MEMORIAL AND WREATH-LAYING SERVICE9/11

MADRE DE UN HÉROEP. 11

P. 10

By Cinthia Rodriguez |El Observador|

On August 28, theConsulate Gen-eral of Mexico in

San Jose, along with unionrepresentatives presentedthe third annual LaborRights Week proclamation

that runs until September 2.The event took place in a si-multaneous way in the otherConsulates of Mexico acrossthe nation.

Individuals are encour-aged to attend the differentworkshops available. Someof the topics include safetyin the work place, workers

compensation, discrimina-tion issues, and salary viola-tions.

Last year, the event pro-vided information on laborrights to more than 500people. Ninety personalconsultations were takencare of and 38 serious casesof labor abuse were de-

tected. These cases wereadvised by attorneys, inves-tigated by labor authoritiesand given suitable pursuitby the Consulate.

“”Having that relation-ship is very important to us,to let them know that weare here to protect theirrights,” said Neil Struthers,

Chief Executive Officer,Building and ConstructionTrades Council. ”We are nothere to take advantage ofthem.”

The workshops takeplace at the main office lo-cated on 2125 Zanker Road,San Jose, CA. The event isopen to the public, free ofcharge. The local legal serv-ices as well as the nationaldepartments participate ona pro-bono basis.

”With the economy’sslow recovery some seg-ments of our society re-sponded by blamingimmigrants. So we need tostand up and stand togetheragainst racism, against dis-crimination,” said Ron Lind,Presidents, United Food &Commercial Workers Union,Local 5. ”We need compa-nies like Wal Mart and MiPueblo accountable if theyviolate the rights of workerson the job.”

The panelists are pre-pared to take any com-plaints and assist with anytype of question relating tolabor rights. One big concernof an attorney is operationsrun by other Latinos.

“”We see a tremendousamount of abuse against

workers. We see workersthat are being payedstraight time for 60 hours,”said Fernando Chavez,Chavez Law Group.

Sometimes the abusegoes unnoticed because theworker doesn’t want to losehis job. It’s important thatthe worker stands up forwhat he or she is entitled toin terms of being paid a fairand legal wage.

The legal teams ap-proach each case in a posi-tive manner for the worker. The consultations of greaterfrequency are nonpaymentof extra hours, discrimina-tion in the workplace, reduc-tion of working hours, dismissals by no-match ofthe social security, and re-sponsibility of the employerregarding injuries made onthe job.

”This week only reflectsthe intention of the laborauthorities, authoritiesin†Mexico and the unions, toshow our intention and ourconcern, but obviouslythis†is a permanent duty ofthe Consulate,” said CarlosPonce, Consul General ofMexico to San Jose.

San Jose Cops Sever TiesWith Feds

The Obama Administration’s announce-ment that it will bring its deportationpractices in line with common sense

law enforcement priorities has generated thepredictable outcry from mass-deportation ad-vocates, who incorrectly have characterized thesensible policy announcement as a “backdooramnesty.”

However, the wildly exaggerated rhetoric ofimmigration opponents combined with unsa-vory scam artists – notaries who pretend to belawyers and unscrupulous lawyers who pretendto be helpful – who prey on the hopes of immi-grants has led to confusion over the implica-tions of the policy for individual immigrantfamilies.

As a result, longtime immigration reformchampion U.S. Representative Luis Gutierrez (D-IL) is teaming up with the Illinois Coalition forImmigrant and Refugee Rights (ICIRR) and otherlocal organizations on a nationwide educationcampaign to highlight the opportunities andlimits of the policy announcement and to ensurethat immigrant families don’t fall victim to thoseseeking to exploit the hopes of desperate immi-grants for profit.

At the new education campaign, Rep. Gutier-rez praised the policy announcement from theObama Administration but warned, “There arescoundrels out there. There are people whoprey on our immigrant community. This is notamnesty. This is not a program you sign upfor. Don’t be fooled.

As the Chicago Sun-Times reported, “Byscoundrels, Gutierrez was referring to the pred-ators who have historically played immigrantsfor suckers whenever a change in federal immi-gration law created an opportunity, although I’msure he also feels that way about some of the

conservative voices who would want you tothink Obama has thrown the borders wideopen.

The Sun-Times went on to clarify, “There isno legalization program, despite how the policychange has been portrayed by its opponents, and therefore no reason to be paying for any-thing, The change of direction from the Obamaadministration doesn’t do anything to solve theunderlying problem of a country in bad need ofcomprehensive immigration reform, but in themeantime, it restores a little bit of commonsense to a program that sometimes has tar-geted immigrants for traffic violations. At best,it gives temporary breathing room to some —and a reason to hope for a more lasting solu-tion.

