SCHEDULE ‘A’ AND EXPLANATORY NOTE

THE CORPORATION OF THE CITY OF BURLINGTON

BY-LAW NUMBER 2020.359

A By-law to amend By-law 2020, as amended; File No.520-03-01/15

WHEREAS Section 34(1) of the Planning Act, R.S.O. 1990, c. P. 13, as amended, states that Zoning By-laws may be passed by the councils of local municipalities; and

WHEREAS the Council of the Corporation of the City of Burlington approved Recommendation on September 14, 2015, for the general amendments to Zoning By-law 2020, as amended,;

THE COUNCIL OF THE CORPORATION OF THE CITY OF BURLINGTON HEREBY ENACTS AS FOLLOWS:

1. THAT Part 1, General Conditions and Provisions, Section 2.3 – Patios,Decks, Balconies, and Porches – Residential subsection 2.3.2 be deleted andreplaced with the following:

2.3.2 Decks, as defined in Part 16, are permitted in all zones.

(a) Deck roofs shall be subject to the yard and setback regulations containedin Tables 1.2.1 and 1.2.2.

2. THAT Part 1, General Conditions and Provisions, Section 2.3 – Patios,Decks, Balconies, and Porches, Table 1.2.1 Regulations for Decks beamended:

“Decks over 1.2 m high and over 15 m2 permitted in the side yard – yes.”

3. THAT Part 1, General Conditions and Provisions, Section 2.4 - Fencing andPrivacy Screens 2.4.1.(a) be deleted and replaced with the following:

“(a) For all non-residential uses and residential abutting non-residential uses maximum height shall be 3m provided the fence is located on a common lot line.

4. THAT Part 1, General Conditions and Provisions, Section 2.4 – Fencing andPrivacy Screens 2.4.2 and 2.4.3 be deleted and replaced with the following:

2.4.2 “Privacy screens are permitted on decks and balconies for detached,semi-detached, duplex, triplex, fourplex, and townshouse dwellings subject tothe following regulations:

(a) Maximum height from grade 2.5 m (b) Maximum height from platform 1.8 m (c) Enclosed on two sides only (d) Setback from the street 9 m (e) Setback from side lot line 1 m (f) Setback from a rear lot line 1.5 m (g) Combined length of privacy

Screens (per unit) 12 m

5. THAT Part 1, General Conditions and Provisions, Section 2.5. – SwimmingPools, be amended by adding 2.5.1.(d):

“(d) On lots abutting a pipeline, a swimming pool must be setback 3m from the limits of the right-of-way.:

6. THAT Part 1, General Conditions and Provisions, Section 2.6 – Video Gameand Pinball Machines be deleted and replaced by the following :

“Video Games and Pinball Machines are permitted accessory to the followinguses:

(a) Hotel (b) Recreational establishment (c) Standard restaurant or night club (d) Industrial uses

7. THAT Part 1, General Conditions and Provisions, Section 2.13 –Encroachment into Yards subsection 2.13.1 (a) be deleted and replaced withthe following:

“(a) The following obstructions may project 50 cm maximum into a side yardand 1 m maximum into any other yard from the wall of the building:

chimney, pilaster, belt course eave or gutter, overhang, sill, lintel, cornice, ornamental projection.”

8. THAT Part 1, General Conditions and Provisions, Section 2.26 -General Parking Provisions subsection (1)(a) be deleted and replaced bythe following:

“(a) Each parking space shall have a minimum width of 2.75 m and a minimum area of 16.5 m2 and be readily accessible without obstructions at all times for parking and removal of a motor vehicle without the necessity of moving any other vehicle or obstruction. The minimum area of a parking space may include walkways for residential uses only.”

9. THAT Part 1, General Conditions and Provisions, Section 2.31 –Residential Building Height, Table 2.31. be deleted and replaced by thefollowing:

“Building Additions: Alternatively, additions and enlargements to existing dwellings are permitted to a maximum height of two storeys measured from the ceiling of the existing dwelling, a maximum of 6 m at the peak of the roof or a maximum of 3 m to a flat roof for a two storey and 4.5 m at the peak of the roof or a maximum of 2.25 m to a flat roof for a one and half storey.”

