18-Paying Authority: PAO,User Deptt

(a)The payment to the suppliers in all the adhoc Contract (A/Ts) and / or Supply Order placed against DGS&D Rate Contracts shall be made directly by indentors i.e. order placing authotity through their concerned Pay & Accounts Offices only,instead of CCA(Supply) or its Regional Pay & Accounts Offices of Department of Commerce.(b)The payment to the supplier shall be paid by the indentors asper prescribed forms of payments including timelines for payments within 60 days of due date which must be ensured by the indentors.Delays,if any, in this regard would render the indentors responsible and not the DGS&D in any manner whatsoever.(c)Consequently,the requisite Departmental charges + prevailing Service Tax thereon shall be deposited by the respective Pay & Account offices (PAO) of the indentors directly to the Receipt Head Account of DGS&D as prescribed by CGA.(d)Indentors shall be directly responsible for any non-compliance/default for the afore-said provisions.

24- Departmental Charges : Departmental charges at the rates prescribed by government from time to time shall be levied,for the services rendered by the Directorate General of Supplies and Disposal,in regard to Purchase & Inspection. The rates currently applicable for departmental charges in regard to purchase and inspection of stores against DGS&D R/C.24(a) For Purchase : - Departmental Charges will be levied @1.0% of the value of the contract or supply order placed against the DGS&D rate contract.24(b) For Inspection :- Departmental Charges will be levied @1.0% of the value of the contract or supply order placed against the DGS&D rate contract.24(c). The value of the Contract or Supply Order shall be all inclusive basis including all taxes & duties. Service tax at prevailing rate as applicable shall be chargeable as extra on the Departmental Charges.24(d) Such direct/referral Supply Orders being placed by various Government users on Rate Contract holding firms or their dealers/sub agents,obtaining supplies and making direct payments to the firms for the cost of stores prescribed in theRate Contracts are liable to pay a nominal fee as Departmental Charges @0.25% of the value of Supply Order (all inclusive including taxes & duties ) + Service Tax extra as applicable. After receipt of Supply Order,the firm will deposit the said Departmental charges + service tax thereon at the rates provided in the R/C to the concerned Controller of Accounts (CCA) viz. Delhi/Mumbai/Kolkata/Chennai, as the case may be ,as indicated in the R/C by way of Demand Draft/Bank Transfer. In case , the supplies are made in installments, the aforesaid Departmental charges + Service Tax can be paid by the firm with CCA on pro-rata basis based on the value of the supplies made. In case no supplies are made,Departmental charges would not be payable / claimable as no service would deem to have been rendered by DGS&D. The firms can claim Departmental charges from PAO of the indentor for the direct/referral orders placed by them.Those who err/conceal/misrepresent/default in payment of prescribed Department Charges would be viewed adversely and shall be liable for actions as deemed fit by DGS&D including de-registration,debarring or suspension of business dealings,blacklisting , bad performance and denial of further Rate Contracts etc, in addition to recovery of the requisite amounts.IT would be the responsibility of the user department to ensure that the prescribed departmental charges have been paid by the supplier before releasing their payments for the supplies. The firm would also disclose the same to DGS&D.24(e) The Referral /Direct Orders placed by the indentor by tweaking DGS&D Rate Contract terms & condition and/or Specifications and obtaining the supplies within 1% of the DGS&D Rate Contract prices, such transactions will fall within the purview of DGS&D Rate Contract and will also attract the aforesaid Departmental Charges @0.25% of the value of stores ordered and supplied alongwith applicable Service Tax thereon.24(f) In the event of placing such Referral/Direct Supply Orders, indentors shall send e-mail to DGS&D for which a special provision would be provided on DGS&D website. While the indentors placing on-line Supply Order on DGS&D e-procurement portal shall have the protection under the terms & conditions of DGS&D Rate Contract, the same would not be available in case they choose to place paper Supply Order and such transactions would be at their own risk.

