Synopsis
The Environmental Representative Report has been prepared to provide details of the actions and decisions on matters for which the Environmental Representative was responsible under the terms of the State Significant Infrastructure (SSI) Approval granted under the Environmental Planning & Assessment Act 1979 for the Eden Breakwater Wharf Extension (the Project).
Specifically, this Report has been prepared to address the requirements in Conditions A16(l) of the Infrastructure Approval (SSI 7734).

1 Introduction The Eden Breakwater Wharf Extension Project (the Project) includes the extension of the existing Eden Breakwater Wharf and associated dredging.
The Infrastructure Approval (SSI Approval No. 7734) was granted for the Project by the Executive Director, Priority Projects Assessment (as delegate of the Minister for Planning) on 5 July 2017.
The Construction Environmental Management Plan (CEMP) and CEMP Sub-plans have been prepared, approved by the Secretary of the Department of Planning and Environment (the DP&E) on the 22 August2017, and implemented. Revised CEMP and CEMP Sub-plans relevant to Stage 21 of the Project were updated and subsequently approved by DP&E on 28 February 2018.
This Environmental Representative (ER) Report (Report) addresses Condition A16(l) of the Infrastructure Approval. This Report provides an update on the environmental and social performance of the Project’s construction.
1.1 Purpose and Content of this Report
Condition A16(l) of the Infrastructure Approval requires an ER Report to be prepared and submitted to the Secretary for information each month. This will be submitted within seven days following the end of eachmonth for the duration of Construction of the Project or as otherwise negotiated with the Secretary. The report details the actions and decisions on matters for which the ER was responsible in the preceding month.
Further, Condition C16 requires the results of the Construction Monitoring Programs be submitted to the Secretary and relevant regulatory agencies, for information at the frequency identified in the relevant Construction Monitoring Program. As these reports will be monthly, relevant information will be contained and submitted along with this report.
Construction of Stage 1 commenced on 4 September 2017, as marked by the arrival of the tugs, split-hopper barges and the dredge. Construction of Stage 2 commenced on 13 April 2018, as marked by the commencement of survey for scour protection removal in anticipation of pile installation. This report covers construction activities from 1 August 2018 to 31 August 2018.
1.2 Project Description The Project is located in Snug Cove, Eden, New South Wales and comprises the extension of the existing Eden Breakwater Wharf and dredging of the approach channel and berth pocket with offshore disposal, to accommodate the berthing of cruise ships of up to 325m in length.
1 Stage 2 is outlined in the Project Staging Report (Advisian 2017, as submitted to the Secretary 24 July 2017 in accordance with Condition A37 of the Infrastructure Approval)

Key features of the Project include:
Extension of the existing wharf by approximately 95m, including 78 piles to support the extension
Installation of three mooring dolphins and two berthing dolphins, including 30 piles Installation of new landside bollards to restrain the ship’s bow, including 18 piles Dredging of 210,148m³ of in-situ material (including over-dredging allowance) Transport and placement of the dredge material at an offshore disposal site
Installation of minor services (lighting, power, potable water and emergency water) Installation of navigational aids.
1.3 Project Status During the period covered by this report (1 August 2018 to 31 August 2018), the following key activities wereundertaken and milestones achieved relating to the Project:
On-site noise monitoring is ongoing
Piling works are ongoing (refer to Figure 1-1), 78 wharf piles (56 complete and 22 partially complete) and nine onshore bollard piles have been completed
Dolphin topside fabrication is ongoing (off-site fabrication) Precast concrete deck plank fabrication is complete and Silane treatment commenced Precast concrete headstock troughs fabrication is ongoing, 18 have been poured One headstock installed on the wharf Temporary works have commenced for transition wharf Trimming piles is ongoing
Removal of rock amour and pile gate poured for navigational aid/tower.