10. THAT Part 1, General Conditions and Provisions, Section 2.26 – GeneralParking Provisions subsection (5) for Parking Structures be amended to benumbered as follows:

i) Any part of an enclosed parking structure that projects 1.6 m or moreabove grade shall be subject to the yard requirements of the zonedesignation.

ii) Entrance and exist ramps to below-grade and above-grade parkingstructures or building shall be setback 7.5 m from a street line.

iii) Below-grade parking structures shall not extend into a required landscape bufferand shall be setback 3 m from all other property lines and street lines.”

11. THAT Part 2, Residential Zones, Section 3 - R Zone Permitted uses,footnote to Table 2.3.1.(a) the paragraph with respect to exteriorentrances and driveway widths to be deleted and replaced by thefollowing:

“The accessory dwelling unit shall have its own exterior entrance separatefrom the exterior entrance to the principal dwelling unit. The separateentrance to the accessory dwelling unit shall not be located on anyelevation of the building facing a street. Access to a principal andaccessory unit through a common vestibule is permitted.

12. THAT Part 2, Residential Zones, in Section 4.1 – Lot Width, Area, Yards,Table 2.4.2., Section 5.1 – Lot Width, Area, Yards, Table 2.5.2., Section6.1 – Lot Width, Area, yards, Density, Height Table 2.6.2., Section 8.1 –Lot Width, Area, yards, Height, Landscape Area, Table 2.8.2., Section9.1 – Lot Width, Area, Yards, Density, Floor Area Ration, Height, AmenityArea, Privacy Area, Table 2.9.2, Section 10.1 – Lot Width, Area, Yards,Density, Floor Area Ration, Height, Amenity Area, Privacy Area, , Table2.10.2, Section 11.1 – Lot Width, Area, Yards, Table 2.11.2, Section 12.1– Lot Width, Area, Yards, Table 2.12.2, Section 14.1 – Lot Width, Area,Yards, Density, Floor Area Ratio, Height, Amenity, Table 2.14.1, Section15.1 – Lot Width, Area, yards, Table 2.15.2, Section 22.1 – Lot Width,Area, Yards, Table 2.22.2, Section 23.1 – Lot Width, Area, Yards, Table2.23.2, Section 24.1 – Lot Width, Area, Yards, Table 2.24.2, Section 25.1Lot Width, Area, Yards,Table 2.25.2. be deleted and replaced by thefollowing:

13. THAT Part 3, Employment Zones, Section 4.2 – Yards,Table 3.4.2,Section 5 - Yards, Table 3.5.2, Section 6 - Yards, Table 3.6.1. bedeleted and replaced with by the following:

14. THAT Part 4, Commercial Zones, Section 4.1 – Yards, Table 4.4.1.,Section 6 – Yards, Table 4.6.1, Section 7 – Yards, Table 4.7.1. bedeleted and replaced by the following:

“Yard abutting a pipeline easement 7 m”

15. THAT Part 5, Mixed Use Corridor Zones, Section 4.1 – Lot Width, Areaand Yards, Table 5.4.1, Section 5.1 – Lot Width, Area, Yards, Floor AreaRatio, Building Height, Table 5.5.1. be deleted and replaced by thefollowing:

“Yard abutting a pipeline easement 7 m”

16. THAT Part 7, Uptown Mixed Use Centre Zones, Section 4.1 – Lot Width,Area, Yards, Floor Area Ration, Density, Height, Table 7.4.1., Section 5.1

17. THAT Part 8, Rural Zones, Section 3.1 – Lot Width, Lot Area, Yards,Building Height, Table 8.3.1. be deleted and replaced by the following:

“Yard abutting a pipeline easement 7 m”

18. THAT Part 12, Development Zone, Utility Services Zone, Section 1 – DZone, Table 12.1.2. be deleted and replaced with by the following:

“Yard abutting a pipeline easement 7 m”

19. THAT Part 3, Employment Zones, Section 4.6, Section 5.14 and 6.10 –Retail Sales be deleted and replaced by the following:

“1. A maximum total floor area of 15% only in conjunction withmanufacturing, fabricating, processing, assembling or warehousing uses.2. Permitted only where the use legally existed on the effective date of thisBy-law.3. The maximum total floor area for accessory retail sales or showroomshall be the lesser of a maximum total floor area of 15% of the main use or250 square metres,4. The accessory retail or showroom area shall be contained within thesame premises as the associated permitted use.5. The area within the remainder of the facility by a permanent, solid,floor-to-ceiling and wall-to-wall partition, including closed doors.”