25.DGS&D reserves the right for pre-dispatch inspection at manufacturer"s premises or consignee end inspection after reciept of stores or at both places,at the option of indentors.

26.Jurisdiction/Arbitration Clausea)Jurisdiction will be the place of issue of the rate contract.Sole Arbitator will be appointed by DG(S&D).For details refer Clause-23 of DGS&D-1001.Further,where the Contract/Rate Contract is governed by DGS&D arbitration clause,thedispute cannot be referred by the supplier or entertained by Facilitation Council or any other Adjudicating Forum.b)The arbitary as appointed under provisions of para 18.1.1 of DGS&D Mannual shall adjudicate only on the disputes arising out of interpretation of terms & conditions stipulated in Rate Contracts.For settlement of disputes relating to execution of supply orders placed by various Direct Demanding officers (DD0s)/Indentors against DGS&D Rate Contracts, each DDO/INDENTOR shall himself nominate an arbitrator at the time of placement of supply orders,as per guidelines/instructions for appointment of arbitator in indenting organisation.c)DGS&D or its regional offices shall not be made a party in any dispute relating to execution of Supply Order placed by DDO/Indentor against DGS&D Rate Contracts including the case filed in MSME Facilitation Councils.

23-Packing & Specification :

Supply order(s) in any other form placed on or after 01-10-2008 shall not be valid and shall not be acted upon by the contractor or any other concerned agencies. DDO shall download the supply order and send an ink signed copy to the concerned paying authority specified in the rate contract through Registered / speed post immediately after on-line placement of Supply Order(s).

1) Terms of DeliveryA) FOR Station of despatch( with provision for free delivery within municipal limit or 50 Kms from factory/works whichever is more) duly packed. B) Above 50 KM freight charges will be reimbursed extra. This will be quoted in per unit per KM basic indicated under item no. 121of this R/C. C) The supplier will be responsible till the entire stores contracted for arrive in good condition at destination. The Stores shall remain in every respect at the risk of thecontractor until their actual delivery to the consignee at the stipulated place or destination. The transit risk in this respect shall be covered by the Contractor. The property in goods shall pass from seller to purchaser only after receiptof stores by consignee and interpretation of FOR Despatch shall stand amended accordingly.2. Minimum Order Value : Rs.100000/(Assorted Sizes).(Itemwise Min order quantity shall be 0 only.3. PRICE VARIATION CLAUSE:-A) Price of finished product quoted should be based on the average basis price of four metros viz. NEW DELHI, KOLKATA, CHENNAI & MUMBAI FOR HDPE grade mentioned below:-a) HDPE Grade [email protected] Per M.T. for PE 80 as on 15.01.2015.b) HDPE Grade [email protected] Per M.T. for PE 63 as on 15.01.2015.B) Price to be taken into accountfor working the escalation/de-escalation will be the average basis price of New Delhi, Kolkata, Chennai & Mumbai price as declared on the website of M/s. GAIL(India)Limited, New Delhi. Only one price variation shall be allowed in 3 months.C) The price taken for the purpose of working of adjustment will consist of basic price only as indicated above prevaioling on the date of 30 days prior to the date on which the said lot was offered for inspection as indicated in theInspection Notes. All relevant documents shall be submitted by the firm in this connection for verification of their claim.D) For every rise or fall of average basis price by Rs.1500/-per M.T. or more during 3 months period in the basic price of HDPE Grade the amount of adjustment in price per MT of Pipes will arise. No adjustment in contract price will be made if the average price variation up or down the aforesaid basic rate of materials is less than Rs. 1500/- per M.T. during 3 month period.E) The price variation may be allowed on the basis of 1:0:95 i.e. for an increase of Rs.1 per Kg. In the price of Raw Material, increase of Rs. 0.95 per Kg. of HDPE Pipe shall be allowed.