2 Review and Amendments to the CEMP or Approvals
2.1 CEMP amendments The CEMP and CEMP Sub-plans for Stage 1 of the Project were formally approved by the Secretary on 22 August 2017.
The CEMP and CEMP Sub-plans for Stage 2 of the Project were prepared and submitted to DP&E for approval. The CEMP and CEMP Sub-plans were approved by the Secretary on 28 February 2018.
During the period covered by this report, there were no reviews or minor amendments made to the CEMP and/or CEMP Sub-plans.
2.2 Infrastructure Approval Amendments Consultation is ongoing with DP&E and the Community Consultation Committee (CCC) regarding a potential modification to operational conditions concerning the environmental management of noise amenity and airquality (E17, E18, E20, and E22). Written comments have been received regarding the potential amendments, some comments support the changes and some comments raise concerns.
A Modification Request was formally submitted to DP&E on the 04 July 2018. The DP&E placed themodification request on public exhibition from 13 July to Friday 27 July 2018.
On the 03 August 2018, the DP&E provided a letter requesting a response to the issues raised in submissionsand requested additional information to support the proposed modifications. The Department received a total of 18 submissions on the Modification Request, including:
Five regulatory agencies (NSW Office of Environment and Heritage, NSW Environment Protection Authority, NSW Department of Industry, Transport for NSW and Bega Valley Shire Council)
Four organisations (Cat Balou Cruises, Bega Valley Shire Residents and Ratepayers Association Inc, Eden Tourism Incorporated and Sapphire Coast Buslines)
Nine private stakeholders. Of the 18 submissions, only one objected to the Modification Request related to the proposed modification of Conditions E20 and E22 (related to air quality). A Response to Submissions Report was submitted to the Department on the 03 September 2018 for assessment and a decision

3 Environmental Performance Environmental performance was measured through observation of construction activities and identification of continual improvement opportunities.
3.1 Environmental Issues For this reporting period, two environmental performance issues occurred on-site.
3.1.1 Minor Hydraulic Oil Leak On 23 August 2018, the Pilequip ICE 44B Vibro Hammer was laid on the wharf, with the hydraulic hose lines secured and capped, awaiting repair of a coupling seal failure on the main hose. On 24 August 2018 it was relocated on the wharf for space utilisation and production reasons. While stored on the wharf, a leak developed and oil spilled on the ground. The spill was noticed on arrival on site and walk around on 27 August 2018, after the weekend. Spill pads were deployed and the hammer elevated to stop the spill. Indiscussion with the hydraulic fitter it was found that the Pilequip ICE 44B Vibro Hammer is required to bestored on an angle to prevent the hydraulic sump stored fluid level from covering the Thermo Relief valve opening. Once the issue was identified the hammer was repositioned to clean up the spill. The hammer was stored on an incline to ensure the free fluid in the sump did not cover the valve. No further spill has occurred.
An incident report was prepared and it was noted that there was no impact to the environment and the report was closed out. An upright storage frame will be implemented to prevent a reoccurrence.
3.1.2 Use of Cordless Hammer Drill On 29 August 2018, the Proponent advised that the preparation of the surface profile on the fender headstocks currently on the barge, were not prepped to the correct profile, as per the specification andrequested approval from the ER to scabble the pockets on the barge using a Milwaukee cordless hammer drill. The contractor provided an outline of the required works, environmental control and monitoring measures, the duration and timing of works and community engagement activities.
On 29 August 2018 and having reviewed to the CEMP, the description of required works and environmental control measures, the ER advised that the works required to be carried out are generally in accordance withthe Infrastructure Approval terms and intent of the CEMP. Their impact is also consistent with the existingenvironmental risk assessment for this stage.
The work was carried out on 31 August 2018. For the remainder of construction, green cutting of the construction joints will be carried out in accordance with the CEMP.

