The oncomouse began life inthe laboratory, where it was genetically modified for use as a research tool to assist with the study of human cancer.Its design, a product of genetic modification, made the oncomouse potentially patentable subject matter. The UnitedStates was the first jurisdiction to award the patent and several others followed. However, the question of animalpatenting was most contentious in Europe and Canada. In this paper I examine debates about animal patentingwithin the legal and moral spaces created by United States, European and Canadian patent law, focusing ondifferences that emerged in each case. I argue that oncomouse as a patentable invention was made possible andacceptable as different ways of being mouse as natural animal, research tool and invention were made to cohere:that is as they were made to overlap and depend upon one another. In the paper I use the term “cohere” to describethe logic of animal patenting that emerged with, and was essential to, the outcome in each jurisdiction. I describe anontological politics of connecting and separating different ways of being mouse, as the oncomouse’s geneticmodification, risks, benefits, and suffering were juxtaposed with patent law, precedent, laboratory protocols, andunderstandings of human agency and control. As connections and separations were made, a relation, “naturalanimal­research tool­invention”, was established, and logic of animal patenting emerged: but differently each case.

Medicine and Law: The World Association for Medical Law 2008 March; 27(1): 53­69 Abstract: In May 2003, one of the most important benefit sharing agreements to date was signed in South Africa.The South African San Council and the South African Centre for Scientific and Industrial Research agreed to sharethe benefits derived from genetic research on the Hoodia plant. Payments to the San Council started in 2005 andcould reach 1.3 million US Dollars per year for approximately 15 years. Members of the San community in SouthernAfrica are exposed to serious poverty, resulting in malnutrition and avoidable illnesses. The question we areinterested in is: could benefit sharing in compliance with the Convention on Biological Diversity be a partial solutionto lack of access to essential health care? In the first part of the paper, we shall briefly introduce the legalbackground of benefit sharing and the San case. In the second part of the paper, we shall argue that benefit sharingand access to essential health care should not be formally linked. We shall substantiate our claim by introducingpractical, normative and so­called 'bigger picture' reasons against the link.

This paper proposes thatwe take the allegation of biopiracy seriously due to the impact it has as an intervention which indexes a number ofdifferent, yet interrelated, problematizations of biodiversity, biotechnology and IPR. Using the neem tree case as anexample, it describes activists' use of the term as one that involves a deliberate simplification of science and IPR.Additionally, it argues that in so doing, biopiracy is positioned as a touchstone that mobilizes actors and problems,and ultimately generates 'solutions' to the very challenges it creates. The paper will also encourage a view ofbiopiracy claims that does not always treat them simply as claims of theft, or as a misallocation of benefits, butrather as claims that are designed to raise broader questions about the IPR system itself. It concludes byadvocating that, in order to properly understand how to address biopiracy, we must be prepared to move beyond thecurrent narrow readings to develop a more complete picture of the term's influence in challenging how, and by whom,the decisions about what is natural and what is invented come to be made.

More than 1,500 of these applications have been granted. Other jurisdictions are experiencing a similar rushto mine and protect genomic gold. This paper argues that although many jurisdictions allow the patenting of humangenes, this is ethically indefensible and amounts to an unjustified appropriation of a general human heritage.Economic and legal arguments in favour of patenting are considered and rejected. Reference is made to theWellcome Trust Consortium's initiative and the Merck Gene Index Project, which place patented genetic informationinto the public domain.

Plaintiffs in thiscase were a group of parents of children afflicted with Canavan disease, who provided tissue for research on thedisease and aided in identification of other affected families, and three nonprofit organizations that had developed aconfidential database and Canavan disease registry. The defendants were physician­researcher Reuben Matalon,who isolated and patented the Canavan gene sequence and developed genetic screening tests for it, and the Miamifacilities where he did his research. The U.S. District Court for the Southern District of Florida dismissed several ofthe plaintiffs' claims, including lack of informed consent, breach of fiduciary duty, fraudulent concealment of thepatent, and misappropriation of trade secrets. However, the court upheld the claim of unjust enrichment made by thedonors of tissue, on the grounds that "the facts paint a picture of a continuing research collaboration that involvedPlaintiffs also investing time and significant resources.

Forexample, much controversy surrounds the patenting of genes that predispose to breast­cancer, and in the USA thedebate continues about whether or not stem­cell technology should be accessible to all. In this report, we argue thatsome of these concerns can be addressed within national patent systems. In particular, we examine the "orderpublic or morality" clause that exists in most national patent procedures. Furthermore, we propose that patents forinventions that present social and ethical questions should be subject to suspension by an independent, transparent,and responsible tribunal made up of specialists in ethics, research, and economics. This suspension should bereversible so that, when the social or ethical concerns have been addressed in an appropriate manner, thesuspension can be lifted. Although controversial, such a flexible mechanism would assist governments and industryin enhancing public support for patents in the biotechnology area.

Richard Biomedical patents and ethics: a Canadian solution McGill Law Journal 2000 May; 45(2): 413­435 Abstract: World Trade Organization member states are preparing for the upcoming renegotiation of the Agreement onTrade­Related Aspects of Intellectual Property Rights. One of the important elements of that renegotiation is theethical considerations regarding the patenting of higher life forms and their component parts (e.g. DNA and cell­lines). The interface between the genetic revolution, patentability, and ethical considerations is the subject of thisarticle. The author identifies, explores, and critiques four possible positions Canada may adopt in respect ofpatentability of biomedical material. First, Canada could do nothing. This approach would mean keeping biomedicalmaterials outside the patent system and outside the stream of commerce. Canada would simply wait for aninternational consensus to develop before adopting a position of its own. Second, Canada could go it alone. It couldimplement a policy that balances the incentive effects of patents with the need to incorporate ethical and socialvalues into the decision­making process regarding the use of biomedical materials. Third, Canada could follow theUnited States, Europe, and Japan by providing for almost unrestricted patenting of biomedical materials. This wouldbe the most industry­friendly alternative. The fourth and final option is to use the medicare system to promotediscussion of ethical considerations involved in the use of biomedical materials. The power of provincial healthagencies may be used as a lever to ensure discussion of ethical considerations concerning the use of biomedicalmaterials. The author concludes that the fourth and final option is the best alternative for Canada while waiting for aninternational consensus to emerge.
