PART A - INTERPRETATION

1. Application, interpretation and amendment of these by-laws 1.1. These by-laws govern all Hockey ACT Competitions (senior and junior, men’s and

women’s, outdoor and indoor), except where specifically exempted by the Board.

1.2. These by-laws are approved by the Board under the provisions of the Hockey ACT Constitution and can be amended under those provisions. The Competitions Committees; ICAC, JCAC and SCAC are appointed by the CEO under the authority of the HACT Board to advise on the interpretation and operation of these by-laws and are also the committees responsible for recommending any amendments to these by-laws for approval by the Board. The ICAC, JCAC and SCAC will operate under terms of reference approved and published by the Board.

1.3. These by-laws are to be read in conjunction with other Hockey ACT documentssurrounding Hockey ACT competitions, all of which are available on the publications page of the Hockey ACT website. To the extent that there is any inconsistency between these by-laws and other Association governing documents, the ICAC, JCAC and SCAC will provide a provisional ruling, considering that no by-law or regulation may be inconsistent with the provisions of the Constitution and that the Board may have to issue a final ruling.

2. Definitions

2.1. In addition to the definitions set out in the Hockey ACT Constitution, the following definitions shall apply in these by-laws:

'APPEALS PANEL RULES' refers to the separate Hockey ACT document that governs the appointment of an Appeals Panel by the Board to investigate, report and make decisions on appeals against decisions of Hockey ACT committees.

‘ASSOCIATION' refers to Hockey ACT Incorporated.

‘BOARD' refers to the Board of Hockey ACT or its delegates.

'CANBERRA CUP’ refers to those structured level, team registration grades that are part of the main Winter season senior outdoor competition, but which are designed to encourage player participation in a friendly, social manner.

‘CAPTAIN’ refers to the nominated captain of the team. However, where these by- laws refer to a captain being responsible for administrative details, the team manager may assume those responsibilities as appropriate.

'CAPITAL LEAGUE’ refers to the elite level, club registration grades that are part of the main Winter season outdoor competition, organised with the objective of providing the highest standard of regular competition hockey.

‘CHIEF EXECUTIVE OFFICER (CEO)’ means the Chief Executive Officer of HACT or any person to whom the Chief Executive Officer has delegated a function under these Procedures.

‘CLASSIFICATION MATCH/SERIES’ a match or series of games played at the conclusion of round matches.

‘CLUB’ means, unless otherwise stated, a member Club of the Association (as defined in the Hockey ACT Constitution) that has at least one team participating in a competition.

‘CLUB DELEGATE’ refers to the person from the club entitled to represent and carry the vote of the club at a club meeting.

'CLUB MEETING' refers to a meeting convened by the Relevant Committee to which each Club participating in a club registered competition is required to send at least one delegate or representative.

‘CLUB VOTE’ means a vote taken at a Club meeting whereby each Club represented is entitled to one vote.

'COMBINED TEAM' means a team, approved by the Relevant Committee, comprised of players from two Clubs.

‘COMPETITION(S)’ consists of all Hockey ACT men's, women's, boys and girls graded senior and junior indoor and outdoor hockey competitions arranged under these by-laws.

‘COMPETITION MATCHES’ means all matches in the competitions, including finals matches.

‘COMPETITION RULES’ refers to the set of competition rules (junior, senior, indoor) that are applicable to the relevant competition and referred to by-law 6.

‘CONSTITUTION’ refers to the separate Hockey ACT Incorporated Constitution.

‘DELEGATE HANDBOOK’ refers to a document produced for each competition, for the information of Club Delegates, which specifies any additional requirements and associated procedures that Clubs may need to comply with.

‘DISCIPLINARY TRIBUNAL RULES’ refers to the separate Hockey ACT document that governs the Tribunal appointed by the Association to investigate allegations of misconduct in relation to any match conducted under the auspices of the Association.

“DIVISION’ means any series of hockey matches within a grade in the senior competition or within an age group in the junior competition.

‘ERS’ refers to the Electronic Registration System for the Association’s online player registration and competition/results database.

'FINALS MATCHES/SERIES' refers to semi-finals, preliminary finals and/or grand finals.

‘GENERAL BY-LAWS’ refers to the separate Hockey ACT document containing general by-laws made under the provisions of the Constitution.

