My dear fellow exporters,

A close reading of the Union Budget Proposals indicates that there are a couple of amendmentsproposed in the Budget that would have serious consequence for the exporters.

Clause 85 of the Finance Bill 2008-09 seeks to amend the definition of banking and financialservices for the purpose of service tax. Section 65(12) is proposed to be amended so as to levyservice tax on purchase or sale of foreign currency, including money changing, provided by anauthorized dealer in foreign currency or an authorized money changer, in addition to a foreignexchange broker. Thus, exporters may have to pay service tax calculated at the rate of 0.25%of the gross amount of currency exchanged. This proposal contains ominous possibility ofaffecting the conversion of export proceeds into Indian Rupees.

Further, Clause 64 of the Finance Bill proposes to amend Section 108 of the Customs Act, 1962empowering any gazetted officer of the Customs to summon any person whose attendance heconsiders necessary to either give evidence or to produce a document or any other thing in anyinquiry which such officer is making under this Act.

Also, Clause 65 of the Finance Bill amends Section 117 of the Customs Act, 1962 affecting anincrease in penalty from Rs. 10,000 to Rs. One Lakh for contravention of any provisions of theCustoms Act, for which no specific penalty is provided. Clearly, these amendments are likely toadd to the woes of the exporters given the fact that such powers are likely to be misused. TheCouncil has received innumerable verbal complaints against the Customs personnel that smackof harassment and there is, therefore, no grounds for further arming the Customs authorities withprovisions that are one sided and liable to be misused.

The Council has taken up these issues with the Hon�ble Finance Minister in its Post-BudgetMemorandum as well as with the Hon�ble Commerce Minister seeking his intervention so that thenecessary modifications can be made to the above amendments to ensure that the problemsbeing faced by the exporters are not aggravated further on account of these proposals.

INTERMACH is the Asia�s No. 1 High-Tech Machinery Exhibition. INTERMACH 2008 will provide exhibitors with the finestrange of facilities and amenities to display and demonstrate their product range of the latest, innovative manufacturingtechnology, plus a whole spectrum of relevant information, offering maximum exposure before the largest gathering ofinterested visitors in the whole ASEAN Region. About the Event : ITMA ASIA + CITME

ITMA is the world�s largest international textile machinery exhibition, an event which is owned by CEMATEX. ITMA is

recognised as the �Olympics� of the textile machinery industry and the event has taken place every 4 years since its launch

in 1951. In 1999, CEMATEX made the decision to introduce an event which catered to the growing needs of Asian textilemanufacturers which represent a significant percentage of its association members� buyers. In 2001, ITMA ASIA made its

debut in Singapore.

CITME was launched in 1988. It has grown to be the most established as well as the largest international textile machinery

exhibition in China. It has become the first ever international textile machinery exhibition in China endorsed by UFI (the

Global Association of the Exhibition Industry) in 2002.

Starting from 2008, a combined show known as �ITMA ASIA + CITME 2008� will be held in China, scheduled to take place

every two years. Taking off in Shanghai, the milestone event features the unique strengths of the ITMA brand and China�smost important textile event. ITMA ASIA and CITME are two of the most influential trade shows for the industry. The

integration of these two well-established exhibitions into one mega show aims at offering their exhibitors and customers a

high quality cost effective exhibition.

Opportunities in the Textile Machinery Market in China

A major manufacturing centre for textile products, China has become the world�s most dynamic market. This has generatedenormous demand for high-tech textile machinery. In recent years, China�s textile industry has enjoyed rapid growth.Currently, it has one third of the global textile production capacity. With the dismantling of quota restrictions on textile andclothing exports at the end of 2004, and the rapid development of technology, the textile industry has witnessed massivechanges. The need for Asian textile makers to modernise their operations in order to compete globally has spawned hugeinvestment in quality machinery. India�s Exports of Textile Machinery to China

In the last five years, India�s exports of textile machineries to China have increased by leaps and bounds, by about 114%annually. However, India�s share in China�s global imports of about USD 4 billion remains miniscule, only about 0.13% in2006. India exported USD 6 million worth of textile machineries and parts to China.

Economy

� The Saudi economy rests primarily on oil revenues. Its crude oil reserves, amounting to 259.40 billion barrels, are

estimated to be 25% of the world�s known reserves. Its natural gas reserves at 200 trillion cubic feet are 4% of world

reserves. The average daily output of oil during the year 2002 was around 7.09 mbd. The petroleum sector accounts for

78% of total revenues, 37.5% of the Gross Domestic Product and 88% of export earnings. About 41% of the GDP is

generated by the private sector. The Kingdom, under its "Saudization policy", has undertaken to reduce its dependence

on foreign labour in key sectors by progressively replacing expatriate workers (around 3.6 million) by Saudis.

