Improving Access To Behavioral Health Information Technology Act

Key Features

• Amends Title XI (General Provisions) of the Social Security Act

• Specifies that the Center for Medicare and Medicaid Innovations may test models to provide incentive payments to behavioral health providers for:

• Adopting electronic health record technology

• Using that technology to improve the quality and coordination of care

Definition Of Behavioral Health Provider

• Psychiatric Hospital

• Community Mental Health Center

• Clinical Psychologist

• Clinical Social Worker

• Hospitals, treatment facilities, and mental health or substance use disorder providers that participate in a State plan under title XIX or a waiver of such plan

Proposed policies strengthen interoperability between EHRs to support sharing health care data with consumers and with other provider organizations.

New measures will be introduced, including:

– Query of the Prescription Drug Monitoring Programs (PDMP)

– Verify Opioid Treatment Agreement, related to e-prescribing of opioids (Schedule II controlled substances) that align with the overall agency initiative on the treatment of opioid and substance use disorders.

Proposed removing certain measures which do not emphasize interoperability and the electronic exchange of health information.

The first 3 months of 2018:

77 health care data breaches reported to the Department of Health and Human Services Office for Civil Rights

Affected more than 1 million consumers

– This is almost twice the number of consumers affected in Q4 of 2017

In 2017, cyberattacks targeted hospitals and health systems at a rate nearly exceeding 1 breach per day

Patient data breaches cost organizations $380 per violated record – more than 2.5 times the global average of $144 per record across industries
