carboxylic acids; Salts or anhydride thereof
A61K 8/361 ..... Carboxylic acids containing more then 7 carbon
atoms in an unbroken chain
A61K 8/362 ..... Polycarboxylic acids
A61K 8/365 ..... Hydroxycarboxylic acids; Hetocarboxylic acids
A61K 8/368 ..... With carboxyl groups directly bound to carbon
atoms of aromatic rings
European Patent Office 19
What and where to classify
Last-place-rule (LPR)
A61K 8/00 follows the LPR locally for A61K 8/02
and A61K 8/18
A61Q and A61K 2800/00 do not follow the LPR,
as several uses or properties could be relevant to
characterise an invention.

Multiple schemes system
Class-crossing This is a powerful tool to retrieve all documents dealing with
same subject-matter by combining classes from two or three
different schemes.
Example 1:
A sunscreen composition containing an UV-filter is claimed;
an anti-aging composition is described.

European Patent Office 25
Specific topics
Form of the composition
WO 2007/115675
A61Q 3/02
A61K 2800/412 : particle size between 0,1-100 microns
(100-261μm in examples)
A61K 2800/654 : core comprising macromolecular material
A61K 8/731 (cellulose)
A61K 8/87 (polyurethane)
A61K 8/0241 (particulate

Polymers
43 polymer groups Monomers are classified
The last-place-rule is applied by allocating to a co-polymer
the monomer-class occurring last in the scheme.
e.g. acrylate/acrylamide polymer
A61K 8/8158 (not -8147).
Crosslinking branches are not classified
(exception for polysiloxanes)
Block and graft polymers are placed at the end of
the scheme
(exception for polysiloxanes)
European Patent Office 27
Specific topics
Polymers – typical error
LPR: A61K 8/8182
copolymer of vinylpyrrolidone
A61K 8/8158
(not 81881)
A61K 8/8182
1 The part of the monomer molecule which forms the polymer is the methacrylamide not the sulfate.
