The case of theHacker Combs Jasm Deaton and Johnand Thomas Davidson assigned to tieBourbon Circuit Court on a change ofvenue from the Breathitt Circuit Courtwas set for trial in the Bourbon court

were indicted jointly fur the murderof John Abner in Jackson last summerHon A Floyd of Winchesterwho prosecuted Abner in the Breathittcourt on several indictments will assist Col R B Franklin in the prosecution of the noted feudists allegedslayers The fuur defendants werepresent in court when itheir nameswere called

Col Franklin arose upon the call ofmotion hour and stated to the courtthat the papers in the case had beenreceived by Clerk W H Webb byregistered mail on the afternoon of

Former Circuit Judge J P Adamsof the Breathitt Circuit Court and AH Paton of Jackson were introducedto the court by Judge Denis Dundon asattorneys for the defendants whereupon they took the oath Judge Dundon has been engaged in the case asone of the attorneys for the defendantsCol Franklin further stated to thecourt that as many as forty witnesseswould be introduced by the prosecutionand that he understood as many astwenty witnesses would be on hand totestify in behalf of the defendants andasked that at least oneweek be giventhe attorneys to look into the caseAfter an expression of opinion from

December 7 and indicated that the de

Stout then delivered hischarge to the grand jury He laidspecial stress upon the infractions ofthe minor laws and declared that theirviolation was but a graduation incriminology The enormity of a crimefor murder he said forced itself uponthe attention of grand juries but thatit was his experience that to get atthe root of the evil through probe wasnceessary to uncover the identity ofthose who violate the minor lawsJudge Stout asked the grand jury toinquire diligently into the violationliquor laws gaming vagrancy andthe carriyng of deadly weapons concealed Mr Ferguson was appointedforeman of the grand jury

In the case of the Commonwealth vsCleveland Stafford which was set fortrial Tuesday Judge Harmon Stittstated to the court that the defendant attorney Judge Samuel Holmesof Carlisle was detained on accountof the death of a relative and askedthat the case be passed till the latterpart of the week to which Col Franklin assented Judge Stitt asked thathis employment as an attorney in thecase or the defendant be noted