4 Environmental Monitoring Summary Monitoring for Stage 2 activities included observations on aquatic ecology, water quality and air quality, and site-based monitoring for noise amenity and vibration. No observations have identified any adverse environmental impacts due to the Project.
Marine Mammal Observer (MMO) trained personnel were onsite conducting observations during piling works in line with the requirements of the EPBC Act Referral Decision Notice conditions. The following was noted during this reporting period:
No incidents involving marine mammals have occurred
Whales have been sighted within Twofold Bay, with one observed in the Observation Zone during the reporting period. To date there have been no sightings of whales within the shut-down zone (refer to Appendix A for the Whale Register.
The Observation and Shut down zones were increased on the 30 August to 2.2km and 1.3km (respectively) to cater for the whale migration and as prescribed in the EPBC referral (EPBC2016/7828).
4.1 Noise and Vibration Monitoring Noise and vibration monitoring equipment was installed on the 27 April 2018 prior to the commencement of piling on the 28 April 2018. The vibration monitoring equipment was in place for two weeks and has now been removed, and noise monitoring equipment will remain in place for during of piling to monitor any adverse impacts. No noise or vibrations incidents or non-conformances have been raised during this reporting period.
A Piling Construction Noise Monitoring report dated 06 September 2018, has been developed by ERM and is attached at Appendix B. This report has been prepared in accordance with the Noise and Vibration CEMP Sub-plan and outlines the results for the continuous monitoring period from 01 – 31 August 2018. Weeklystatistics are provided in the reports since the commencement of piling.
The results of the monitoring were compared to the predicted noise levels outlined in the EIS and the Noise and Vibration CEMP Sub-plan for the Project. Based on continuous monitoring and identified periods of piling activity, it is evident that while site activities are audible and contribute to the noise environment at the identified sensitive receivers, noise impacts are below Approved Noise Levels during identified periods of piling activities. Noise levels at both logging locations were found to be heavily influenced by prevailing wind conditions.
The report recommended that ongoing noise monitoring be maintained as per the program, and noise impacts be reviewed where any significant changes to piling equipment or operation occurs, particularly once dolphin piling works commence.

ERM was engaged by Waterway Constructions Pty Ltd (Waterway) to complete ongoing noise
monitoring as part of Stage 2 of the Eden Breakwater Wharf Extension. Noise monitoring is
required as part of the Noise and Vibration CEMP Sub-plan for the works, and as a requirement
of Infrastructure Approval (SSI 7734, July 2017), stated by the Department of Planning and
Environment (DP&E).
The attached document is an assessment of noise impacts from piling for the period 1st to 31st
August 2018.

1 Introduction
The monitoring scope included long term unattended monitoring at two locations after the
commencement of piling activities. This report outlines the results for the period 1st to 31st August
2018. Weekly statistics have been presented for Weeks 15 to 19 in this report, being the weeks
since the commencement of piling and monitoring.

2 Monitoring Locations and Approved Noise Levels
2.1 Sensitive Receivers and Monitoring Locations
Individual receiver locations and addresses are indicated in the Air Quality and Noise
Assessment (PEL 2016a), and reproduced in Attachment B. Monitoring locations are presented in
Attachment B and Figure 2-1.
Location L1 was required for monitoring as part of Stage 1 of the Eden Breakwater Extension, but
is not required as part of Stage 2, however naming has been maintained for the remaining sites
for consistency with previous reports.

2.2 Approved Noise Management Levels
The noise limits for the project are stated in the CEMP and are based on noise predictions from
the Air Quality and Noise Assessment (Pacific Environment, 2016). Model Scenario 3 includes
impact piling at the port, and a situation where piling equipment is relocated to the wave
attenuator. Noise levels have been presented at the receivers adjacent the noise loggers, being
SR43 at By Street (L2) and SR21 Victoria Terrace (L3). These are reproduced in Table 2-3.
Noise levels have been presented with the magnitude of noise exceedances as per Table 2.2,
with the results applied in subsequent table. Red background indicates noise levels in
exceedance of the highly noise affected criteria.

3 Noise Monitoring
3.1 Equipment Failure
Due to ongoing issues with the noise monitors modems failing to consistently connect to the mobile
phone network, and subsequent data loss, replacement monitors were swapped over to allow for
testing by the equipment manufacturer. The following instruments were in place:
Location L2, By Street – swapped to logger serial number 8780A2 on 31st of July, and
subsequently a replacement battery installed on the 7th of August.
Location L3 Victoria Terrace swapped to logger serial number 8780A3 on 8th of August.
3.2 Monitoring Methodology
Continuous unattended noise monitoring was completed with Class 1 noise loggers with reference
to AS1055.1:1997. Instrumentation calibrated by a NATA testing laboratory with in field checks of
instrument calibration. Noise loggers were set to record A-weighted noise levels every 15 minutes
and set to ‘fast’ response time. Calibration was checked monthly with no significant drift observed.
All logging equipment carry current NATA calibration certificates (Attachment D).
Noise logging graphs and daily summaries for location L2 and L3 between the 1st and 31st August
2018 are summarised in Attachment C. The existing noise environment was influenced by
prevailing wind conditions and sea swell.
With regard to the approved noise levels (Table 2-3), piling noise levels are to comply with
77 dB(A) at L2 and 75 dB(A) at L3. It is noted that these levels are based on 15 minute
assessment periods.
The instantaneous maximum piling noise impact can generally be approximated from the
maximum noise levels recorded in the daily logger graphs (Attachment C) when piling is being
undertaken.
Weekly statistics for location L2 and L3 are discussed in the following sections for the period of
continuous data collection.
4 Results
4.1 Week 15 – 1st to 31st August 2018
During Week 15, piling only occurred on 1st August 2018 between 07:30 and 12:46; on 2nd August
2018 between 08:23 and 16:55; and on 7th August 2018 between 09:17 and 17:11.

