The mine identification signs are all located at a point of public access into the various segments of the permit area. The signs are consistent with each other and were found to be in compliance with the Coal Rules.

Diversions through out the mine site were found to be functional.

The explosive magazine storage area was observed as part of the partial inspection. The magazines were found to have proper signs and placement of signs as well as being grounded.

5. Explosives

The mine site was found to be compliant with regard to noncoal waste. The site was free of noncoal waste items and the storage area for noncoal waste was being used as designed.

The lower reach of the diversion that is adjacent to the access road to the lamp house is building with sediment and needs maintenance.

Observed scattered noncoal waste through out the mine site. The noncoal waste is more concentrated around the trash bins and the lower pad or load out area. In addition there is a lot of belting spread out in this area and scrap metal. This area needs to be cleaned and materials consolidated and/or removed. The mine site remains idle at present date. This issue needs to be addressed to avoid enforcement action on future inspections.

The mine identification is mounted on a power pole adjacent to the Savage fuel station. The sign is at the entrance into the mine permit area and contained the required information.

2. Signs and Markers

A smoker (refuse fire) was observed at the base of Excess Spoil Pile #1 and the contact point of the Reuse Pile that has been mined out in this area. The area where the smoker is located is not at the full extent of the boundary of Excess Spoil Pile #1. Earthen material (dirt has been hauled or is being hauled to this location. The plan is to terrace this area to a point to allow a two foot earthen cap to be placed over the area to extinguish the smoker. At this point the Excess Spoil Pile #1 can be extended to its full capacity. The area to be covered is large and make take several weeks to cover with the earthen cap.

There was no signs of wind or water erosion to the topsoil piles.

3. Topsoil

Diversions were recently cleaned. There was some water flow from wash down of equipment and dust suppression.

The mine sediment pond did contain water but was not discharging during the inspection. No hazardous conditions were noticed during the inspection. The refuse sediment had no water. No hazardous conditions were noticed.

The refuse pile was inspected. No hazardous conditions were noticed. The refuse pile is not schedule to be used until next year.

Diversions on the east, south and west sides of the permit boundarl were observed as having been reeshly redefined and they appeared capable of functioning as designed.

4.a Hydrologic Balance: Diversions

Both the east and west sediment ponds contained water, although the elevation of each water volume was well below the discharge elevation of the open channel spillway associated with each pond. The west pond contains sunflowers in the pond bottom. There were no compliance issues identified with either of the ponds. Mr. Edwards said that it was his intent to more the annual pond certification / inspections to the 2nd quarter or possibly the third. The purpose is to give the Permittee time during the warm season to repair any problems identified by Mr. Richard B. White, P.E. during his annual inspection of the two impoundments.

4.b Hydrologic Balance: Sediment Ponds and Impoundments

No wildlife was observed within the permit area or in the airspace above it.

9. Protection of Fish, Wildlife and Related Environmental Issues

The Permittee provided the Division with an Acord general liability insurance renewal form on this day. The coverage period is !0/1/2012 through 10/1/2013. Coverage amounts for each occurrence and general aggregate are $ 2,000,000 and $ 4,000,000.respectively. Two insurers provide coverage, Lexington Insurance Company and Liberty Mutual Fire Insurance Company. Liberty Mutual has an A.M. Best rating of "A+" as of December 31, 2012.

Peter Behling recently was transferred to one of Consol Eastern Operations.

The Division received a telephone call the morning of October 11, 2012 @ 8:35 AM from Mr. Jon Sundstrom of the Town of Emery, Emery County, Utah. Mr. Sundstrom had developed a concern about holes and cracks in the ground surface of the Qaurter Section of land which he owns SSE of the Town. Later investigation revealed that the land is the SE1/4 of Section 15, T 22 S, R 06 E, SLBM.The Divison met Mr. Sundstrom at the Rest Area adjacent to Highway 10 in the Town of Emery at approximately 10:30 AM, briefly discussed the concern and then drove to the site to evaluate same. The southern property line of the SE 1/4of Section 15 is about .62 miles north of the 4th East portal / truck loading area.Mr. Sundstrom and his son, Pat Sundstrom represented themselves as the surface owners during today's inspection.The permitted areas of the Emery Deep Mine (areas disturbed for surface facilities) were not inspected this day.