According to Frank Sharry, Executive Direc-tor of America’s Voice Education Fund, “The im-migrant community should listen to LuisGutierrez, not Lamar Smith and the scam artistshe’s enabling.

This policy announcement is an importantstep forward in bringing humanity and commonsense to our nation’s enforcement practices, butit remains limited in scope.

Those seeking to take advantage of this an-nouncement – whether scam artists seeking fi-nancial profit or Lamar Smith and his allies whoare seeking political profit – should stop ex-ploiting it for their own benefit. Fortunately, thenew education campaign from Rep. Gutierrez,ICIRR, and other advocates should go a long waytowards setting the record straight and ensur-ing the new policy is implemented fully andfairly.

Myths on Deportation Policy Changes

The top local news last Thurs-day, August 25, 2011 was thatPolice Chief Chris Moore ter-

minated the agreement between theSJPD and ICE that utilized two ICEagents to root out undocumentedcriminal gang members.

Commentary, Aaron R. ResendezAs a member of the Police Chief’s

Community Advisory Board, I com-posed a published Letter to the Editorto the Mercury News giving kudos toPolice Chief Chris Moore for listening tothe community and taking action.Congratulations, Chief Moore! You lis-tened and acted! Now the communityknows that the Police Chief is a man ofhis word who has honored the decla-rations he made publicly to Congress-man Luis Gutierrez (D-Chicago, Illinois)that the San Jose Police Departmentwould not participate on immigrationenforcement.

I am a U.S. citizen born and edu-cated in Mexico who came to San Jose31 years ago. I live in two worlds andtwo cultures, seeing both sides of thisissue. Understanding immigration isan important key for a better world.

I was once critical and participatedin a rally in front of City Hall againstSan Jose Police for their actions to-wards Latinos. In December of 2009my wife and I attended the Citizen Po-lice Academy. This course experiencehelped us understand police officersand their work in the line of fire.

In April of this year I was asked tobe part of the Police Chief AdvisoryBoard. Since the beginning of the col-laboration between SJPD and Immigra-tion Customs Enforcement (ICE), Ipersonally opposed and advised ChiefMoore of the fear, anxiety and distrustin the community. A coalition in oppo-sition to Operation Community Shield(OCS) including PACT and SIREN urgedthe Police Chief to terminate that part-nership with ICE.

Chief Moore, the San Jose Latinocommunity looks forward to workingcollaboratively with SJPD to betterserve the Latino community and thecommunity at large.

To Build communication, to build abridge and to build trust is a two waystreet of honesty, sunshine and com-promise from both, our community andthe San Jose Police Department.

Chief Moore decision to end hispartnership with Operation communityShield (OCS) was great. Now, we as

community have a bigger responsibilityto cooperate in helping SJPD, reachingout to our community and keep to con-tinuous improvement in relations forthe better of our great City of San Jose.

Commentary, Publisher of El Ob-servador Hilbert Morales

The above reflects the positivefeelings generated by the news thatthose two ICE agents are no longerworking collaboratively with the SJPD.Now the challenge in the Latino com-munity is the following:

1) Let’s make an effort to reduce vi-olence of all types in our communities.Killings, domestic violence, elder abuse, and child abuse are all are wrong andcan be mitigated. If you are a witnessto a criminal act, be willing to report itto the police investigators. Know thatyour act of being a witness can bemade anonymous and confidential byusing Crime Stoppers (Phone: 408-947-7861).

2) Since many individuals and fam-ilies are in great need and under a lotof stress, especially if unemployed, be-come aware that these unfortunatepeople need all the help which can beprovided. Learn to tell them personallythat groceries are available at the localfood bank and be able to refer them toSocial Services Agency, etc. Be awarethat desperate individuals do desper-ate acts to survive.

3) Be willing to organize and partic-ipate in community groups like Com-munity Watch which informs localhouseholds and community memberson the many methods used to deterburglars, vandalism, and other actswhich destroy or damage property.

4) Be willing to tell others thatthere is no need to carry a weapon(knives or guns) in this community. And be willing to be the role model foryour kids by not carrying a weapon, showing weapons provide no securityat all.

5) Be willing to take prior action bytraining yourself and others in angermanagement. Know that in a momentof passionate anger, your life may bepermanently changed.

