VORWORT Die vorliegende 12., durchgesehene Auflage der Textausgabe des Europischen Patentbereinkommens enthlt die Texte des bereinkommens ber die Erteilung europischer Patente (Fassung vom 1. Januar 2006) und seiner Ausfhrungsordnung (Fassung vom 1. Juli 2005), des Zentralisierungsprotokolls vom 5. Oktober 1973, des Anerkennungsprotokolls vom 5. Oktober 1973, des Protokolls ber Vorrechte und Immunitten vom 5. Oktober 1973 und der Gebhrenordnung (Fassung vom 1. April 2006). Von der Diplomatischen Konferenz 2000 (siehe ABl. EPA 2001, Sonderausgabe Nr. 4) wurden am 29.11.2000 zahlreiche nderungen des EP angenommen. Vorlufig anwendbar und damit unmittelbar wirksam sind die nderungen der Artikel 16, 17, 18, 37, 38, 42 und 50 EP, des Zentralisierungsprotokolls und das Personalstandsprotokoll. Diese neuen Vorschriften wurden zustzlich zu den bestehenden Texten aufgenommen. Die Textausgabe enthlt auerdem ein Verzeichnis der verffentlichten Entscheidungen/ Stellungnahmen der Groen Beschwerdekammer (Anhang I), eine bersicht ber die Rechtsausknfte des EPA (Anhang II) und ein alphabetisches Sachregister. PREFACE This 12th, revised edition of the European Patent Convention contains the texts of the Convention on the Grant of European Patents (version as of 1 January 2006) and its Implementing Regulations (version as of 1 July 2005), the Protocol on Centralisation of 5 October 1973, the Protocol on Recognition of 5 October 1973, the Protocol on Privileges and Immunities of 5 October 1973 and the Rules relating to Fees (version as of 1 April 2006). On 29.11.2000, the Diplomatic Conference 2000 (see OJ EPO 2001, Special edition No. 4) adopted numerous amendments to the EPC. The amendments to Articles 16, 17, 18, 37, 38, 42, and 50 EPC, to the Protocol on Centralisation and the Protocol on the Staff Complement are provisionally applicable, and thus already in effect. These new provisions have been inserted in addition to the existing texts. Moreover, the revised edition encompasses an index of published decisions/opinions of the Enlarged Board of Appeal (Annex I), Legal Advice from the EPO in brief (Annex II) and an alphabetical keyword index. INTRODUCTION La douzime dition rvise de la Convention sur le brevet europen comprend les textes mis jour de la Convention sur la dlivrance de brevets europens er (rdaction du 1 janvier 2006) avec son rglement er d'excution (rdaction du 1 juillet 2005), du protocole sur la centralisation du 5 octobre 1973, du protocole sur la reconnaissance du 5 octobre 1973, du protocole sur les privilges et immunits du 5 octobre 1973 et du rglement relatif aux taxes (rdaction du er 1 avril 2006). Le 29.11.2000, la Confrence diplomatique 2000 (cf. JO OEB 2001, dition spciale o n 4) a adopt de nombreuses modifications la CBE. Les articles 16, 17, 18, 37, 38, 42 et 50 CBE et le Protocole sur la centralisation tels qu'amends et le Protocole sur les effectifs sappliquent titre provisoire et prennent donc immdiatement effet. Ces nouvelles dispositions ont t insres en sus des textes existants. L'dition rvise contient en outre une liste des dcisions/avis publis de la Grande Chambre de recours (Annexe I), un tableau rcapitulatif des renseignements juridiques communiqus par