Dear Mr. Diao Peng,

After the inspection of CW1 B work package on 04th August 2015, we would like to highlight some

environmental issues on your site regarding unclean working environment as mentioned on the

environmental inspection report in the attachment. Please follow up our instructions/guidance in the

report to take quick action and give us your response for those issues by 12th August 2015.

By the way, we would like to mention to you some remaining issues from last ADB/DFAT mission

on March 2015 as follows:

There are no drainage system along access road. This problem was reminded to you in some

previous letters DDIS/CW1 B/0847 on 17 March 2015 and DDIS/CW1 B/0994 on 29th June

2015.

First aid kit should be available on office and worker accommodation.

The excavated soil disposing quantity should be recorded and reported to DDIS. However,

this report was not fully detailed by your submission; please request your staffs to fully fulfil

DDIS instruction and quickly submit to us before 12th August 2015.

Your quick actions on these issues is highly recommended.

Issues

GOOD practice: Contractor can reuse the fuel drum to store equipment and small tool to work on site.

Overspreading excavated soil on site without any proper storage. This soil must store in designated area

for disposal area. For reuse purpose, this soil should store in a temporary place with barricade and

notification broad.

Access road was dirty and full of dust during transport. To avoid dirty road affecting by construction

activity, Contractor must regularly spray water at least 6 times/day, this frequency might need to

increase for either the hot and sunny day or increase of transport activity.

Domestic waste was found on site and worker accommodation. Contractor must require cleaning activity

for these places and remind your worker to keep clean condition for their environment.

Metal waste was spread over on fabrication yard; this material should be stored in a designated area for

metal waste with barricade and (label) notification broad as reference.

Many old machines were broken and repaired on site which led to fuel leakage and contaminated soil

and ground. This contamination should be clean up by collecting contaminated soil to hazardous storage.

Contractor must provide secondary containments to use for emergency case (e.g. broken crane) to avoid

fuel leakage to ground.

Many chemicals/fuel on site are not labeled. It might be dangerous for workers and newcomer.

Contractor need to strictly require workers to label any can/drum/barrel of liquid materials.

There are many large bunches of water hyacinth stuck on the pipes of temporary bridge in both North

and South sides. These bunches will be waste storage on the river and cause difficulty for transportation.

Contractor must quickly remove and repeat this action with other stuck water hyacinth.

Both batching plants are dirty and full of concrete waste. Settling pond in batching plants in south side

are problematic since these area are always overfilled; the wastewater might run into the supply water

canal to agricultural field. Since settling pond was full, the wastewater run in shallow area nearby. This

issues had been reminded to contractor many times but there are no action and feedback. Contractor

need to clean these areas and remove all concrete waste as well solid waste under settling ponds as

soon as possible.

Vấn đề

Thực hành TỐT: Nhà thầu tái sử dụ gàth gàđựng dầuàđể chứa máy móc và các dụng cụ nhỏ để làm việc

trê à gàtrường.

Đấtàđổ thảiàđổ tr àla àtrê à gàtrường không có mộtà ơià hứa phù hợp.àĐất này cần phảiàlưuàtrữ tại

khu vự àđ àđược bố tríà hoàđổ thải.àĐể cho mụ àđí hàt iàsử dụ g,àđất này cần phảiàđược chứa trong khu

vự àđổ thải tạm thờiàtrê à gàtrườ gàđượ à gă à ởi dảià gă à hàv à à ảng thông báo cho khu chứa

đấtàđổ thải tạm thời.

Đường công vụ bẩ àv àđầy bụi trong quá trình vận chuyể .àĐể tr hàđường bẩn do các hoạtàđộng thi

công, nhà thầu cần phảiàthườ gà u ê àphu àtưới nước it nhất 6 lần/ngày, tần xuấtàtưới cần phảiàtă gàtro gàtrường hợp trời nắng nóng hoặ àgiaàtă gàlưuàlượng vận chuyển.

R àđược nhận thấy ở khắpà gàtrường và khu nhà ở của công nhân. Nhà thầu cần yêu cầu dọn dẹp cho

những khu vực này và nhắc nhở công nh àđể dọn dẹp và giữ gìn vệ si hà hoà iàtrường của họ.