4.1.1 Location L2, 8 By Street Due to equipment error, data was not captured for 6th and 7th August 2018 at Location L2.
Average noise level (LAeq) varied from 39 dB(A) to 64 dB(A) during the day time period. The
maximum noise levels (LMax) ranged from 52 dB(A) to 85 dB(A) during the day time period.
During Week 15, piling LAeq noise levels were measured from 46 to 64 dB(A). Lmax levels during
these periods ranged between 55 to 80 dB(A). Lmax peaks were typically between 70 to 77 dB(A),
with a single peak event of 80 dB(A) recorded on 2nd August.
LAeq 15 minute average noise levels during the day time period did not exceed 77 dB(A).
4.1.2 Location L3, 17 Victoria Terrace Due to equipment error, data was not captured at Location L3 for Week 15 of the monitoring
program.
4.2 Week 16 – 8th to 14th August 2018
During Week 16, piling was undertaken on 8th August 2018 between 08:03 to 17:04; on 9th August
2018 between 08:15 to 15:07; and on 10th August 2018 between 08:37 and 11:30.
4.2.1 Location L2, 8 By Street The average noise level (LAeq) varied from 38 dB(A) to 66 dB(A) during the day time period. The
maximum noise level (LMax) varied from 50 dB(A) to 86dB(A) during the day time period.
During Week 16, piling LAeq noise levels were measured from 40 to 63 dB(A). Lmax levels during
these periods ranged between 57 to 77 dB(A). Lmax peaks were typically between 65 to 75 dB(A).
LAeq 15 minute average noise levels during the day time period did not exceed 77 dB(A), except on
8th August where the measurements were influenced by equipment calibration checks and
maintenance activity, occurring between 16:30 and 17:00.
4.2.2 Location L3, 17 Victoria Terrace The average noise level (LAeq) varied from 36 dB(A) to 68 dB(A) during the day time period. The
maximum noise levels (LMax) ranged from 52 dB(A) to 87 dB(A) during the day time period.
At L3, piling LAeq noise levels were measured from 44 to 68 dB(A). Lmax levels during these periods
ranged between 60 to 80 dB(A). Lmax peaks were typically between 60 to 77 dB(A).
LAeq 15 minute average noise levels during the day time period did not exceed 75 dB(A).
4.3 Week 17 - 15th to 21st August 2018
No piling was undertaken during Week 17.

At L3 during Week 17, noise levels were measured between 50 to 65 dB(A). As no piling was
undertaken during Week 12, recorded noise levels can be attributed to existing environmental
noise.
LAeq 15 minute average noise levels during the day time period did not exceed 75 dB(A).
4.4 Week 18 – 22nd to 28th August 2018
No piling was undertaken during Week 18.
4.4.1 Location L2, 8 By Street The average noise level (LAeq) varied from 39 dB(A) to 68 dB(A) during the day time period. The
maximum noise level (LMax) varied from 53 to 89 dB(A) during the day time period. As no piling was
undertaken during Week 18, recorded noise levels can be attributed to existing environmental
noise.
4.4.2 Location L3, 17 Victoria Terrace The average noise level (LAeq) varied from 40 dB(A) to 62 dB(A) during the day time period. The
maximum noise levels (LMax) ranged from 57 dB(A) to 85 dB(A) during the day time period. As no
piling was undertaken during Week 12, recorded noise levels can be attributed to existing
environmental noise.
4.5 Week 19 – 29th to 31st August 2018
During Week 19, piling was undertaken on 30th August between 07:30 to 14:15.
4.5.1 Location L2, 8 By Street The average noise level (LAeq) varied from 42 dB(A) to 66 dB(A) during the day time period. The
maximum noise level (LMax) varied from 49 to 96 dB(A) during the day time period.

