What is Due Process?

• The conduct of legal proceedings according to established rules and principles for the protection and enforcement of private rights, including notice and the right to a fair hearing before tribunal with the power to decide the case.

• Black’s Law Dictionary, 8th Edition

(a procedure that simulates a court proceeding to help make a decision between parties that don’t agree: the district and parents)

The Purpose of Due Process

• To obtain a decision on issues of disagreement by an independent, third-party.

Page 6: Due Process: Views from the Sides

It is not something to fear

• It may be tense at times

• It is easier if you think about the child involved

• You can get along with participants when it’s over, but occasionally it may take time

• Sometimes it’s a relief to have a neutral person look at issues.