Rác kim loạiàđể lan tràn khu vự à iàđ àdầm; vật liệuà à ê àđượ àlưuàtrữ tại khu vự àđược thiết kế

cho rác kim loại với dảià gă à hàv à ảng thông báo.

Nhiềuà à à ũàđ àhưàv àsửa chữa trong côngàtrườ gàđ àdẫ àđến tràn dầuàv àđất nhiễm dầu. Khu vực

đất nhiễm dầu cần phảiàđược dọn dẹp bằ gà hàthugào àđất ô nhiễ àđến các khu chứa rác nguy hại.

Nhà thầu cần cung cấp khay chứaàđể sử dụ gàtro gàtrường hợp khẩn cấpà hưàhưà ẩu àđể tránh dò rỉ dầu và nhiên liệu xuố gàđất.

Nhiều chất hóa học/nhiên liệuàtrê à gàtrường không có dán nhãn. Những chất này có thể nguy hiểm

cho công nhân và nhữ gà gười mớiàđến. Nhà thầu cần yêu cầu công nhân tuân thủ nghiêm ngặt việc dán

nhãn cho các can và thùng chất lỏng.

Nhiều mảng lớn lục bình trôi bị kẹt giữa các cột trên cầu tạm cả hai bên bờ nam bắc. Những mảng lục

bình này sẽ l à ơià hứa rác thảiàv àg à ê àkh àkhă àtro gàvận chuyển. Nhà thầu cần nhanh chóng dỡ

bỏ những khu vực lục bình kẹt vào cầu tạm và liên tục lặp lại nếu gặpàtrường hợpàtươ gàtự,àtr hàđể lục

bình kẹt thanh mảng lớn.

Cả hai trạm trộ àđều rất bẩn và nhiều rác bê tông. Khu vực bể lắng của trạm trộn ở bờ Nam là có vấ àđề

khi toàn bộ khu vực này luôn trong trình trạng bị tr àđầ ;à ước thải có khả ă g chảy vào khu vực rạch

ước cho hoạtàđộng nông nghiệpàtrê àđồng. Vì bể lắ gàđầ ,à ước thải từ trạm trộ àđ à hảy vào khu vực

đất thấp xung quanh. Vấ àđề àđ àđược nhắc nhở đến nhà thầu nhiều lầ à hư gà h àthầuàđ àkh gàcó bất cứ h hàđộng gì và phản hồi lạiàTưàvấn. Nhà thầu cần phải dọn dẹp các khu vực này và dỡ bỏ tất

cẩ àr à êàt gà ũ gà hưà hất thải rắ àdưới bể lắng nhanh chóng.

Issues

Burning waste in worker accommodation is forbidden. Please instruct your workers to strictly comply

with ADB environmental requirements which had been mentioned in the ADB-DFAT mission in Feb 2014.

There are still many unlabeled cans locating on site. These cans should be located in the materials

storage and label with name of chemicals.

Toilets in the worker accommodation were really dirty, smelly, and full of water spreading and wastes.

Contractor must request workers/cleaners often clean and remove waste to the proper storage (waste-

bin). Contractor also need to have environmental trainings for these workers living in the worker

accommodation. These trainings should be recorded and reported to DDIS.

We had observed that many wastes were not collected to waste-bin though this trash-bin locates next

to. This is problematic and missing cooperation from wo ke s’ attitude. Cont acto is e uested to

workers often collect wastes into waste-bin and also train workers for environmental understanding and

proactive attitude in the waste management. This environmental training should be recorded to DDIS.

Water in the concrete tank in the worker accommodation often use for washing and cleaning. These

water tanks were not regularly clean. DDIS request Contractor to assign cleaners/workers to quickly

remove and clean moss and algae in the bottom of concrete tank.

Temporary disposal area for excavated soil was not barricaded. Contractor should barricade this area

to separate this area to access way to fabrication yard.

Vấn đề

Đốt rác trong khu ở của công nhân là hoàn toàn bị cấm trong dự .àMo gà gàh àhướng dẫn những

gười công nhân ở trong khu vực này tuyệtàđối tuân thủ với nhữ gà u àđị hà iàt ườ gàđ àđược nhắc

nhở từ thờiàđiể àđo àáDB-DFAT kiể àt aàv oàth gà à ă à 5. Vẫn có nhiềuà a àđựng nhiên liệu không có dán nhãn trên công t ường. Những can nhiên liệu này cần

phảiàđượ àđể trong khu vực kho chứa vật liệu nhiên liệuàv àđược dán nhãn tên loại hóa chất chứa bên

trong.

