Ind10 - Notification of the Ministry of Industry Re: Eradication of Refuse or Materials which are no longer used, B.E.2548.

- In case the site keep the refuse or materials which are no longer used in factory more than 90 days. The site must be approved by DIW according to the Sor-Kor1.

The penalty of a fine not exceeding 200,000 THB. (under the Factory Act B.E.2535, section 45.)

Follow accordingly Compliance

- It is forbidden to take the refuse or materials which are no longer used out side the compound of the factory unless permission has been abtained from the Director-General of the Industrial Factories Department or person assigned by Director-General of the Industrial Factories Department.

- The site must have manifest form every time refuse or materials which no longer used are moved out of factory's premise and notified to the DIW by the internet.

- The site must supervise to ensure the refuse or materials which are no longer used are beging brought to elimination premise and must be also be liable to any event that many cause nuisance or damage to lives, properties and the environment.

- Thec site shall have a duty to submit annual report to the DIW according to the Sor-Kor3 within 1 March every year.

Ind13 - Notification of Ministry of Industry Re: Hazardous Waste Manifest System B.E.2547.

The notification defines the factory which rise a hazardous waste exceed 100 Kg. per month to follow this law and establishes hazardous waste storage checklist, list of hazardous waste, quantity, analysis report, must have the Generator 's ID Number form DIW and prepare a manifest form every time hazardous waste moved out of factory's premise.

- Hi-P are exempted from this law, however the site already have the Generator's ID No., and follow up the manifest system. When the site removal the hazardous waste, the site will select the Treatment Storage Disposal Facilities (TSDFs) which has the license and no baclist from DIW.

Environmental Quality Monitoring and Report

I12 - Notification of Ministry of Interior B.E.2534 Re: Safety in Performance of work concerning lethal chemical

- The site shall arrange for the measurement of quantity of concentration of lethal chemicals in the atmosphere of the workplace. Such a practice must be carried out in period of not later than 6 months each time.

Conduct the Environmental Quality Monitoring and submit the report to the Provincial Governor .

Compliance

- The results of measurement shall be made per the form (Sor-Aor.3) and submitted to the Director-General or the Provincial Governor or the persons assigned by them within 30 days from the date of measurement.

L12 - Ministerial Regulation on the standard for Administration and Management of Safety, Occupational Health and Working Environment in relation to Heat, Light and Noise B.E.2549.

The site shall arrange for the measurement of working environment in relation to Heat, Light and Noise and shall made a report at least once at year.

Imprisonment for a term not exceeding 6 months, or a fine not exceeding 100,000 THB, or both. (under the Labour Protection Act B.E.2541, section 154)

Others Legal & Regulatory: The following legal are establishes prescriptions of controlled factory;

E3 - The Energy Conservation Promotion Act (No.2) B.E. 2550.S4 - Royal Decree Prescribing Controlled Factory B.E.2540.

Energy Conservation

S3 - The Energy Conservation Promotion Act, B.E. 2535.

The owner of a controlled factory shall assign at least one person who has to responsibility with regard to energy program. Such person shall have the qualification as Ministrial Regulation issued under this Act.

Any owner of the designted building who fail to comply with the Ministrial Regulation issued under this Act shall be punished with a fine of not exceeding 200,000 THB (Section 55)

Or1 - Directive 2002/95/EC of the European Parliament and of the council of 27 January 2003 on the restriction of the use of certain hazardous substances in electrical and electronic equipment.

The site shall ensure that, from 1 July 2006, new electrical and electronic equipment put on the market dose not contain lead, mercury, cadmium, hexavalent chromium, polybrominated biphenyls (PBB) or polybrominated diphenyl ethers (PBDE).

Member States shall determine penalties applicable to breaches of the national provisions adopted pursuant to this directive. The penalties thus provided for shall be offective, proportionate and dissuasive.

To ensure that our products are not contain lead, mercury, cadmium, hexavalent chromium, polybrominated biphenyls (PBB) or polybrominated diphenyl ethers (PBDE).

I12 - Notification of Ministry of Interior B.E.2534 Re: Safety in Performance of work concerning lethal chemical

- The employer who has in possession lethal chemical in the place of busines shall report the details (Sor-Aor 1 form) thereof to the Director-General, Provincial Governor or the persons assigned by them within 7 days from the dtae of possession of lethal chemicals.

Whenever it appears that the employer violates or fails to comply with stipulations stated herein, the competent authority may first issue a warning to the employer to comply there with correctly within the period prescribed.

To submit Sor-Aor 1 form to provincial office of welfare and labour protection and conduct the environment quality monitoring .

- The employer shall make rectification that the quantity of concentration of lethal chemicals in the place where the employee are working not exceed the limits prescribed by the Ministry of Interior.

L15 - Notice of the Department of Labour Protection and Welfare on criteria and Method of transportation, storage, move and method of disposal of hazard chemical containers.

The employer shall keep and storage the hazard chemical away form working area at least 8 m., shall have a ventilation system and clean.

I8 - Notification of Ministry of Interior Re: Safety in Performance of work concerning operation of machinery.

- Every machine using electricity shall be provide with an earth wire to prevent leakage of current according to the standard for electrical safety.

- Machine with transmission of energy by the use of axle, belt, pulley, fly-wheel, shall have its energy revolving and transmission parts covered completely with mild steel grate.

- Machine for sharpening, grinding or dressing the surface of the metal shall be provided with a shield to protect the spark or wastes during the operation.- The employer shall not operate or allow the employees to operate the mechanical equipment at the rate exceeding the designated.- The employer shall provide a passage for entrance-exit of a width not less than 80 cm. at the place of operation in connection with the machinery.- The employer shall arrange for the installation of fence, partition or clear dangerous boundary lines at the location of machine or the area of the machinery that may cause danger.
