Comments for "Total recorded crimes"
2.3 In Germany “murder” and “manslaughter” both describe intentional killings of persons. Non‐intentional killing would be “homicide by neglicence”. 2.5, 2.6 Suspects and use of firearms only are reported with the sum of completed and attempted offences (total offences of a specific sort of crime) at the present system of crime statistics. Changes are already planned for the future.

Comments for "Non‐intentional homicide"
Comments for "Assault"
Rape in Germany means penetration into any natural opening of the body AND other humiliating sexual practices, done by force against the person or threatening with force. Other sexual offences are named sexual coercion. Consensual sexual relations with children and juveniles are named sexual abuse.
Comments for "Rape"
Theft with violence or threatening against persons in Germany is unknown in legal sense. That would be robbery. Theft with force against things (breaking) is named aggravated theft, not included in “robbery”, but in “theft total”.
Comments for "Robbery"
2.30 – 2.32 Housebreaking and theft of motor vehicle excluded 2.33 ‐ 2.35 Aggravated theft without housebreaking and theft of motor vehicles. Aggravated theft is only possible with things of non low value (appr. more than 100 Euros). Aggravated theft for instance may be done by force against things, by acting together, by acting professional, by bearing but not using a weapon, by taking away goods from a person who cannot defend or by taking away a thing of public/ cultural importance.
Comments for "Theft"
automobile theft includes joy‐riding, that means the use without the owners permission. Numbers here are NOT part of the numbers for theft, lines 2.30 – 2.35
Comments for "Motor vehicle/automobile theft"
Gaining access by use of force against persons or by intimidating would be “robbery”. If an offender comes in by using force against door and later on uses force against inhabitant, that act is classified and reported as robbery in house, not as (aggravated) theft / housebreaking.
Comments for "Housebreaking / Burglary"
Fraud and breach of trust, without embezzlement. In German crime statistics of the police there exists a summing‐up‐category “economic crime” relating to business activities. Economic fraud by business‐people is one part of that “economic crime”.

Comments for "Counterfeit currency offences"
In present crime statistics of the police reported only as part of a group of offences “resistance to public authority and offences against public order”. There is a special report on Organized Crime in Germany, depart from crime statistics. That report is gained by analysis of case‐information‐systems of state and federal agencies.

A suspect is everyone who based on police inquiries and adequate factual evidence, is suspected of having committed an unlawful (criminal) act. This also includes accomplices, instigators and abettors. Suspects only are reported with cases “cleared up”. The suspect may have been caught in the act or may only be known by name. It is not necessary to be interviewed or arrested by the police. UNODC comment (due to space limitation): The complete non‐numerical data for 3t2 is: 18 and more. Suspects aged 18, but not yet 21 years, may be prosecuted by the judge under youth court act, that means for instance maximum prison is 10 years instead of a life sentence for adults from 21 years upwards. The complete non‐numerical data for 3t3 is: 14, not yet 18 years old, always prosecuted under youth court act. Suspects younger than 14 years (“children”) are counted additionally – not included above ‐, but are not responsible under criminal law.

In regular Prison Statistics there is no differentation between juvenile and adult prisons, so official specific data is not available. Therefore ministry of Justice asked German Laender to estimate the capacity in juvenile prisons: At the end of 2006 there were 28 specific juvenile prisons with a capacity of 7.000 places. At the same time there were accessorily 28 juvenile branches in adult prisons with a capacity of 2.100 places. Please note: The estimated numbers are not as detailed and therefore not fully comparable with official statistics.