Các nhà vệ sinh trong khu ở của công nhân rất bẩn, mùi hôi và tràn ngậpà à ũ gà hưà ước ngập. Nhà

thầu cần phải yêu cầu công nhân hoặ à gười dọn dẹpàđể dọn sạch khu vực này và di chuyể à àđế à ơiàthug om (thùng rác). Nhà thầu cần phải yêu cầu công nhân dọn dẹpàthường xuyên và ũ gà ần phải tổ

chức các khóa họ à iàt ườ gàđ oàtạo cho công nhân sinh sống trong khu vực này. Những buổiàđ oàtạo

cần phảiàđược ghi lạiàv à oà oàl àTưàvấn.

Ch gàt iàđ à ua às tàđược nhiềuà àv àt ià àkh gàđược thu gom và bỏ vào thùng rác dù thùng rác

ngay gần bên cạ h.àĐấy là một vấ àđề về thiếu ý thức. Nhà thầu cần phải yêu cầu công nhân thu gom

àv oàđ gàvị t íàth gà àv àđ oàtạo công nhân về ý thứ àv à àth iàđộ chủ động trong quản lý rác.

Các buổiàđ oàtạo này cần phảiàđượ àghià h pàv à oà oàTưàvấn.

Nước trong bồ à ước tại khu ở củaà gà h àthường sử dụng cho mụ àđí hàtắm rửa. Tuy nhiên những

bồ à ướ à àkh gàthườ gà u àđược cọ rửaàđể mọ à o gà u.àTưàvấn yêu cầu nhà thầu cử công nhân

và nhân viên dọn dẹp sạch các rong rêu trong đ à ồ à ước.

Dear Mr. Diao Peng,

After ADB-DFAT observations, we have checked and re-inspected your work package. We noted

some improvement in your work, especially for hazardous waste storages. We are highly

appreciated your cooperation on this work.

We also noted some remain ing environmental issues in your site as follows:

1. The batching plants in South side: there are no proper settling ponds and drainage systems.

This problem must be corrected following DONRE comments and ADB-DFAT observations.

However, you did not take any action. Thus we recommend you to temporary stop of two

batching plants in South sides till the corrective actions will be fulfilled.

2. The Tuan Loc batching plant on the Tien River: there are no storage or containers for

concrete waste and wastewater. The discharge is directly to the river. Please explain us the

method you had been used for disposing of concrete waste and how you treat your

wastewater. You are requested to have corrective actions on this issue as soon as possible.

If we still discover your waste dumping directly to the river, the Tuan Loc floating batching

plant will be terminated for working.

3. After DONRE comments on the wastewater from worker accommodation in the South side,

there is no action of wastewater discharge till now. The DONRE comments had been noticed

by MOT via the reference letter Ref. No. 16145/BGTVT-MT dated 041h December 2015. If

there is no action taken for this issue, we would recommend to CIPM and ADB for your non-

compliance action.

Other environmental issues have been described in the Environmental Inspection Report 24 Dec

2015 in the attachment. You are requested to correct our findings by 2nd January 2016.

Issues

The two settling ponds in two batching plants in South side are problematic. These settling ponds must

contain three separate ponds at least. These settling ponds should be re-designed and re-built to ensure

the effective treatment of wastewater from batching plant before discharge to public water body.

There are no effective drainage system in two batching plants in the South side. Therefore, the

wastewater from both batching plant spilled out of empty land and contaminated all empty land nearby

without any treatment. Contractor must create a good drainage system for both batching plants and this

wastewater must run into the settling pond instead of empty land surrounding. The wastewater in the

empty land must be transferred to settling ponds for treatment after these settling pond rebuilding. The

contaminated soil by wastewater must be removed to disposal area.

There are full of concrete waste from two batching plants. These concrete wastes must be collected and

removed to the approved disposal areas. This issues had been repeatedly reminded contractor.

The discharge of wastewater from Tuan Loc batching plant is to the river. Contractor must have the

collectors of the concrete waste and wastewater for casting activity of batching plant on river as

mentioned in the Batching plant environmental protection plant.