‘GRADE’ means any series of hockey matches between teams of a similar standard.

'GRADING MATCHES' refers to pre-season matches arranged by the Relevant Committee for the purpose of determining the relative strength of nominated teams.

‘GROUND MANAGER’ means a person appointed by the Relevant Committee to supervise the conduct and timing of Competition matches at a particular venue.

‘HOCKEY ACT (HACT)’ refers to Hockey ACT Incorporated.

‘HOCKEY CENTRE’ means the hockey facilities at 196 Mouat Street, Lyneham, ACT.

‘ICAC’ refers to the Indoor Competition Advisory Committee.

‘INTERSTATE ASSOCIATION’ means any state or territory hockey associations affiliated with Hockey Australia, other than Hockey ACT.

‘INTERSTATE CLUB’ means a Club affiliated with Hockey Australia through an Interstate Association.

‘JCAC’ refers to the Junior Competition Advisory Committee.

‘MATCH’ means a hockey match played between two teams within a grade during a season.

'MATCH CARD' refers to the Association score card as distributed by the Relevant Committee for the current competition season.

‘MEMBERSHIP COORDINATOR’ refers to the person designated by the Association to oversee and coordinate hockey competitions within the ACT.

‘NOMINATED PLAYER’ is one who is named in a team when the Club submits their team nomination form.

‘NOTIFICATION’ refers to the appropriate form of media for the nature of the material to be communicated:

in the off-season, the standard form of media will be by mail or e-mail

from 1 February to 30 September each year, the standard form of communication will be via e-mail and/or the Club boxes at the Hockey Centre. The usual deadline for material to be placed in the box will be Tuesday night and Clubs will be expected to have cleared their box by Friday morning ;

otherwise, contact will be made directly via the telephone or e-mail to the appropriate Club representative.

'PLAYER' means:

a male person registered to participate in the men’s competition; or

a female person registered to participate in the women’s competition; or

a male person under the age of 18 at the start of the year the season concludes for the junior boys competition; or

a female person under 18 years at the start of the year the season concluded for the junior girls competition; or

where the Relevant Committee has made a decision to allow a female person to

be a member of a male team, a female person in the men’s or junior boys competition; or

where the Relevant Committee has made a decision to allow a male person to be a member of a junior girls team, a male person in the junior girls competition.

‘REGISTRAR’ is the member of the relevant competition committee with responsibilities in relation to the registration of players.

‘RELEVANT COMMITTEE’ for a particular competition, refers to the Competitions Committee or the Senior Competition Advisory Committee, Junior Advisory Competition Committee or Indoor Competition Advisory Committee, whichever Committee has responsibility (under by-law 6) for interpreting these by-laws and the Competition Rules that relate to that competition.

‘REPRESENTATIVE PLAYER’ Is a player that was an International Representative, Australia Hockey league Player or ACT U21 representative in the last 12 months

'ROUND MATCHES' means all competition games excluding grading matches and finals matches.

‘SCAC’ refers to the Senior Competition Advisory Committee.

‘SEASON’ refers to a period of time for the conduct of a grade competition, consisting of round matches and a finals series and commences on the date of the first fixture of the first round of the competition.

‘STATE LEAGUE’ refers to Graded Competitions as explained in by-law 4.3.2.

‘TEAM’ means a team nominated by a Club and accepted in a grade by the Relevant Committee.

‘TEAM OFFICIALS’ includes team coaches, assistant coaches and managers.

‘TECHNICAL BENCH’ is the designated area for use by game officials.

‘UMPIRING & TECHNICAL COMMITTEE (UTC)’ refers to the Umpiring and Technical Committee appointed by the Board.

'UNFINANCIAL PLAYER' refers to a player notified to the Association by an ACT Club, an interstate Club or another Association as being in debt to that Club or Association. A debt includes a financial debt (e.g. nonpayment of fees or fundraising proceeds) or non-return of equipment (e.g. uniform or goalkeeping gear).

‘WINTER SEASON’ means that part of the year determined by the Relevant Committee to be the winter season for the conduct of Competition grading days and Competition Matches.

PART B – SETTING UP COMPETITIONS

3. Competition core values

3.1. All clubs, teams and individuals participating in the Hockey ACT Competitions, shall agree to participate in the spirit of good will and fairness, encouraging participation and fostering cooperation.