6) If our community really wantssafety, security, and tranquility the ef-fort begins with each of us doing theright thing in the right manner, andbeing responsible for our own actions.Safe and secure communities beginwith the individual, not with those whoenforce the law.

Taxpayers sometimes need tax re-turns from previous years for loanapplications, to estimate tax with-

holding, for legal reasons or because recordswere destroyed in a natural disaster or fire.If your original tax returns were lost or de-stroyed, you can obtain copies or transcriptsfrom the IRS.

Here are 10 things to know if you needfederal tax return information from a previ-ously filed tax return.

- There are three options for obtainingfree copies of your federal tax return infor-mation on the web, by phone or by mail.

- The IRS does not charge a fee for tran-scripts, which are available for the currentand past three tax years.

- A tax return transcript shows mostline items from your tax return as it wasoriginally filed, including any accompanyingforms and schedules. It does not reflect anychanges made after the return was filed.

- A tax account transcript shows anylater adjustments either you or the IRSmade after the tax return was filed. Thistranscript shows basic data, including mar-ital status, type of return filed, adjustedgross income and taxable income.

- To request either transcript online, goto www.irs.gov and use our online toolcalled Order A Transcript. To order by phone, call 800-908-9946 and follow the promptsin the recorded message.

- To request a 1040, 1040A or 1040EZ

tax return transcript through the mail, com-plete IRS Form 4506T-EZ, Short Form Re-quest for Individual Tax Return Transcript.Businesses, partnerships and individualswho need transcript information from otherforms or need a tax account transcript mustuse the Form 4506T, Request for Transcriptof Tax Return.

- If you order online or by phone, youshould receive your tax return transcriptwithin five to 10 days from the time the IRSreceives your request. Allow 30 calendardays for delivery of a tax account transcriptif you order by mail.

- If you still need an actual copy of a pre-viously processed tax return, it will cost $57for each tax year you order. Complete Form4506, Request for Copy of Tax Return, andmail it to the IRS address listed on the formfor your area. Copies are generally availablefor the current year and past six years. Please allow 60 days for actual copies ofyour return.

- The fee for copies of tax returns maybe waived if you are in an area that is de-clared a federal disaster by the President.Visit www.irs.gov, keyword “disaster, formore guidance on disaster relief.

Visit www.irs.gov to determine whichform will meet your needs. Forms 4506,4506T and 4506T-EZ are available atwww.irs.gov or by calling 800-TAX-FORM(800-829-3676).

San Antonio Elemen-tary school firstopened its doors in

1967 in East San Jose. It was anexciting feeling. but thingshave changed dramaticallysince then. Freshly paintedclassrooms, an improved jun-gle gym, and new lawns makeup the campus now.

”Something important isgoing on here,” said Joe Coto, former California Assembly-

member. The appearance of a

school sends a message tostudents. The right message iscritical to students, parents, and teachers. That message isthat there is nothing more im-portant than the beauty ofdreams and the education ofstudents. The campus evenhas a new principal, award-winning Norma Rodriguez.

”You see further proof ofvaluable education with mem-bers of the board from theAlum Rock School District. It

gives me a lot of pleasure to behere and to be able to tell youthat this facility is furtherproof that you all deserve thebest,” said CouncilmemberXavier Campos.

Campos spoke directly tothe students present, tellingthem they can do whateverthey want. He also told themto aspire to be great becausethey are the future leaders ofthe city.

San Antonio is the newestschool in the Silicon Valley. It isalso the most wired elemen-tary school. Students in K-3will receive an iPod touchwhile grades 3-4 will workwith iPads.

The electronics will beused to explore the differentways students learn. Someare visual learners while oth-ers are auditory learners. Theequipment provides those twofeatures. Other schools in thestate have already integratediPods in the curriculum.

”We worked very hard tomake this a reality,” said Do-lores Marquez, President,Board of Trustees, Alum RockUnified School District.

Construction cost $20 mil-

lion, paid for through $12 mil-lion in bond funding and $8million in state assistance. Thetechnology improvementsprovided by federal stimulusfunds cost $450,000.

”Someday some of youout there are going to be sit-ting on the 18th floor of cityhall, meeting the next genera-tion of the East Side Commu-nity residents,” said Campos.

“Parece ayer lo quesucedió la tragediadel World Trade Cen-

ter en New York.