No plastic waste collection on site and no storage for metal waste. Contractor must collect all plastic

waste and store in the trash-bin or non-hazardous waste storage on site. The metal waste should be

located in the metal waste storage with roof and impermeable layer to avoid metal rust contamination

from weather effect.

Dear Mr. Diao Peng,

Refer to your letter No. CW1 B/DDIS/0953 dated 281h August 2015, we would like to give you our

feedback as follows:

1. EO mobilization: As we had discussed with your Safety and Environment Manager, DDIS

would like to request you to designate an Environmental Officer (separate from Safety duty)

which had mentioned in the contract. The person in charge of environment should be

competent and qualified with environmental background and experiences. However, your

staff has no background in environment and few working experiences for this field (especially

report preparation and checking). Therefore, we would like to insist you to mobilize your EO

a part from Safety duties which fu lfil requirement qualification in Specification.

2. Excavated soil/spoil : this soil in the North side must store in the approved disposal areas.

However, your structural excavation work has mostly completed on site but there is no

approved disposal area to dump this material. Thus, we would strongly request you to quickly

propose the disposal area for local authority.

Issues

Both batching plants are dirty and full of concrete waste. Settling pond in batching plants in south side

are problematic since these area are always overfilled. Since settling pond was full, the wastewater run

in shallow area nearby. The wastewater run into the supply water canal to agricultural field. This issues

had been reminded to contractor many times but there are no action and feedback. Contractor need to

clean these areas and remove all concrete waste as well solid waste under settling ponds as soon as

possible.

The cement chemicals had been leaking on the ground. The contractor need to clean this mess and stop

the leaking by replacing the containment.

Concrete pile heads locate on site. This concrete wastes should be stored in temporary storage and

completely removed to designated disposal area.

Fuel/oil leaking on the ground in the fabrication area. This contaminated materials/concrete must be

clean and collect to hazardous waste storage.

Metal waste was spread over on fabrication yard; this material should be stored in a designated area for

metal waste with barricade and (label) notification broad as reference.

Many chemicals/fuel on site are not labeled. It might be dangerous for workers and newcomer.

Contractor need to strictly require workers to label any can/drum/barrel of liquid materials.

Domestic waste was found on site and worker accommodation. Contractor must require cleaning activity

for these places and remind your worker to keep clean condition for their environment.

Chiếu theo số thư No. CW1B/DDIS/0953 ngày 28/08/2015 của nhà thầu, chúng tôi xin ph n hồi như sau:

1. Huy động nhân viên môi trường: Như chúng tôi đã th o luận với người qu n lý môi trường và an toàn bên ông, Tư v n yêu cầu ông cần ph i huy động một nhân viên môi trường (không liên quan đến các nhiệm vụ an toàn) như đã yêu cầu trên hợp đồng. Người nhân viên này chịu trách nhiệm môi trường cần ph i đ m b o trình độ và năng lực với kiến thức và kinh nghiệm làm môi trường. Tuy nhiên, nhân viên của ông vẫn chưa có ai có nền t ng kiến thức về môi trường và ít kinh nghiệm làm việc trong lĩnh vực này (đặc biệt đối với việc chuẩn bị báo cáo và kiểm tra báo cáo). Vì vậy, chúng tôi vẫn yêu cầu ông huy động nhân viên môi trường riêng tách ra từ các nhiệm vụ về an toàn và đáp ứng đầy đủ các yêu cầu trong Chỉ dẫn kỹ thuật.

2. Về đ t đổ th i: Đ t đổ th i ở khu vực bờ Bắc yêu cầu cần chuyển đến khu vực được ch p thuận đổ th i. Tuy niên những công tác đào móng bệ trụ đã gần hoàn thành ông vẫn chưa có một khu vực nào đổ th i được ch p thuận cho khu vực này. Vì vậy chúng tôi yêu cầu ông cần nhanh chóng trình nộp b i đổ th i tới chính quyền địa phương.

Ngoài ra, chúng tôi đã kiểm tra công trường ông trong thời gian gần đây và lưu ý một số v n đề vẫn còn tồn đọng từ nhiều tháng trước (theo báo cáo kiểm tra môi trường như trong b n đính kèm). Mong ông cần ph i đưa ra các hành động thực thi về các v n đề đã được mô t và ph n hồi chúng tôi vào ngày 02/10/2015.