4. Approval and establishment of competitions

4.1. The Board will approve all competitions, which should respect the core values expressed in by-law 3.1.

4.2. Once a competition has been approved by the Board, the Competitions Committee shall determine:

4.2.1. The level of the competition – Elite, Graded, Structured or Social (see by- law 4.3).

4.2.2. The players that shall be eligible to participate in the competition and how they will register for the competition – Club Registration, Team Registration or Individual Registration (see by-law 4.4).

4.2.3. The grade structure of the competition and the basis on which teams will be placed in grades (see by-law 5).

4.2.4. The Competition Rules that shall apply to the competition; and the Relevant Committee that shall be responsible for the interpretation and administration of those Competition Rules (see by-law 6).

4.3. Competitions will be at one of the following levels:

4.3.1. Elite Competitions consisting of one or two top grades, designed for the best hockey players (on the basis of merit) of a particular sex and age group (e.g. the senior men’s and women’s Capital Leagues and Premier Leagues).

4.3.2. Graded Competitions with players in teams organised into grades of similar playing standard and/or age group, with higher grades consisting of players/teams of higher standard (e.g. the senior men’s and women’s State Leagues and junior competitions).

4.3.3. Structured Competitions which are open to all players of a particular sex and age group(s), but which share some of the features of graded competitions, such as being part of the main Winter season outdoor competitions, organised into a series of grades and/or having finals (e.g. the senior Canberra Cup grades).

4.3.4. Social Competitions, open to all players, but which need only minimal additional rules to administer the competition (e.g. Summer social competitions).

4.4. Player registration is detailed in part D of these by-laws. Competitions also differ in how players register to participate:

4.4.1. Club Registration – clubs are invited to organise their playing members into teams and nominate those teams for inclusion in the competition (e.g. the main Winter season outdoor competitions, excluding the Canberra Cup grades).

4.4.2. Team Registration – teams of players (which may or may not be affiliated

with clubs) will be invited to nominate for inclusion in the competition (e.g. Summer social competitions and the Canberra Cup grades). Players may register for team registration competitions regardless of whether or not they have a usual club affiliation.

4.4.3. Individual Registration – players may be required to nominate themselves for inclusion in competitions (e.g. senior men’s and women’s Premier Leagues). Players may register for individual registration competitions regardless of whether or not they have a usual club or team affiliation.

5. Competition structure and team nominations 5.1. Competitions may be established at any level (Elite, Graded, Structured or Social or

some combination of the different levels). The Relevant Committee (ICAC, JCAC or SCAC) will provide advice to the Membership Coordinator on the grade structure of each competition, approval of team entries into each grade, the basis on which teams will be placed in grades and any other conditions to be placed on nominations. The Membership Coordinator will have these details approved by the Board and the details will be released at least forty-five (45) days prior to the start of the season.

5.2. For Club Registration competitions, clubs will be invited to nominate teams to participate under the conditions specified in by-law 5.1. For Team Registration competitions, Clubs and/or individuals may be invited to enter teams; and for Individual Registration competitions, individuals may be invited to nominate on their own behalf, again as per any details published under by-law 5.1.

5.3. The Membership Coordinator may decide not to accept any nomination which does not comply with any conditions specified under by-law 5.1 (including the payment of a required deposit) or which is not received by the nomination due date.

5.4. At least fourteen (14) days prior to the start of the season, the Membership Coordinator will inform everyone who submitted a nomination, which nominations have been accepted and provide written reasons for any changes to the details specified for the competition under by-law 5.1.

5.5. If a club withdraws an accepted team nomination the following penalties will apply based on the prescribed criteria:

1) Withdrawal after competition structure is published but before the final draw is published will result in a penalty of the first half of competition fees for that season.

2) Withdrawal after the final draw is published will result in a penalty of the full amount of competition fees for that season.

5.6. A club’s nomination of a team after the close of the expressed nomination period, will only be accepted if a bye exists in the nominated competition or if there are two teams nominating for an even numbered team. There is no fee or penalty for a club nominating a team after the expressed nomination period.