Eastridge To Commemorate 10-YearAnniversary

Many in the localLatino commu-nity know Blanca

Alvarado, retired Supervisor, after 30 years of distinguishedpublic service. After all, Blancais the “Grand Dame” of localLatino politics who continuesto be very active, and engagedin local community matters.

In an exclusive interviewwith EO’s publisher, HilbertMorales, her personal “dia-betes story was conveyed withthe purpose of encouraging allto be checked for this insidiousdisease process, which is sooften ignored or denied.

Those who have familymembers with diabetes needto be tested on a regular an-nual basis to permit early de-tection and management.Diabetes can be and is very de-structive and eventually is thecause of other organ systemfailures (kidneys, blood circula-tion, blindness, etc.)

Adult onset diabetes isknown as Type Two diabetes. Itis caused when your pancreasfails to produce the insulin es-sential for the normal metabo-

lism of glucose (sugar).Blanca first became aware

of her diabetes when she trav-eled to southern California tovisit her brother who was af-flicted with bone cancer.

During the trip she experi-enced frequent urges to uri-nate which she “put up with .Some time later she went toher doctor. He ended her med-ical exam by telling her ”yourhealth is good.”

Then, on her way out, herdoctor decided to prick her fin-ger to obtain a drop of blood todo a simple blood glucose test.

”Goodness, Blanca, youhave diabetes.” He then re-ferred her to Planetree to learnabout diabetes management.Of course, Blanca did not goand for about 10 years justtook her prescribed pills andwent on with her life. She de-veloped a severe neuropathy(loss of nerve function essen-tial to feeling heat and cold.)

One day, Supervisor DianeMcKenna, whose husband wasdiabetic, insisted upon referringBlanca to her husband’s doctorwho was a well known dia-betes disease specialist prac-ticing in Palo Alto.

Blanca was thoroughly ex-

amined by Dr. Pendergast, who, after having all the test resultsin hand, informed Blanca thather personal case of diabeteswas totally “out of control .

Blanca had ignored her di-abetes symptoms and could nolonger do that without very se-rious health and wellness out-comes. Dr. Pendergast wasable to formulate a personal di-abetes control process for herwhich did not include any in-sulin injections.

As a member of the Health& Hospital Systems Commit-tee, she consulted with Dr. Al-fonso Banuelos, MedicalDirector, who referred her toSCVMC’s diabetes specialists,Dr. Aguinaldo.

A patient-doctor relation-ship evolved which informedBlanca about the many waysdiabetes does damages to thebody. The establishment ofSCVMC’s Diabetes Center ben-efitted from Supervisor BlancaAlvarado’s role as its influentialchampion.

Its focus is on educationand training concerning dia-betes with its special focus onlocal Latino residents.

In her particular case, she

developed a very disciplined at-tention to her dietary intakecoupled with exercises requiredto maintain upper bodystrength, especially that herarms remain capable of reach-ing up.

Today Blanca delights ineffectively controlling her dia-betes by eating correctly (nutri-tion), doing her exercises(physical therapy), and gettingthe sleep her body requires. ”Itis very essential that I stay veryinterest in my life’s interestsand activities,” said Blanca Al-varado who now checks herblood sugar levels morning, noon and evenings daily.

She manages her diabetesso well that no insulin injec-tions are needed because herdisciplined practices keep herAIC levels below 5 and bloodsugar levels below 100. ”Once Igot beyond my denial and neg-lect, I was able to learn all thatwas needed to go on with mylife, its interests and activities,”said Blanca who enjoys a

chocolate now and then buteverything is now controlledand in moderation.

As a result, today BlancaAlvarado enjoys excellent well-being and health status; feelsfull of energy and vitality; at herage her mind is sharp and clear;and her body functions well.

Alvarado recommendsthat anyone who experiencesunexplained urge to pee ; unex-plained loss of feeling (toes, fin-gers, lower legs and arms), toimmediately undergo a dia-betes test. Early detection en-ables effective preventivemanagement when one learnswhat to do that works. Neglectonly leads to complications.

”I do not now neglect norignore the many signals mybody provides me which mayindicate the onset of some dis-ease process. I encourage any-one who has any of the initialsymptoms of diabetes, to getfully examined and diagnosed. Then take charge of your ownhealth and wellness so thatyou can live your life normally.”

Blanca is very active todayas evidenced by the experi-ences in getting her to taketime from all those meetingswherein she continues to be a“retired but active and expe-rienced community leader inSan Jose’s East Side neighbor-hood. Our community has ben-efited, and continues to benefit, from her interests, experience, and community service.

