Road Share Research• There is a clear and strong association between presumed liability

legislation and higher levels of walking and cycling. • All countries with high levels of safe walking and cycling have

some form of presumed liability legislation. • Leading cities in Europe with some form of Presumed liability now

see more than 55% of trips being made by walking and cycling, but Scotland falls well behind this.

• Lower litigation and insurance costs are achieved due to a higher proportion of victims obtaining compensation quickly and fairly.

• Presumed Liability has already been successful across a range of sectors in Scotland. It is not a “new” concept and extending it to transport presents no fundamental legal or administrative barriers.