PART C - COMPETITION ADMINISTRATION

6. Competition Rules and the Relevant Committee

6.1. Each competition shall be governed by a set of Competition Rules, which will be determined prior to the start of the competition season, in consultation with the Clubs (e.g. the main Winter season senior outdoor competition will be governed by the Senior Competition Rules). Each set of Competition Rules will be approved by the CEO and may not be amended once the competition has commenced.

6.2. All competitions (typically including any and all Club Registration competitions) be governed by the Membership Coordinator in conjunction with advice from the Senior Competition Advisory Committee (SCAC), the Junior Competition Advisory Committee (JCAC) or the Indoor Competition Advisory Committee (ICAC), whichever is appropriate, or by some other committee specifically appointed to provide advice on a particular competition. A committee appointed under this by-law will be referred to as the relevant committee.

6.3. The Relevant Committee will operate under terms of reference approved by the CEO, who will appoint the members of the committee.

6.4. The Relevant Committee will be responsible for advising the Membership Coordinator on the interpretation and operation of the Competition Rules in that competition and will also be responsible for recommending any amendments to the Competition Rules for approval by the CEO for adoption in subsequent competitions.

6.5. Where it is unclear whether a matter (e.g. a player registration or grading issue) concerns these by-laws or the Competition Rules, prior to the start of the season, the Relevant Committee (ICAC, JCAC or SCAC) will provide advice to the Membership Coordinator regarding any decision. After the commencement of the season, any matter will be resolved by the Membership Coordinator using advice provided by the Relevant Committee, who may also seek advice on the matter from the CEO.

7. Reviews and appeals from committee decisions

7.1. In the first instance, any Club, team or individual dissatisfied with a decision made by the Membership Coordinator should approach the Relevant Committee with a written request to review the decision. This written request may include additional information that the Membership Coordinator may not have been aware of when they made the decision.

7.2. The committee shall respond to a written request under Competition by-law 6.1 with a ‘final’ decision, in writing, within five days of receipt of the request. The committee shall also take reasonable steps to notify all other affected Clubs, teams and individuals of this ‘final’ decision.

7.3. If any Club, team or individual is still dissatisfied with the ‘final’ decision, the affected party may lodge an appeal to the Board.

8. Administration

8.1. Routine administration of each competition will be the responsibility of the

Membership Coordinator, working with the support and supervision of the Chief Executive Officer and the other staff in the Hockey ACT office.

8.2. Clubs, teams and individuals should communicate with the Association (including the Relevant Committee.) by letter or email through the Membership Coordinator. Other means, including mobile phone and texting, may be used but will not be regarded as official communication for the purposes of decisions and appeals.

8.3. The Membership Coordinator will decide upon routine matters and may seek information or advice from the Relevant Committee and the Clubs, teams and individuals affected by the decisions. The Membership Coordinator may request a ruling on any matter in the Competition Rules or any matter in these by-laws from the relevant committee or the Board of HACT.

8.4. Any matter that must be presided over by a relevant committee as referred to in these by-laws or the Competition Rules will be passed to that relevant committee by the Membership Coordinator. A Club, team or individual may also request that the Membership Coordinator refer a matter to the Relevant Committee.

8.5. It is not necessary for a Relevant Committee to meet in order to make decisions about the administration of the competition; all committees may conduct their affairs by email, telephone or other suitable means.

8.6. The Membership Coordinator shall be responsible for keeping a record of all decisions made in respect to each competition.

8.7. In Team Registration and Individual Registration competitions, the Membership Coordinator shall maintain regularly consult with team officials or representatives, and may decide to convene regular meetings, if needed.

9. Club Meetings

9.1. In Club Registration competitions, the Membership Coordinator in conjunction with the Relevant Committee shall conduct regular meetings with Club Delegates, under conditions specified in the terms of reference for that committee (e.g. frequency of meetings, notice periods, agendas).

9.2. Whilst the Competition Rules may not be amended once the season has started, at a Club Meeting, the Relevant Committee and the Clubs may agree on additional minor requirements to be placed on individuals, teams and Clubs (e.g. uniform, equipment, etc.).

9.3. If a Club is not represented at a particular meeting, the Club is still responsible for complying with any decision arrived at during those meetings.

10. Umpiring

10.1. The Umpiring and Technical Committee (UTC) is the committee appointed by the CEO to administer umpiring and technical officials in all Hockey ACT competitions and the UTC operates under terms of reference approved and published by the Board, which appoints the members of the committee.