exceed 77 dB(A).
4.5.2 Location L3, 17 Victoria Terrace The average noise level (LAeq) varied from 40 to 60 dB(A) during the day time period. The maximum
noise levels (LMax) ranged from 56 dB(A) to 84 dB(A).
At L3, piling LAeq noise levels were measured from 44 to 59 dB(A). Lmax levels during these periods
ranged between 59 to 78 dB(A). Lmax peaks were typically between 70 to 75 dB(A).
LAeq 15 minute average noise levels during the day time of the period 29th to 31st August did not
exceed 75 dB(A).
4.6 Statement of Compliance
Based on continuous monitoring and identified periods of piling activity, it is evident that while site
activities are audible and contribute to the noise environment at the identified sensitive receivers,
noise impacts are below Approved Noise Levels during identified periods of piling activities.
For weeks 15 to 19, measured LAeq average noise levels during the daytime period at location L2
(By St) did not exceed 77 dB(A).
For Weeks 15 to 19, LAeq average noise level noise levels during the daytime at location L3 (Victoria
Terrace) did not exceed 75 dB(A).
At both monitoring locations, instantaneous maximum noise levels were estimated at being above
70 dB(A) at several short interval events throughout the monitoring period, however these levels
were not sustained and did not result in exceedance of the approved LAeq 15minute noise levels.
Noise levels were found to be impacted by prevailing wind conditions. As noted during previous
attended monitoring campaigns, winds tend to be elevated during the daytime period, which
results in increased noise levels received at the logging locations.
5 Conclusion
ERM has completed ongoing noise monitoring as part of Stage 2 of the Eden Breakwater Wharf
Extension. Noise monitoring is required as part of the Noise and Vibration CEMP Sub-plan for the
works, and as a requirement of Infrastructure Approval (SSI 7734, July 2017), stated by the
Department of Planning and Environment (DP&E).
This report presents noise impacts from piling for the period 1st to 31st August 2018 for Weeks 15
to 19 of the monitoring schedule.

The results of monitoring were compared to the Project Approval limits. Measured noise levels
have been below the Approval limits referred to in the Infrastructure Approval. Noise levels at
both logging locations were found to be heavily influenced by prevailing wind conditions.
It is recommended that ongoing noise monitoring be maintained as per the program, and noise
impacts be reviewed where any significant changes to piling equipment or operation occurs,
particularly once dolphin piling works commence.

Term Description
Weather conditions that affect noise measurements (wind, rain and temperature inversions) that occur at a particular site for a significant period of time. The
Adverse weather maximum wind speed allowed during acoustics measurements is 5m/s. No rain is allowed.
The all-encompassing noise environment at a given location, comprising sources in Ambient noise
the near and far field.
Assessment The period in a day over which assessments are made.

Adjustment made to a noise level based on international standards. Approximates a A-weighting
human’s hearing response to frequency at lower sound levels.
Background noise is the term used to describe the underlying level of noise present in an area, measured in the absence of any extraneous noise. Typically when

LA1,T The noise level exceeded for 1% of the time period, T.
LA10,T The noise level exceeded for 10% of the time period, T.
The noise level exceeded for 90% of the time period, T. Commonly referred to as the LA90,T background noise level.
The equivalent average noise level of the time period, T. It represents in a single LAeq,T number, the energy of the actual fluctuating noise level over the period.
LAmax,T The maximum noise level measured during the period, T.
Rating Background Level. The background noise level as defined by the NSW RBL Industrial Noise Policy (EPA, 2000). It is calculated by the taking the median value of
the lowest 10th percentile LA90 measurements in any day, evening or night period.
Is the difference between the pressure produced by a sound wave and the Sound Pressure
barometric (ambient) pressure at the same point in space. Typically expressed in Level (SPL)
decibels, as measured by a standard sound level meter with a microphone.