Vấn đề

Cả hai trạm trộ àđều bẩn và tràn ngập các rác thải bê tông. Bể lắng của trạm trộn bên bờ Na àđãà àvấn

đề từ lâu vì bể lắng khu vực này luôn ngậpàđầy các bê tông lắng. Một khi bể lắ gàđãàđầ ,à ước thải

thường chảy vào khu vự àđất thấpà u gà ua h.àNước thải này sẽ được dẫn trực tiếpàđến khu vự àtưới

tiêu của các hoạtàđộng nông nghiệp. Vấ àđề àđãàđược nhắc nhở đến nhà thầu rất nhiều lầ à hư gànhà thầuàkh gà àh hàđộng thực thi hiệu quả. Nhà thầu cần phải dọn dẹp các khu vực này sạch sẽ và

chuyển toàn bộ à êàt gà ià ă gàdưà ũ gà hưà à àthải rắ àkh àđọ gàdưới bể lắ gàđià gà ha hàcàng tốt.

Các loại hóa chấtàd gà hoà ià ă gàđãà ị rò rỉ aà go ià ê àđất. Nhà thầu cần phải dọn dẹp khu vực này

v à gă à hặn các vết rò rỉ kia.

C àđầu cọc bê tông vẫ àđa gàđể t ê à gàt ường. Nhữ gàđầu cọc bê tông này cần vận chuyể àđến khu

chứa tạm thờiàt ê à gàt ường hoặc chuyể àđến khu vực tập kết bảiàđổ thảiàđãàđược phê duyệt.

Dầu tràn hoặc nhiên liệu tràn trên nền trong khu vự àđổ dầm. Các loại chấtà àđãà ị nhiễm dầu/nhiên

liệu cần phảiàđược dọn dẹp và thu gom vào khu vực để rác thải nguy hại.

Rác thải kim loạiàđể tràn lan trong khu vực ãiàđ àdầm; những tài liệu này cần phảiàđược dự trữ trong

khu vự àđược thiết kế cho vật liệu này vớiàđầ àđủ các cảnh báo, dây an toàn che chắn, bảng tên thông

báo.

Nhiều loại nhiên liệu/ ă g dầu không có nhãn mác. Các loại này có thể sẽ nguy hiể à hoà gười công

nhân hoặc nhữ gà gười mớiàđến. Nhà thầu cần phải nghiêm ngặt yêu cầu công nhân dán nhãn cho các

can, thùng vật liệu này.

Các loại rác thải sinh hoạtàđược tìm thấ àt ê à gàt ường và trong khu vực nhà ở của công nhân. Nhà

thầu cần yêu cầu các hoạtàđộng dọn dẹp cho những vị trí này và nhắc nhở công nhân giữ gìn vệ sinh.

Dear Mr. Huong,

Refer to your reference letter Ref. No. CW1 C/DDIS/0266 dated 071h December 2015, DDIS had

been re-inspected your corrective actions and site improvement on your CW1 C work package. We

observed many remaining issues which mentioned in the Environmental Inspection Report 18th Dec

2015 in the attachment.

We noted that many ADB-DFAT observation had not corrective yet.

No hazardous waste storage

Poor domestic garbage management with no proper solid waste storage

No action on concrete waste spillage from batching plant

We strongly request contractor to quickly take serious actions for ADB-DFAT observation and report

to us by 251h December 2015. Please review our Environmental Inspection Report 18th December

2015 to see remaining issues which we keep reminding for months. If no action is taken by the

deadline for batching plant and other relevant issues, we would take strong action to temporarily

stop work till ADB-DFAT and DDIS requirement is fulfilled.

Contractor many times. However, no action are taken. This sludge must be clean and removed to

• Metal waste was stored next to the office and worker accommodation without a proper storage. This

metal waste was reminded from months ago and no action is taken. Plus, some metal waste from

construction activity are dumped next to the river. This material should be stored in a designated area

for metal waste with barricade and (label) notification broad as reference. Without storage, the metal

waste must be removed as soon as possible to limit the metal leakage to soil/ground.

• The concrete pile head WliJ found on Jite without n proper Contl'llctor muJt collect hiJ concrete

• There was overspreading excavated soil on site without any proper storage. This soil must store in

designated area for disposal area. For reuse purpose, this soil should store in a temporary place with