10.2. The UTC may delegate all or any part of the administration of umpires for a particular competition to the Membership Coordinator, supported by the Relevant Committee. No protests or disputes relating to the decision of an umpire with regard to the rules of hockey can be made to any committee. These matters must to be referred to the UTC.

10.3. The UTC, in consultation with the Relevant Committee, may require, as a condition for participating in the competition, Clubs and/or teams to nominate or provide umpires of a suitable standard for that particular grade. The UTC may then allocate the nominated umpires to competition matches.

10.4. If the UTC decides not to allocate umpires for a particular competition match, then the allocation of umpires will be the responsibility of the Relevant Committee, who, in turn, may ask the Membership Coordinator to roster Clubs and/or teams to provide umpires.

10.5. Penalties for failure by Clubs and/or teams to nominate required umpires under by- law 10.3 and/or supply allocated umpires under by-law 10.4 will be determined and applied by the Relevant Committee under section 18 of these by-laws.

PART D – PLAYER REGISTRATION AND TRANSFERS

11. Eligibility for registration

11.1. A player may only participate in a competition if registered in accordance with these by-laws.

11.2. In Club Registration competitions, no player shall be registered with more than one Club or more than one team during a season, except where expressly provided in these by-laws and/or with the prior approval of the Relevant Committee.

11.3. Clubs may only seek to register players who have been properly transferred and are financial as per section D of these by-laws.

11.4. Players may be registered with more than one Club to participate in different Club Registration competitions, with the approval of the Relevant Committee(s) (e.g. an eligible junior player may be registered to play in both senior and junior competitions for different Clubs and a women player may play in both the men’s and women’s senior competition for different Clubs).

11.5. In Team Registration competitions (eg. Canberra Cup grades) players may be registered with more than one team, regardless of which club they are usually affiliated with.

11.6. In Individual Registration competitions the conditions under which players are allocated to teams (and the teams they may be registered with), will be specified as part of the details for that competition under by-law 5.1.

11.7. The Relevant Committee may place other restrictions on the eligibility and registration of players, including the following:

11.7.1. To be eligible to compete in junior competitions, players must be under the age for the age group as at 1 January in the year they wish to compete (see the junior Competition Rules for age groupings).

11.7.2. To be eligible to compete in senior competitions, players must be 13 years of age prior to the 1st of January in the year in which they wish to compete.

11.7.3. Senior women are eligible to compete in senior men’s competitions, but other competitions are only for players of the designated sex, unless otherwise approved by the Relevant Committee.

11.7.4. A woman competing in both senior competitions can only be registered up to and including two grades below the equivalent of her senior

women’s grading. This restriction does not apply to Canberra Cup grades, which are Team Registration competitions.

11.7.5. In situations where a team nomination has been accepted for a combined team representing two different clubs in a Club Registration competition, players in the combined team may be registered with only one of the involved Clubs. The players concerned will not be registered with the other involved Club and will not be eligible to play for any other team from that Club.

11.7.6. Representative players, as defined by HACT as an International Representative (excluding Australian Masters Representatives), Australia Hockey league Player or ACT U21 representative in the last 12 months can only register in Capital League 1 teams or a division 1 team in any junior competition they are eligible by age to participate in. ACT U21 Representative players are permitted to register and play in the Capital League 2 competition, however, they are not permitted to play in any State League Competition.

11.8. The Relevant Committee may, at its discretion, take into account special circumstances applying to any individual and waive any of the above limits (excluding 11.7.2.) on registration. In particular, they may approve dual registration for an individual player in a Club Registration competition on the basis of a written submission from that player's Club (e.g. allowing the player to register as a goalkeeper in one team and a field player in another team).

11.9. In all circumstances where a player is legally registered to play in two different teams in the same competition, they will be treated as two different player registrations, distinguished by the different roles under which they are registered. These distinct roles must be clearly identified (e.g. a role playing as a goalkeeper must be clearly distinguished from when they are playing on the field in their other registered role).

12. Registration – at the start of the season

12.1. Players should register themselves prior to the start of the season (completing required player registration information on HACT’s online registration system). Each registration should also identify the player’s affiliated club (for Club Registration competitions) and/or team (for Team Registration Competitions).

