QUESTION ANALYSISQuestion 37 - 39: This set of question consists of 5 principles and a long set of facts followed by three questions. The Principles are based on certain topics from Consumer Laws. This question is slightly different from the others as it a multiple principle based question on the topic of consumer laws, unusual than the ones usually on constitution, torts or contracts. So, one should definitely attempt this question for experience purpose. The questions that follow are also not very difficult.
W.r.t question 37, Satish will not qualify as a consumer because he was sourcing Potassium for commercial purposes and going by Principle 2, any person who buys any goods for commercial purposes will not come under the purview of consumer. Hence, option (a) would be the correct answer.
W.r.t question 38, Indo-Potassium will be liable for commission of restrictive trade practices because the price of Potassium and even the supply trend was affected because of the division of market areas. Hence. Option (a) would be the correct answer.
W.r.t question 39, Option (b) would be the most appropriate of the options because option (a) and (c) are stating about deficiency of service but the facts did not have any service in picture.
QUESTION ANALYSISQuestion 49 - 50: question 49 and 50 are based on the same set of facts which are reasonably long. However, the Principle for the same is pretty simple and easy to understand in a single reading.
In Question 49, we need to figure whether The Institute of Constitutional and Parliamentary Studies will qualify to be State under Article 12. Going by the facts provided, it can be easily discerned that the institute is functionally as well as financially controlled by the Government and as the principle clearly states that a body will be considered to be State under Article 12 if it is functionally and financially controlled by the Government. Hence, Option (c) will be the correct answer.
W.r.t. question 50, in the same facts situtation, if the Institute is not State within the meaning of Article 12, then Mudit will not be able to file a writ petition against the same because a writ petition can be filed only against thew the bodies which qualify to be State within Article 12. Hence, option (b) will be the correct answer.