l'OEB (Annexe II) et un index alphabtique. Die vom Verwaltungsrat der Europischen Patentorganisation seit dem Inkrafttreten des bereinkommens am 7. Oktober 1977 beschlossenen nderungen des bereinkommens, der Ausfhrungsordnung und der Gebhrenordnung sind in Funoten zu den betroffenen Bestimmungen kenntlich gemacht. Sie weisen das Datum des entsprechenden Verwaltungsratsbeschlusses, den Zeitpunkt seines Inkrafttretens und die Fundstelle seiner Verffentlichung im Amtsblatt des Europischen Patentamts (ABl. EPA) aus. Bei einigen wenigen Vorschriften, deren redaktionelle Fassung zu Zweifeln Anlass geben knnte, erschien es ntzlich, durch Randvermerke darauf hinzuweisen. Neben den Texten des bereinkommens und der Ausfhrungsordnung erscheinen Verweisungen auf einschlgige Artikel und Regeln. In den einzelnen Vorschriften selbst bereits zitierte Artikel und Regeln werden jedoch nicht nochmals angefhrt. Es wird ausdrcklich darauf hingewiesen, dass diese Verweisungen nicht Bestandteil der offiziellen Texte des bereinkommens sind, sondern, ohne Anspruch auf Vollstndigkeit zu erheben, die praktische Handhabung der Textausgabe erleichtern sollen. Hierzu dienen auch die o.g. Anhnge I und II sowie das alphabetische Sachregister. Hinweise auf die Aktenzeichen der Entscheidungen/Stellungnahmen der Groen Beschwerdekammer und auf die Nummern der Rechtsausknfte sind bei den betroffenen Artikeln und Regeln als Funoten abgedruckt. These footnotes give the date of the Administrative Council decision concerned, the date on which it entered into force and the reference to the Official Journal of the European Patent Office (OJ EPO) in which it was published. It has been thought useful to indicate, by way of marginal notes, some provisions the drafting of which might give rise to misinterpretation. References to pertinent Articles and Rules appear on the right-hand side of the text of the Convention and its Implementing Regulations. However, Articles and Rules already quoted in the provisions themselves are not again indicated. It is expressly pointed out that these references do not form part of the official text. They are simply intended to facilitate its use, and do not claim to be exhaustive. Annexes I, II and the alphabetical keyword index as mentioned above are designed to serve the same purpose. PRAMBELDie Vertragsstaaten in dem Bestreben, die Zusammenarbeit zwischen den europischen Staaten auf dem Gebiet des Schutzes der Erfindungen zu verstrken, in dem Bestreben, einen solchen Schutz in diesen Staaten durch ein einheitliches Patenterteilungsverfahren und durch die Schaffung bestimmter einheitlicher Vorschriften fr die nach diesem Verfahren erteilten Patente zu erreichen, in dem Bestreben, zu diesen Zwecken ein bereinkommen zu schlieen, durch das eine Europische Patentorganisation geschaffen wird und das ein Sonderabkommen im Sinn des Artikels 19 der am 20. Mrz 1883 in Paris unterzeichneten und zuletzt am 14. Juli 1967 revidierten Verbandsbereinkunft zum Schutz des gewerblichen Eigentums und einen regionalen Patentvertrag im Sinn des Artikels 45 Absatz 1 des Vertrags ber die internationale Zusammenarbeit auf dem Gebiet des Patentwesens vom 19. Juni 1970 darstellt sind wie folgt bereingekommen:

PART I GENERAL AND INSTITUTIONAL PROVISIONSChapter I General provisions Article 1 European law for the grant of patents A system of law, common to the Contracting States , for the grant of patents for invention is hereby established. Article 2 European patent (1) Patents granted by virtue of this Convention shall be called European patents. (2) The European patent shall, in each of the Contracting States for which it is granted, have the effect of and be subject to the same conditions as a national patent granted by that State, unless otherwise provided in this Convention. Article 3 Territorial effect The grant of a European patent may be requested for one or more of the Contracting States.1

European Patent Organisation (1) A European Patent Organisation, hereinafter referred to as the Organisation, is established by this Convention. It shall have administrative and financial autonomy. (2) The organs of the Organisation shall be: (a) a European Patent Office; (b) an Administrative Council. (3) The task of the Organisation shall be to grant European patents. This shall be carried out by the European Patent Office supervised by the Administrative Council.

(2) Die Organisation besitzt in jedem Vertragsstaat die weitestgehende Rechts- und Geschftsfhigkeit, die juristischen Personen nach dessen Rechtsvorschriften zuerkannt ist; sie kann insbesondere bewegliches und unbewegliches Vermgen erwerben und veruern sowie vor Gericht stehen. (3) Der Prsident des Europischen Patentamts vertritt die Organisation. Artikel 6 Sitz (1) Die Organisation hat ihren Sitz in Mnchen. (2) Das Europische Patentamt wird in Mnchen errichtet. Es hat eine Zweigstelle in Den Haag. Artikel 75 4

Artikel 8 Vorrechte und Immunitten Die Organisation, die Mitglieder des Verwaltungsrats, die Bediensteten des Europischen Patentamts und die sonstigen Personen, die in dem diesem bereinkommen beigefgten Protokoll ber Vorrechte und Immunitten bezeichnet sind und an der Arbeit der Organisation teilnehmen, genieen in den Hoheitsgebieten der Vertragsstaaten die zur Durchfhrung ihrer Aufgaben erforderlichen Vorrechte und Immunitten nach Magabe dieses Protokolls.

Sub-offices of the European Patent Office By decision of the Administrative Council, sub-offices of the European Patent Office may be created if need be, for the purpose of information and liaison, in the Contracting States and with inter-governmental organisations in the field of industrial property, subject to the approval of the Contracting State or organisation concerned.

Article 8 Privileges and immunities The Protocol on Privileges and Immunities annexed to this Convention shall define the conditions under which the Organisation, the members of the Administrative Council, the employees of the European Patent Office and such other persons specified in that Protocol as take part in the work of the Organisation, shall enjoy, in the territory of each Contracting State, the privileges and immunities necessary for the performance of their duties.

Artikel 9 Haftung (1) Die vertragliche Haftung der Organisation bestimmt sich nach dem Recht, das auf den betreffenden Vertrag anzuwenden ist. (2) Die auervertragliche Haftung der Organisation fr Schden, die durch sie oder die Bediensteten des Europischen Patentamts in Ausbung ihrer Amtsttigkeit verursacht worden sind, bestimmt sich nach dem in der Bundesrepublik Deutschland geltenden Recht. Ist der Schaden durch die Zweigstelle in Den Haag oder eine Dienststelle oder durch Bedienstete, die einer dieser Stellen angehren, verursacht worden, so ist das Recht des Vertragsstaats anzuwenden, in dem sich die betreffende Stelle befindet. (3) Die persnliche Haftung der Bediensteten des Europischen Patentamts gegenber der Organisation bestimmt sich nach den Vorschriften ihres Statuts oder der fr sie geltenden Beschftigungsbedingungen. (4) Fr die Regelung der Streitigkeiten nach den Abstzen 1 und 2 sind folgende Gerichte zustndig: a) bei einer Streitigkeit nach Absatz 1 das zustndige Gericht der Bundesrepublik Deutschland, sofern in dem von den Parteien geschlossenen Vertrag nicht ein Gericht eines anderen Staats bestimmt worden ist; b) bei einer Streitigkeit nach Absatz 2, je nach Lage des Falls, entweder das in der Bundesrepublik Deutschland zustndige Gericht oder das zustndige Gericht des Staats, in dem sich die Zweigstelle oder die Dienststelle befindet.

Article 9 Liability (1) The contractual liability of the Organisation shall be governed by the law applicable to the relevant contract. (2) The non-contractual liability of the Organisation in respect of any damage caused by it or by the employees of the European Patent Office in the performance of their duties shall be governed by the provisions of the law of the Federal Republic of Germany. Where the damage is caused by the branch at The Hague or a sub-office or employees attached thereto, the provisions of the law of the Contracting State in which such branch or sub-office is located shall apply. (3) The personal liability of the employees of the European Patent Office towards the Organisation shall be laid down in their Service Regulations or conditions of employment. (4) The courts with jurisdiction to settle disputes under paragraphs 1 and 2 shall be: (a) for disputes under paragraph 1, the courts of competent jurisdiction in the Federal Republic of Germany, unless the contract concluded between the parties designates the courts of another State; (b) for disputes under paragraph 2, either the courts of competent jurisdiction in the Federal Republic of Germany, or the courts of competent jurisdiction in the State in which the branch or sub-office is located.