12.2. In Club Registration competitions, Clubs will be responsible for organising their registered players into their nominated teams by a date determined by the Relevant Committee.

12.3. Prior to the time line specified in Procedure 12.2, Clubs must notify the Membership Coordinator in the approved template which team they wish the player to be registered in, but if they fail to do so, or if there is any confusion over where a player is registered, the player will be deemed registered in the first team in which they play.

12.4. By the time line specified in by-law 12.2, Clubs must submit team lists of registered players. The Membership Coordinator will decide the number of players to be listed in each team and any other requirements (e.g. specifying goalkeepers and dual registered players) and may allow exemptions for these requirements in exceptional circumstances.

13. Registration – later in the season

13.1. Players not already registered under by-law 12 may be registered by:

13.1.1. The Club, team or individual submitting a registration before the player plays their first game (e.g. entering the player’s details into HACT’s online registration system) and nominating the grade and team in which they wish to register that player.

14. Player Transfers

14.1. In the interests of assisting all Hockey ACT Clubs, Interstate Clubs and Interstate Associations with the management of player debts and disciplinary sentences, a permit is required for the transfer of any player who was last registered:

14.1.1. with a Hockey ACT Club ('the previous Club') that is different to the Club ('the new Club') they are intending to play for in the current season (see by-law 15); or

14.1.2. with an Interstate Club or Association (see by-law 16)

14.2. Except as described below, a transferring player may not register to participate in any Hockey ACT competition until a permit for that transfer has been obtained through the nominated transfer system. All Interstate transfers are to also be completed through the nominated transfer system. The Membership Coordinator will advise the previous and new Clubs and/or any Interstate Clubs and Associations not using the nominated transfer system, of such transfers in writing.

14.3. Any player bans issued by any Interstate Association will be enforced in Hockey ACT competitions. Any transfer permit will not be issued and registration will be refused of any player who is the subject of the ban for the duration of their disciplinary sentence.

14.4. In circumstances other than players bans, a permanent permit for a player transfer may be issued, unless the previous Club, an Interstate Club or Association advises that the transferring player is un-financial (see by-law 17) or that there are other reasonable grounds on which to refuse the transfer.

14.5. Clubs and teams may play any transferring player for whom they have received a permanent or temporary transfer permit, without penalty, unless they are advised that the temporary permit has been revoked or that there is a problem or dispute under by-laws 14.3 or 14.4.

15. Transfers from a previous Hockey ACT Club

15.1. The Club to which a player is transferring to, shall make a request for transfer through the nominated transfer system. This will alert the club that the individual previously played for, asking for agreement to transfer the player.

15.2. The previous Club shall respond within seven days, advising whether or not the player has met all commitments to the previous Club and whether or not the previous Club agrees to transfer the player. The previous club will then complete the transfer through the nominated transfer system.

15.3. The previous Club can only refuse a player transfer if the player has an outstanding debt with the previous club, or is in possession of club equipment or property. A transfer cannot be refused beyond these grounds without Relevant Committee

approval.

15.4. If the previous Club does not respond within seven days or if there is a dispute, the player or their new Club may ask the Relevant Committee to issue a temporary permit for the transfer, to permit the player to participate in competition.

15.5. A temporary permit will become permanent once any dispute has been resolved and the previous Club agrees to the transfer.

15.6. If an outstanding dispute is not resolved, the previous Club may apply to the Relevant Committee to have a temporary permit revoked.

16. Transfers from an Interstate Club or association

16.1. The Club, to which the new player is transferring to, must first request an interstate transfer through the nominated transfer system. If the player cannot be found in the system, the requesting club shall, at least seven days before the transferring player's first game, send a written request for transfer to the HACT Membership Coordinator. The request should state the player's name, date of birth, registration number (if known/applicable), previous State, previous Association and/or previous Club on the form provided for this purpose (see the appropriate Handbook). Hockey ACT will forward this transfer request to the previous Interstate Club and/or Association.

16.2. The player in question may participate in competition, under an assumed temporary permit, until the requesting Club obtains approval for the transfer through the nominated transfer system or the Membership Coordinator receives a written response to the transfer request.

16.3. If the previous Interstate Club and/or Association approves the transfer request, the temporary permit becomes permanent.