The first observation made this day was of the point of diversion on the SE corner of the Emery Town limits where ditch water is diverted into two flow volumes by a wooden flow divider. The flow, which was small, runs South on the west boundary of Section 10, and then is split again at the SW corner of Section 10. A drainage is depicted of each side of the Section demarcation (secondary road) indicating two separate flow paths. The single road splits in the SW corner of Section 10 and crosses NW quarter of Section 15 to access the sundstrom property (SE1/4 Section 15). // Mr. Sundstrom explianed the following. A land surveyor from CONSOL had performed some surveying on his land about six years ago, and he thought that this was preliminary to laying out mine development entries for the Emery Deep Mine. The topographic map made by the U S Geological Survey depicts a secondary road across the Sundstrom property starting in the NW1/4 SE1/4 and terminating in the middle of the southern Section Boundary. Two drainages (one on either side of the road) are roughly paralleling this secondary road. // As observed by the Divison on October 11, 2012, multiple holes and cracks were observed adjacent to and south of the stock watering pond which is depicted on this same topo map. Mr. Sundstrom indicated that he had cut a ditch with his tractor around the stock pond to determine if his received water right volume would find other access points to the subsurface of his land. Damp areas were seen around several holes in the area. The Division examined PLATE IV-2, UG Operations Plan, as contained in the Emery Deep Mine MRP. Mr. Steve Behling, of CONSOL Energy was also contacted on October 15, 2012 to obtain a partial map of the underground workings at this Mine,which is required to be completed for the Assistant Secretary of Labor, in accordance with the requirements of 30 CFR 75.1204. A review of that partial map, and PLATE IV-2 indicates that the area in question on the Sundstrom property is 1.32 miles north of the Second Right panel which saw primary mining in 2010. Some secondary mining was also practised in 2010 in panel 00 North. The Mine was placed into temporary cessation on February 2, 2010. No mining occurred in 2011. // The Sundstrom land is well outside of the delineated Adjacent Area for Non-water Resources line shown on PLATE IV-2. The surface openings and cracks observed in Section 15 on the Sundstrom land are over two delineated flow paths, which were probably re-graded at some point in time covering over the flow paths. The holes may be caused by burrowing animals in that area, and then accentuated by water flowing into them. In either case, surface flows crossing the same area have found these voids, and percolated into the ground through them. It is not possible that the underground mining caused these openings to develop. The surface flows have dropped into the soils, and more than likely percolate down to the original drainage elevation shown on the topo map. The affects would also be outside of the angle of dewatering in this area using a maximum angle of 72 degrees for shallow cover areas.

Trail signs were installed by Kyle Beagley along the realigned East Mountain trail.

2. Signs and Markers

Vegetation was well established on access roads and pad sites. Vegetation consisted mostly of grasses, but some forbs were present. Woody species were not included in the seedmix and very few volunteers were present on the reclaimed area. Very little weedy or undesireable species were present on the reclaimed site. One or two thistle plants were identified near the failure area. Phase I bond release does not have a requirement for vegetation to meet success standards. The vegetation on the reclaimed areas appears to be doing well and should meet requirements for phase II bond release. The permittee will have to explain why woody species were not included in the seed mix and how these areas will meet the land use needs.

Some slope movement was noted and documented on the upper portion of the Hilfiker retaining wall above the sediment pond. The upper portion of this Hilfiker Wall has come to a vertical position. When the wall was originally installed it was laid back on a slope toward the road. This region does not pose an immediate treat or concern, but needs to be monitored in the future to ensure that the wall does not start to slope inward toward the pond, thereby becoming a stability issue for the roadway as well as one of the banks of the pond. Pictures were taken of this area and are attached.

Mine identification signs are present at all points of access into the permit area from public roads. The signs are clearly posted and contain all of the information set forth in the R645 Coal Rules for Utah.

2. Signs and Markers

The subsoil pile adjacent to the topsoil pile located at the beginning of the haul road has been re-graded and re-seeded. A pictures of this pile was taken and is attached.

3. Topsoil

The Robinson Creek By-Pass diversion has had additional rip-rap added in the areas that were identified as being some what lean or lacking. The entire by-pass channel is now armored. Pictures of these areas were taken and are attached with proper labels to identify the different reaches.

4.a Hydrologic Balance: Diversions

Sediment ponds 1, 1B, 2 and 3 all contained water from a recent storm event from the prior week. Pictures of a;; of the ponds were taken as part of this partial inspection and are attached as part of this report.

Seven acres on the toe slope of the west end of the Excess Spoils pile had been drill seeded with a mycorhizae amendment. Straw and Nutri-Mulch, a turkey manure based soil amendment(1%N:1%P:1%K), were being spread over the drilled surface and will be crimped in. Sagebrush and winterfat seeds were included in the drill seeding, but will alsobe broadcast over the surface. The reclamation work is being done by Kevin Heaton. Seed mix, mychorrhizal tag and nutrimulch information are attached to this report. Refer to Topsoil Handling Dwg 2-2 for topsoil stockpile locations.