Kapitel III Das Europische Patentamt Artikel 10 Leitung (1) Die Leitung des Europischen Patentamts obliegt dem Prsidenten, der dem Verwaltungsrat gegenber fr die Ttigkeit des Amts verantwortlich ist. (2) Zu diesem Zweck hat der Prsident insbesondere folgende Aufgaben und Befugnisse: a) er trifft alle fr die Ttigkeit des Europischen Patentamts zweckmigen Manahmen, einschlielich des Erlasses interner Verwaltungsvorschriften und der Verffentlichung von Mitteilungen an die ffentlichkeit;6

Chapter III The European Patent Office Article 10 Direction (1) The European Patent Office shall be directed by the President who shall be responsible for its activities to the Administrative Council. (2) To this end, the President shall have in particular the following functions and powers: (a) he shall take all necessary steps, including the adoption of internal administrative instructions and the publication of guidance for the public, to ensure the functioning of the European Patent Office;6

Article 9 Responsabilit (1) La responsabilit contractuelle de lOrganisation est rgie par la loi applicable au contrat en cause. (2) La responsabilit non contractuelle de lOrganisation en ce qui concerne les dommages causs par elle et par les agents de lOffice europen des brevets dans lexercice de leurs fonctions est rglemente conformment aux dispositions de la loi en vigueur en Rpublique fdrale dAllemagne. Si les dommages ont t causs par le dpartement de La Haye ou par une agence, ou par des agents relevant du dpartement ou de cette agence, la loi applicable est celle de lEtat contractant dans lequel le dpartement ou lagence est situ. (3) La responsabilit personnelle des agents de lOffice europen des brevets envers lOrganisation est rgle dans les dispositions fixant leur statut ou le rgime qui leur est applicable. (4) Les juridictions comptentes pour rgler les litiges viss aux paragraphes 1 et 2 sont : a) en ce qui concerne les litiges viss au paragraphe 1, les juridictions comptentes de la Rpublique fdrale dAllemagne, dfaut de la dsignation de la juridiction dun autre Etat dans le contrat conclu entre les parties ; b) en ce qui concerne les litiges viss au paragraphe 2, selon le cas, soit les juridictions comptentes de la Rpublique fdrale dAllemagne, soit les juridictions comptentes de lEtat dans lequel le dpartement ou lagence est situ. Chapitre III LOffice europen des brevets Article 10 Direction (1) La direction de lOffice europen des brevets est assure par le Prsident, qui est responsable de lactivit de lOffice devant le Conseil dadministration. (2) A cet effet, le Prsident a notamment les comptences ci-aprs : a) il prend toutes mesures utiles, notamment ladoption dinstructions administratives internes et la publication dindications pour le public, en vue dassurer le fonctionnement de lOffice europen des brevets ;6

b) er bestimmt, soweit in diesem bereinkommen hierber nichts vorgesehen ist, welche Handlungen beim Europischen Patentamt in Mnchen und welche Handlungen bei seiner Zweigstelle in Den Haag vorzunehmen sind; c) er kann dem Verwaltungsrat Vorschlge fr eine nderung dieses bereinkommens sowie Entwrfe fr allgemeine Durchfhrungsbestimmungen und Beschlsse vorlegen, die zur Zustndigkeit des Verwaltungsrats gehren; d) er bereitet den Haushaltsplan und etwaige Berichtigungs- und Nachtragshaushaltsplne vor und fhrt sie aus; e) er legt dem Verwaltungsrat jedes Jahr einen Ttigkeitsbericht vor; f) er bt das Weisungsrecht und die Aufsicht ber das Personal aus; g) vorbehaltlich Artikel 11 ernennt er die Bediensteten und entscheidet ber ihre Befrderung; h) er bt die Disziplinargewalt ber die nicht in Artikel 11 genannten Bediensteten aus und kann dem Verwaltungsrat Disziplinarmanahmen gegenber den in Artikel 11 Abstze 2 und 3 genannten Bediensteten vorschlagen; i)7

