    21 st. Healso announced that September isshaping up to be a very busy month in thedistricts. The International Cannabis and HempExpowill take place on September 4th , theRemember Themsculpture unveiling will takeplace on September 6 th , Project Bandaloop willbe holding their annual event on the Great Wallon September 15 th , 16 th and 17th , and The"Moneyball"premiere will be held on September19that TheParamount Theatre with a gala eventat the Foxto follow.Neeta PuthanveetiJ informed the group of KarenEngel's interest in coming to the next boardmeeting to discusscombined marketing efforts.Karen isthe Executive Director of the EastBayEconomic Development Alliance and has a lot ofexperience to bring to the table. It wassuggested that Karen be invited to the next DISImeeting to interface with TimGallen.Marco suggested that we consider inviting thecandidates for Nancy Nadel's district to a futureboard meeting.

    Report from Captain Tull Captain Tullwas unable to attend this meeting. It No action taken.was suggested that he be invited to the Octobermeeting.

    Designation of Organization Marco referred to pages 11-12 and explained the JC moved andCommittee as Nominations nominations process to the board. He asked the Chris secondedCommittee board to designate the Organization Committee the motion to

    as the Nominations Committee. designate theMarco referred to the bylaws on page 16-17 of Organizationthe agenda packet Committee as the

    status of Oakland Shines Elizabeth Clark explained that the latest version of No action taken.Agreement the Quest contact proposes that the boardcontracts with a subcontractor of Quest namedStan Williams. The contract issuggestingremuneration in the amount of $40K to hold anevent, but does not discuss timing and what wewould have to do to receive the $40K.It was clarified by staff that the requirement ofthe first event isto sign up 1,000,000square feet ofoffice space within the districts to be audited byQuest. Elizabeth recommended that staffprepare a list of committed property ownerswithin the district to include as exhibits to the

    contract.Elizabeth expressed concerns over Phoenix andtheir inaction and advised having the check inhand prior to holding the event.Number of applications Marco explained that the deadline for No action taken.returned for Executive applications to be submitted for the ExecutiveDirector's position, 7 Director position was July 29th, and, as of thatapplications, 2 finalists date only seven applications had been received.The Joint Organization Committee met on August10th to review the submissions and selected the

    7two finalists. The finalistswill be interviewed onSeptember 9th by the Joint OrganizationCommittee and then a meeting of the JointBoard will be called to discuss. A decision will beannounced at the October board meetings.

    Status of Grant Task Force, Marco explained that he, Steve and Andrew met No action taken.Urban Ecology and back of with BARTdirector Robert Raburn to discussBARTproject forward progresswith the planters on the back of

    BARTentrances.Andrew explained that Mr. Raburnwas fullysupportive of the idea, but needed to obtain staffapproval. Hisonly concern was in regards towater from the planters getting on the escalatorsand causing damage. Andrew explained thatthe drainage on the planter boxes will bedesigned to drain away from the escalators.The contractor isin place and ready to proceedonce a letter of authorization from BARTsreceived.Elizabeth asked to receive any agreements fromBARTso that she can review before proceeding.Andrew explained that the city has authorizedhim to proceed with the installation of hangingplants on Broadway as the initial permit allows forhanging plants(please see page 22 of theagenda packet). Andrew hopes to begin the firstround of installation thisyear and will finish upnext year when we have the budget to do so.

    Gallen Neilly Report TimGallen referred to pages 23-30of the agenda No action faken.packet and reviewed the mid-year activityreport.Timexplained that the "Moneyball" premiere atthe Paramount, beautification projects, thesuccess of InOak and pop-up galleries, like theBetty Ono Group, are storiesthey are pitching tothe media.He discussed talking to the media about thesuccessful public-private partnership happeningin the districts and how it should be emulated byother cities. Oakland isahead of the curve andeventually the story will be about how Oaklandmade it happen in bad economic timesNext Meeting Annual Meetinq to be held on October 5th, 2011.

These services have been fundedby the assessments generated by the Downtown Oakland Community Benefit District, whichwas overwhelmingly approved by property owners in July 2008.The Downtown Oakland Association is the non-profit public benefit corporation and DistrictManagement Corporation which is under contract with the City of Oakland to disburse therevenues of the CBD on behalf of the property owners in the district. The Association has beenoperating since the Fall of 2008 with a volunteer Board of Directors and officers.The annual Board of Directors nominations process is an open process and all interestedproperty owners are encouraged to participate.Please keep in mind that in nominating yourself to the Board, this is a working Board ofDirectors. Volunteer Board members are expected to:

    September 26,2011Thank you for your interest in applying to the City of Oakland's Pilot Program for Parklets!A Parklet isthe temporary use of space in the dedicated public right-of-way (parking spaces,unused bus stops, and other types of vehicular and non-vehicular zones) for public uses such asseating or bicycle racks. Parklets will be publicly accessible space for the enjoyment and use ofall Oakland citizens, and are privately constructed and maintained. It is envisioned that theParklets will be located in areas with pedestrian activity, as additional seating areas for retailpatrons, and in areas where there is a desire to create a more pedestrian-friendly environment.Parklets are intended to be seen as pieces of street furniture, providing aestheticenhancements to the overall streetscape. In place of car parking, a platform is built to extendthe grade of the sidewalk into the street. Once the platform is installed, benches, tables, chairs,landscaping, and bike parking can all be placed on top in order to create a Parklet. Parkletsmust remain publicly accessible and will require signage to this effect. Table service is notpermitted. Commercial signage and advertising are not permitted.Eligible Applicants to the Parklet program may be Business Improvement Districts, storefrontbusiness owners, non-profits, and community-based organizations. As much as possible, theselected Parklets will be distributed throughout the City.Parklets must be located away from a corner and cannot be along a street with a speed limit ofmore than 25 mph. They may be allowed in white and green zones if the entity that originallyrequested the white or green zone agrees to repurpose that curb area. Parklets are notpermitted to be placed in front of a hydrant or in a way that restricts accessto any private orpublic utility. Parklets shall not be placed in front of or adjacent to a multi-space parking meter(Kiosk) and a minimum clearance of six (6) feet shall be maintained around all Kiosks.

    ResponsibilitiesThe Permit Holder for each Parklet will be required to:

    1) Carry Insurance. Provide evidence of at least $1 million in general liability insurancenaming the City of Oakland asadditional insured.2) Sign a Maintenance Agreement. Sign a Maintenance Agreement with the City of

    Oakland that will require the Permit Holder to do the following:a. Keep all plants in good healthh. Keep the Parklet free of debris and grimec. Adequately maintain the surface.d. Twice a month, or more often if needed, sweep out debris from under the

    Parklet.e. Once a year before the rainy season, move the Parklet to allow street sweepers

    underneath. The Watershed and Stormwater program coordinator can providemore information to selected Permit Holders at [email protected].

    A refundable security deposit may be required as part of the Maintenance Agreement.Unsecured furniture is not permitted after business hours if the Permit Holder is abusiness. If the Permit Holder is not a business, the hours for unsecured furniture willneed to be included in the Maintenance Agreement.

    Design ParametersParklets are intended to be aesthetic improvements to the streetscape, and materials will berequired to be of high quality, durable, and attractive. The width ofthe Parklet must notextend beyond six feet from the curb line. Safe hit posts and wheel stops, or approved equals,are required. A visible edge is to the Parklet is required, Which may consist of planters, railing,or cabling. The edges should be visually permeable or "see-through." Accesspanels must beincluded in order to maintain the gutter and area underneath the Parkletand the design mustallow for drainage along the gutter to pass underneath the Parklet. Pleasesee attachedHandout for additional design information.If bike parking is provided, the bike racks can be at street grade.

    Parklets must be accessible to individuals with disabilities per the Americans with DisabiHtiesAct Accessibility Guidelines (ADAAG). People who use wheelchairs must be able to enter theParklet and access all the primary features of the Parklet. Parklets shall not reduce the adjacentpedestrian travel way (sidewalk) width to less than four feet clear. Parklets shall not interferewith the use of designated disabled parking zones; passenger loading zones; curb ramps; ACtransit stops or other accessfeatures of the public right of way.

    18Where the Parklet utilizes parking spaces, the Parklet shall not exceed the length and width oftwo (2) curb parallel parking spaces with a setback of a minimum of one (1) foot from eitherend of the parking spaceregardless of the length of the space. Parklets shall not be erected inparking spaceswhen parking spaces are either angled or perpendicular to the curb.FeesThere will be a non-refundable Application Feeof $150 per Applicant made payable to City ofOakland. Once selected, the application will be processed asa Minor Encroachment Permit fora Permit Fee of $1,133.73. This fee will cover staff time for processing and a site inspection fee.In order to qualify, a project shall be designated as Revenue neutral, which means: a) No loss ofparking revenue at the selected location; or b) City staff has identified and created newmetered spaces to bring in equivalent revenue asto what is being lost; or c) An annual lostmeter revenue fee of $1,680 shall be paid to the City. The Applicants will not be required toidentify alternative meter locations; however, suggestions will be taken.Demonstrated Community SupportAs part of the application process, Applicants will be required to demonstrate communitysupport for their Parklet. Evidence can be provided in the form of letters of support or a signedpetition that should include the location of the parklet, the home or business address of thesupporter, and any comments.Selection Process and Public NoticingThe projects will be ranked according to the following criteria:

    1) Good location - the proposed Parklet is likely to be well used and active2) How it enhances the aesthetic quality ofthe streetscape3) Demonstrated community support for public space at the proposed location4) Evidence that the Parklet will be well-maintained

    Once the initial eight Applicants are selected, the Planning Department will provide copies of aPublic Notice and the Applicant will be required to post them on site for 17 calendar days,informing the public that a permit is being considered to allow the installation of the Parklet atthe proposed location. Planning staff will provide mailing labels and notices to Applicants tomail to property owners within a 300 foot radius of the proposed location. If there are noobjections from the public, the Applicants will submit detailed plans and drawings showing alldetails, including finishes, plant species, and furniture types, aswell as a Maintenance Plan andproof of insurance. Upon review and approval of a complete set of plans, a permit will beissued.If there are objections from a resident, business owner, or property owner who lives or workswithin 300 feet of the proposed Parklet, the City Administrator's office will hold a specialhearing.