20. THAT Part 5, Mixed Use Corridor Zones, Section 4.6 – Parkingsection (f) to be deleted and replaced by the following:

“(f) Pedestrian Walkway: A 3 m walkway shall be provided from thestreet connecting the sidewalk to the principal entrance of the building and shall be unencumbered except that the walkway may cross a driveway.

21. THAT Part 5, Mixed use Corridor Zones, Section 4.6 – Parking subsection(g) be deleted and replaced by the following:

(g)Notwithstanding (f), if a detached dwelling is converted to aservice commercial or office use, a pedestrian walkway of 1.5 m shall be provided from the street connecting the sidewalk to the

principal entrance of thebuilding and shall be unencumbered except that the walkway may cross a driveway.”

21. THAT Part 5, Mixed Use Corridor Zone, Section 4.6 – Parking beamended by adding (h) to read as follows :

“(h)Truck and Trailer Parking: Truck and Trailer parking is prohibitedexcept:

i) when the truck or trailer is being loaded and unloaded;ii) when the truck or trailer is for customers of the permitted

principal use;iii) when the truck or trailer belongs to a property owner or tenant;iv) when the truck or trailer is being used for charitable purposes.

22. THAT Part 6, Downtown Mixed-Use Centre Zones, Section 4.11, AmenityArea to be deleted and replaced by the following:

“For apartment dwelling units and retirement homes: 20 m2 per unit

23. THAT Part 14, Exceptions to Zone Designations, Exception 70, subsection3, Regulations for Duplex Dwelling for height be amended to read asfollows:

Height maximum 2 ½ storeys

24. THAT Part 14, Exceptions to Zoning Designations, Exception 96,regarding floor area be deleted and replaced by the following:

Maximum floor area: 1 storey 130 m2 1 ½ storey 139.3 m2 2 storey 167 m2 Split level 134 m 2

25. THAT Part 14, Exceptions to Zoning Designations, Exception 205 bedeleted and replaced by the following:

“Additional permitted uses:

Uses permitted in all zones as well as uses permitted in a BC1 zone aresubject to BC1 zone regulations, except that the maximum building heightshould be six storeys.”

26. THAT Part 14, Exceptions to Zoning Designations, Exception 333illustration wording to be amended to Urban Plaza rather than UrbanSquare.

27. THAT Part 14, Exceptions to Zoning Designations, Exception 444regarding the parking be deleted and replaced by the following:

“Parking:

Notwithstanding Part 2, Subsection 14.3(a), required parking forapartment dwelling units is 1 occupant per unit.

Phase 1 and 2

Occupant – Phase 1 - 127 spaces, Phase 2 – 54 spaces Total 181

Visitor Phase 1 – 11 spaces (enclosed in garage) Phase 2 – 26 spaces (enclosed in garage) Total 59 parking spaces

Note: Occupant/Visitor – 26 parking spaces are required for the existing building on Parcel A to be provided in Phase 1 of development on Parcel B.”

28. THAT Part 15, Zoning Maps, Zoning Map Number 14E, be amended byrezoning lands located at 2238 Caroline Street from “R3.2” to “CN2” asShown on Schedule “A” attached to this By-law.

29. THAT Part 16, Definitions, Lot Coverage be deleted and replaced by the

following:

“Means the pecentage of the lot area covered by all buildings measuredto the outside of the exterior walls, including all buildings andprojections (cantilevered floor space, window projections, etc). Carports,porches and decks may be excluded from the lot coverage calculationprovided there is no floor area above them.

When no notice of appeal is filed pursuant to the provisions of the Planning Act,

R.S.O. 1990, c.P.13, as amended, this By-law shall be deemed to have come

into force on the day it was passed

If one or more appeals are filed pursuant to the provisions of the Planning Act, as

amended, this By-law does not come into force until all appeals have been finally

disposed of, and except for such parts as are repealed or amended in

accordance with an order of the Ontario Municipal Board this By-law shall be

deemed to have come into force on the day it was passed.
