SUBJECT: Revised Submission of Performance Bond in Compliance with Decision 13-05-035
PURPOSE
Pursuant to Ordering Paragraph (OP) 8 of Decision (D.)13-05-035, this advice letter provides Southern California Edison Company’s (SCE) submission of a $25,000 performance bond which is included as Attachment A.
BACKGROUND
In D.98-12-083, the California Public Utilities Commission (Commission or CPUC) granted a certificate of public convenience and necessity (CPCN) to SCE to operate as a competitive local exchange carrier (CLEC) in the State of California. SCE performs this function through Edison Carrier Solutions, a business unit of SCE.
Pursuant to OP 8 of D.13-05-035, the Commission required that telephone corporations that hold a CPCN, such as SCE, submit annually a Tier-1 advice letter to the Director of the Communications Division containing a copy of a performance bond of $25,000 no later than March 31. The Commission’s requirement was in response to a State Controller’s Audit Report, which found that the Commission had failed to collect surcharges, fines, and restitution from California utilities operating as telephone corporations under the CPUC’s jurisdiction. The Commission required that the performance bond be continuous (i.e., there is no termination date on the bond) and issued by a corporate surety company authorized to transact surety business in California. The Commission must also be listed as the obligee on the bond.
This advice letter serves as SCE’s compliance with OP 8. SCE’s Performance Bond was issued by Fidelity and Deposit Company of Maryland and meets the requirements set forth in the ordering paragraph.