(b) in so far as this Convention contains no provisions in this respect, he shall prescribe which transactions are to be carried out at the European Patent Office at Munich and its branch at The Hague respectively; (c) he may place before the Administrative Council any proposal for amending this Convention and any proposal for general regulations or decisions which come within the competence of the Administrative Council; (d) he shall prepare and implement the budget and any amending or supplementary budget; (e) he shall submit a management report to the Administrative Council each year; (f) he shall exercise supervisory authority over the personnel; (g) subject to the provisions of Article 11, he shall appoint and promote the employees; (h) he shall exercise disciplinary authority over the employees other than those referred to in Article 11, and may propose disciplinary action to the Administrative Council with regard to employees referred to in Article 11, paragraphs 2 and 3; (i)7

Sie knnen vom Verwaltungsrat nach Anhrung des Prsidenten des Europischen Patentamts wieder ernannt werden. (4) Der Verwaltungsrat bt die Disziplinargewalt ber die in den Abstzen 1 bis 3 genannten Bediensteten aus.

(3) The President shall be assisted by a number of Vice-Presidents. If the President is absent or indisposed, one of the Vice-Presidents shall take his place in accordance with the procedure laid down by the Administrative Council.

Article 11 Appointment of senior employees (1) The President of the European Patent Office shall be appointed by decision of the Administrative Council. (2) The Vice-Presidents shall be appointed by decision of the Administrative Council after the President has been consulted. (3) The members, including the Chairmen, of the Boards of Appeal and of the Enlarged Board of Appeal shall be appointed by decision of the Administrative Council, taken on a proposal from the President of the European Patent Office. They may be re-appointed by decision of the Administrative Council after the President of the European Patent Office has been consulted. (4) The Administrative Council shall exercise disciplinary authority over the employees referred to in paragraphs 1 to 3.

b) il dtermine, dans la mesure o la prsente convention ne comporte aucune disposition cet gard, les formalits qui doivent tre accomplies respectivement auprs de lOffice europen des brevets Munich ou de son dpartement la Haye ; c) il peut soumettre au Conseil dadministration tout projet de modification de la prsente convention, ainsi que tout projet de rglementation gnrale ou de dcision qui relve de la comptence du Conseil dadministration ; d) il prpare et excute le budget ainsi que tout budget modificatif ou additionnel ; e) il soumet annuellement au dadministration un rapport dactivit ; f) Conseil

Article 11 Nomination du personnel suprieur (1) Le Prsident de lOffice europen des brevets est nomm par dcision du Conseil dadministration. (2) Les Vice-Prsidents sont nomms par dcision du Conseil dadministration, le Prsident entendu. Artikel 12 Amtspflichten Die Bediensteten des Europischen Patentamts sind verpflichtet, auch nach Beendigung ihrer Amtsttigkeit Kenntnisse, die ihrem Wesen nach unter das Berufsgeheimnis fallen, weder preiszugeben noch zu verwenden. Artikel 13 Streitsachen zwischen der Organisation und den Bediensteten des Europischen Patentamts (1) Die Bediensteten oder ehemaligen Bediensteten des Europischen Patentamts oder ihre Rechtsnachfolger haben das Recht, in Streitsachen zwischen ihnen und der Europischen Patentorganisation das Verwaltungsgericht der Internationalen Arbeitsorganisation nach der Satzung dieses Gerichts und innerhalb der Grenzen und nach Magabe der Bedingungen anzurufen, die im Statut der Beamten oder in der Versorgungsordnung festgelegt sind oder sich aus den Beschftigungsbedingungen fr die sonstigen Bediensteten ergeben. (2) Eine Beschwerde ist nur zulssig, wenn der Betreffende alle Beschwerdemglichkeiten ausgeschpft hat, die ihm das Statut der Beamten, die Versorgungsordnung oder die Beschftigungsbedingungen fr die sonstigen Bediensteten erffnen. Artikel 148

