A12 DISCIPLINARY CASE

At its meeting on 4 October 2016, the Kennel Club Disciplinary Sub-Committee considered the conviction of Ms AK Adams of Norwich, from the Great Yarmouth Magistrates Court for offences contrary to the Animal Welfare Act 2006.

The Committee imposed the following penalties:

1 To disqualify her from exhibiting at, taking part in, attending and/or having any connection with any event licensed by the Kennel Club. If any person disqualified under this sub-paragraph shall attend any canine event whilst disqualified the General Committee shall have the power to increase the period of disqualification [A11 j (4)]

2 To disqualify her from being or becoming a member of any canine club or society registered with or affiliated to the Kennel Club [A11 j (5)]

3 To disqualify her from acting as an Officer or serving on the committee of any canine society [A11 j (6)]

4 To disqualify her from taking part in the management of any event licensed by the Kennel Club. [A11 j (7)]

5 To disqualify her from judging at any event licensed by the Kennel Club [A11 j (8)]

6 To disqualify her from effecting registrations of any or all dogs and/or progeny of such dogs which are owned and/or registered by them (whether or not jointly owned and/or whether or not owned and/or registered in the name of a nominee). [A11 j (9)]

The above listed disqualifications are to be for Ten (10) years from 4 October 2016.

The Committee, following the imposition of these penalties, would draw the attention of the Respondent to the effect of Rule A11 sub-section n.

The Committee noted that a five year disqualification from owning/keeping dogs was imposed by the Magistrates Court. The Committee also noted that Ms Adams did not respond substantively to the referral under Rule A12 and no mitigation or contrition has been expressed.

2017 F REG UPDATES

REGULATION F(1).21.(Addition in Bold)

21. Judges and Judging.

a. Not more than three Judges shall be appointed to adjudicate for any award.

b. General Canine Society Championship and Open Shows - Affiliated Societies

and Breed Club Open Shows.

(1) For non Challenge Certificate breeds at Championship Shows and for General Canine Society Open Shows, Affiliated Organisations Open shows and Breed Club Open Shows scheduling more than three 1 breed classes for a particular breed (five 2 classes for Stud

Book Band E breeds), the selected Judge must, when appointed by the Club/Society, either:

(a) Have previously been approved to award Challenge Certificates to the relevant breed and not have been declared ineligible to do so by the time of carrying out the

appointment or

(b) Be included on a Breed Council/Club B judges list or above. In the latter case before accepting such an appointment, the selected Judge must ensure that their name is included on a relevant Breed Council/Club judges list. Except:-

(i) Judges resident in Northern Ireland. Persons who are approved to award Green Stars under Irish Kennel Club Rules and are resident in Northern Ireland are permitted to judge the above mentioned classes at Kennel Club licensed Championship and Open Shows held in Northern Ireland without being included on a Breed Council/Club judges list.

(ii) Overseas Judges. For non Challenge Certificate breeds at Championship Shows and for General Canine Society Open Shows, Affiliated Organisations Open Shows and Breed Club Open Shows the organising Club/Society must ensure that any overseas Judge appointed to judge more than three breed classes (five classes for Stud Book Band E breeds) has been approved to judge the breed concerned at Championship level in the country in which they are domiciled, or are on a Kennel Club registered Breed Club/Council B list or above for the breed concerned.

(2) General Canine Society Open Shows and Affiliated Organisation Open Shows only. Persons appointed to judge Best in Show, Best in Group, Best Puppy in Group and/or Variety Classes must have previously been approved to award and have awarded Challenge

Certificates to at least one breed, and be currently eligible to do so. Classes for varieties of a breed and handling classes are exempt from this Regulation

1. Non B List Judges are permitted to judge a puppy class in addition to the 3 classes currently permitted.

2. Non B List Judges are permitted to judge a puppy class in addition to the 5 classes currently permitted.

Before reinstatement Ms Adams would need to reapply and give satisfactory written reassurances and undertakings to the General Committee that she had appropriate resources in place to meet the welfare requirements* of the dogs then in her care and control should she intend to resume any of the activities as listed above.

*It is worth expressly stating the needs of an animal which must be met to the extent required by good practice under the Animal Welfare Act 2006 are

(a) its need for a suitable environment,

(b) its need for a suitable diet,

(c) its need to be able to exhibit normal behaviour patterns,

(d) any need it has to be housed with, or apart from, other animals, and

(e) its need to be protected from pain, suffering, injury and disease.

At its meeting on 4 October 2016, the Kennel Club Disciplinary Sub-Committee considered the conviction of Mrs M Mazan of Bradford, from the Bradford and Keighley Magistrates Court for offences contrary to the Animal Welfare Act 2006.

The Committee imposed the following penalties:

1 To disqualify her from exhibiting at, taking part in, attending and/or having any connection with any event licensed by the Kennel Club. If any person disqualified under this sub-paragraph shall attend any canine event whilst disqualified the General Committee shall have the power to increase the period of disqualification [A11 j (4)]

2 To disqualify her from being or becoming a member of any canine club or society registered with or affiliated to the Kennel Club [A11 j (5)]

Those Societies paying by direct debit are reminded that if any changes have been made to their bank details, a new direct debit form must be obtained and completed in order for Kennel Club records to be correct. RALLY & LISTED STATUS AGILITYThe fees for Rally & Listed Status Agility are both £60. Listed Agility also has an additional fee of 5p per dog over 1000 dogs (maximum £100).
