 PER CURIAM:

Petitioners Isagani Cruz and Cesar Europa brought this suit for prohibition and mandamus as

itizens and ta!pa"ers# assai$ing the onstitutiona$it" of ertain provisions of Repub$i %t No.&'() *R.%. &'()+# other,ise -no,n as the Indigenous Peop$es Rights %t of )( *IPR%+# and

its Imp$ementing Ru$es and Regu$ations *Imp$ementing Ru$es+.

In its reso$ution of September /# )&# the Court re0uired respondents to omment.) In

omp$iane# respondents Chairperson and Commissioners of the Nationa$ Commission onIndigenous Peop$es *NCIP+# the government agen" reated under the IPR% to imp$ement its

 provisions# fi$ed on Otober )'# )& their Comment to the Petition# in ,hih the" defend the

onstitutiona$it" of the IPR% and pra" that the petition be dismissed for $a- of merit.

On Otober )# )&# respondents Seretar" of the 1epartment of Environment and Natura$

Resoures *1ENR+ and Seretar" of the 1epartment of 2udget and 3anagement *123+ fi$edthrough the So$iitor 4enera$ a onso$idated Comment. The So$iitor 4enera$ is of the vie, that

the IPR% is part$" unonstitutiona$ on the ground that it grants o,nership over natura$ resouresto indigenous peop$es and pra"s that the petition be granted in part.

On November )5# )&# a group of intervenors# omposed of Sen. 6uan 7$avier# one of the

authors of the IPR%# 3r. Poniano 2ennagen# a member of the )&8 Constitutiona$ Commission#

and the $eaders and members of ))/ groups of indigenous peop$es *7$avier# et. a$+# fi$ed their3otion for Leave to Intervene. The" 9oin the NCIP in defending the onstitutiona$it" of IPR%

and pra"ing for the dismissa$ of the petition.

On 3arh //# )# the Commission on :uman Rights *C:R+ $i-e,ise fi$ed a 3otion toIntervene and;or to %ppear as %mius Curiae. The C:R asserts that IPR% is an e!pression of the prinip$e of parens patriae and that the State has the responsibi$it" to protet and guarantee the

rights of those ,ho are at a serious disadvantage $i-e indigenous peop$es. 7or this reason it pra"s

that the petition be dismissed.

On 3arh /'# )# another group# omposed of the I-a$ahan Indigenous Peop$e and the

:aribon 7oundation for the Conservation of Natura$ Resoures# In. *:aribon# et a$.+# fi$ed a

motion to Intervene ,ith attahed Comment<in<Intervention. The" agree ,ith the NCIP and

7$avier# et a$. that IPR% is onsistent ,ith the Constitution and pra" that the petition for prohibition and mandamus be dismissed.

The motions for intervention of the aforesaid groups and organizations ,ere granted.

 pub$i domain of the Phi$ippine Is$ands# and presribed the terms and onditions to enab$e persons to perfet their tit$es to pub$i $ands in the Is$ands. It a$so provided for the @issuane of

 patents to ertain native sett$ers upon pub$i $ands#@ for the estab$ishment of to,n sites and sa$e

of $ots therein# for the omp$etion of imperfet tit$es# and for the ane$$ation or onfirmation ofSpanish onessions and grants in the Is$ands.@ In short# the Pub$i Land %t operated on the

assumption that tit$e to pub$i $ands in the Phi$ippine Is$ands remained in the governmentA) and

that the governmentJs tit$e to pub$i $and sprung from the Treat" of Paris and other subse0uenttreaties bet,een Spain and the United States./5 The term @pub$i $and@ referred to a$$ $ands of the pub$i domain ,hose tit$e sti$$ remained in the government and are thro,n open to private