Article 12 Duties of office The employees of the European Patent Office shall be bound, even after the termination of their employment, neither to disclose nor to make use of information which by its nature is a professional secret. Article 13 Disputes between the Organisation and the employees of the European Patent Office (1) Employees and former employees of the European Patent Office or their successors in title may apply to the Administrative Tribunal of the International Labour Organisation in the case of disputes with the European Patent Organisation in accordance with the Statute of the Tribunal and within the limits and subject to the conditions laid down in the Service Regulations for permanent employees or the Pension Scheme Regulations or arising from the conditions of employment of other employees. (2) An appeal shall only be admissible if the person concerned has exhausted such other means of appeal as are available to him under the Service Regulations, the Pension Scheme Regulations or the conditions of employment, as the case may be. Sprachen des Europischen Patentamts (1) Die Amtssprachen des Europischen Patentamts sind Deutsch, Englisch und Franzsisch. Europische Patentanmeldungen sind in einer dieser Sprachen einzureichen. (2) Natrliche oder juristische Personen mit Wohnsitz oder Sitz im Hoheitsgebiet eines Vertragsstaats, in dem eine andere Sprache als Deutsch, Englisch oder Franzsisch Amtssprache ist, und die Angehrigen dieses Staats mit Wohnsitz im Ausland knnen europische Patentanmeldungen in einer Amtssprache dieses Staats einreichen. Sie mssen jedoch eine bersetzung in einer der Amtssprachen des Europischen Patentamts innerhalb einer in der Ausfhrungsordnung vorgeschriebenen Frist einreichen; diese bersetzung kann whrend des gesamten Verfahrens vor dem Europischen Patentamt mit der Anmeldung in der ursprnglich eingereichten Fassung in bereinstimmung gebracht werden. (3) Die Amtssprache des Europischen Patentamts, in der die europische Patentanmeldung eingereicht oder in die sie im Fall des Absatzes 2 bersetzt worden ist, ist in allen Verfahren vor dem Europischen Patentamt, die diese Anmeldung oder das darauf erteilte Patent betreffen, als Verfahrenssprache zu verwenden, soweit in der Ausfhrungsordnung nichts anderes bestimmt ist.

Languages of the European Patent Office (1) The official languages of the European Patent Office shall be English, French and German. European patent applications must be filed in one of these languages. (2) However, natural or legal persons having their residence or principal place of business within the territory of a Contracting State having a language other than English, French or German as an official language, and nationals of that State who are resident abroad, may file European patent applications in an official language of that State. Nevertheless, a translation in one of the official languages of the European Patent Office must be filed within the time limit prescribed in the Implementing Regulations; throughout the proceedings before the European Patent Office, such translation may be brought into conformity with the original text of the application. (3) The official language of the European Patent Office in which the European patent application is filed or, in the case referred to in paragraph 2, that of the translation, shall be used as the language of the proceedings in all proceedings before the European Patent Office concerning the application or the resulting patent, unless otherwise provided in the Implementing Regulations.