During the last few years, the Kingdom has been introducing changes in its trade, investment and taxation regulations to

make itself an attractive investment destination as also to pave the way for its accession to the WTO. The Saudi Arabian

General Investment Authority (SAGIA), set up in May 2001 provides �fast-track� approvals for investment in different

sectors, including setting up of 100% foreign owned entities.

� Major items exported by India are primary & semi-finished iron and steel, machinery and instruments, basmati/non-

basmati rice, tea, manmade yarn, fabrics, made ups, cotton yarn, , chemicals, plastic & linoleum products.

� Major items imported by India apart from crude oil and petroleum products are organic chemicals, inorganic chemicals,

artificial resin, plastic materials, sulphur, iron pyrites, pulp & waste paper, mineral ores & metal scrap, coal, coke &

briquettes, iron & steel and non-ferrous metals.

� Saudi Arabia is the largest supplier of crude oil to India. Both public and private sector companies buy around 23 Million

Metric Tones of crude oil per annum from Saudi Aramco, which is about 26% of India�s annual crude oil imports.

� The bilateral economic and commercial relations between India and Saudi Arabia have grown substantially in the non-

oil sector and both countries view each other as important economic partners in respect of investments, joint ventures,

projects on technology transfer and joint venture projects in third countries.

� Cooperation in the field of manpower is an important dimension of the Indo-Saudi relationship. Approximately 1.5 million

Indians are working in Saudi Arabia, around 85% of whom are in the blue-collar workers category. Remittances by

Indian workers are estimated to be over US$ 3 billion annually.

� India and Saudi Arabia are actively discussing Bilateral Investment Protection and Promotion Agreement (BIPPA) and

Double Taxation Avoidance Agreement (DTAA). These agreements are expected to strengthen the institutional

arrangement required to promote and further enhance economic interaction between the two countries.

� India and Saudi Arabia concluded a Bilateral Accession Agreement on Saudi Arabia's accession to the WTO on 16 June,

2004 at Geneva. The Agreement included agreed tariff schedules on items of export interest for India in the Saudi

Arabian market as well as Saudi Arabia's market access commitments in services sectors of interest to India.

� India and Saudi Arabia are actively cooperating in the field of science and technology. The Council for Scientific &

Industrial Research (CSIR) and the Saudi Arabian Standards Organization (SASO) has an ongoing programme of

technical cooperation (POC) since June 1993.

� India and Saudi Arabia cooperate in the field of training of agricultural experts. Indian experts were deputed to the

Kingdom during 1993-98 to help Saudi scientists in the field of red palm weevil management. Saudi agricultural experts

were also provided training in India in this field in 2001 at agricultural research facilities in New Delhi, Bangalore,

Kasaragod and Kayamkulam.

Investment

The bilateral investment between the two countries is growing steadily. From April 2000, many Indian firms have takenadvantage of the new Saudi investment laws which allow setting up of 100% foreign owned projects or joint ventures in theKingdom. The Saudi Arabian General Investment Authority (SAGIA) established in April 2002 as the main licensing body forforeign investments in Saudi Arabia has awarded more than 82 licenses to Indian companies for establishing Joint venturesand hundred percent Indian owned companies in Saudi Arabia in different sectors such as management and consultancyservices, construction projects, power, telecommunications, IT, pharmaceuticals, furniture, etc.

The Embassy and Consulate General play active role in encouraging Indian companies to participate in trade fairs/exhibitionsin Saudi Arabia to showcase their products and services. Indian companies have regularly participated in the followingannual Saudi exhibitions :

Saudi Arabia, Industry and Electricity

Though distinctly present since the founding of the Kingdom of Saudi Arabia, attention given to industry has increasedrapidly since the establishment of the Ministry of Industry in 1975. Industry in the Kingdom is divided into two categories :

1. Conversion Industries

2. Basic Industries

Encouraged by the State and run by the private sector, the conversion industries produce enough consumer goods andmaterials to meet the needs of the local market. The number of conversion industry factories in the Kingdom rose from 199in 1970 � 1971 with a total capital of SR 2.8 billion, to 2,458 in 1995, with a total capital of some SR 162 billion.

� The value of conversion industries exports totaled SR 5,436 million.

* The number of workers in these industries increased from 14,000 in 1960 � 1971 to 218,000 in 1995.

