AsalifelongresidentandhomeownerinSeminoleHeightsIpurposethatallrezoningrecommendations
mustnotrestrictpropertyownerrightsandmeetthesetenprinciples.
10PrinciplesforLivableCities:
1. Themostfundamentalprincipleisthat,absentamaterialthreattootherindividualsorthecommunity,peopleshouldbeallowedtoliveandworkwhereandhowtheylike.
2. Prescriptive,centralizedplansthatattempttodeterminethedetailedoutcomeofcommunityformandfunctionshouldbeavoided.Such"comprehensive"plansinterferewiththedynamic,adaptive,and
evolutionarynatureofneighborhoodsandcities.
3. Densitiesandlandusesshouldbemarketdriven,notplandriven.Proposalstosupersedemarketdrivenlandusedecisionsbycentrallydirecteddecisionsarevulnerabletothesamekindofperverse
consequencesasanyotherkindofcentrallyplannedresourceallocationdecisions,andshowlittle
awarenessofwhatsuchasystemwouldhavetoaccomplisheventoequalthemarketineffectiveness.
4. Communitiesshouldallowadiversityinneighborhooddesign,asdesiredbythemarket.Planningandzoning
codes
and
building
regulations
should
allow
for
neo
traditional
neighborhood
design,
historic
neighborhoodrenovationandconversion,andothermixedusedevelopmentandthemoredecentralized
developmentformsofrecentyears.
5. Decisionsaboutneighborhooddevelopmentshouldbedecentralizedasfaraspossible.Localneighborhoodassociationsandprivatecovenantsaresuperiortocentralizedorregionalgovernment
planningagencies.
6. Localplanningproceduresandtoolsshouldincorporateprivatepropertyrightsasafundamentalelementofdevelopmentcontrol.Problemsofincompatibleorconflictinglanduseswillbebetter
resolvedthroughtherevivalofcommonlawprinciplesofnuisancethanthroughzoningregulationswhich
tendtoberigidandinefficient.
7. Allgrowthmanagementpoliciesshouldbeevaluatedaccordingtotheircostoflivingand"burdenshifting"effects.Urbangrowthboundaries,minimumlotsizes,restrictionsonhousingdevelopment,
restrictionsoncommercialdevelopment,andotherlimitsonfreelyfunctioninglandmarketsthatincrease
theburdensonlowerincomegroupsmustberejected.
8. Marketorientedtransportationstrategiesshouldbeemployed,suchaspeakperiodroadpricing,HOTlanes,tollroads,anddemonopolizedmasstransit.Monopolypublictransitschemes,especiallyfixedrail
transitthatlackstheflexibilitytoadapttothechangingdestinationsofadynamic,decentralized
metropolis,shouldbeviewedskeptically.
9. Therightsofpresentresidentsshouldnotsupersedethoseoffutureresidents.Planners,citizens,andlocalofficialsshouldrecognizethat"efficient"landusemustincludeconsiderationforhouseholdand
consumerwants,
preferences,
and
desires.
Thus,
growth
controls
and
land
use
planning
must
consider
thedesiresoffutureresidentsandgenerations,notsolelycurrentresidents.
10. Planningdecisionsshouldbebaseduponfacts,notperceptions.Anumberoftheconcernsraisedinthe"sprawl"debatearebaseduponfalseperceptions.Theuseofgooddatainpublicpolicyiscrucialtothe
continuedprogressofAmericancitiesandthesocialadvanceofallitscitizens.