Parklets that areelevated to be level with the sidewalk will have to meet the minimum distributed live loads inthe 2010 CABuilding CodeTable 1607 A.l (60 pounds per square foot). The Parklet will needto meet standards for flooring gaps, rail gaps, and handrail height that will be determined bythe Building Department.If the program issuccessful and the City allows more Parklets, the Municipal Code may beamended to add a specific section on Parklets.Why a Pilot Program?Parklets can be an innovative way to improve the pedestrian experience of the City. We hopeall residents will benefit from the creativity and initiative of private businesses and communitygroups in the creation of unique, attractive urban spaces. It needs to be movable,have access beneath for cleaning and for drainage and also to be re-movable. The initial permitwill be for one year, with up to two annual renewals contingent upon the Permit Holdermeeting its Maintenance Agreement.     In Attendance: Aliza Gallo, Deborah Boyer, JC Wallace, Drew Lisac, Gregory Hunter, VitalyTroyan, Walter Cohen, Steve Snider, Tori Decker and Andrew Jones were all present.

    Medians: The CBDs plans for renovating the medians within the district boundaries werediscussed in great detail. Visual aids, including elevation drawings, were provided. Afterdiscussing our plans, Mr. Troyan indicated that the scope of work, in his opinion, falls outsidethe rules and regulations ofthe City of Oakland union charter, which states: "that no employeeshall lose his Of her job or compensation to another organization ..." Since neither of these tworules will be broken, it is not a PWA issue.Mr. Troyan indicated that in an effort to assist us in attaining our goals, he would start theprocess of assessing the condition of the irrigation systems within each median.Master Encroachment Permit: We were given permission to amend our Master EncroachmentPermit to include median landscaping. We have been told not to proceed with the renovationsuntil we get word back from Mr. Troyan or Aliza Gallo that the grievance that was filed againstus has been arbitrated and a decision has been made. This should be done by early November.

    PWA Staff on Our Board: We recommended that PWA assign a representative to our boardsand 50BO committee. City staff seemed to agree that this was a good idea and Aliza agreed tohelp to facilitate this. Mr. Troyan indicated that the PWA representative may need to be aliaison and not a voting member of the board or committee.

    Parks and Public Spaces: Public space development and maintenance was discussed in generalterms. City staff seemed supportive of our vision and again said that these projects are not inconflict with the city, but must wait until the process of arbitration is complete.

    Additional Items: Steve Snider made the recommendation that we look further into the arbitration

    process as we may be lumped into same grievance as a Volunteers for Americagrievance that has nothing to do with our districts. Allza indicated that she could followup with Tracy Nichol, the city attorney for arbitration to see about this.

    Aliza advised that CBOstaff work with City staff, such as Blair M i ller, to com pile adetailed master schedule of streetscape improvements such as lighting and way findingsign, so that we not duplicate our efforts.

    Downtown Oakland Association - October 2011The Lake Merritt/Uptown District Association (LMUDA) and Downtown Oakland Association(DOA) are seeking a qualified consultant(s) in the field of Land Use Consulting, grant writingand Government Relations services, for the respective districts. Individuals or group ofindividuals or companies are encouraged to submit a response to this RFP to provide one ormore of these professional services for the Lake Merritt/Uptown and Downtown OaklandCommunity Benefit Districts. The background and conditions of the contract for services forthis position are as follows:Background:The LMUDA and DOA are two public benefit corporations whose primary functions are toadminister the Lake Merritt/Uptown and Downtown Oakland Community Benefit Districts(CBDsor Districts). The Lake Merritt/Uptown CBD and Downtown Oakland CBD have contractswith the City of Oakland to administer the revenues for these assessment districts. The FY2011-12 revenues for the CBDsare anticipated to not exceed $ 2,200,000. The districts havebeen administered jointly with the same contracted staff since January 2009.The special benefit services funded by these two CBDs include maintaining security, cleanlinessand order in the public rights of way, improving district identity, running the web site and alldistrict events, serving the corporations' administrative needs and advocating on behalf of theareas property owners, business owners and residents. The CBDs are mandatory assessmentdistricts that fund special benefits or those services over and above currently provided by theCity of Oakland.     Government Relations Services Experience required:}- Demonstrated ability to understand the goals and needs of the DOA and LMUDA Boards

    of Directors in the implementation of their non-profit purposes;}- Demonstrated knowledge of the Brown Act and the Sunshine Ordinance in

    administering the two districts;r: Ability to effectively communicate the needs and goals of the Joint Boards to electedand City/government staff;

    ~ Ability to work with Board staff and consultants in order to orchestrate the Boards'messages for maximum effectiveness;
