EMPLOYEE HOUSING PROGRAM Adopts and enforces statewide regulations for the construction, maintenance, use, and occupancy of privately owned and operated employee housing facilities providing housing for five or more employees to assure their health, safety, and general welfare.

HCD and local enforcement agencies oversee the application of state laws, regulations and code enforcement.

LOCAL ENFORCEMENT AGENCIES A City or County or City and County may assume the responsibility for the enforcement of the Employee Housing Act and the Regulations by way of a valid ordinance or resolution

If the Operator listed on your application is a company, rather than an individual person, the form is not required.

INSPECTIONS • All Employee Housing facilities must be

inspected and approved by HCD fieldinspectors and all fees shall be paid prior to occupancy.

• Inspections include, but are not limited to:• New Construction and existing facilities • Floor Area per employee (50 sq. ft.) • Sleeping Rooms • Kitchens / Community Kitchens / Mess Halls • Plumbing / Heating / Electrical • Agricultural land use designation (36 beds or 12

units) • The use of Mobile/Manufactured Homes

Inspection Process

Meet with field inspector and conductinspection

Once the application is approved, contactHCD Area Field Inspector and schedule an

inspection

Permit to Operate (PTO) is issued once noviolations are found.

If violations are found, correct violations, schedule a reinspection, and pay reinspection

fees (min. $178.00)

EMPLOYEE HOUSING FEES Permit To Operate Fees • $200 Issuance Fee • $27 / Employee/Lot • $13 Applicant Verification Fee

Reinspection Fee • $178 / first hour • $82 / second and subsequent whole hours • $41 / each 30 minutes or fraction thereof

Amended Permit Fees • $20 Issuance Fee • $27 / Additional Employee

TIMEFRAMES • PTO applications (non-H-2A) are submitted

at least 45 days prior to the date of initial occupancy.

•

• PTO applications linked with H-2A facilitieswill be inspected ASAP, typically within 30days.

• Field inspectors manage their ownschedules. Scheduling and inspectiontimeframes depend on the inspector’sworkload and availability.

• Once the facility is clear of any violationsand all fees are paid (reinspections oradditional employees not on originalapplication), HCD will issue the EH PTO.

COMPLAINTS

COMPLAINTS The Department conducts complaintinvestigations under its Employee HousingAct enforcement activities for allegedviolation of the Act. Violations of the Act may include, but not limited to: • Lack of heat (70 degrees) • Unsafe structural, elec., mech., plumb. • Lack of exiting • Pest infestation • Unsanitary conditions • Unsafe drinking water • Lack of cooking facilities; i.e., community

kitchens, mess halls (local health dept.) Facilities shall be maintained in safe conditions during occupancy.