Oakland, CA,– In the aftermath ofHurricane Irene, the AmericanRed Cross Northern California

Blood Services Region is now urging imme-diate blood and platelet donations.

The Red Cross has already had to cancelmore than 72 blood drives along the EastCoast due to Hurricane Irene, resulting in theshortfall of more than 2,400 units ofblood. In addition, hundreds of blood andplatelet donors have been unable to maketheir scheduled donation appointments be-cause of storm-related issues. And localblood drive cancellations because of poweroutages continue to impede Red Cross op-erations along the East Coast this week.

The Red Cross is moving blood productsto the areas affected by Hurricane Irene sothat these products will be available in loca-tions where blood cannot be collected. Ifpeople will make an appointment to donateblood in the upcoming days and weeks, blood will be available should conditionscontinue to prohibit people in some parts ofthe country from traveling or coming toblood drives.

“Since the Bay Area is no stranger tonatural disaster, we expect strong local re-sponse to Hurricane Irene, said Jeff Meyer,CEO, American Red Cross Northern Califor-nia Blood Services Region. “If you are ask-ing yourself what can you do 3,000 milesaway, the answer is simple. Please donateto the American Red Cross. During this timeof need, we all need to do whatever we canto help.

The Red Cross has an urgent and very

critical need for platelet donors. Eligibleplatelet donors are asked to schedule a do-nation as soon as possible. Platelets arecommonly used for patients undergoingcancer treatment, trauma victims and manyother hospital patients. Since platelets havea shelf-life of just five days, it is imperativethat there are enough platelets on-hand tomeet the needs of local hospital patients.

Nationwide, around 44,000 blood dona-tions are needed every day to meet theneeds of accident victims, cancer patients, and children with blood disorders. Everytwo seconds, someone in America needs ablood transfusion. These patients and oth-ers rely on blood products during their treat-ment.

To schedule an appointment to donateblood, please call 1-800-RED CROSS (1-800-733-2767) or go to redcrossblood.org. Eligi-ble platelet donors should call1-888-881-0988. Please be aware the RedCross anticipates unusually high call volumeduring the next several days from those di-rectly affected by the hurricane and you mayexperience long delays.

The cost of the Red Cross disaster reliefresponse will be millions. People who canhelp are encouraged to click, text or call todonate to American Red Cross Disaster Re-lief. Visit www.redcross.org , call 1-800-REDCROSS or text the word REDCROSS to 90999to make a $10 donation. Contributions mayalso be sent to your local Red Cross chapteror to the American Red Cross, P.O. Pop, rock, piano, and singer-songwriter are the fivewords Francisca Valenzuela used to describe hermusic during a recent interview with El Observador.

She just released her second album “Buen Soldado,” and fullyexplained the process behind it.

“It’s kind of like siting down and saying what do I want totalk about,” said Valenzuela.

Her latest 12-track album, all written and composed byher, is musically different. She experimented with instru-ments, arrangement and built her band in a distinctive way. While the first album was more organic and feminine, her newstuff explores social and political issues.

“It was a challenge but it was awesome to sit down andtry to write about other stuff and become other people aswell,” admitted Valenzuela.

Following her own advice, Valenzuela was a good soldierand did not bite her tongue on her latest material. She talksabout insecurities, loss of a relationship, sadness, but she alsodescribed some of songs as fantastic, intellectual, and gutsy.

“Chile has been kind of my cradle, where I’ve developedmy art and grown a bit more. So I’m ready to come back tothe states and keep growing,” confessed Valenzuela.

Born and raised in California, until moving to her currenthometown of Santiago, Chile at age 13, she has had the bestof both worlds. She loves the diversity and progressive culturethe state has to offer. She enjoys contributing to society anddid so in a particular way.

She wrote “Salvador” for Latin America. Where she talksabout someone going and saving the area. The title itselfmeans savior but she isn’t talking about religion. In its place,

she would like to see more people congregate and actuallymake change in the status quo there is today. There isn’tenough true leadership to her.

Other tracks are just fun to listen to, they’re sweet catchylove songs. Some are even folksy, mellow, and jazzy.

Although she is always writing songs or poetry, and allsorts of stuff, she loves being on stage. Performing at showsallows her to grow. She finds it exciting and delivers with herpersonalized shows.

“Everyone has to be a good soldier, respect what they do,whatever endeavor they’re in and move forward, just keepworking,” said Valenzuela. “I’m doing that as well.”