Article 12 Devoirs de la fonction Les agents de lOffice europen des brevets sont tenus, mme aprs la cessation de leurs fonctions, de ne pas divulguer ni utiliser les informations qui, par leur nature, sont couvertes par le secret professionnel. Article 13 Litiges entre lOrganisation et les agents de lOffice europen des brevets (1) Un agent ou un ancien agent de lOffice europen des brevets, ou leurs ayants droit, peuvent recourir au Tribunal administratif de lOrganisation internationale du travail pour les litiges qui les opposent lOrganisation europenne des brevets, conformment au statut dudit Tribunal et dans les limites et conditions dtermines par le statut des fonctionnaires, par le rglement de pensions ou rsultant du rgime applicable aux autres agents. (2) Un recours nest recevable que si lintress a puis tous les moyens de recours qui lui sont ouverts par le statut des fonctionnaires, par le rglement de pensions ou par le rgime applicable aux autres agents, selon le cas.8


Article 14

Langues de lOffice europen des brevets (1) Les langues officielles de lOffice europen des brevets sont lallemand, langlais et le franais. Les demandes de brevet europen sont dposes dans une de ces langues. (2) Nanmoins, les personnes physiques et morales ayant leur domicile ou leur sige sur le territoire dun Etat contractant ayant une langue autre que lallemand, langlais ou le franais comme langue officielle, et les nationaux de cet Etat ayant leur domicile ltranger peuvent dposer des demandes de brevet europen dans une langue officielle de cet Etat. Toutefois, une traduction dans une des langues officielles de lOffice europen des brevets doit tre produite dans le dlai prvu par le rglement dexcution ; pendant toute la dure de la procdure devant lOffice europen des brevets, cette traduction peut tre rendue conforme au texte original de la demande. (3) La langue officielle de lOffice europen des brevets dans laquelle la demande de brevet europen a t dpose ou celle dans laquelle cette demande a t traduite, dans le cas vis au paragraphe 2, doit tre utilise, sauf sil en est dispos autrement par le rglement dexcution, dans toutes les procdures devant lOffice europen des brevets relatives cette demande ou au brevet dlivr la suite de cette demande.

(4) Die in Absatz 2 genannten Personen knnen auch fristgebundene Schriftstcke in einer Amtssprache des betreffenden Vertragsstaats einreichen. Sie mssen jedoch innerhalb einer in der Ausfhrungsordnung vorgeschriebenen Frist eine bersetzung in der Verfahrenssprache einreichen; in den in der Ausfhrungsordnung vorgesehenen Fllen knnen sie auch eine bersetzung in einer anderen Amtssprache des Europischen Patentamts einreichen. (5) Wird ein Schriftstck, das nicht zu den Unterlagen der europischen Patentanmeldung gehrt, nicht in der in diesem bereinkommen vorgeschriebenen Sprache eingereicht oder wird eine bersetzung, die in diesem bereinkommen vorgeschrieben ist, nicht rechtzeitig eingereicht, so gilt das Schriftstck als nicht eingegangen. (6) Die europischen Patentanmeldungen werden in der Verfahrenssprache verffentlicht. (7) Die europischen Patentschriften werden in der Verfahrenssprache verffentlicht; sie enthalten eine bersetzung der Patentansprche in den beiden anderen Amtssprachen des Europischen Patentamts. (8) In den drei Amtssprachen des Europischen Patentamts werden verffentlicht: a) b) das Europische Patentblatt; das Amtsblatt des Europischen Patentamts.

(4) The persons referred to in paragraph 2 may also file documents which have to be filed within a time limit in an official language of the Contracting State concerned. They must however file a translation in the language of the proceedings within the time limit prescribed in the Implementing Regulations; in the cases provided for in the Implementing Regulations, they may file a translation in a different official language of the European Patent Office. (5) If any document, other than those making up the European patent application, is not filed in the language prescribed by this Convention, or if any translation required by virtue of this Convention is not filed in due time, the document shall be deemed not to have been received. (6) European patent applications shall be published in the language of the proceedings. (7) The specifications of European patents shall be published in the language of the proceedings; they shall include a translation of the claims in the two other official languages of the European Patent Office. (8) There shall be published in the three official languages of the European Patent Office: (a) the European Patent Bulletin; (b) the Official Journal of the European Patent Office. (9) Entries in the Register of European Patents shall be made in the three official languages of the European Patent Office. In cases of doubt, the entry in the language of the proceedings shall be authentic.