I also observed and photographed the 8 reclaimed drill sites on fee coal north of the permit area. These sites were drilled and seeded in July 2012 (Task 4099).

Approximately 7,528 cu yds of topsoil from topsoil stockpile #3 was placed approximately 8 inches deep on top of the 3 ft subsoil cover over the 7 acre area. Plans are to utilize the remaining 23,000 cu yds of topsoil in stockpile #3 before this winter. This stockpile is not long term, but will be reshaped and seeded if it is not utilized in 2012, so as to provide erosion protection, per plan Section 231.100. This situation was not anticipated by the MRP, so As I discussed with Mr. Nicholes, I think it is appropriate to seed a single species at the end of 2012 to achieve a quick, effective, short-term cover on what remains of Topsoil pile #3.

3. Topsoil

Ditch 4 is in place on the north side of the Excess Spoil pile. The slope below the ditch has been covered with topsoil, but has not been seeded yet. Water emanating from the alluvium is entering pit #7 at an approx. rate of 15 gpm. This water is being pumped from the pit and is used for dust control.

4.a Hydrologic Balance: Diversions

Pit 6 coal is exposed and ready for drilling and setting small (less than 0.5 lb) charges to lift the coal and make it easier to load.

5. Explosives

Pits 6 and 7 are open and in various stages of development. The length of the pit wall where coal has been exposed is approximately 1,300 ft. long. Overburden from pit 6 is being hauled to the Excess Spoil pile.

6. Disposal of Excess Spoil, Fills, Benches

The respread topsoil was sampled and analyzed. Analytical results are attached. A low nutrient formulation of Nutri-mulch (composted Turkey manure from Manti) is being spread at a rate of 1 ton per acre along with 1 T/ac straw on the surface of the drill seeded area. This will be crimped into the surface to a depth of approximately 4 inches..

12. Backfilling And Grading

Mycorhizae, the seed mix and supplemental forb mix were drilled using a rangeland drill seeder. Mycorhizae, mix, and forb supplement are attached). Broadcast seeding of Mountain big sage and winterfat will follow the crimping.

13. Revegetation

A haul road will be constructed across ditch DD 4 to provide access to sediment pond #3 when the current access is overtaken by the excess spoil pile.

I photographed all 8 exploration holes on fee lands to the north. These holes were drilled and reclaimed in July 2012, see Task 4099 for further information. Holes were marked and identified. In most locations, the disturbance was extremely small (5 ft. x 5 ft.). In a couple locations the disturbance was a bit larger 15 ft. x 15 ft. Where cows have been excluded, the reseeded grass is emerging. Where cows have access, the disturbed soil is preferred by the animals for resting and vegetation can not take hold. These areas may be reseeded when the animals are removed.

Had some opening discussion on the status of amendments. The company had finalized responses to two outstanding amendments: South Fork of Quitchupah undermining of the perennial stream and the Northwater Springs mitigation project. Both amendments were received by the Division during the week of October 15, 2012.

1. Permits, Change, Transfer, Renewal, Sale

Topsoil salvage piles were observed at the waste rock site. The piles were observed with silt fence encircling them for sediment control. Additional drainage ditches leading to an alternate sediment control (ASCA) were constructed leading from topsoil piles that were not necessary. Inspector Helfrich indicated that the silt fencing alone is adequate sediment control.

3. Topsoil

An undisturbed drainage culvert is located beneath the subsoil pile designed to convey undisturbed runoff from the hillslopes northeast of the wasterock site. The culvert daylights on the east side of the subsoil pile where it was found to be comingling with disturbed drainage from the outslopes of the subsoil pile. The Permittee was asked to better isolate the undisturbed drainage culvert with additional sediment controls for the outslopes of the subsoil pile. Robust silt fencing was installed at an inlet culvert for the undisturbed drainage, which again is routed under the subsoil pile. Despite the silt fencing, a considerable amount of sediment was noted at the outfall of the undisturbed culvert discharge located on the south side of the subsoil pile. The berm surrounding the active waste rock cell was also evaluated. The berm was in stable condition, however it was noted that portions of the berm were constructed of waste rock and not dirt. The Permittee was asked to make the correction and replace the waste rock with dirt for their berm areas. The drainage control adjustments recommended by the Division should minimize the amount of sediment discharging off the permit area. If not, a review of the engineering design of sediment controls in this area for the company to evaluate is recommended. A follow up inspection of the area to address these concerns is recommended.

4.a Hydrologic Balance: Diversions

The Permittee indicated that they have performed some weed removal at the waste rock site. Kosher and Thistle weeds have been removed from the site.
