This full day session will bring you right up to date on developments in relation to data protection and freedom of information. We are extremely fortunate to have as our keynote speaker Richard Thomas, theUKInformationCommissioner.Hisprofilehascontinuedtoriseover the past year as a result of various bold initiatives he has taken in relation to both data protection and freedom of information. Of particular note has been his focus on targeted enforcement action in both the private and public sectors. Against a backdrop of some high profiledatabreaches,hehascontinuedtocallforgreaterinvestigativepowers and tougher sanctions. He has also extracted enforcement undertakingsfromasignificantnumberofhigh-profileorganisationsand has made it very clear that he intends to maintain pressure on businesses that engage in practices that he considers unacceptable such as obtaining personal data unlawfully and failing to maintain adequate security arrangements. In the meantime, UK businesses face

increasing challenges in complying with their international obligations inthisfield.Inparticular,theymustdeviseaworkablestructureformanaging international data transfers, especially in the context of outsourcing arrangements, and must increasingly be ready to handle potentialconflictsinrespondingtorequestsfromforeignregulatorsfor access to personal data. For the first time, this eventwill alsodeal with the data protection challenges that arise from use in the workplace of social networking sites and user-generated content.

While this event is designed for lawyers with some existing experience in data protection matters, an optional pre-conference briefing isincluded for those who wish to have a crash course or refresher on UK and EU data protection law. This event will also include a panel session in which you can put your questions to Richard Thomas and other speakers.

Chairman:ChristopherMillardisapartnerintheLondonofficeofLinklaters.Hehas25yearsexperience inthetechnologyandcommunications lawfieldsand has led many multi-jurisdictional privacy compliance and other legal risk management projects. As a Visiting Professorial Fellow of Queen Mary, University of London, he teaches on LLM courses in IT Law, Internet Law and Telecommunications Law. He is author of many articles and book chapters on data protection, IT and communications law, is a General Editor of the International Journal of Law and Information Technology (Oxford University Press) and is a founding editor of Data Protection Laws of the World.

Speakers:PeterChurch is a professional support lawyer in the TMT Group at Linklaters. His practice covers a wide range of commercial areas including regulatory data protection advice. He has advised on a number UK and multi-national data protection compliance projects and has spent time on secondment at Dixons Group Plc and at Vodafone Group Plc.

RichardCumbley is a partner in the TMT Group at Linklaters. His practice covers both contentious and non-contentious IT, data protection, e-commerce and media matters. As well as advice on outsourcings, IT services agreements and regulatory issues, he has particular experience in multi-national data protection compliance projects. His contentious practice includes IT and media disputes, including reported cases, before the UK courts as well as arbitration panels both in the UK and overseas. As well as writing many articles, he has contributed to the IT volume of Butterworth’s Encyclopaedia of Forms and Precedents and has also served as an assistant examiner on the IT Law course at Queen Mary & Westfield,UniversityofLondon.

Julian Cunningham-Day is a managing associate in the TMT Group at Linklaters. His practice covers a wide range of commercial areas including regulatory data protection advice, information risk management and technology contracts. He has advised on a number of UK and international data protection compliance projects and has spent time on secondment as European Technology Counsel to JPMorgan Chase.

DarrenIsaacsis counsel in the Employment Group at Linklaters. He specialises in all aspects of employment law, but has particular interests in discrimination, whistleblowing, contentious matters and the impact of data protection legislation on the employment relationship. Darren regularly advises clients on employee subject access requests and monitoring issues that arise within workplaces. He has also written numerous articles on employment law, is the author of monthly legal updates, and is a regular speaker at seminars.

Georgina Kon is an associate in the TMT Group at Linklaters. Georgina advises on IT, outsourcing and general commercial transactions, as well as data protection compliance and the Freedom of Information Act. She has advised on numerous UK and global data protection compliance matters.

RichardThomas took up appointment as the Information Commissioner on 30 November 2002. He has independent status, reporting directly to Parliament, with responsibility for enforcing the Freedom of Information Act 2000 and Data Protection Act 1998.

His previous career has included: • Director of Public Policy at Clifford Chance (the internationallawfirm);•DirectorofConsumerAffairsattheOfficeofFairTrading; •Headof Public Affairs and LegalOfficer at theNationalConsumerCouncil; • Solicitor with the Citizens Advice Bureau Service.

He has also previously held various public appointments, including membership of the Lord Chancellor’s Civil Justice Review Advisory Committee and the Board of the Financial Ombudsman Service.

Catrina Smith is a partner in the Employment Group at Linklaters. She specialises in all aspects of employment law, including corporate transactions, collective labour law, discrimination issues and the full spectrum of contentious and non-contentious work. She also advises on corporate governance issues and executive governance issues and executive appointments and terminations.