* Loans extended for the Kingdom's industrial projects in 1994 � 1995 totaled SR 55.6 billion, up from SR 35 billionin 1974, an increase of 40.1%.

Basic Industries

The planning and execution of these industries is carried out by the State, which has built the two industrial cities of Jubail

and Yanbu. The two cities are built to the highest technological standards of hydrocarbon industries and their derivatives as

well as ancillary and secondary industries. Jubail city is located on the Kingdom's eastern Arabian Gulf coast, while Yanbu

is situated on the Kingdom's western Red Sea coast. The two cities contain the complexes of the Saudi Arabian Basic

Industries Corporation (SABIC) and those of the General Organization for Petroleum. They are supervised by the RoyalCommission for Jubail and Yanbu, whose Board of Directors is chaired by the King.

Electricity

Investment in electricity in the Kingdom of Saudi Arabia highlights the private sector's vital contribution to the Kingdom'sfree market economy. Although the General Electricity Corporation runs and operates the power utilities in rural areas,investment in this sector is undertaken by shareholder companies. The State has fully financed the services-orientedprojects of these companies since 1995 through long-term, interest free loans extended by the Saudi Fund for IndustrialDevelopment. The Saudi Government guarantees seven percent of the private investor's shares in the capital of thesecompanies.

The Government's assistance to electricity companies during the period 1970 - 1995 totaled R 21.6 billion. The Government's

policy of merging approved electricity companies into one big company resulted in the emergence of four consolidated

government-assisted companies in the Central, Eastern, Western and Southern regions.

Electric Motors

Electric motors are designed to supply power to machines and other equipment in order to turn the electric power to

mechanical energy. These are divided into two types based on the electric current used :

Electric motors operated by alternating current such as those used in manufacturing household equipment (e.g. air

conditioners, washing machines, fans, etc.) and in manufacturing industrial and agricultural equipment.

Electric motors operated by direct current such as those used for certain conditions requiring using continuous current.

The Kingdom of Saudi Arabia is the biggest free economic market in the Middle East. It acquires 25% of gross national Arab

product and has the biggest oil reserve in the world (25%). Saudi Arabia is the most ideal environment for projects depending

on energy consumption because it provides energy for investment projects with the least prices at global level. In addition,

there are many natural resources in mining that are supported by the geographical location of the Kingdom making them of

easy access to European, Asian and African markets. Saudi market has a high purchasing power and of continuing expansion.

Business Transaction and Payment Term

The general term is that the payment is effected at DP, DA basis, Letter of Credit basis. The LC terms are normal in Saudi Arabia.The prices vary from customer to customer and also from supplies to projects, industries, sub-contractors, wholesalers and retailers.

The Saudi Arabia is very competitive market. Indian companies have to compete with the developed countries like USA,Germany, Italy, France, Japan, UK, Finland, Austria, Switzerland, Sweden, China, Korea, Singapore, Brazil etc.

The business for projects, services and supplies are diverted to competing countries on recommendations of their projectconsultants. Therefore Indian exporter and contractor should have good contact/rapport with the promoter and consultantsof the projects for supply of its products and services.

The Saudi Riyal is one of the most stable currencies in the world. There was no significant change in its exchange rate and valueduring last three decades. There are no restrictions/Scarcity on foreign currency exchange and outgoing money transfers.

Delivery Terms/Packings etc.

Exporter should strict to delivery schedule committed to the importers. Packing of the goods should be export worthy and

parallel to international standard, so that goods should reach the destination without any damage etc. The appearance of the

package should look good to attract customers.

The electric motors and generators are capital in nature, therefore packaging is very important for safely arrival at

destination.

Recommendations

1. Export of electric motors and generators need to contact the end users directly to ascertain their demand. The end

users have the final say in terms of selection of vendors, price and quality with Government agencies.

2. Indian Companies should register their companies to quote tenders floated by the government industries and refineries

etc. The exporters have to meet all the terms and conditions, if essential exporters should have local partner to quote

tenders joint on behalf of the Indian Companies.

3. Personal visit of senior officials of Indian company is most useful for building of contact with Saudi Arabian importers;

companies and study the market situation having presents of competing companies for Indian products.

4. Personal visit will also give a scope to study the supply of product in Saudi Arabian market by the competing countries

and Indian exporter can determine quality, price and matching delivery etc.

5. Fielding of delegation of the leading manufactures exporters of electric motors and generators should benefit to explore

market details & to generate personal contact with the Saudi importers for Indian products.

6. Indian Electric Motors and Generators manufactures and exporters should exhibit their products in the relevant Saudi

Arabia International Trade fairs/Exhibitions.