16.4. If the previous Interstate Club and/or Association refuses the transfer request and the reasons provided for the refusal are in dispute, the requesting Club may make a written request asking the Relevant Committee to issue a further temporary transfer permit pending resolution of the dispute. The temporary permit will become permanent once the dispute is resolved.

17. Un-financial Players

17.1. A player who has been declared un-financial by any previous Club, or by any Interstate Association or Club or Association may not play in any competition other than with a team belonging to the body with whom he/she is un-financial.

17.2. A player who receives written notice from a previous Club, Interstate Association or Club or Association that he or she is un-financial, may apply to the Membership Coordinator for a temporary transfer permit to play in the competition for a Club other than the body with whom he or she is un-financial.

17.3. The Membership Coordinator’s power to issue a temporary transfer permit is discretionary; however, permission should not be granted unless the Relevant Committee is satisfied that granting permission to play is just and equitable.

17.4. The Membership Coordinator should have regard to the following factors in determining whether or not to issue a temporary permit:

17.4.1. Whether or not the debt, or any part of the debt, is disputed;

17.4.2. Arrangements, if any, that have been made for the repayment of the

debt.

17.5. Any decision by the Membership Coordinator to issue a temporary transfer permit is not a determination of the rights and or liabilities of the player or the previous Club, or the Interstate Association or Club or Association in respect of the alleged debt.

17.6. The handling of individual players' debts to Clubs is the responsibility of Clubs.

17.7. Players who have reached an agreement with the Association to pay off Association debts will again be deemed to be un-financial if they fail to meet the deadlines detailed in their repayment schedule.

17.8. Players who are deemed un-financial with the Association will not be granted a transfer permit to play for any Interstate Association or Club.

17.9. Any player who is declared un-financial by any previous club, current club or their Association, at the request of that club or Association can be suspended from participating in any competition until such time that all outstanding monies are paid.

PART E – PENALTIES, DISCIPLINE AND TROPHIES

18. Penalties

18.1. The General By-Laws authorise the CEO to impose penalties on Clubs and/or teams for infringements of these by-laws and the Competition Rules and for failure to comply with any responsibilities imposed by these by-laws or under the Competitions Rule. These penalties may include (but are not limited to) warnings, fines and loss of competition points.

18.2. A decision to impose a penalty under by-law 18.1 will be considered a recordable competition decision under by-law 8.6 and the Membership Coordinator shall keep a record of all penalties imposed in a competition (including warnings). This record shall be made available for inspection on request.

18.3. Any decision to impose a penalty shall consider the record of previous penalties in by-law 18.2 and shall be consistent with previous penalties imposed for similar infringements.

18.4. The imposition of any penalty, as with all committee decisions, is subject to review and possible appeal under the provisions of by-law 7.

19. Disciplinary Matters

19.1. All allegations of misconduct on the part of any member of the Association (including, but not limited to a player or official) during, or in relation to, a competition match, including all red card reports from umpires, are considered to be disciplinary matters.

19.2. All disciplinary matters, including (but not limited to) any breach of these by-laws or the Competitions Rules by an individual, will be referred to the Chief Executive Officer (CEO), who will exercise his or her discretion to take appropriate action under the Disciplinary Tribunal Rules and Procedures.

19.3. The Membership Coordinator will refer the receipt of any red card and/or the receipt of repeated yellow cards in the current season to the CEO as a disciplinary matter under by-law 19.2.

19.4. In exercising his or her discretion under by-law 19.2, the CEO may decide that a

Club and/or team is responsible for all or part of an individual disciplinary matter, and may refer the details to the Relevant Committee to consider the imposition of a penalty on that Club and/or team under by-law 18.

20. Trophies and prizes

20.1. The Membership Coordinator shall be responsible for maintaining and publishing a list of any trophies and prizes to be awarded during a competition or at the end of the season.

20.2. This list of trophies and prizes shall include the provisions under which these trophies and prizes are awarded. This list may be kept as an attachment to the Competition Rules, but unlike the main body of the Competition Rules, may be amended once the season has commenced.

20.3. The Membership Coordinator, assisted by the Relevant Committee, will decide any issues arising in the awarding of trophies and prizes.

20.4. Perpetual trophies remain the property of the Association, but may be engraved and retained by the receiving Clubs, team or individuals until the start of the following season, when they must be returned to the Membership Coordinator.
