ENFORCEMENT POLICIES AND GUIDELINES
1. BOAE Resolution No. 1, series of 2009
PAES on Farm-to-Market Roads shall serve as technical reference by all agricultural engineers in the signing and sealing of plans, design and specifications and other related works in the practice of profession
“ The practice of agricultural engineering shall include the following: xxx
2) Management or supervision and the preparation of engineering designs, plans, specifications, project studies and estimates for:
• agricultural, aquaculture and fishery, and forest product machinery,
• agricultural buildings and structures,• farm electrification and energy systems, • agricultural processing equipment,• irrigation and soils conservation systems and facilities, • agricultural waste utilization systems and facilities; xxx
3) Conducting research and development, training and extension work, and consultancy services on agricultural engineering facilities/services, system and technologies
4) Testing, evaluation and inspection of agricultural, fishery and forest product machinery and other related agricultural engineering facilities and equipment;

1. BOAE Memo Circular 9, series of 2009
All concerned Government Agecies ( DA, DAR, DENR, DPWH, LGUs, ARMM), pursuant to the policy mandates/directives of R.A. No. 8559 shall comply the following:
a) To engage or assign licensed agricultural engineer/s to perform the identification, validation, inspection, monitoring, coordination and preparation or evaluation of feasibility studies, programs of works and cost estimates of farm-to-market roads in their respective offices

All concerned Government Agecies ( DA, DAR, DENR, DPWH, LGUs, ARMM), pursuant to the policy mandates/directives of R.A. No. 8559 shall comply the following:
b) To require the participating contractors in public bidding of FMR projects to have PCAB AE works license or have licensed agricultural engineers as their Sustaining Technical Employee who shall be responsible in the supervision and inspection of FMR projects.

3 . DA Administrative Order No. 28, s. 2009
All DA Units shall enforce the PAES-FMR as integral part in the planning, feasibility studies, inspection, evaluation, procurement and implementation of FMR projects.
The PAES-FMR shall serve as technical reference by all DA agricultural engineers in the signing and sealing of plans, designs, technical specifications and program of works of farm-to-market roads.

4 . DILG MC No. 2008-167
Pursuant to Section 17(d) of R.A. No. 7160, the design, plans, technical specifications and cost estimates used in the procurement and/or implementation of LGU’s programs and projects on xxx farm-to-market roads shall be signed and sealed by licensed and registered agricultural engineer/s in accordance with the BOAE Res. No. 07, series of 2003 and the Philippine Agricultural Engineering Standards;
4.5 Pursuant to Section 17(d) of R.A. No. 7160, the design, plans, technical specifications and cost estimates used in the procurement and/or implementation of LGU’s programs and projects on agricultural and fishery machinery, buildings and structures, small water impounding projects, post harvest facilities, slaugtherhouses, poultry
dressing plants, farm-to-market roads and other agricultural engineering facilities and systems shall be signed and sealed by licensed and registered agricultural engineer/s in accordance with the BOAE Res. No. 07, series of 2003 and the Philippine Agricultural Engineering Standards;

COA Memorandum No. 2004-2006 to all its Operating Units put into action COA’s role under implementation of AE Law which is to---
help enforce BOAE Res. No. 7, series of 2007 (signing and sealing of plans and designs by AEs) as part of the auditing of government projects on shallow tube wells, small water impounding projects, other irrigation projects, agricultural and fishery mechanization, post harvest facilities, agricultural and fishery infrastructure and other agricultural engineering projects