4. Payment Terms: The payment terms against DGS&D Contracts/Rate Contracts for all items will be as under :-

(a)Green Channel Firms90% against provisional receipt of stores by consignee, after delivery of stores byGreen Channel firms on self certification with OEM warranty/Guarantee certificate andbalance 10% on acceptance of stores by consignee within 60 days of receipt of stores.(b)For Jute/HDPE/PP Bags Firms 90% + 10% payment to jute/HDPE/PP bags firms with 90% against proof of inspection & dispatch and balance 10% on acceptance of stores by consignee within 60 days of receipt of stores.

Note:

(1)In cases of dispatches by road, the provisional receipt certificate by consigneeshall also be required for initial 90% payment.

(2)In case of HDPE/PP bags, proof of inspection would be the I-Note to be issued

TEST REPORTS FOR REGISTRATION AND ACCEPTANCE OF GOODS:In case of products having satisfactory test reports from International Laboratory Accreditation Cooperation (ILAC) or their worldwide affiliated/recognized labs or NABL approved labs, it would be sufficient to consider the products of requisite quality for acceptance without insistence for any further testing pursuant to DGS&D Manual Correction Slip No. 38 dated 18-12-2012.


after receipt of satisfactory test reports from laboratories and not the Dispatch Advices which are issued for permitting the delivery of stores to the consignee after pre-dispatch inspection at firm's premises and not for payment.

(c)Others Firms80% against inspection of stores(wherever applicable) and provisional receipt ofstores by consignee, and balance 20% on acceptance of stores by consignee within 60days of receipt of stores.

Note: Provisional Receipt of stores by consignee are to be given on copy no. 1 of theI-Note for initial payment of 90% or 80% as the case may be, followed by acceptanceof stores certificate to be given by consignees on copy no. 2 & 5 of I-Notes forbalance 10% or 20% payments as the case may be.

(d) For Safety/Difficult/Complaint Prone Items for all firms shall be as under:

100% payment against complete acceptance of the material by the consignee after dueverification of quality and quantity. This process of verification shall be completed within a period of 60 days of the receipt of the consignment, failing which payment shall be released.

List of Parallel Rate Contract For HDPE PIPES FOR WATER SUPPLY


1. The item shall be supplied in length of 6 meters. Short length of 3 meter (Min)up to Max of 10% of total supply shall be acceptable as per relevant specification clause No. 6.4 .The pipes from 32mm to 50mm Dia up to PN 6.0 rating should be supplied in coil of having drum diameter of 25 times the nominal diameter of the pipe as per relevant specification clause 6.5 of ISS supplied in a coil of 50 meters length if specified in the supply order.

2. The supplier shall submit valid Type Test Report from NABL accredited laboratoryto the concerned DQA at the time of first inspection for any one size of pipe within each of the following group ranges separately for each combination of PN rating & applicable raw-material grades as per clause 5.2 of ISS. For the purpose of submission of Type Test Report, grouping of HDPE pipes shall be as under:- Size- 20 mm to 110 mm, Size-125 mm to 180 mm, Size-200 mm to 315 mm.

3. The validity of type test certificate is two years as per Cl.9.1 of IS: 4984/1995 with Amdt. 1 to 6(Reaffirmed 2012). The supplier shall ensure to have their type approval revalidated timely during the currency of the R/C till suppliesare completed.

4. The Supplier shall submit manufacturer,s test certificate for the raw materialused for each lot of HDPE Pipes duly supported by purchase decuments/invoices etc. at the time of of inspection .They shall also furnish certificate regarding compliance to requirements given in clause 5.1 of ISS.The supplier shall use virgin raw material only.

5. The firm shall submit valid BIS license along with their offer as per IS: 4984/1995 with Amdt. 1 to 6(Reaffirmed 2012).

6. The pipes/coils shall be marked with indelible ink/paint on line at every meter with:-a) Manufacturer's name/Trade Markb) Description of storesc) Lot No./Batch No.d) Month/Year of manufacture.

7.Pre-despatch inspection of stores against the R/C shall be reported as per Inspection Report Performa No.DQA/GE/RC-66 (Revision- 2).
